The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, May 13, 1987 at 8 P.M. at City Hall. Council At roll call the following Aldermen were present: Bolger, Lieder, Meeting McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Absent: None. Attendance City staff in attendance were Supt. Batt, Attorney Narusis, Clerk Gilpin, Park Director Merkel, Chief Joyce. Penny Hughes of Hughes Sign Company appeared on behalf of the tenants at 4005 Kane Avenue in the Water Tower Place commercial complex to request a sign variation. Motion by Lieder, seconded by Serritella, to deny the sign variation request as presented. Voting Aye: Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: Bolger. Absent: None. Motion carried. Motion by Teta, seconded by Serritella, to permit the tenants at 4005 W. Kane to put up a sign that is no taller than 3 feet which is what abutting sign heights are and that the sign be designed in a manner similar to adjoining signs on the facade of the complex and to adjust the sign size in such a manner that it would not exceed 3 feet in height by 13 feet in length and eliminate 38 square feet for both tenants. Alderman Serritella withdrew her second. Bolger then seconded the motion. Motion by Lieder, seconded by McClatchey, to table the motion. Voting Aye: Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: Bolger. Absent: None. Motion carried. Motion by Lieder, seconded by Patterson, to approve the fence variation request of Dave Gelwicks at 3817 W. Waukegan Road as presented. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Patterson, Serritella, Teta. Voting Nay: Smith. Absent: None. Motion carried. Motion by Smith, seconded by Bolger, to approve the request of McHenry Villa for a temporary banner on the south side of the building through the end of July to announce their grand opening. Voting Aye: Bolger, Lieder, McClatchey, Patterson, Smith, Serritella, Teta. Voting Nay: None. Absent: None. Not Voting: Nolan Motion carried. Alderman Serritella, Chairman of the Purchasing Committee, announced that she would give a report of the May 12, 1987 Purchasing Committee Meeting at the Regular Council Meeting on May 18, 1987. Alderman Smith, Chairman of the Street and Sidewalk Committee, reported on the Street and Sidewalk Committee meeting of May 12, 1987 regarding the MFT summer street maintenance program and private roads in newly annexed property. Motion by Bolger, to direct the City Attorney to acquire easements needed for sewer lines and to acquire rights -of -way for Bally (River Road) and Prairie Street in Idyl Dell Subdivision. Motion failed for lack of a second. It sewer service and others were asked to contact the Mayor Wednesday, May 14, 1987 Page 2 Motion by Nolan, seconded by McClatchey, to authorize the City Public Clerk to purchase magnetic signs for the Aldermen to be placed on the Property cars during Fiesta Day activities. Purchases Voting Aye: Bolger, Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by McClatchey, seconded by Nolan, to pass an ordinance prohibiting bike riders and drivers of motorized vehicles from wearing Ords. head phones or walk -man radios while driving their vehicles on City Streets and highways. Voting Aye: Nolan, Smith, McClatchey, Patterson. Voting Nay: Bolger, Teta, Lieder, Serritella. Absent: None. There being a tie vote, the Mayor cast an Aye Vote and declared the motion carried. Proclama- Mayor Busse proclaimed the week of May 17-23, 1987 as "National tions Public Works Week" in the City of McHenry and called upon all citizens and civic organizations to aquaint themselves with the problems involved in providing public works and to recognize the contributions that public works officials make every day to our health, safety and comfort. Parks - Motion by Smith, seconded by Patterson, to approve the picnic Beer beer permits as presented. Permits Voting Aye: Bolger, Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Exec. Motion by Smith, seconded by Patterson, to go into executive Session session at 9:57 P.M. for the purpose of discussing personnel, property acquisition and pending litigation. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Serritella, seconded by Patterson, to go back into open session at 11:35 P.M. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. 'olice Motion by Teta, seconded by Nolan, to instruct the Chief of Iisc. Police to post a guard at the Kane Street railroad crossing for the 7:36 A.M. train just on school days until the end of this school term. The & NW RR City will then start proceedings to get permission from the ICC for ripping out that crossing. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Motion by Lieder, seconded by Bolger, to instruct the City Sale of Attorney to proceed with whatever steps are necessary to sell property in ,ity Prop. the Green Street Parking Lot to the McHenry Savings Bank. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Special Motion by Smith, seconded by Patterson, to schedule a Special Mtg. Meeting for executive session on Thursday, May 14, 1987 at 7:30 P.M. for the purpose of discussing property acquisition. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Patterson, Smith, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Wednesday, May 13 , 1987 Page 3 Motion by Smith, seconded by Teta, to instruct the City Attorney to proceed with condemnation proceedings for the structure at 3516 W. Pearl Street.
