Mtg. order by Mayor Busse on Thursday, May 23, 1985 at 6:30 p.m. at city Attend. hall. At roll call the following Aldermen were present: Bolger, & McClatchey, Smith, Serritella, Teta. Snell arrived at 6:37 p.m., Lieder Special & arrived at 6:50 p.m. Absent: Nolan. City staff in attendance were McH. Sand Attorney Narusis, Clerk Gilpin. Also in attendance were approximately & Gravel 150 people appearing in support of McHenry Sand & Gravel. Mayor Busse announced that the original intention of this meet- Coun.Mtg. ing was to continue the discussion on unfinished business from the Special & Monday, May 20th Council Meeting. Since it was close to 1:00 a.m., the McH. Sand Council could not discuss the matter any further and therefore decided to & Gravel continue the discussion at a Special Meeting which was called for tonight. Mayor Busse announced that the City of McHenry had received notice that a petition had been filed by McHenry Sand & Gravel with the McHenry County Zoning Board of Appeals. The hearing was scheduled to be held on Wednesday, June 12, 1985 at 2:00 p.m. in Room 203 of the McHenry County Court House. Mayor Busse announced that on Thursday morning, Chuck Miller of McHenry Sand & Gravel provided him with the following documents: Noise Assessment of Proposed Expansion of West Oper- ations prepared by Barton-Aschman Assoc.; Air Quality Effects of McHenry Sand & Gravel Company's Proposed Gravel Extraction Operation prepared by ETA Engineering, Inc. and Reclamation Plan for McHenry Sand & Gravel pre- pared by Associated Planners. That information was placed on the desks of the Aldermen at tonight's meeting and since they had no chance to review the documents, Mayor Busse suggested that this Special Meeting be recessed to a time and place where proper time and notice could be given and be mutually agreeable to all interested parties. Alderman Smith ask whether the Council was going to follow the agenda set for this meeting and go into executive session. It was the consensus of opinion that no executive session should be held at this meeting. Smith stated that he felt all discussions should be completely and totally discussed in open session. The Council agreed. Attorney Tom Rausch of Holmstrom & Green, the law firm repre- senting McHenry Sand & Gravel, addressed the Council. He requested that the City Council not discuss this matter in executive session. Mayor Busse suggested that all persons who are interested in this matter should be given the opportunity to come before the Council and present evidence or testimony on the petition. It was suggested that possibly McHenry High School Auditorium could be used as a meeting place. Since this was a recess meeting of the City Council, it would be up to the City Council to select a location and notify all of the interested parties of the time and place. The City Clerk was instructed to make arrangements for a meeting place preferably on May 28, 29 or 30th. Attorney Narusis reported that he had been in contact with the law firm of Holmstrom & Green and any of the dates mentioned were agreeable to them. Alderman Smith asked what the exact purpose of the meeting would be. Mayor Busse said that it would be for the Alderman to consider the merits of the petition and arrive at a decision as to whether or not the Council should oppose or support the petition. Alderman Bolger asked if a full fledged debate was held before the City Council, would the City be in danger of pre-empting the County Zoning Board's jurisdiction. Narusis felt that it would not create a problem. Mr. Miller initiated the contact with the City and offered to come forward and explain to the City the facts that they deemed to be important in their determination. If there were others with different views, they should be afforded the opportunity to present their views also, he said. Narusis felt that nothing that happened at these Monday, May 23, 1985 page 2 meetings would effect the judgement of the McHenry County Zoning Board of Appeals. They only thing that would come out of this Special Meeting was that the City Council would make a decision as to the position it wished to take regarding the petition. Narusis pointed out that the City in its present state does not have zoning power on this matter. It has only the right to appear as an objector. Attorney Rausch agreed but said he did not want to under- estimate the importance of the decision of the City Council on this peti- tion. He felt the City Council's decision had great bearing upon the ultimate outcome of the petition before the County. He said "It is your decision. It is your City. The property is located very near to the City. It has great bearing upon each and everyone in the area and con- sequently County Board Members and County Zoning Board Members will put great weight upon what the City Council does". That was the reason they wanted to come before the City Council and present their side of the situation. Rausch said much had been read and said about it, but some- times things get distorted in the process. If the City was going to make a decision either pro or con, they felt all of the evidence should be presented and the Council should hear both sides. Rausch also agreed that anything the City Council did would not pre-empt the County Zoning Board of Appeals procedures. Alderman Smith pointed out that he felt the Council had an three options, not two; to be pro, con, or neutral regarding the petition. Coun. Mtg. Motion by Smith, seconded by Serritella, to recess this Special Spec. & Meeting until either May 28, 29, 30 depending on availability of a McH. Sand & meeting location. The Regular Meeting of the McHenry City Council was called to Council order by Mayor Busse on Monday, May 20, 1985 at 8:00 P.M. in city hall. Mtg. At roll call the following Aldermen were present: Bolger, Lieder, Attendance McClatchey, Nolan, Smith, Snell, Serritella, Teta. Absent: None. City staff in attendance were Supt. Halvensleben, Attorney Narusis, Clerk Gilpin, Park Director Merkel, Chief Joyce. Motion by Nolan, seconded by Serritella, to accept the minutes of the May 13, 1985 Regular Meeting as presented. