WEDNESDAY, APRIL 17, 1991
The Regular Meeting of the McHenry City Council was called to order
by Mayor Busse on Wednesday, April 17, 1991 at 8:00 P.M. in City Hall.
At roll call the following Aldermen were present: Bolger, Donahue,
Lieder, Teta, McClatchey, Smith, Serritella. Patterson arrived at 8:05
P.M. Absent: None. City Staff in attendance were: City Attorney
Narusis, Assistant to City Clerk Marth, City Administrator Peterson,
Director of Building and Zoning Halik, Director of Public Works Batt,
Absent: City Clerk Gilpin, Director of Parks and Recreation Merkel, and
Chief of Police Joyce.
No one signed up for the ten minute public input session.
CONSENT AGENDA: Motion by McClatchey, seconded by Donahue, to
approve the Consent Agenda as follows (after removing the Donald Toole
Resolution which was passed on a separate motion):
- Approved April 10, 1991 Regular City Council Meeting Minutes;
- Awarded Bid for Mowing Unit to Illinois Lawn Equipment at the
bid price of $8,206 - Parks and Recreation Department;
- Approved Treasurer's Report;
- Approved Budget Report;
- Approved the payment of the following March Bills:

Motion by Teta, seconded by Smith, to pass a Resolution recognizing
Donald Toole who recently resigned from the Plan Commission.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
Mayor Busse presented the Resolution to Don Toole and congradulated
him on completing nineteen years of community service on the Plan
Commission.
Nancy Fike, who recently resigned from the Landmark Commission, was
also presented with a Resolution recognizing her assistance in helping to
establish the Landmark Commission five years ago and her dedication to
preserving historic landmarks.
LOCAL TAG DAYS: Motion by Smith, seconded by Serritella, to approve
the Local Tag Days schedule as presented.

REQUEST FOR SOLICITATION: Motion by Serritella, seconded by
McClatchey, to eny a r-e-q—ue-sf of Mike Spangler, real estate agent, for
a permanent Class "B" solicitor's permit.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting May: None.
Absent: None.

SIGN VARIATION REQUEST FOR DOBYN'S HOUSE RESTAURANT: Motion by
Smith, seconded y Patterson, to approve an additional sign variation on
the existing 40 foot Dobyn's House Restaurant sign at 1202 N. Riverside
Drive, granting an additional 10 feet in height to 50 feet. (The
original sign variation being granted on October 17, 1990).
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
SIGN VARIATION REQUEST FOR NURSING STATIONS QUALITY TRANS. CARE:
Motion by Bolger, seconded y Donahue, to approve the sign variation
request for a 25.5 square foot wall sign instead of the 18 square foot
sign allowed under our ordinance for Nursing Stations Quality Trans. Care
at 3720 W. Elm Street due to Petitioner's building frontage having only
twelve feet.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
DETERMINATION OF DEFINITION APPLIED TO "DOMESTIC HOUSEHOLD PETS":
Motion by Teta, seconded y Donahue, to table the matter until ur er
information can be secured and reviewd by the staff.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
MAYOR'S STATEMENTS AND REPORTS: The Mayor announced that McHenry
Township decided, after a we -at ended township meeting, that they would
again participate in a mosquito abatement program. They have provided
the City with specifications which can be reviewed in the City Clerk's
Office.
The Mayor reported that he and Alderman Lieder would be meeting with
School District 15 on April 29th at 3:00 p.m.to share ideas on items of
mutual concern including developer donations and a school de -annexation
proceeding.
COMMITTEE REPORTS: Alderman Lieder reported that the Finance
Commt ee me on on ay, April 15th, and completed all the necessary work
on the budget which will be presented to the Council for consideration
either on the 24th of April or May 1st.
Lieder stated that he would like to finalize the developer donations
for the Library, Fire District and Schools, since the Park fees have
recently been amended.
Motion by Lieder, seconded by Patterson, to schedule a Special
Meeting for Tuesday, April 23, 1991 at 7:30 p.m, to discuss developer
donations with the Library District, Fire Protection District and both
School Districts.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.

DEPARTMENT HEAD REPORTS: Administrator Peterson reported that the
City was ge ng a reen ous amount of building permit requests of all
types during the last several weeks and that Building Administrator Halik
would give the figures later.
Public Works Director Batt reported that Sparks Excavating had
requested permission to close Green Street between Elm and Pearl on
Wednesday, April 24th, weather permitting, for the purpose of making a
sewer connection to the new building being constructed by McHenry State
Bank. Batt said that he would be giving them permission to do that,
however, they also ask for a waiver of the City ordinance regarding
starting hours of construction so they can complete the connection in one
day. They would like to begin at 5:00 a.m. instead of 7:00 a.m.
Motion by Smith, seconded by Donahue, to waive Section 14-8(g) of the
Municipal Code, to allow Sparks Excavating to begin sewer construction at
5:00 a.m. on April 24th, weather permitting, at the new McHenry State
Bank Building.

McClatchey, Patterson, Serritella.

Motion carried.
Building Administrator Halik reported that the Building Department
had received 124 building permit applications from March 25 to April 15.
NEW BUSINESS: Alderman Smith asked when the newly elected officials
woul a e o ce. Attorney Narusis said that because of a new law which
took effect recently, they would assume office at noon on the first
Monday in May, if they had signed their Oath of Office. The swearing in
ceremony of the new officers would be at the next regular meeting on May
15, unless an emergency meeting was scheduled before the 15th.
Motion by Bolger, seconded by McClatchey, to pass a Resolution urging
our Illinois State Representatives to persuade Governor Edgar to preserve
the nation's oldest fish hatchery at Spring Grove and not close it down.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Patterson, seconded by Serritella, to go into Executive
Session after a short 10 minute recess, to discuss pending lititation and
personnel/budget matters.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
The Council recessed at 9:00 p.m.
The Council went into Executive Session at 9:10 p.m. to discuss
pending litigation and personnel/budget matters.
Alderman Teta left the meeting at 10:08 p.m.
Alderman McClatchey left the meeting at 10:15 p.m.
Motion by Bolger, seconded by Donahue, to go back into Open Session
at 10:40 p.m.
