The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, April 16, 1986 at 7:45 P.M. in city hall. At roll call the following aldermen were present: Bolger, Nolan, Council Teta, Lieder, McClatchey, Smith, Snell, Serritella. Absent: none. City Mtgs.- staff in attendance were Superintendent Batt, Attorney Narusis, Clerk Attendance Gilpin, Chief Joyce, Park Director Merkel. Motion by Serritella, seconded by Nolan, to accept the minutes of the March 17, 1986 Special Meeting as presented. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Bolger, seconded by Nolan, to grant the sign var- iation request of Ron Bosse for installation of a sign on the site of Sign Permit a proposed McHenry County Health Club with a one-year time limit on & VariationE the sign variation. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Bolger, seconded by Snell, to grant the fence var- iation request of Thomas Nozeka at 602 Broadway in McHenry Shores as Variations presented. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. 1986 Fiesta Days Co -Chairman Trey Covalt and Sue Low pre- sented a detailed list of the 1986 Fiesta Days events, policies and procedures for Council approval. Motion by Bolger, seconded by Nolan, to approve the schedule of events and the 1986 Fiesta Day policies as presented, with the Fiesta Days exception of the Tuesday street dance. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Alderman Teta spoke on behalf of six citizens of the Whis- pering Oaks area who were concerned with the restoration work which was to be completed by Lakes Cablevision for installation of cable lines that had been installed last fall. They were seeking assurance from the Council that everything would be done to encourage Lakes Ca- blevision to complete the work by May 10, 1986. Mayor Busse informed the citizens that the Council will insure that any disruption due to the installation of the cables in that area would be satisfactorily resolved as was set forth in the Cablevision franchise agreement. Motion by McClatchey, seconded by Nolan, to approve the lo- cal tag day requests as submitted. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Ron Howard addressed the Council concerning his request for an addition to his garage. He stated that he had obtained verbal permission from Building Inspector Rosing prior to the imposition of a 21-day moratorium on accessory buildings which was placed by the Council at the April 2, 1986 meeting. He said that based on that verbal approval he had removed bushes and had ordered construction material to begin the work. Cablevision Tag Days Wednesday, April 16, 1986 page 2 Motion by Bolger, seconded by McClatchey to lift the mor- atorium on issuing accessory building permits and approve new ac- cessory building regulations as presented by Mayor Busse, and to give a building permit to Ron Howard as promised by the Building and Zo- ning Officer prior to the moratorium. Mayor Busse called for a recess at 9:07 P.M. The meeting reconvened at 9:23 P.M. with everyone still in attendance. Mr. Howard said that he would give his written assurance that he would not park more than three cars in the garage if he could construct it. Alderman McClatchey withdrew his second to the previous mo- tion, and Alderman Bolger withdrew his motion. Building & Motion by Lieder, seconded by Teta, to adopt the Building Zoning-Misc. Code amendments regarding accessory buildings as presented, effective -Ordinances within ten days after April 16, 1986. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Building & Motion by McClatchey, seconded by Lieder, to authorize the Zoning-Misc. Building and Zoning officer to issue an accessory building permit to Ron Howard if he would sign a written statement that he would not vi- olate the Zoning Ordinance by storing more than three motor -driven vehicles in his garage unless he would come back for a zoning var- iation before the Zoning Board of Appeals, with the understanding that if and when he came for a variation, the filing fee would be waived. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Chicago & Motion by Lieder, seconded by Teta, to authorize the Mayor NW Transp. and City Clerk to execute two copies of Amendment No. 2 to the ex - Co. isting Grant Agreement for the commuter parking lot project along with Budget No. 3 which will enable the City to close out the Phase I Grants projection cost, and to authorize the Mayor and City Clerk to sign two copies of the Phase II Grant Agreement for the commuter parking lot project along with Budget No. 4 which will enable the City to proceed with construction of the commuter parking lot. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Chicago & Motion by Nolan, seconded by Teta, to authorize the Mayor NW Transp. and City Clerk to sign the lease agreement with the Chicago and Co. Voting Nay: None. Absent: None. Motion carried. Ordinances Motion by Bolger, seconded by Lieder, to pass an ordinance amending the Fair Labor Standards Act by stating that effective April Wages & 15, 1986, overtime will be paid to all employees on a time and Benefits one-half basis for all hours in excess of eight hours per day or in excess of forty hours per week, except in those instances where it is pre -determined by mutual agreement between the department head and the employee. For sworn police personnel, all hours in excess of 2,080 hours per year (divided into thirteen twenty-eight day per- iods), will be paid at a time and one-half basis. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Alderman Lieder, Chairman of the Finance Committee, pre- sented the proposed 1986-87 Fiscal Year Budget, which will be pre- sented for approval at the April 28, 1986 Regular Council Meeting. A Budget Public Hearing on the proposed budget will be held on April 28, 1986 at 7:00 P.M. Alderman Teta, Chairman of the Building & Zoning Committee, reported on a meeting held Monday, April 14, 1986. Motion by Teta, seconded by Nolan, to pass an ordinance amending the Subdivision Control Ordinance that would require the filing of a soils map and a soils analysis report for any proposed subdivisions. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Teta, seconded by Lieder, to increase the building permit fees from the current $.08 per square foot to $.12 per square foot, effective May 1, 1986. Voting Aye: Bolger, Lieder, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: McClatchey. Absent: None. Motion carried. Ordinances Subdivision Control Ord. Ordinances Building & Zoning Misc. Purchases- Motion by Snell, seconded by Bolger, to authorize the Su - Water Dept. perintendent of Public Works to purchase five tons of additional fil- ter media for Wells 2 & 3 at a cost not to exceed $1,355.00. Motion by Smith, seconded by McClatchey, to approve the City Employees Clerk's request to hire an experienced secretary for the City Clerk's office at a beginning salary of $15,000.00. The City Clerk announced that Dolores Blake, the Public Resignations Works Secretary, had submitted her resignation as of May 2, 1986. Employees Anne Rodenkirch, from the City Clerk's office, would fill her va- cancy. Kathleen Kunzer is being hired by the City Clerk to fill Ro- denkirch's vacancy in the Clerk's office, effective April 28, 1986. Motion by Serritella, seconded by Snell, to authorize and Purchases- approve the purchase of a new cash register for the Park Department Park Dept. at a cost of $720.00. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Executive Motion by Snell, seconded by Smith, to go into executive Session session at 11:40 P.M. to discuss personnel and seek legal consul- tation from the City Attorney.
