The Regular Meeting of the McHenry City Council was called to order by Mayor Stanek on Monday, May 7, 1984 at 8:00 P.M. At roll call the following aldermen were present:: Bolger, Busse, Datz, McClatchey, Smith, Snell, Serritella. Absent: Nolan. City staff in attendance were Supt. Halvensleben, Clerk Gilpin, Attorney Narusis, Chief Pasenelli, Park Director Merkel. Motion by Busse, seconded by Serritella, to accept the minutes of the April 30, 1984 Annual Meeting and the April 30, 1984 Regular Meeting as amended. Voting Aye: Bolger, Busse, Datz, McClatchey, `.smith, Snell, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. Motion by McClatchey, seconded by Snell, to authorize and approve Pioneer Center's request for installation of their new building for a fire alarm on the Police alarm board in City Hall. Voting Aye: Bolger, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Busse, seconded by Datz, to authorize and approve the payment of $500 to the McHenry County Historical Society from Revenue Sharing Funds. Voting Aye: Bolger, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Snell, seconded by Smith, to approve the request of the Rusty Nail Inn softball team -to hold their annual 12" softball tourna- ment for the weekend of August 3, 4, 5, 1984 at Petersen Park. Voting Aye: Bolger, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Snell,,seconded by Smith, to authorize and approve the purchase of two tires and a spare wheel for the Front Endloader as recom- mended by the Purchasing Committee. Voting Aye: Bolger, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. Council Mtg. Attendance McH. Cty. Assoc. for Retarded Pol. Dept. Misc. Revenue Sharing Parks- Misc. Public Work Purchases A solicitation permit for Tuff and Tidy Corporation of Arlington, Solicitatio Texas who wished to sell an all purpose cleaner through door-to-door solici- tation was presented by Alderman Serritella, Chairman of the License Committee. Motion by Busse, seconded by Datz, to deny the solicitation request. Following discussion Busse withdrew his motion and Datz withdrew his second. Motion by Serritella, seconded by Snell, to approve the solicitation request of Tuff and Tidy Corporation and allow solicitation until May 31, 1984. Voting Aye: Bolger, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: Busse. Absent: Nolan. Motion carried. Monday, May 7, 1984 page 2 gilding & Alderman Busse, Chairman of the Building & Zoning Committee, )ning- presented a request from Building Inspector Richard Rosing regarding 'sc. etc. installation of a 26 foot house trailer at. 4408 Clearview Drive for a period of three weeks. The house was gutted by fire and is unliveable. Owner requested permission to live in the trailer for three weeks until her children are out of school and the house is restored. Motion by Serritella, seconded by Datz, to deny the request. Motion by Smith, seconded by Bolger, to amend the motion to add that the request be denied until the two aldermen from Ward 4 and the Building Inspector investigate the matter and then determine whether or not permission should be given. Following discussion, Smith withdrew his amendment to the motion and Bolger withdrew his second. Alderman Serritella, withdrew her motion to deny and Datz withdrew his second. Motion by Smith, seconded by Bolger, to authorize Aldermen Serritella and Snell along with Building Inspector Rosing to study the matter and decide jointly whether or not to permit use of the house trailer on the lot in question. Voting Aye: Bolger, Datz, McClatchey, Smith, Serritella, Busse. Voting Nay: None. Not Voting For Possible Conflict of Interest: Snell. Absent: Nolan. Motion carried. quests- Motion by Busse, seconded by Bolger, to grant permission to Ray Guzzardo, owner of the building at 3922 W. Main Street, to block sc. off the sidewalk and two parking stalls in front of the building for three or four days in order to repair storm damage done to the building. Motion by Datz, seconded by McClatchey, to pass an ordinance •d. amending the Subdivision Control Ordinance by requiring that all side- dewalks walks in new subdivisions be ramped where they meet the curb line. Voting Aye: Bolger, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. solution Motion by Datz, seconded by Bolger, to pass a resolution supporting federal legislation which will furnish total immunity to units of local government and to local government officials from the kind of anti-trust litigation that they are now confronted with as a consequence of the Boulder decision and to authorize this resolution be sent to Senators Percy and Dixon. Voting Aye: Bolger, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Nolan Motion carried. Voting Aye: Bolger, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Smith, seconded by Busse, to approve the merit salary increases for the Public Works Department as recommended by Supt. of Public Works Paul J. Halvensleben. Voting Aye: Bolger, Busse1, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Snell, seconded by Bolger, to pass art ordinance establish- ing the following speed limits to conform with State regulations: 55 MPH speed limit on Elm Street from Dot west to city limits 55 MPH speed limit on Richmond Rd. from McCullom Lake Rd. to north city limits 50 MPH limit on Front Street 1000 feet south of High Street to south city limits Voting Aye: Bolger, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. Mayor Stanek announced that aldermen should have their recommenda- tions for summer street maintenance program repairs to the Supt. of Public Works by June 1, 1984. Attorney Narusis announced that Hartford Insurance Company will undertake defense of the lawsuit by Peter Tutera vs. the City of McHenry. Alderman Smith requested the Building & Zoning Inspector to check 1504 N. Park Street for violations; of zoning and health regulations. Alderman Snell asked the Supt. of Public Works to check the drainage area in the easement in back of the car wash at the corner of Meadow and Elm to see if there is any blockage occurring. Motion by Smith, seconded by Snell, to go into executive session at 10:17 P.M. to discuss personnel. Voting Aye: Bolger, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Wages/Benefits Motion by Busse, seconded by Serritella, to pass an ordinance deleting Section 2-76 B of the Wage and Benefit Ordinance re: insurance waivers. Employees Voting Aye: Busse, Bolger, Datz, McClatchey, Smith, Serritella. Voting Nay: Snell. Absent: Nolan. Motion carried. Motion by Busse, seconded by Serritella, to pass an ordinance amending the Section 2-74 of the Wage and Benefit Ordinance as proposed by the Finance Committee and to set the salary of the new City Clerk employee at Voting Aye: Bolger, Busse, Datz, McClatchey, Smith, $12,380.00. Snell, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Serritella, seconded by Snell, to defer a request for reconsideration of the shop foreman's salary until the next meeting. Voting Aye: Busse, Datz, McClatchey, Smith, Snell, Serritella.
