MONDAY, MAY 23, 1988 8:00 P.M.
The Regular Meeting, of the McHenry City Council was called to Council
order by Mayor Busse on Monday, May 23, 1988 at 8 P.M. at City Hall. At
g.
roll call the following Aldermen were present: Nolan, Lieder, Teta, Attendance
McClatchey, Patterson, Serritella. Absent: Smith. Bolger arrived at A
8:18 P.M. City staff in attendance were Supt. Batt, Attorney Narusis,
Clerk Gilpin, Park Director Merkel, Chief Joyce, Finance and Personnel
Administrator Vitas.
Motion by Nolan, seconded by Teta., to accept the minutes of the
May 4, 1988 and May 11, 1988 Regular Meetings as presented with
corrections.
Voting Aye: Nolan, Lieder, Teta,
McClatchey, Patterson., Serritella.
Voting Nay: None.
Absent: Bolger, Smith.
Motion carried.
Attorney Dan Curran addressed the Council on behalf of Timothy
Wirfs, William Jepsen and John Hoffstetter who were seeking an amendment oning-
to the McHenry County Zoning Ordinance For property located on Bull County
Valley Road just east of Crystal Lake Road. The parties were requesting Matters
a change from Agriculture to a light industrial classification. TheY
appeared before the City Council to explain the intended use of the
property since it is within a 1 1/2 mile jurisdiction of the City of
McHenry.

Motion by Patterson, seconded by Lieder, that the City file an Piotions
opposition letter with the County Zoning Board of Appeals for the
petitioner's request from A-1 Agriculture District to I-1 Light Industry
District.
Voting Aye: Teta, Lieder, Patterson, Busse.
Voting Nay: Bolger, Nolan, McClatchey, Serritella.
Absent: Smith.
Motion did not carry.
Carl Moon of Baxter and Woodman reported that all documents had Sewer
been sent to the Illinois EPA for awarding of a $320,000 grant in Plant -
connection with the construction of the McHenry South Wastewater South
Treatment Plant. He recommended that the Contract not be awarded for Bid
this project until a letter awarding the grant had been received from the Awarding
EPA. The Council concurred.
Motion by Lieder, seconded by Nolan, to accept the low bid of
Yonke and Soper Excavating of Zion Illinois for the McHenry South
Wastewater Treatment Plant Influent Sewer at a cost of $144,650.
Voting Aye: Bolger, Nolan, Lieder, Teta, McClatchey,
Patterson, Serritella.
Voting Nay: None.
Absent: Smith.
Motion carried.
Mayor Busse reported that the Board of Local Improvements
recommended that the City Council accept Option B of the McHenry Shores
Supplemental Assessment Schedule which called for a Supplemental Special
Assessment of $200,000 to be spread among the property owners of McHenry Assessment
Shores and $110,650 to be paid by the City's Capital Development Fund to
make up the $310,650 difference caused by the over bid for the Special
Assessment project.
Motion by Nolan, seconded by Teta,
of the Board of Local Improvements and chose
Assessment schedule.

McClatchey, Patterson,
Voting Nay: None.
Absent: Smith.

Improvements meeting which had been recessed from 7:59 P.M. this evening.

deficiency for the McHenry Shores Supplemental Assessment of 8.3 percent
or $199,999.50.

Motion carried.
Motion by Nolan, seconded by Serritella, to approve a draft
ordinance providing for a Supplemental Assessment to meet the deficiency
of the first assessment in the amount of $110,650 as presented and to
recommend that the City Council proceed with the project.
Voting Aye: Bolger, Nolan, Lieder, Teta,
McClatchey, Patterson, Serritella.
Voting Nay: None.

recommendation of Baxter & Woodman and award the contract as amended to
George W. Kennedy Construction Co., Inc. in the amount of $2,710,044 for
the McHenry Shores Area Sanitary Sewer System Special Assessment No. 31
as presented.
Voting Aye: Bolger, Nolan, Lieder, Teta,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: Smith.

of the Board of Local Improvements for May 4, 1988 and May 11, 1988 as

Mayor Busse reconvened the Regular Meeting of the City Council
at 9:21 P.M.
The City Clerk was directed to publish in pamphlet form the
Special
proposed ordinance providing for a Supplemental Assessment to meet the
Assessments
deficiency of the first assessment for McHenry Shores Sanitary Sewer
Special Assessment No. 31.
Harold Warren of Warren Associates, financial consultant for the
City of McHenry, addressed the Council concerning the bond issue needed
to fund the Special Assessment project.
Mayor Busse called for a recess at 9:30 P.M. The meetinq
reconvened at 9:45 P.M. with everyone still in attendance.

The following discussion was held concerning the preliminary
plat of Green Valley presented by Don Meyer of McIntosh, Inc.: 1)Access
easements be required along Turnberry Drive through the side yards for
maintenance of existing manholes; 2)Regarding the 40 foot easement
which is required in the Annexation Agreement, it was decided to have the
developer record a 20 foot easement for installation of the sanitary
sewers with the understanding. that if additional footage is required by
the City after final engineering is applied to the Final Plat, the
developer will increase the size of the easement to 30 or 40 feet,
whichever is necessary; - 3)Meyer reported that the seven items required
by the Plan Commission had been completed except Items 1, 2, and 7. He
said these items would be complied with on the final plat through
engineering; 4)Possibly a statement should be put on the plat alerting
buyers to be aware that basements cannot be constructed on certain lots
in the subdivision; 5)Turnberry Drive should be a 27 foot roadway with
a 60 foot right-of-way; 6)The developer should consider curving Loch
Glen Drive to the south at the eastern boundary of the property to meet
McHenry Avenue which connects to Bull Valley Road.

plat of Green Valley as submitted by Don Meyer of McIntosh, Inc. with the

Commission's request to plaque the Dennis and Jessica Smith Home at 3712
W. Main Street.

Motion by Teta, seconded by Patterson, to approve the contract
and contract bond for the City's annual crack filling program with the
low bidder, Behm Pavement Maintenance in the amount of $25,000 to be
funded with MFT Funds.

the resignation of Sandra Eckstein from the McHenry Plan Commission and
pass a resolution recognizing her accomplishments and expressing Resignations
appreciation on behalf of the citizens of McHenry for her 11 years of Resolutions
service on the Plan Commission Board.

recommendation of the Police Chief and authorize the City Attorney to
