HomeMy WebLinkAboutMinutes - 06/03/1992 - City CouncilREGULAR MEETING June 3, 1992 The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, June 3, 1992 at 7:30 p.m. in the Municipal Center Council Chambers. At roll call the following Aldermen were present: Bolger, Donahue, Lieder, Smith, Adams, Patterson, Serritella. Locke arrived at 8:50 p.m. Absent: None. City Staff in attendance: City Clerk Gilpin, City Attorney Narusis, City Administrator Peterson, Chief Joyce, Director of Public Works Batt, Park Director Merkel, Building and Zoning Director Lobaito. Absent: None. PUBLIC INPUT SESSION Ten people signed up for the Public Input Session. Anton Rebel of 4009 W. Maple reported on the Boone Creek clean up project which took place May 30. It was very successful. Jim Higgins of Ashley and Front Royal complained that road salt had ruined his parkway and was asking the City to do restoration work in that area. Mark Stephenson of 1209 Capri Terrace complained of the water quality in McHenry Shores and brought a bottle of discolored water to prove his point. Bob Wegener of 3713 Biscayne Drive, Craig Musser of 3705 Biscayne Drive, Gary Hansen of 3801 Biscayne Drive, and Lonnie Powell also of Biscayne Drive all addressed the Council to complain of the lack of water and the water quality on Biscayne Drive. Those residences are hooked up to the McHenry Shores Water Company. Glen Noble of 3305 Pearl Street who resides in an apartment on the southwest corner of Pearl and Riverside Drive complained that there was no place for him to park overnight without receiving a ticket. Mark Reinwall and Deanna Gardner signed up to speak during the Public Hearing Session of the proposed Knox Annexation project. Their comments were taken during the Hearing. CONSENT AGENDA Motion by Patterson, seconded by Bolger to approve the Consent Agenda as follows: (1) Approve May 13, 1992 Regular Meeting Minutes as presented. (2) Approve May 20, 1992 Regular Meeting Minutes as presented. (3)Approve picnic/beer permits as presented. Voting Aye: Bolger, Donahue, Lieder, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: Locke. Motion carried. RESOLUTION FOR PETER ADAMS Peter Adams has served on the McHenry Police Commission since 1975. He did not seek reappointment. Motion by Serritella, seconded by Adams to pass a resolution recognizing Peter Adams for his service and dedication to the McHenry Police Commission for the past seventeen years. Voting Aye: Bolger, Donahue, Lieder, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: Locke. Motion carried. Mayor Busse presented the resolution to Mr. Adams who was in attendance at the meeting, and expressed appreciation on behalf of the City Council and all the citizens of McHenry. SOLICITOR'S LICENSE Brian Scott of Chicago Research Marketing, was in attendance requesting a Solicitation Permit to go door-to-door to distribute promotional material for the Hob Nob Restaurant. Motion by Serritella, seconded by Patterson to deny the request of Chicago Research Marketing for a Class B Solicitor's License. Voting Aye: Bolger, Donahue, Lieder, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: Locke. Motion carried. June 3, 1992 SIGN VARIATION REQUEST Page 2 McHenry Firestone, located at 1301 N. Front Street, was requesting permission to erect a sign off -site to advertise their business and to Increase the maximum square footage allowed by City Ordinances. The Firestone property has no frontage either on Elm Street or Front Street. They have been operating at this location since 1979 with signage that appears on the east side of the building. Due to its generally poor visibility from Elm Street and Front Street, the petitioners were requesting permission to construct a pole sign off -site at Front Street where it could be seen by traffic on Elm Street. Motion by Patterson, seconded by Bolger, to approve the sign variation request for McHenry Firestone at 1301 N. Front Street for placement of an off -site sign on adjacent property not owned by Firestone, but if the ownership or use of the building changes, another variation will have to be requested. Voting Aye: Bolger, Donahue, Lieder, Smith, Adams, Patterson. Voting Nay: Serritella. Absent: Locke. Motion carried. PROPOSED ANNEXATION OF TYNIS PROPERTY Walter Tynis, Jr. owns an eight acre parcel located on the east side of Ringwood