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Mayor Busse called to order a Public Hearing regarding a plan to finance the construction and equipping of a professional and medical office building located at 616 S. Route 31, McHenry. Pursuant to the plan of financing, the city proposes to issue and sell its Industrial Development Revenue Bonds in an amount of $650,000.00 and lend the proceeds thereof to CLR Development Group, an Illinois General Partnership, of which the partners are James Berg of McHenry and Ronald Ulakovich of East Dundee, so as to finance the cost of the project and to pay for certain costs incidental thereto. The project will be owned by American National Bank and Trust Co. of Chicago as trustee under Trust No. 63679. Written or oral comments could be submitted to the City Clerk or presented at the Public Hearing on this date. Members of the audience in attendance were Martin Koleno Sr., Thomas P. Mathews, Tony Oliver and Vic Santi. Attorney Narusis explained that this Public Hearing was a repeat of a prior one due to a name change of the corporation from CLR Development Corporation to CLR Development Group. Nothing else in the previously passed resolution had been changed. Mayor Busse asked if there were any oral or written comments to be presented at this time. There was no response from anyone in the audience or on the Council. Motion Public: Hearing Voting by Nolan, seconded by McClatchey, to at 8:14 P.M. Motion carried. adjourn the Motion by Nolan, seconded by Lieder, to affirm and ratify the previous action taken by the Mayor and City Council on April 22, 1985 adopting a resolution authorizing and providing for the issuance by the City of McHenry of $650,000.00 in Industrial Project Revenue Bonds for the CLR Development Group Project. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by McClatchey, seconded by Nolan, to hire eight employees for summer jobs in the Public Works Department as presented. Motion by Smith, seconded by McClatchey, to authorize and approve anniversary increases for the various departments as pre- sented for approval. Motion by Nolan, seconded by Serritella, to authorize and L.P. approve the payment request of Northern Illinois Utilities for Water Co. installation of 38 meters at a cost of $11,400.00 and 38 valves at $234.08 for a total of $11,634.08, said funds to come from money withheld on the sale of Lakeland Park Water Co. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Lieder, seconded by Nolan, to authorize the hiring Employees for personnel for the Park Department as presented and recommended by the Park Director. Zoning Matter A letter was presented to the Council from Bruce Koepke, owner of Bruce's Standard Service at 3522 W. Elm Street. Mr. Kepke requested permission to replace his underground gasoline storage tanks and increase the tank capacity from 13,000 gallons to 18,000 gallons storage capacity. The present zoning ordinance only allows a maximum of 16,000 gallons total storage. Motion by Serritella, seconded by McClatchey, to have the City petition the Zoning Board of Appeals and remove the section referring to the gasoline underground storage tanks from the Zoning Ordinance to the Building Code. Motion by Lieder, seconded by Teta, to table the above motion until further information is available. Voting Aye: Lieder, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: Bolger, McClatchey. City Clerk Gilpin informed the Alderman that the letter of Letters of credit for completion of sidewalks in Phases I & II in Millcreek Credit Subdivision was up for expiration on June 15, 1985. Three extensions had already been granted for this project. It was the consensus of opinion that Elgin Federal Savings and Loan, owners of the Millcreek Subdivision, should be notified that it was the City's request that the installation of the sidewalks in Phases I & II be completed prior to June 15, 1985. IDOT A letter from IDOT was addressed to the Council regarding the installation of two pedestrian signal heads and two pedestrian Street Maint. push buttons at the intersection of 120 and Industrial Drive. The & estimated cost to the City for this revision would be $808.75. The Repair Supt. of Public Works was authorized to contact IDOT and obtain further information before the Council would make a deci- lion for the expenditure of these funds. Motion by Snell, seconded by Smith, to pass a resolution Resolutions designating the parade route for the annual Fiesta Day Parade on & Sunday, July 28, 1985 and requesting a parade permit from the Fiesta Days Illinois Department of Transportation. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Lengthy discussion was held on the correction of the drain- Committees - age and road problems on Park Street. The matter was referred to the Auth, Instrct Street & Sidewalk Committee for further Study. Mayor Busse called for a recess at 9:50 P.M. The meeting reconvened at 10:01 p.m. with everyone still in attendance. Discussion was held on Police overtime and the 28 day scheduling period. Sergeant Commander Donahue addressed the Council and requested instructions as to the implementations of the new scheduling program. Motion by McClatchey, seconded by Bolger, to authorize the Employees Police Department to enter into a 28 day schedule with a maximum of 171 hours for overtime consideration. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Lieder, seconded by Serritella, to authorize the Street Superintendent of Public Works to advertise for bids for mowing of Maint. & vacants lots in the City and right-of-ways along City streets with Repair the vacant lots to be mowed not more than three times a season on the condition that the Supt. of Public Works would have to authorize each cutting. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Snell, to authorize and approve LP Water Co the payment of real estate tax bills for the Lakeland Park Water & Company and for the Knox Park recent annexation of 1 acre as Land Acquis follows: 3 parcels of land in Lakeland Park at $1,022.44 and 1 acre in Knox Park for $173.86 for a total of $1,196.30. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: one. Motion carried. Monday, May 20, 1985 page 6 Donations, Motion by Smith, seconded by Nolan, to instruct the Supt., of etc. Public Works to have city employees stripe the parking lot at McHenry Country Club in lieu of payment for an aerator to be donated to the Park Department from the Country Club which was valued at approximately $250 with the striping of the parking lot to be clone during regular city working hours. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Pol. Dept. Motion by Nolan, seconded by Bolger, to establish a summer Misc. & crossing guard at the corner of Lillian and Front Streets to assist Parks, Misc. children crossing from the west side of Lillian Street to Knox Park Pool. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Coun. Mtgs. Motion by Nolan, seconded by Smith, to go into executive Exec. Sess. session at 11:32 p.m. to discuss pending litigation and legislative consultation.
