The annual meeting of the McHenry City Council was called to order Counci by Mayor Stanek on Monday, April 25, 1983 at 8:00 p.m. in City Hall. At roll Mtg. call the following Aldermen were present: Pepping, Nolan, Busse, Datz, Gelwicks, Smith, Serritella, Meurer. Absent: None. City staff in attendance were Supt. Halvensleben, Attorney Narusis, Clerk Gilpin, Chief Pasenelli, Park Director Attend - Merkel. ance To comply with the Revenue Sharing requirements Mayor Stanek announced that a public hearing on the 1983-84 fiscal year control budget would be conduct- Coun ed at this time. The purpose of the hearing was to allow the public to participate Mtg in the discussion and to present oral or written statements regarding the proposed Pub control budget and the relationship of Revenue Sharing allocations to that budet. Hrgs Mayor Stanek asked if there was anyone in the audience who wished to make oral or & written comments on the proposed budget. There was no reply from the audience. Rev. Shar The regular business of the annual meeting was then conducted. Motion by Nolan, seconded by Meurer, to accept the minutes of the April 18, 1983 meeting as presented. The Aldermen were presented with letters from City Attorney Bernard Narusis and Attorney James Militello representing William Tonyan & Sons Indus- trial Park. William Tonyan & Sons, developers of Tonyan Industrial Park,were concerned regarding zoning and subdivision of their Industrial Park as related to the an Annexation Agreement with the former Village of McHenry Shores. On November 18, 1976, the Village of McHenry Shores entered into a certain Annexation Agreement with William Tonyan and Sons, Inc., relative to acreage located on Route 31. Said Annexation Agreement, among other items, provided the following: Monday, April 25, 1983 Page 3. 1. The re-classification for property owned by William Tonyan & Sons, Inc., to "M-Limited Manufacturing District" with further amendments to set forth in Exhibit E of said Annexation Agreement. 2. Provided for the subdivision of the subject parcel pursuant to a Plan of Subdivision identified as Exhibit D in the aforementioned Agreement. Following discussions between Narusis and Militello, the following was understood: 1. The area of the subject property covered under the Annexation Agree- ment which has been or will be finally platted and of record prior to the end of the ten year term is, and after said ten year period, shall lawfully possess the zoning classification and permitted uses as provided pursuant to the Annexation Agreement. 2. The City of McHenry shall honor the plan of subdivision and substan- tive provisions regarding said subdivision as provided within the Annexation Agreement, except that as to minor procedural matters the future subdivision would follow the City of McHenry's procedural steps relative to subdivision. In order to avoid any possible future misunderstandings regarding permitted land use, William Tonyan & Sons request that the City Council formally acquiesce to the existing permitted uses as set forth under the Annexation Agreement relative to platted lots that exist or may come into existence prior to November 18, 1986 with said permitted uses to be lawful uses after November 18, 1986. Based on these facts, a motion was made by Smith, seconded by Datz, that the City of McHenry acknowledge that the property in Tonyan Industrial Park is Zoni zoned and is to be subdivided and developed pursuant to the terms and provisions and contained in an Annexation Agreement dated November 18, 1976 between the Village Tonya of McHenry Shores, Illinois and William H. Tonyan & Sons, Inc. Ind.P Voting Aye: Pepping, Nolan, Busse, Datz, Gelwicks, Smith, Serritella, & McH Meurer. Shore Voting Nay: None Absent: None. Motion carried. Motion by Nolan, seconded by Serritella, to authorize ,and approve payment IDC to the Illinois Department of Transportation for $10,059.89 as final City's share & of the Meadow Lane Improvement (total improvement cost $461,571.21; City's share Mead 24.82% or $114,561.97 minus previous payments of $104,502.08 = balance due $10,059.89). Motion by Nolan seconded by Smith, to authorize the Park Director to I& Employees hire up to a total of 6 summer employees for maintenance of the parks. Motion by Serritella, seconded by Smith, to instruct the Supt. of Public Works to remove the RTA shelter from its present location at Hornsby's Store in RTA the McHenry Shopping Center and move it to another suitable location. Voting Aye: Pepping, Nolan, Busse, Datz, Gelwicks, Smith, Serritella, Meurer. Voting Nay: None. Absent: None. Motion carried. Council Motion by Smith, seconded by Busse, to go into executive session at Mtgs. 10:16 p.m. for discussion of personnel. Motion carried. As this was the last meeting for Aldermen Gelwicks, Meurer and Pepping, whose terms expire with this meeting, each made a farewell statement.
