APRIL 23, 1991
A Special Meeting of the McHenry City Council was called to order by
Mayor Busse on Tuesday, April 23, 1991 at 7:30 P.M. in City Hall. At
roll call the following Aldermen were present: Bolger, Donahue, Teta,
Lieder, Smith, Serritella. Patterson arrived 7:40 P.M. McClatchey
arrived at 7:50 P.M. Absent: None. City Staff in attendance were:
City Clerk Gilpin, City Attorney IJarusis, and City Administrator
Peterson. Also in attendance were Jim Althoff of the McHenry Township
Fire Protection District; Bill Landis and Chris Cardamone of School
District 15, Dr. Mowery and Steve Cuda of School District 156; Catherine
Kasper, Marilyn Lean and Jerry Benes of the McHenry Public Library
District; Developers Don Meyer and Brian Cunat; and news reporters Joe
King and Roger Rouland.
Mayor Busse announced the purpose of the meeting was to discuss
amending the Developer Donation Ordinance concerning collection of fees
for school districts, library district, and fire protection district.
Alderman Lieder, Chairman of the Finance Committee, presented a
Developer Donation Plan which reflected his ideas for administering a
formula for developer donation fee collections. He felt his plan would
be easy to administer and adjust each year utlizing an automatic change
which would occur on the first day of February every year. The plan
would take into consideration the impact that new development has on the
local school districts and local taxpayers. He also felt his plan took
into consideration the developers and the impact those fees would have on
them and new residents moving into the community.
He presented his plan for a Developer Donation Cost/Revenue
Methodology which would serve as the basis for determining all future
developer donation costs. He recommended that the computations to
determine cost be updated every other year, beginning with the developer
fees established to begin on June 1, 1991. He also recommended that the
City treat all apartments as two bedrooms.
Lieder further recommended that the developer donation fees should
reach the level of paying the entire cost of a new school based on the
number of students generated by a three, four, and five bedroom home.
Based on his Developer Donation Cost/Revenue Methodology sheet dated
April 23, 1991, this level could be too large of an increase to
accomplish in one year and therefore the Council might want to consider
reaching the cost of a new school over a longer period of time. The
proposed fees and increases he suggested were based on a projected 5% CPI
increase and would be adjusted every other year based on the actual CPI.
He felt the plan as presented would be easy to administer and would allow
developers to use the information to plan accordingly.
City Administrator Peterson pointed out that two County ordinances
which provide for the collection of impact fees from developers or owners
of property who build in an unincorporated part of the County were
included with the Council information. The County does not provide for
the collection of impact fees for other types of governmental units, only
schools. Based upon the County school donation formula, McHenry School
District 15 & 156 will receive $2,630.34 for a new three bedroom home
which is divided in accordance with a mutually agreed upon split of 65%
to District 15 and 35% to District 156. The County School Donation
Ordinance does not apply to areas of the County which are within the
limits of an incorporated area.
A major concern of several Aldermen were the legal technicalities
involved with adopting this ordinance based on the Naperville case.
There appeared to be no problem with the issue of land donation, but some
concern was expressed when the Council gets into the area of requiring
cash donations. Some aldermen felt that based on the Naperville
Ordinance and on the advice of Attorney Narusis, the Council should not
go ahead until it is certain that a lawsuit would not be filed against
the City.
Other Aldermen felt that it was impossible to determine what might
happen in the future, and therefore, felt the Council should proceed with
implementing the Developer Donation Ordinance as presented.
Mayor Busse called for a recess at 8:56 P.M. The Meeting reconvened
at 9:10 P.M. with everyone still in attendance.

Discussion continued between the Aldermen and representatives of
School Districts 15 and 156.
Motion by Lieder, seconded by Patterson, to agree in principle with
the Developer Donation figures for schools as follows and to present this
concept to taxing districts and developers for comment:
Three Bedroom home - $2,600.00
Four Bedroom home - $3,600.00
Five Bedroom home - $3,700.00
Two B/R Apartment - $ 643.00
Three B/R Apartment- $2,700.00
To implement the above figures for 1991; to adjust the fee schedule
formula through 1993 based on actual Consumer Price Index (CPI) figures
utilizing the same CPI figure used by the City in reviewing salary issues
relataive to employee salaries, and to implement an automatic increase
every February 1 through 1993.

Motion carried.
It was suggested that other communities who send students to District
15 and 156 School Districts should also be encouraged to charge developer
donation fees to pay their fair share toward growth in the schools.
Discussion was then held on the library district and fire district
developer donation fees.
Motion by Smith, seconded by Serritella, to require developer
donation fees for the library district and the fire district of $200.00
each for a three bedroom home with that amount to be adjusted for other
bedroom homes based on the Illinois School Consultant Plan, and to review
those fees after one year.

Motion by Teta, seconded by Patterson, to raise the developer
donation fee for the library district from $200.00 to $250.00.

Absent: None.
Motion did not carry.
Motion by Smith, seconded by McClatchey, to adjourn.
