MONDAY, APRIL 16, 1984 7:41 P.M.
The Regular Meeting of the McHenry City Council was called to order
by Mayor Stanek on Monday, April 16, 1984 at 7:41 P.M. At roll call the follow-
ing aldermen were present: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell,
Serritella. Absent: None. City staff in attendance were Supt. Hal vensleben,
Attorney Narusis, Clerk Gilpin, Chief Pasenelli, Park Director Merkel.
Motion by Datz, seconded by Serritella, to accept the minutes of the
April 2, 1984 Regular Meeting as presented.

Motion by Bolger, seconded by Datz, to grant the request of
Oxford Realty Group for a sign variation for installation of a sign on
opment property (Riverside Terrace) near the corner of Route 31 and
McCullom Lake Road.

Motion by Nolan, seconded by Bolger, to pass a resolution author-
izing the financing of Economic Development facilities;authorizing the
issuance of a $2,600,000 Economic Development Revenue Bond (Chroma Corpora-
tion Project) Series 1984 in connection therewith; authorizing the execution
and delivery of an agreement among the City of McHenry, Illinois, Chroma
Corporation and American National Bank and Trust Company of Chicago as
purchaser and American National Bank and Trust Company of Chicago,as deposi-
tary,providing for the making of a loan to Chroma Corporation from the pro-
ceeds of said bond, the security for said bond, the sale of said bond to
American National Bank and Trust Company of Chicago and related matters.

A letter was presented from John J. Brittain, representing Elgin
Federal Savings & Loan, requesting an extension on the June 15 completion
date for sidewalks in Phases I & II. He requested that the June 15 date be
extended to October 15, 1984 with a 'like extension of the letter of credit
of Elgin Federal Financial Center guaranteeing the installation of the
sidewalks.
Motion by Smith, seconded Icy McClatchey, to authorize and approve
the granting of an extension to Elgin Federal Financial Center for installa-
tion of the sidewalks in Millcreek Subdivision from June 15, 1984 to October
1984 and to grant a similar extension of the letter of credit to cover same.

Snell, Serritella.

Attorney Narusis presented a draft of a proposed agreement prepared
by the Attorney for the Lakeland Park Property Owners Association.
Motion by Nolan, seconded by Snell, to enter into an agreement
between the Lakeland Park Property Owners Association Inc., Lakeland Park
Girl Scouts Troops 41 & 488, Boy Scouts 459, Lakeland Park Womens Club,
Lakeland Park Little League and the City of McHenry, and to authorize the
Mayor and Clerk to sign said agreement.

the hiring of Thomas J. Schmidt as a new full-time employee in the Parks
Department, and to hire Jon M. Schmitt as a full-time employee in the
Public Works Department to replace Jim Steinbach who resigned.

Employees Supt. Halvensleben reported there would be another vacancy in
the Public Works Department and he was instructed to advertise for a laborer
for the Public Works Department.
Grants & Motion by Smith, seconded by Snell, to authorize and approve pay -
Sewer Deptment to J.R. Meyers Co. for Payment Estimate No. 1 in the amount of
Repairs,Impvt. $83,512.27 for the Green Street Lift Station (DCCA) Project as recommended
by Baxter & Woodman

Motion by Snell, seconded by Busse, to authorize and approve
Tag Days the following requests for Bike-a-thons: American Cancer Society Bike-a-
thon on Sunday, May 20th and Saint Judes Childrens Research Hospital

Park Director Merkel reported that two bids had been received
for a mowing unit for the Parks Department as follows: Illinois Lawn
Equipment Inc. $6,215.44; George P. Freund Inc. $7,600.00.
Purch.Park Dept. Motion by Snell, seconded by Busse, to authorize and approve the
Bid Opening & purchase of a Jacobsen Turfcat II mowing unit at the low bid of $6,215.44.

Park Director Merkel reported that three Park Districts had
inspected the Concession Wagon of the City of McHenry which was up for
resale. Two Park Districts submitted bids as follows: Wauconda Park
District $2,500.00; Crystal Lake Park District $2,200.00
Sale of City Motion by Datz, seconded by Nolan, to authorize selling the
Property Park Department Concession Wagon to the 'Wauconda Park District at the
high bid $2,500.00.

Alderman Busse requested that the Revenue Sharing allocations
set at $8,500.00 for the Park Department mowing unit be reduced to cover
the exact amount of the mowing unit.

reduction in the Revenue Sharing allocation for Parks Department new mower
from $8,500.00 to $6,215.44.

reduction in the total Revenue Sharing allocation for 1984-85 from $251,900.00

Mayor Stanek proclaimed the month of May as Better Hearing and Speech
Month as requested by the American Speech Language and Hearing Association.
He also proclaimed Saturday April 28, 1984 as Walk-a-thon day for the March of
Dimes Birth Defects Foundation. The Mayor also proclaimed the next 30 days
as Spruce Up and Fix Up For Spring as requested by the McHenry Beautification
Committee.

