WEDNESDAY, APRIL 19, 1989
The Regular Meeting of the McHenry City Council was called to order
by Mayor Busse on Wednesday, April 19, 1989 at 8:05 P.M. at City Hall.
At roll call the following Aldermen were present: Bolger, Nolan,
Lieder, Smith, McClatchey, Patterson, Serritella, Teta. Absent: none.
City staff in attendance were Attorney Narusis, Adm. Asst. to City Clerk
Joan Marth, Chief Joyce, Finance and Personnel Administrator Vitas,
Director of Development Greenwood, Superintendent Batt, Building 8 Zoning
Enforcement Officer Halek. Absent: Clerk Gilpin and Park Director Merkel.
Attorney Sam Diamond, representing Cunat Bros., Inc., in the
proposed annexation and zoning of the 78.69 acre King Farm located on the
south side of McCullom Lake Road in the vicinity of Peterson Park,
presented further detailed information as requested by the Countil in
September, 1988.
The following items were discussed:
- The variety of land uses proposed, including single family
homes, townhouses, apartments and a 13.65 acre park;
- Increase in traffic for the area involved;
- Internal street plan;
- Availability and capability of handling public utilities for
416 apartments, 108 single family homes and 60 townhouses;
- Impact on schools;
- Retention and drainage of storm water; and
- Possibility of proceeding as the first PUD (Planned Unit
Development) under the City's new Zoning Ordinance.

Motion by Lieder, seconded by Bolger, to have the Petitioner (Cunat
Bros., Inc.) proceed initially with the PUD Review Committee and based on Annexations
the Committee's recommendation, how to proceed further.
Voting Aye: Bolger, Nolan, Lieder, Smith, Teta,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
Frank Salathe, Vice -President of JEN Land Design, presented a
concept plan for annexation of 127 acres known as Hawthorn Estates, which
is located on the east side of Crystal lake Road, north of Winding Creek
5. The Council expressed enthusiasm over the proposed development of a 21 Annexations
acre wetland area and the continuation of Dartmoor as a neighborhood
collector road in an east -west direction, but expressed concerns over the
proposed development of commercial and multi -family uses since the
surrounding area was mostly single family homes. There was also concerns
expressed over the availability and capacity of the City's water/sewer
facilities. Because of these concerns, the Mayor requested that Mr.
Salathe make some adjustments to the concept plan and return at a later
date to present the revisions to the Council, which Mr. Salathe agreed to
do. Donald "Butch" Meyer of McIntosh Builders presented the Preliminary
Plat for all of Green Valley Subdivision and the Final Plat of Unit #1
for approval. Discussion took place over the use of "open ditches" vs.
"piped ditches" for water runoff and the maintenance of those ditches.
Meyer assured the Council that they would install as much pipe as was
feasible based on engineering when completed.
Motion by McClatchey, seconded by Serritella, to approve the
Preliminary Plat of Green Valley Subdivision and the Final Plat for Green
Valley Unit #1 subject to: (1) utility easements being shown on the Plats
sides and rear lot lines; (2) securing a permit from the Army Corp of
Engineers because of the "perched fen" in the southwest corner of the
property; and (3) using piped ditches instead of open ditches wherever
feasible.

McClatchey, Patterson, Serritella.

Motion by Nolan, seconded by Patterson, to approve the request of
the Chamber of Commerce for a temporary beer/wine license permit for Fiesta Days
Fiesta Days, July 16 through July 23, 1989.
Voting Aye: Bolger, Nolan, Lieder, Smith, Teta,
McClatchey, Patterson, Serritella.

Mayor Busse announced that Don Folz, owner of Don's Submarine at
1237 N. Green Street, had made a request to change his liquor license
classification from a "G" license (service of liquor at table only) to an
"A" license (full service). Mr. Folz (who was in the audience) explained
that his main interest was and would continue to be, the food service
business which he was expanding to include banquets, catering and private
parties. With the "G" license, people could not sit at the bar he had
(which could seat approximately 4) but that people would like to. He
also stated that he would not increase the size of the bar if granted the
"A" license. A consensus of the Council was that Mr. Folz proceed to
fill out his liquor license renewal application for an "A" license and
that it would be brought up for approval at the Annual Council Meeting
next week along with all the other liquor license renewal applications.
Mayor Busse called for a recess at 9:32 P.M. The meeting reconvened
at 10:42 P.M. with all Aldermen still in attendance.
The following bids were received for the 1989 Summer Roads' Program:
Peter Baker & Sons $169.780.50;
Curran Contract $219,660.35; and
Skokie Valley Asphalt Co. $164,938.15.
The lowest bid being $32,321.85 below the approved cost estimate.
Bid Awarding Motion by Teta, seconded by Lieder, to approve the recommendation of
Baxter & Woodman and award the 1989 Summer Roads' Program contract to
Street Maint. Skokie Valley Asphalt Co., Inc., in the amount of $164,938.15, subject to
approval by the Illinois Dept. of Transportation.

McClatchey, Patterson, Serritella.

Motion by Smith, seconded by Bolger, to approve the March
Treasurer's Report as presented.

McClatchey, Patterson, Serritella.

Motion by Lieder, seconded by Nolan, to apporve the March Clerk's
Report as presented.

Motion by McClatchey, seconded by Smith, to approve the following
Bond Payments bond payments: 1988 Special Assessment Bond - $127,543.37; 1986 Sewer
Construction Bond - $258.781.25.

McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
Several long discussions took place on the establishment of new
Developer Donation Fees and Capital Development Fees after review of the
Council's survey for suggested fee amounts (for a 3-bedroom single family
home) and the elimination of the suggested fee for Public Safety since
the Council had voted 4 to 3 not to include this category at the previous
Council meeting.
The following motions were made regarding Developer Donation and
Capital Development Fees based on a 3-bedroom single family home:

Motion by McClatchey, seconded by Patterson, to raise the Water
Capital Development Fee to $450.00. Capital
Voting Aye: Nolan, Lieder, Smith, Teta, Dev.
McClatchey, Patterson, Serritella.
Voting Nay: Bolger
Absent: None.
Motion carried.
Motion by Teta, seconded by Patterson, to raise the Sewer Capital
Development Fee to $1,315, based on the recommendation in Baxter &
Woodman's report of current cost for a sewer plant expansion. Cap. Dev.
Voting Aye: Nolan, Lieder, Smith, Teta,
McClatchey, Patterson.
Voting Nay: Bolger, Serritella.
Absent: None.
Motion carried.
Motion by Bolger, seconded by Serritella, to allocate the percentage
of the Developer Donation Fee for schools as follows: 70% to Elementary Dev. Don.
School District #15 and 30% to High School District #156.
Voting Aye: Bolger, Nolan, Smith, Teta,
McClatchey, Patterson, Serritella.
Voting Nay: Lieder.
Absent: None.
Motion carried.
Motion by Patterson to amend the Developer Donation Ordinance to
delineate which funds can be used for what purpose to eliminate all
arguments as to the application of funds.
After discussion Patterson withdrew his motion.
Motion by McClatchey to raise the Schools' Developer Donation Fee to
$2,800.00. Failed
Motion failed for lack of a second. Motions
Motion by Patterson, seconded by McClatchey to set the Schools'
Developer Donation Fee for a 3-bedroom single family home at $3,300.00.
Voting Aye: Teta, Patterson, McClatchey.
Voting Nay: Lieder, Nolan, Bolger, Serritella, Smith.
Absent: None.
Motion did not carry.
Motion by Bolger, seconded by Smith, to set the Schools' Developer
Donation Fee for a 3-bedroom single family home at $2,400.00. Dev. Don.
Voting Aye: Bolger, Nolan, Serritella, Smith.
Voting Nay: Lieder, Teta, Patterson, McClatchey.
Absent: None.
There being a tie vote, Mayor Busse cast an aye vote and declared the
motion carried.
Motion by McClatchey, seconded by Patterson, to set the Library's Dev. Don.
Developer Donation Fee for a 3-bedroom single family home at $200.00.
Voting Aye: Bolger, Nolan, Lieder, Smith, Teta,
McClatchey, Patterson.
Voting Nay: Serritella.
Absent: None.
Motion carried.
Motion by Patterson, seconded by Nolan, to set the Parks' Developer
Donation Fee for a 3-bedroom single family home at $1,000. Failed
Voting Aye: Teta, Nolan, Patterson, McClatchey. Motions
Voting Nay: Lieder, Bolger, Serritella, Smith, Busse.
Absent: None.
Motion did not carry.
Motion by Serritella, seconded by Nolan, to set the Parks' Developer
Donation Fee for a 3-bedroom single family home at $850.00.
Smith asked Serritella if she would amend her motion to $750.00,
whereupon Nolan said she would not withdraw her second to allow the
amendment.

Dev. Don. There being no motion and second to amend, the vote was called on
the original motion.

Based on the foregoing passed motions, the following Developer
Donation and Capital Development Fees were established for a 3-bedroom
single family home:
Water $450.00
Sewer $1,315.00
Schools $2,400.00
(70% of fee to District #15 and
(30% of fee to District #156)
Library $200.00
Parks $850.00

Motion by McClatchey, seconded by Patterson, to review the Developer
Donation and Capital Development Fees along with an accounting of the
fees annually in April.
Voting Aye: Bolger, Nolan, Lieder, Smith, Teta,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
A $200.00 Municipal Building Developer Donation Fee was discussed,
Dev. Don. but because it was not a fee that had been previously considered or
discussed, the matter was to be kept in mind to be considered at a later
time.
Attorney Narusis was directed to draft an ordinance setting forth
the new Capital Development and Developer Donation Fees along with a
provision for holding the Sewer Capital Development Fee at $750.00 for a
pre -determined length of time in the Special Assessment area of McHenry
Shores and Idyl Dell Subdivisions.
Director of Development Greenwood announced that the Zale Group had
withdrawn their Petition and would not be on the Plan Commission meeting
agenda for Thursday, April 20th.
Alderman Lieder announced a Finance Committee meeting on the
proposed employee salary matrix and budget for Monday, April 24, 1989 at
7:30 p.m., asking the whole Council to attend if at all possible.
Bldg. & Zng. Mayor Busse requested that Building & Zoning Enforcement Officer
Misc. Halek periodically give a status report of how many building permit
applications are received and processed and how many are still
outstanding.
Mayor Busse announced that there would not be an executive session
meeting tonight since he had nothing to report.
Motion by Smith, seconded by McClatchey, to adjourn.
Voting Aye: Bolger, Nolan, Lieder, Smith, Teta,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
