Mayor Stanek on Monday, April 27, 1981 at 8 P.M. At roll call the following Annual aldermen were present: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer. Absent: Nolan. Also in attendance were Supt. Weber, Attorney Attendance' Narusis, Clerk Gilpin, Chief Pasenelli and Park Director Merkel. Motion by Adams, seconded by Schooley, to accept the minutes of the April 20,1981 Regular Meeting as read. Voting Aye: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: Nolan. Motion carried. Mr. and Mrs. Mark Serpe of 4711 W. Home Avenue addressed the Council Fence concerning variations of the fence ordinance. Variation Motion by Wieser, seconded by Harker, to defer action on the LL variation request until the next regular meeting of the Council on May 4, 1981. Voting Aye: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Pepping, seconded by Adams, to amend the Zoning Or- dinance of the City of McHenry to permit three habitable stories in Multi Family and Condominium Zoning Districts. Following discussion, Pepping withdrew his motion and Adams withdrew his second. Motion by Pepping, seconded by Adams, to grant a variance as ordinance Zoning requested in the petition of American National Bank and Trust Company of Chicago (Hillcrest Apartments - Housing for the Elderly) to permit con- struction of a building with three habitable stories in their proposed development. Motion by Harker, seconded by Schooley, to grant a variance as requested in the petition of American National Bank and Trust Company of Chicago (Hillcrest Apartments - Housing for the Elderly) to permit a re- duction in the number of parking spaces required per unit from 2 to 12 based upon the construction of one -bedroom units conditioned upon the Ordinance Zoning petitioners' ability to secure a loan from HUD and IHDA for housing for the elderly. Voting Aye: Pepping, Harker, Datz, Adams, Schooley, Meurer. Voting Nay: Wieser. Absent: Nolan. Motion carried. Motion by Adams, seconded by Schooley, to grant a variance as Ordinance requested in the petition of American National Bank and Trust Company of Zoning Chicago (Hillcrest Apartments - Housing for the Elderly) to permit an increase in the number of living units in the development from 46 to 48 one -bedroom units conditioned upon the petitioners' ability to secure a loan from HUD and IHDA for housing for the elderly. Voting Aye: Pepping, Harker, Datz, Adams, Schooley, Meurer. Voting Nay: Wieser. Absent: Nolan. Motion carried. Mayor Stanek authorized the Building and Zoning Committee to Committees review the recommendation of the Zoning Board of Appeals regarding possible amendment of the Zoning Ordinance relating to habitable living stories in Multi Family Districts and report back in three weeks with a recommendation. Monday, April 27, 1981 Page 3 Motion by Harker, seconded by Datz, to pass an Ordinance providing for the approval of an annexation agreement between the City of McHenry and Ordinance Annexation LaSalle National Bank as Trustee for McHenry Group (also known as Malibu Estates) and to authorize the mayor and clerk to sign the pre -annexation agreement. Voting Aye: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer, and Mayor Stanek. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Schooley, seconded by Adams, to pass an Ordinance pro- viding for the annexation of 8.3 acres of land on Crystal Lake Road owned by the McHenry Group (known as Malibu Estates.) Voting Aye: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Meurer, seconded by Adams, to pass an Ordinance es- tablishing an R-3 zoning district for the 8.3 acres of land on Crystal Lake Road owned by McHenry Group (known as Malibu Estates.) Voting Aye: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Wieser, seconded by Schooley, to deny the request of the Shriners for placement of advertisement by the city in its Circus Book. Voting Aye: Pepping, Datz, Wieser, Schooley, Meurer. Voting Nay: None. Pass: Harker, Adams. Absent: Nolan. Motion carried. Motion by Harker, seconded by Pepping, to authorize and approve 1979 an additional payment of $8,517.81 to Keno & Sons Construction for sewage Sewer Construc- treatment plant additions to correct an error made on Payment Estimate No. t ion 15, said additional amount being payable upon the recommendation of Baxter & Woodman. Monday, April 27, 1981 Page 6 Motion by Harker, seconded by Schooley, to authorize and approve Bond payment to McHenry State Bank for principal and interest payments due on Payment the City of McHenry Water Works and Sewage Revenue Bonds, Series 1979, as follows: Principal $85,000.00; Interest $34,500.00; Bank Fee $25.00 - Total of $119,525.00. Voting Aye: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: Nolan. Motion by Datz, seconded by Adams, to authorize and approve pay- Authori- ze d ment to Burroughs Corporation for computer equipment in the amount of payment $13,273.00. Resolutions Motion by Schooley, seconded by Meurer to pass two resolutions appropriating Motor Fuel Tax funds for balances due on traffic light MFT installations as follows: Contract No. 79-00025-00-TL, $446.40 and Contract No. 79-00027-00-TL, $50.53. Voting Aye: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: Nolan. Motion carried. Executive Motion by Schooley, seconded by Adams, to go into executive Session session at 9:24 P.M. to discuss pending legislation. Voting Aye: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer. Motion by Datz, seconded by Adams, to authorize the transmittal of a letter to the FAA stating that the city does not object to the helicopter overflight within the city for spraying bacillus thuringienses Gypsy (BT) by the Illinois Department of Agriculture for control of gypsy moth Moth infestation. Voting Aye: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Adams, seconded by Schooley, to adjourn.
