MONDAY, APRIL 21, 1980 8 P.M.
The Regular Meeting of the City Council was called to order on Monday,
April 21, 1980 by Mayor Stanek at 8 P.M. At roll call the following aldermen
were present: Datz, Wieser, Adams, Schooley, Meurer, Pepping, Nolan, Harker.
Absent: None.
Motion by Nolan, seconded, by Datz, to accept the minutes of the
Regular Meeting of April 7, 1980, the Public Hearing of April 14, 1980 and
the Special Meeting of April 17, 1980, as read.
Voting Aye: Datz, Wieser, Adams, Schooley, Meurer, Pepping, Nolan,
Harker.
Voting Nay: None.
Absent: None.
Motion carried.
Mayor Stanek read a letter from Police Chief Pasenelli commending
Douglas Hiertsell for his cooperation in reporting an incident to the police
department which led to the arrest. of an individual for theft and criminal
damage to property. Mayor Stanek presented a Certificate of Appreciation to
Hiertsell and thanked him on behalf of the citizens of McHenry for his involve-
ment.
Motion by Pepping, seconded by Meurer, that the City Council not
approve the aerial spraying of the chemical Sevin as proposed by the US Dept.
of Agriculture but that another program be undertaken to control eradication
of the gypsy moth that would utilize some of the other measures discussed and
suggested at the April 17, 1980 Special Meeting.
Voting Aye: Wieser, Meurer, Pepping.
Voting Nay: Datz, Adams, Schooley, Nolan, Harker.
Absent: None.
Motion carried.
Motion by Nolan, seconded by Harker, to authorize aerial spraying
for eradication of the gypsy moth as proposed by the Federal and State Depart-
ments of Agriculture.
Voting Aye: Datz, Schooley, Harker, Nolan.
Voting Nay: Wieser, Adams, Meurer, Pepping.
Absent: None.
There bEing a -tie vote, Mayor Stanek cast an "aye" vote and declared the motion
carried.

Motion by Nolan, seconded by Adams, to accept the recommendation of
the Zoning Board of Appeals and pass an Ordinance granting a variation to
Fred Diesel doing business as McHenry Lumber Company.
Voting Aye: Pepping, Datz, Wieser, Harker, Schooley, Nolan, Adams,
Meurer.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Harker, seconded by Adams, to waive the stipulation that
City employees must live in the city limits for hiring of Larry Deja as a full-
time Pulic Works employee as a replacement for Jeff Hoffstetter.
Voting Aye: Pepping, Datz, Wieser, Harker, Nolan, Adams, Meurer.
Voting Nay: Schooley.
Absent: None.
Motion carried.
Mayor Stanek declared a recess at 9:10 P.M. The meeting reconvened
at 9:23 P.M. with all aldermen still in attendance.
Motion by Pepping, seconded by Meurer, to authorize the hiring of
sixteen summer help employees, two life guards, and two temporary fulltime
employees as parking enforcement people.
Voting Aye: Pepping, Datz, Schooley, Wieser, Harker, Nolan, Meurer,
Adams.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Pepping, seconded by Schooley, to pass an Ordinance specify-
ing settlement and fine dollar amounts and adding the designation --"Overtime
Parking-Unmetered" with settlement amounts of $5, $10, and $15 for various
settlement periods.
Voting Aye: Pepping, Datz, Wieser, Harker, Nolan, Adams, Meurer,
Schooley.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Harker, seconded by Schooley, to pass an ordinance amending

the sewer rate charges for Residential Users from $3 to $5 per month and for
Commercial and Industrial Users from .65 cents to .75 cents per thousand gallons
of water usage effective May 1, 1980.
Voting Aye: Pepping, Schooley, Meurer, Adams, Nolan, Harker, Datz,
Wieser.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Harker, seconded by Datz, to pass a Resolution forgiving
$35,729.92 which is owed to the General Fund by the Water Sewer Fund For
expenses incurred in the Operating and Maintenance Account of the ;Dater/Sewer
Department.
Voting Aye: Pepping, Schooley, Meurer, Adams, Nolan, Harker, Datz,
Wieser.
Voting Nay: None.
Absent: None.
Motion carried.

as presented.

report as presented.

Motion by Schooley, seconded by Wieser, to authorize the Mayor and
Clerk to enter into an agreement for consultant services with Hampton, Lenzini
and Renwick, Inc. to provide professional services necessary to accomplish the
Phase I work on the Meadow Lane FAU project from Route 120 to Shore Drive and
to authorize the expenditure of $16,000.00 from the Motor Fuel Tax Fund for the
consultant fees.

Motion by Nolan, seconded by Adams, to authorize the expenditure of
funds for printing of the summer recreational brochures.

Motion by Harker, seconded by Schooley, to pay Keno & Sons payment
Estimate No. 5 in the amount of $131,710.50 for construction of the sewer
treatment plant addition as recommended by Baxter & Woodman.

Motion by Schooley, seconded by Wieser, to pass a Resolution authorizing
the Mayor and Clerk to sign a license agreement with the Chicago Northwestern
Transportation Company relating to construction, maintenance and use of a sani-
tary sewer and water line upon the property and under the track along Orleans
Street in McHenry Lakes Estates.
Voting Aye: Pepping, Schooley, Meurer, Adams, Nolan, Harker, Datz,
Adams.
Voting Nay: None.
Absent: None.
Motion carried.
Mayor Stanek announced that a Public Hearing would be held Monday,
May 12, 1980 at 7:30 P.M. for the purpose of discussing proposed changes in
the Comprehensive Plan, said hearing to be conducted by the McHenry Plan Commis -
Sion.
Motion by Meurer, seconded by Harker, to authorize the purchase of
a Toro Groundsmaster front end mower from George P. Freund, Inc. at a price of
$4,475.00 for use in the parks.
Voting Aye: Pepping, Schooley, Meurer, Adams, Nolan, Harker, Datz,
Wieser.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Wieser, seconded by Meurer, to authorize the purchase of a
Groundsrake for use in the Park Department from George P. Freund, Inc. at a
price of $1,550.00.

Wieser.