Mayor Stanek recessed the meeting at 9:07 P.M. The meeting reconvened
at 9:22 P.M. with everyone still in attendance.
Kenneth M. Schaeffer of 4903 Brorson Lane, McHenry addressed the City
Council concerning an application made by Hillview Farms of Richmond to the EPA
Illinois Environmental Protection Agency for additional sites to apply sludge
near and continguous to single family homes in unincorporated McHenry County.
He asked the City to pass a resolution requesting the IEPA to postpone the
granting of a permit to Hillview Farms of Richmond, Illinois until the matter
could be fully reviewed and the general public would have the opportunity to
present comments and testimony at public hearings on the granting of this
permit.
Motion by Busse, seconded by Nolan, to pass a resolution requesting the
Environmental Protection Agency to postpone the granting of a permit Resolutions
to Hillview Farms until the matter ca.n be fully reviewed by the general
public.

Snell, Serritella.

Motion by Smith, seconded by Snell, to grant the request of Attorney Zoning
Samuel J. Diamond tosubmit a letter to the McHenry Title Company stating Matters
that the City is aware of the encroachment of 2.0 feet onto Green Street of
the front portion of the Top Deck property and will not take action to remove
it so long as the building remains.

Snell, Serritella.

Bill Wilson of McHenry Shores addressed the Council and expressed con-
cern regarding a modular home that is being built in the McHenry Shores area.
He requested that the Building & Zoniing Committee conduct a meeting at which
time he and some residents of McHenry Shores would be able to attend and
express their concerns. Alderman Busse, Chairman of the Building & Zoning
Committee, stated that he would inform Mr. Wilson when the next committee
meeting would be held and he would bE� invited to attend.

A letter from the McHenry Area Chamber of Commerce requested that the
City submit a statement on the water/sewer billings to city residents requesting

Chamber & that $1.00 be earmarked for the annual July 4th Fireworks Display and
Fireworks collected at City Hall. According to the City Clerk there is no space on
the present water/sewer bill to carry this message but the matter will be
presented to the water/sewer billing clerk to see if there is a possibility
of displaying a message which would ask: for donations to the Fireworks
Committee but not to include their donations with their water/sewer payments.
Liquor Motion by Serritella, seconded by Nolan, to authorize and approve
Control & an increase in the 1984-85 Liquor License renewals as follows: Class "A"
Licenses liquor license from $850.00 to $1,000.00; Class "F" from $850.00 to $950.00;
Class "G" from $550.00 to $600.00; Class "H" from $450.00 to $500.00; Class
"B" from $250.00 to $350.00.
Voting Aye: Bolger, Busse, Datz, Nolan, Snell, Serritella.
Voting Nay: Smith, McClatchey.

Liquor Control Motion by Serritella, seconded by McClatchey, to pass an ordinance
& Licenses revising the opening hours to serve alcoholic beverages on Sunday mornings
Failed Mot. from 6 a.m. to 10 a.m. for Class "A" and "G" licenses effective May 1, 1984.
Motion by Smith, seconded by Snell, to amend the above motion
changing the opening hours on Sunday from 6 a.m. to 9 a.m.
Voting Aye: Smith, Datz, Nolan, Bolger.
Voting Nay: Serritella, Snell, McClatchey, Busse.
There being a tie vote Mayor Stanek cast a Nay Vote and declared the motion
did not carry.

Sewer Line Motion by Nolan, seconded by Smith, to authorize and approve the
Repairs & payment of $1,700.00 to J.R. Meyers Company to make a 12 inch tap on the 30
Extensions inch line near Knox Park.
Voting Aye: Bolger, Busse, Datz, Nolan, Smith, McClatchey,
Snell, Serritella.
Voting Nay: None.
Absent: None.

Bond Motion by Busse, seconded by Bolger, to authorize and approve
Payments principal and interest payment to McHenry State Bank on the 1979 Waterworks
and Sewerage Revenue Bonds as follows: Principal $105,000.00; Interest
$26,250.00; Paying Agent Fees $25.00; Total $131,275.00.
Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith,
Snell, Serritella.

Bond Motion by Datz, seconded by Serritella, to authorize and approve
Payments payment of Principal and Interest to American National Bank for the 1956
Waterworks and Sewerage Revenue Bonds as follows: Principal $9,000.00;
Interest $780.00; Paying Agent Fees $39.00; Total $9,819.00.

Sewer Line Motion by Smith, seconded by Bolger, to authorize the expenditure
Repairs & of $1,000.00 a day for labor plus material to J.R. Meyer Co. for visual
Extensions inspection of 200 feet of 30 inch pipe at Knox Park near the City Garage.
Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith,
Serritella.
Voting Nay: Snell.

Motion by Smith, seconded by Serritella, to instruct the Supt. of
Public Works to install a steering wheel on the fire truck at the playground
at the Pearl Street Park.
Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith,
Snell, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
James & Rosemary Denier, owners of a business at 1225 N. Green
Street, submitted a letter to Mayor Stanek requesting a consensus of opinion
from the City Council as to whether or not it would object if the Deniers
approached the Council for a liquor license for their business if they can
find a suitable tenant in the future. It was the concensus of opinion that
the Council would have no objection to issuing a liquor license to the
establishment if a suitable tenant invade application.
Motion by Smith, seconded by McClatchey, to adjourn.
