The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, June 4, 1986 at 8:00 P.M. at City Council Mtgs. Hall. At roll call the following Aldermen were present: Bolger, Attendance Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Absent: None. City staff in attendance were Supt. Batt, Attorney Narusis, Clerk Gilpin, Park Director Merkel, Chief Joyce. Motion by Nolan, seconded by Bolger, to accept the minutes of the May 5, 1986 Special Meeting, the May 7, 1986 Regular Meeting and the May 14, 1986 Regular Meeting as presented. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Lee Sutliffe of First Humanics Corporation, formerly McHenry Villa Project, addressed the Council concerning development of that project. He commented that over 300 people had called to be put on the list to live in the project. The facilities presently are plan- ned for 118 units. He commented that the project would be available to the people of McHenry and the surrounding area. People from other counties would not be contacted. Motion by Nolan, seconded by Snell, to go into executive session at 8:16 P.M. to discuss property acquisition. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by McClatchey, seconded by Teta, to go back into open session at 8:33 P.M. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Bolger, to pass a resolution of the City Council approving the issuance of its $7,850,000 Aggregate Principal Amount First Mortgage Revenue Bonds (First Humanics Corpora- tion - McHenry Villa Project Series 1986) the "Series 1986 Bonds" approving the indenture of trust, loan agreement, the Series 1986 note, the deed of trust, mortgage and security agreements, the bond purchase contract, the arbitrage regulation agreement, the depositary and escrow agreement and the assignment of leases to be executed by the issuer in connection with its issuance of the Series 1986 Bonds; and approving conveyance of the project to the issuer on payment in full of the Series 1986 Bonds and the form of deed and bill of sale from First Humanics Corporation to be placed in escrow with the DeKalb Bank, DeKalb, Illinois, as trustee. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Executive Session Industrial Revenue Bonds Resolutions Motion by Nolan, seconded by Bolger, to grant the request of Ronald M. Bykowski approving the placement of two or three concrete planters in front of 3421 W. Pearl Street. Requests - Voting Aye: Bolger, Lieder, McClatchey, Nolan, Misc. Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Don Gerstad, of Gerstad Builders, addressed the Council con- cerning final plat approval of First Addition to Winding Creek Unit II. Wednesday, June 4, 1986 page 2 Motion by Smith, seconded by Nolan, to approve and accept the Winding final plat of First Addition to Winding Creek Unit II with the stipu- Creek lation that a new plat be presented showing that lots 11, 12 and 13 be changed to three 80 foot lots and contingent upon a letter of credit being submitted as recommended by Baxter & Woodman and that all requirements for final plat approval as outlined in the Subdivision Control Ordinance be met. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Ordinances Motion by Snell, seconded by Teta, to pass an ordinance cor- House recting the house numbering system on Ponca as presented. Numbering Voting Aye: Bolger, Lieder, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: McClatchey. Absent: None. Motion carried. Motion by Teta, seconded by Nolan, to approve the request of Block Cindy Parks for a block party on the south end of Huntington Drive on Party Saturday, June 21, 1986 from 4 p.m. to 11 p.m. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. ' Absent: None. Motion carried. Ordinances Motion by Snell, seconded by Serritella, to pass an ordinance Stop Sign establishing a three way stop at Huntington and Sarasota Drives. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Locations Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Luke Herring of Hobby Town addressed the Council concerning his request for establishment of a race track in one of the parks to operate radio controlled electric battery operated cars. Parks- Motion by McClatchey, seconded by Bolger, to authorize the Authoriza- Park Director to establish a location which meets the requirements for tions the cars with the understanding that the work for establishing the track be provided by other than City employees. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Mayor Busse called for a recess at 9:30 P.M. The meeting reconvened at 9:45 P.M. with everyone still in attendance. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Resolutions Motion by Snell, seconded by Teta, to pass a resolution with Fiesta Days the Illinois Department of Transportation depicting the route of the 1986 Fiesta Day Parade. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. CNW Motion by Snell, seconded by Lieder, to authorize and approve Trans. Co. Partial Payment Estimate No. 1 to Zimmerman Construction Company in the amount of $43,350 for commuter parking lot improvements as recom- mended by Baxter & Woodman. Voting Aye: Bolger, Lieder McClatchey Nolan, Smith, Snell, �erritella, Leta. Voting Nay: None. Absent: None. Motion carried. Wednesday, June 4, 1986 page 3 Motion by Bolger, seconded by Teta, to authorize and approve payment to D & D Seawall Inc. in the amount of $850 for installation Public Prop. of steel sheeting on the northwest bank of the Green Street bridge. Motion by Teta, seconded by Snell, to authorize and approve purchase of an advertisement in the Sesquicentennial addition of the Northwest Herald at a cost of approximatley $1,300. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Smith, to authorize and approve the picnic beer permits as presented. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Authorizations Sesquicenten- nial Park- Beer Permits A drainage problem was brought to the Council's attention Authorizations for run-off from the Shepherd of the Hills Church Parking Lot onto the property owned by Mike Phill of Fairway Drive. Motion by Bolger, seconded by Nolan, to authorize the Super- intendent of Public Works to get cost estimates on solving the drainange problem across Fairway Drive and report back to the Council with long term and short term solutions to the problem. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried.
