The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Monday, April 29, 1985 at 7:30 P.M. in City Hall. At roll call the following Aldermen were present: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella. Absent: None. City staff in attendance were Supt. Halvensleben, Attorney Narusis, Clerk Gilpin, Park Director Merkel, Chief Joyce. Motion by Nolan, seconded by Snell, to accept the minutes of the April 15, 1985 Public Hearing, the April 15, 1985 Regular Meeting, the April 22, 1985 Regular Meeting and the April 22, 1985 Special Meeting as presented. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Mayor Busse announced the proposed appointment of Michael R. Teta oaf 1129 Manchester Mall, McHenry as Second Ward Alderman to fill that position which was vacated with the election of Busse as Mayor. Motion by Serritella, seconded by McClatchey, to approve the Mayor's appointment of Michael R. Teta as Second Ward Alderman to fill the vacancy in the Second Ward with his term to expire in April of 1987. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Teta was given the oath of office by City Clerk Gilpin and was immediately seated on the Council. Mr. Lee F. Sutliffe, representing McHenry Villa, addressed the Council concerning a request for Industrial Revenue Bonds to develop McHenry Villa (the former McHenry Hospital on Waukegan Street) for an adult congregate care assisted living facility. Motion by Nolan, seconded by Bolger, to pass a preliminary resolution of the City of McHenry approving the application of McHenry Villa Associates, Ltd., and authorizing the City to enter a memorandum of agreement with the Company concerning the issuance by the City of Industrial Revenue Bonds in the amount of $6,500,000. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Snell, seconded by Lieder,: to pass an ordinance establishing standing committees of the Council for the 1985-86 Fiscal Year as presented (first name listed is Chairman): Personnel Committee - McClatchey, Teta, Nolan, Snell; Finance Committee - Lieder, Teta, Bolger, Serritella; Public Property and Utilities Committee - Bolger, Smith, Serritella, Lieder; Streets & Sidewalks Committee - Smith, Snell, Bolger, McClatchey; Building & Zoning Committee - Teta, Nolan, Smith, Snell; Parks & Recreation Committee - Serritella, McClatchey, Lieder, Nolan. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Snell, seconded by Lieder, to pass an ordinance amending the Regular Meeting dates to change the Council Meetings from Monday nights to Wednesday nights commencing with the first Regular Meeting in July 1985. Dates of Mt( Monday, April 29, 1985 page 2 Easements A document was presented for a proposed easement on the James Althoff property west of Route 31. Alderman Bolger, Chairman of the Utilities Committee, reported that he had discussed the matter with Mr. Althoff and Althoff did not wish to enter into an easement agree- ment at the present time. An agreement was presented for an perpetual easement for installation and maintenance of municipal mains and other underground municipal utilities on the Raymond Stilling/Michael Mathews property east of Route 31 near the entrance to Knox Park. Motion by Smith, seconded by Snell, to enter into an agree - Easements & ment with Stilling/Mathews for a perpetual easement as stated, McH. Hosp. authorize the Mayor and City Clerk to sign the agreement, and authorize and approve the payment of sewer recapture fees to NIMED in the amount of $114.00 plus 12 1/2 percent interest per year from October 18, 1982 to payment date with payment to be made as soon as possible. Motion by Snell, seconded by Lieder, to approve the request Police Dept. of Duckwall/Alto Stores (formerly Hornsbys Family Center) for permis- Misc. sion to hookup to the Police and Fire Department monitoring alarm systems at City Hall. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Agmts. & Motion by McClatchey, seconded by Smith, to authorize the Pol. Dept. Mayor and City Clerk to enter into an agreement with Nelson Misc. Electronics Inc. for operation of the alarm monitoring receiving system in the Police Department with the two amendments as recommended by the Mayor and City Attorney. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Discussion was held on the McHenry Lakes Estates Industrial Subdivision proposal for development of that property. Mr. Floyd Babbitt of the Law Firm of Berman, Fagel, Haber, Maragos, and Abrams was in attendance at the meeting representing American National Bank of Arlington Heights which has an interest in the McHenry Lakes Estates Industrial Subdivision. Mr. Babbitt submitted a letter to the City Council outlining his understanding of what agreement had been made between Towne Orleans and the City on development of the industrial property. Subd. of Land Motion by Smith, seconded by Serritella, that the City & inform Howard Orleans and Milford Towne (also known as Towne Orleans McH. Lakes Partnership) and the American National Bank