MAY 15, 1991
The Regular Meeting of the McHenry City Council was called to order
by Mayor Busse on Wednesday, May 15, 1991 at 8:00 P.M. in City Hall. At
roll call the following Aldermen were present: Bolger, Donahue, Locke,
Lieder, Smith, Adams, Patterson, Serritella. Absent: None. City Staff in
attendance were: City Clerk Gilpin, City Administrator Peterson, City
Attorney Narusis, Director of Public Works Batt, Director of Building and
Zoning Halik, Director of Parks and Recreation Merkel, and Chief Joyce.
Absent: None.
During the ten minute public input session, Liz Nolan reported on the
McHenry Beautification Committee's projects throughout the City. Maxine
May Cwiak, Fran Flack, and Liz Nolan are the only three women who do all
the work in planting and weeding the thirteen spots in McHenry that the
Beautification Committee maintains. Anyone willing to volunteer to help
the Beautification Committee, should contact her. The Mayor thanked Mrs.
Nolan and her Committee for all they've done in the past and for their
continued dedication to beautification in the City.
Motion by Bolger, seconded by Serritella, to approve the Consent
Agenda as follows:
- Pass a Resolution recognizing Frank Gans for his service on
the Landmark Commission;
- Approve the April 23, 1991 Special City Council Meeting

Motion by Smith, seconded by Patterson, to approve a reduction in the
Letter of Credit for Martin Woods, Unit II from $1,949,592.50 to
$406,971.56, subject to the City's receipt of "as built" plans and the
receipt of an open-end guarantee bond in the amount of $246,819.38
warrantying the materials and workmanship of the completed work as
recommended by Baxter and Woodman.

A discussion on development of a Comprehensive City-wide Bike Plan
was made by Steve Weller, Planning Coordinator for the McHenry County
Conservation Department and Park Director Merkel. A proposed trail map
was presented which showed the Conservation District s plan for a
north/south bikeway along the Chicago/Northwestern railroad track. The
development of this comprehensive city-wide- bike plan would help link
destination points such as schools, parks, business districts, and other
public facilities as well as a link -up with Moraine Hills State Park.
City Administrator Peterson noted that the adoption of a Bikeway Master
Plan for the City would help provide direction for new development
proposals. It would also provide a way to communicate future link -up
plans with existing and proposed bike trail systems which would help to
put the City in a position to obtain 50% matching grant funds in a
program administered by the Illinois Department of Conservation. The
Council listened to the presentation and had no negative comments to make
about the proposed plan. The consensus was to support a City-wide Bike
Plan and also a plan to link the City with other regional bikeways. The
proposed plan could run from Elgin to the Wisconsin State line. No
action was taken at this time.
Motion by Bolger, seconded by Donahue, to grant the request of Irish
Prairie Ltd. Partnership for a use variation at the Shamrock Health and
Fitness Center subject to the following conditions:
1 - No massage parlor or salon shall be allowed on the premises;
2 - The maximum hours of operation in effect shall be 5:30 A.M.
until 10:30 P.M. on Mondays through Fridays and 8:00 A.M. to
5:00 P.M. on Saturdays and Sundays;
3 - That there shall be no operation or rental of the inside or
outside of the facility either after or before the regular
hours of operation;
4 - Participation 1n the health club shall be based upon private
membership only and not available generally to the public or
available on a daily basis;
5 - That the approval criteria for variations as found on pages
376 - 377 of the Zoning Ordinance shall be met;

Discussion was held on the Bretons Drive drainage problem as well as
other City drainage problems. Baxter and Woodman completed a survey on
the lots at 3402, 3406, 3410, and 3414 Bretons Drive. Public Works
Director Batt supplied drawings which showed an elevation profile view of
both side and rear lot lines compared to existing sidewalks and to
originally planned elevations. There were no major differences in design
and as built grades, however, several grades were noted that were not at
a minimun slope of 1.5% which is the slope necessary to drain lots
properly. Following discussion, the Council authorized the staff to
recommend how the problems could be solved and what the costs would be.
Then a meeting should be set up involving all the parties involved in the
drainage problems on Bretons Drive so that responsibility could be shared
and not just borne by the City. It was also noted that there are other
major problems with drainage in other areas of the City which the staff
should identify so that plans could be made to also solve some of those
drainage problems in the future.