Road about 450 feet north of Flanders Road in unincorporated McHenry County. Martin Woods II Subdivision is located on the west side of the road across from the property in question. Mr. Tynis presented a concept plan for an eight acre subdivision and asked permission to pursue annexation. Motion by Bolger, seconded by Donahue to instruct Mr. Tynis to proceed to the Plan Commission and the Zoning Board of Appeals for the annexation process. Voting Aye: Bolger, Donahue, Lieder, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: Locke. Motion carried. PUBLIC HEARING BUSCHANOX ANNEXATION PROJECT Mayor Busse called to order a Public Hearing on the Busch/Knox annexation and zoning petitions at 8:40 p.m. The petition concerned the annexation and zoning of sixty-nine acres of land located on the northeast and northwest corners of Bull Valley Road and Green Street. Attorney Thomas Rupp represented the petitioners along with Thompson Dyke, Land Planner. During the Public Hearing portion, Mark Reinwall of 3816 W. Bull Valley Road, addressed the Council and said that he would prefer RM-1 zoning adjacent to his property instead of RM-2. Deanna Gardner of Shepard Hill Drive objected to the density of the annexation proposal. Court Reporter Cheryl Barrone was also in attendance. Alderman Locke arrived at 8:50 p.m. Mr. Dyke gave an overall brief presentation and displayed exhibits which outlined the project. The main topic of conversation was the proposed zoning uses and the proposed Bull Valley Road right-of-way through the property which connected Route 31 to the Bull Valley bridge. It was also pointed out that the plan as proposed did not meet the City's Comprehensive Plan. Due to the complexity of the project, the meeting was recessed to Monday, July 20, 1992 at 7:30 p.m. to continue deliberation on the proposed annexation. The Public Hearing was recessed at 9:28 p.m. RECESS Mayor Busse called for a recess of the Regular Council Meeting at 9:30 p.m. The meeting reconvened at 9:40 p.m. with all Aldermen still in attendance. June 3, 1992 SOLICIT BIDS FOR PICK UP TRUCK Page 3 Motion by Bolger, seconded by Smith, to advertise for the purchase of a replacement pick up truck in the Parks Division with no bid bond to be required. Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. MAYOR'S STATEMENTS AND REPORTS Mayor Busse announced that the June 10, 1992 Regular Council Meeting would be a Planning Meeting to basically discuss Ward Redistricting. Mayor Busse expressed appreciation to Bjorkman's Ace Hardware for its very generous donation of maple and pine trees worth $1,223.00 for planting in City parks and on other City property. COMMITTEE REPORTS Alderman Patterson, Chairman of the Parks and Recreation Committee, reported on a meeting held May 19, 1992 at the Knox Park Pool. Motion by Patterson, seconded by Bolger, to accept the Marlin's Swim Team Parents Organization donation of a display board to be installed at Knox Park. Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Patterson, seconded by Locke to accept the McHenry Lions Club donation of it's large lighted display sign now located on Elm Street across from the Market Place, which would be relocated approximately 300 feet east of its present location on Elm Street near the Whispering Oaks entrance and would be totally under the City's jurisdiction. Voting Aye: Voting Nay Absent: Motion carried. ANY AND ALL BUSINESS Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. None. None. Motion by Bolger, seconded by Lieder to authorize the Mayor, City Administrator, and Public Works Director to take whatever legal action is necessary to correct the water problem in the Biscayne Highlands Subdivision. Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Patterson, seconded by Bolger to authorize the Public Works Department to pick up debris which resulted from the Boone Creek clean up project. Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. June 3, 1992 Page 4 Discussion was held on a letter written by Mayor Busse to the ICC concerning the possibility of installing another railroad crossing north of Orleans Drive. The matter was discussed during the Transportation Planning Meeting and copies of that meeting will be distributed to the Aldermen so they can verify that the action taken was according to direction given at that Transportation Meeting.