of Arlington Heights and Estates the Law Firm of Berman, Fagel, Haber, Maragos, and Abrams that the developers of the McHenry Lakes Estates Subdivision must go through the proper channels to get this property developed and that it is not now nor has it ever been the City's practice to pay for subdivision improvements not completed by subdividers; and also to inform the parties involved that the agreement as presented is not acceptable to the City. Employees Motion by Smith, seconded by Snell, to authorize and approve the payment of the $100 perfect attendance bonus to the employees as presented. Motion by Serritella, seconded by Snell, to approve the Chamber of Commerce request to serve wine as well as beer on the pre- viously approved dates of Fiesta Week as follows: July 21 - Food Fiesta Day, July 23 - Pearl Street Park night, July 25 - Concert Night, July 26 - Theme Night, July 27 - Banjo Beer Night, July 28 - Parade Day. Control & Licenses Mayor Busse announced that he was calling a Committee Meet- Committees, ing of the Whole with the Zoning Board Members and Plan Commission Auth, Members on Thursday, May 9, 1985 at 7:30 P.M. in City Hall for an Instruct. orientation meeting. etc. Mayor Busse reported that a letter of resignation had been received from Ronald J. Waytula who has served as Chairman of the Police Pension Board for the last 9 years. Mayor Busse accepted the Resignations resignation with regret and expressed appreciation on behalf of the citizens of McHenry to Mr. Waytula for his community service. Mayor Busse announced the Illinois Municipal League was sponsoring a two day seminar for newly elected officials. Anyone interested in attending should contact the City Clerk for information. Motion by Bolger, seconded by Nolan, to authorize and approve the tuition reimbursement request of Sewer Chief Gene Hester for the attendance of Sewer Dept. employee Gary Gilpin at a Wastewater Operation School at the Junior College in Malta, Illinois. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Employees & Sewer Misc. Voting Nay: None. Absent: None. Motion carried. Motion by Snell, seconded by Smith, to authorize the Supt. Bid Auth. & of Public Works to advertise for bids for a pickup truck as a sewer Purch. -Sewer vehicle replacement in the sewer plant as presented. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Lieder, seconded by Nolan, to authorize and approve the purchase of special paint for repainting the sanders and snow- plows in the Public Works Department at a cost of $19.75 per gallon or a total of 40 gallons at $790.00. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Lieder, seconded by Snell, to accept the recom- mendation of the Supt. of Public Works and purchase a concrete saw at the low bid price of $2,750.00 from Wedge Company. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Public Works Purchases Public Works Purchases Motion by Nolan, seconded by Bolger, to authorize and Grants & approve payment of Partial Payment Request No. 2 to NaCon Services Water Dept. Inc. in the amount of $99,585.00 for the Elevated Storage Tank No. 2 Imprvts. as recommended by Baxter & Woodman. City Clerk received a request from Judge Cowlin of the McHenry County Court System and requested use of the McHenry City Council Chambers for court room use on Tuesdays from May through August of 1985 due to the remodeling being done at the Court House. Requests Motion by Smith, seconded by Snell, to grant the request of Misc. Judge Cowlin for use of the Council Chambers as a court room from May through August, 1985 from 8:00 a.m. to 5:00 p.m. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Ctts - Auth. Alderman McClatchey, Chairman of the Personnel Committee, Instruct, announced that a Personnel Committee Meeting would be held Thursday, etc. May 2, 1985 at 7:30 P.M. for the purpose of discussing job descrip- tions of personnel and the position of Police Lieutenant. Donations to Park Director Merkel reported that a $200 donation had been City & received from the McHenry Women's Civic League and $175 from the Park Donations McHenry Area Jaycee Women for use of the Park Department for tables and benches. Park Director Merkel reported that price quotes had been obtained from three firms for utility trailers for the Park Department. They were Chicago Toro Co. $2,518, Illinois Lawn Equip- ment $3,217 and $2,555, and Adams Enterprises $1,095. Purch. - Motion by Snell, seconded by Nolan, to authorize and approve Park Dept. purchase of a utility trailer from the low price proposal of Adams Enterprise at a cost of $1,095. Motion carried. Appts.- Mayor Busse announced that annual mayoral appointments for Annual Officers will be made at a future meeting. Employees Mayor Busse also announced that Lieutenant Robert Kranz had been granted a disability pension from the McHenry Fire & Police Commission Board as of April 22, 1985 and Kranz had made a request for inclusion on the employee insurance coverage and four weeks vacation pay.
