THURSDAY, MAY 12, 1988 7:35 P.M.
A Special Meeting of the McHenry City Council was called to order
by Mayor Busse on Thursday, May 12, 1988 at 7:35 P.M. at City Hall. The
purpose of the meeting was to review the Zoning Ordinance. At roll call
the following Aldermen were present: Bolger, Lieder, Teta, Smith,
Patterson, Serritella. Absent: Nolan, McClatchey. City staff in
attendance were Attorney Narusis, Clerk Gilpin, Building and Zoning
Officer Zabor.
Alderman Lieder left the meeting at 8:22 P.M. and returned at
10:00 P.M. Alderman Bolger left the meeting at 10:00 P.M.
Discussion was held on the following Zoning Matters:
1. Conditional Use Requirements
2. Sign Ordinance Revisions
3. Empty Retail Buildings to Stay Retail
4. Landscape Plan for Commercial Districts
5. Setbacks for Small Accessory Buildings
6. Lot Widths, Density and Setbacks in All Districts
Especially Residential Setbacks for Front and
Corner Lots, Also Lot Areas in RS-3 and RS-2
7. Commercial Parking Spaces
8. Amount of Filing Fees for Minor Variances
9. Enforcement of Present Zoning Ordinance with
Possible Hiring of Additional Staff
10. Removal of Political Signs
11. Fence Height and Placement
12. Gas Station Requirements
13. Buffer Zones and Industrial Districts Adjacent
to Residential Districts.
14. Site Plan Contents
Motion by Smith, seconded by Serritella, to require that fence
heights between the rear and front plane. of a house should not be higher
than 5 feet.
Voting Aye: Bolger, Teta, Smith,
Patterson, Serritella.
Voting Nay: None.
Absent: Lieder, Nolan, McClatchey.
Motion carried.
Motion by Smith, seconded by Serritella, that all fences must be
placed on the lot line with the exception of that portion of the lot
which extends from either side yard to the building.
Voting Aye: Lieder, Teta, Smith,
Patterson, Serritella.
Voting Nay: None.
Absent: Bolger, Nolan, McClatchey
Motion carried.
Motion by Teta, seconded by Patterson, to maintain the 70 foot
lot width for RS-3 but increase the minimum lot area to 9,000 square feet.
Motion by Serritella, seconded by Smith, to table the motion.
Voting Aye; Serritella, Smith.
Voting Nay: Patterson, Lieder, Teta.
Absent: McClatchey, Nolan, Bolger..
Motion did not carry.
Voting on the original motion:
Voting Aye: Teta, Lieder, Patterson.
Voting Nay: Smith, Serritella.
Absent: Bolger, Nolan, McClatchey.
Motion carried
Motion by Smith, seconded by Serritella, to remove all of the
"X's for required contents for site plans on page 41, table 2 except No.
1 - 5 and on page 43 with No. 16 to remain as an R.
Voting Aye: Serritella, Patterson, Smith, Lieder, Teta.
Voting May: None.
Absent: McClatchey, Nolan, Bolger.
Motion carried.
It was also suggested that a separate definition be prepared for
small sheds and accessory buildings such as having a floor area not
exceeding 100 square feet and a height of not more than nine or 10 feet.
It was also suggested for small accessory buildings there be no setback
requirement from the main buildings or for any other structure of that
small size.

It was also suggested that front setbacks be changed from 25 to
30 feet for all zoning districts except RS-4 as listed on page 94 of the
Zoning Ordinance.
City Attorney Narusis was directed to draft the amendments so as
to revise the Zoning Ordinance as discussed at this meeting for
presentation to the Zoning Board of Appeals at a Public Hearing.
Motion by Smith, seconded by Teta, to adjourn.
Voting Aye: Serritella, Patterson, Smith, Lieder, Teta.
Voting Nay: None.
Absent: McClatchey, Nolan, Bolger.
Motion carried.
