HomeMy WebLinkAboutMinutes - 04/30/1990 - City Council (2)SPECIAL MEETING MONDAY, APRIL 30, 1990 • The Special Meeting of the McHenry City Council was called to order by Mayor Busse on Monday, April 30, 1990 at 8 P.M. at City Hall. At roll call the following Aldermen were present: Bolger, Donahue, Teta, Smith, McClatchey, Patterson, Serritella. Absent: Lieder. City staff in attendance were Attorney Narusis, Clerk Gilpin, Building & Zoning Officer Halik: The purpose of the Special Meeting was to continue discussion on the recessed meeting of January 23, 1990 on the proposed annexation of Deerwood Estates Subdivision by Gerstad Builders. In attendance were Roger and Donald Gerstad of Gerstad Builders, John Smith of Smith Engineering and Sam Diamond, Attorney for Gerstad Builders. Court Reporter Cheryl Barone was also in attendance. A large group of people were in the attendance and 32 of them signed up as objectors to the proposed annexation of Deerwood Estates. A list of their names is attached to this meeting. Deerwood Estated is located on Ridge Road abutting Burning Tree Subdivision which recently annexed to the City. The subdivision consists of 113.6 acres and Gerstad proposes to build 107 homes in the subdivision. Motion by Patterson, seconded by Teta, to allow the objectors to addressed the Council and limit each comment period to three minutes. Voting Aye: Bolger, Donahue, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Lieder. Motion carried. Twenty of the 32 people who signed up as objectors addressed the Council to express their concerns about density, lot sizes, drainage and storm water run-off. Numerous questions were asked of John Smith of Smith Engineering who is the project engineer for Gerstad Builders. Susan Connelly, Attorney for Shamrock Beef Cattle Farms, presented a recommendation made on behalf of Shamrock Farms by William Lindley, P.E., concerning recommendations to handle the water run-off and water retention in proposed Deerwood Estates Subdivision: Smith reported that City Engineers Baxter & Woodman had worked closely with Smith and Lindley on the project and Lindley's recommendations would be incorporated into the final engineering plans. Mayor Busse called for a recess at 9:30 P.M. The meeting reconvened at 9:45 P.M. with everyone still in attendance. Discussion was held on lot sizes in the subdivision. Some Aldermen felt that the minimum square footage per lot should be one acre so as to be more compatible with existing lots in that neighborhood. Motion by Patterson, seconded by Teta, that the minimum lot size in Deerwood Estates Subdivision be 40,000 square feet with an average square foot per lot of 43,560 square feet. Voting Aye: Teta, Patterson. Voting Nay: Bolger, Donahue, Smith, McClatchey, Serritella. Absent: Lieder. Motion did not carry. Motion by Smith, seconded by seconded by Serritella, to require an average lot size of 39,200 square feet for the subdivision. Voting Aye: Bolger, Donahue, Lieder, Smith, McClatchey, Serritella. Voting Nay: Teta, Patterson. Absent: Lieder. Motion carried. f Motion by Smith, seconded by Serritella, to approve the preliminary plat of Deerwood Estates conditioned on the incorporation into the preliminary plat of all of the requirements as submitted by Lindley and Associates and requiring that maintenance of all dry wells be done annually by the homeowners association of that subdivision. Voting Aye: Bolger, Donahue, Lieder, Smith, McClatchey, Serritella. Voting Nay:- Teta,-Patterson. Absent: Lieder. Motion carried. Monday, April 30, 1990 Page 2 The annexation agreement was reviewed paragraph by paragraph. In paragraph 13, annexation fees were discussed. Motion by Teta, seconded by Patterson, to defer setting annexation fees until such time as information can be obtained from the Director of Public Works and the Police Chief to determine what additional costs would be needed to service this subdivision. Voting Aye: Serritella, Patterson, McClatchey, Teta, Busse. Voting Nay: Smith, Donahue, Bolger Absent: Lieder. (Since five affirmative votes are required concerning financial matters the Mayor was required to vote. He voted Aye and the motion carried.) Motion by Smith, seconded by Serritella, to reconsider the previous motion on annexation fees. Voting Aye: Bolger, Donanue, Smith, Serritella. Voting Nay: Teta, McClatchey, Patterson. Absent: Lieder. 1 (Since five affirmative votes are needed concerning financial matters the Mayor was required to vote. He voted Aye and the motion carried.) Motion by Bolger, seconded by Serritella, to require that the annexation fees for Deerwood Estates be $500 per acre ($56,800) payable on the execution of this Annexation Agreement; additionally, the owner shall pay $500 per subdivision lot in the following manner: A) $500 for each lot at the time a building permit is issued; B) the balance of $500 per lot for the remaining lots as shown on the preliminary or final plat of subdivision which has not theretofore been paid to the City of McHenry no later than two years from the date of the execution of the agreement. Voting Aye: Bolger, Donahue, Smith, -McClatchey, Serritella. Voting Nay: Teta, Patterson. Absent:; Lieder. Motion carried. Motion by Smith, seconded by Donahue, to pass an ordinance approving the Annexation Agreement between the McHenry State Bank as Trustee under Trust No. 4562 and Donald Gerstad and the City of McHenry as amended. Voting Aye: Bolger, Donahue, Smith, McClatchey, Serritella, Busse. Voting Nay: Teta, Patterson. Absent: Lieder. (Since six affirmative votes are required to annex property, the Mayor was required to vote. He voted aye and the motion carried.) Motion by Donahue, seconded by Bolger, to pass an ordinance annexing the Deerwood Estates Property to the City of McHenry. Voting Aye: Bolger, Donahue, Smith, McClatchey, Serritella. Voting Nay: Teta, Patterson. Absent: Lieder. Motion carried. Motion by Serritella, seconded by Bolger, to pass an ordinance automatically classifying the Deerwood Estates Subdivision to highest restrictive use which is RS-1 Single Family District. Voting Aye: Bolger, Donahue, Smith, McClatchey, Serritella. Voting Nay: Teta, Patterson. Absent: Lieder. Motion carried. Motion by McClatchey, seconded by Smith, to adjourn. Voting Aye: Bolger, Donahue, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: Lieder. Motion carried. Meeting adjourned at 11:10 P.M.