Attorney Steve McArdle, representing Cypress Medical Products, Inc.,
addressed the Council to request that a recapture agreement be approved
in connection with a sewer extension to serve the Cypress Medical
Products property. In order to be served by City sanitary sewers, it was
necessary for Cypress to install a sewer main across their property. It
was noted that in the City Subdivision Control Ordinance, extension of a
sewer line must be made to the end of the property line. This was
required and done by Cypress, and they now felt that they should be able
to recapture money for installation of the sewer line to their property
line.
Motion by Smith, seconded by Patterson, to deny the request for
sanitary sewer recapture agreement for Cypress Medical Products, Inc.

Motion by Serritella, seconded by Smith, to authorize the City to
enter into an inter -governmental agreement with McHenry Township for a
Mosquito Spraying program from Clarke Outdoor Spraying Company at a cost
of $2,618.00, and to enter into a one-year contract with Clarke Outdoor
Spraying for a Mosquito Spraying Program for the Nunda Township portion
of the City at a cost of $877.00, as presented.

Dave Scatterday and Kate Stalker of Martin Associates, the landscape
firm hired by the City to design a landscape plan for the new Municipal
Center, presented a revised overall landscape plan at a proposed cost of
$74,900.00. Following discussion, it was the consensus that the City
should go out to bid for the plan as submitted and if any other donations
for trees or shrubs were made by companies or individuals, those
donations should be in addition to the $74,900.00 budgeted for
landscaping.
Motion by Lieder, seconded by Patterson, to direct Martin Associates
to design and prepare the bid documents so the City can advertise for
bids on the overall landscape plan at a cost not to exceed $75,000.00,
and to also include an outside eating area for employees in the plan.

Mayor Busse called for a recess at 10:27 P.M. The meeting reconvened
at 10:40 P.M. with everyone still in attendance.
City Administrator Peterson presented a concept plan to finish the
shell space in the new Municipal Center for recreational program use,
with the cost of finishing the shell space not to exceed $20,000.00. He
noted that the 2,500 square feet of space on the second floor was left
unfinished to be used for future expansion. The 1991-92 Budget contains
$20,000.00 for finishing this shell space for purposes of conducting a
variety of recreational programs both during and after regular open
hours. Use of this space for recreational purposes is seen as a medium
range (5 years) solution to providing space for the department's
programming needs. At the present time the City 1s renting space for
recreational programs which cost $20,000.00 a year. Lengthy discussion
took place on the matter.
Motion by Adams, seconded by Patterson, to authorize the staff to get
estimates on finishing the shell space for use this year; to look into
how some of the problems could be handled for handicapped access, and
code and fire regulations; and to came back to the Council with a report.

Director and the Parks and Recreation Committee come back to the Council
with a long-term "Building Needs Plan" for the Parks and Recreation
Department and to also submit possible solutions.

Mayor Busse called for a Special Meeting on Tuesday, May 21, 1991 at
8:00 P.M. to discuss the McHenry Muncipal Center Furniture and Telephone
Bids and to present an update on construction at the new site.
Public Works Director Batt reported that Don Meyer of Granite
Builders, offered to donate 200 feet of 66' drainage pipe to the City if
the City would agree to pay for the labor to install the pipe along the
drainage ditch adjacent to McHenry Avenue and the South Wastewater
Treatment Plant. This would solve a problem which has been ongoing in
that area. The estimated value of the pipe installed is $20,000.00. He
recommended that an expenditure of $5,000.00 be authorized to take
advantage of this comparatively tow -cost solution to a serious problem.
Motion by Smith, seconded by Serritella, to approve Batt's
recommendation and authorize an expenditure of $5,000.00 for installation
of the piping.

authorizing the City to enter into a joint governmental purchasing
program with the State of Illinois for the term of this Council.
