APRIL 15, 1992
The Regular Meeting of the McHenry City Coun. it was called to order
by Mayor Busse on Wednesday, April 15, 1992 at 8:00 P.M. in the Council
Chambers of the Municipal Center. At roll call the following Aldermen
were present: Bolger, Donahue, Locke, Smith, Adams, Serritella,
Patterson. Absent: Lieder. City Staff in attendance were: City Clerk
Gilpin, City Attorney Narusis, City Administrator Peterson, Chief of
Police Joyce, Director of Public Works Batt, Park Director Merkel.
Absent: None.
TEN MINUTE PUBLIC INPUT SESSION
During the Ten Minute Public Input Session, three people signed up to
speak. Anton Rebel of Maple Avenue asked for assistance in the Boone
Creek clean-up, scheduled for May 30, 1992. Attorney Sam Diamond
requested that the Council reconsider annexation and issuance of a liquor
license to Anest Bros. for a mini -mart service station on the northeast
corner of Bull Valley Road and Route 31. Jillian Galas, a Girl Scout,
expressed her opposition to the Fox Valley Freeway project.
CONSENT AGENDA
Item S3, to pass a resolution objecting to the Anest County Zoning
Petition, as approved at a prior meeting, was withdrawn from the Consent
Agenda for separate discussion.
Motion by Adams, seconded by Donahue, to approve the Consent Agenda
as follows:
(1) Approve April 1, 1992 Regular City Council Meeting Minutes;
(2) Pass Ordinance for First United Methodist Church establishing
handicapped parking on a 24-hour basis;
(3) Approve March Treasurer's Report;
(4) Approve March Budget Report;
(5) Approve March Bills as presented;

RESOLUTION FOR ANEST COUNTY ZONING PETITION
Lengthy discussion took place on whether to pass a resolution
objecting to the Anest Zoning Petition before the County, or whether the
City should continue discussions with Anest on annexing into the City of
McHenry. The Mayor and Aldermen all felt that the property definitely
belonged in the City limits of McHenry. However, Mayor Busse and
Aldermen Patterson and Smith did not feel a liquor license should be
issued to this or any other service station.

Aldermen Bolger, Donahue, Locke, Serritella, and Adams felt the City
should work with Anest and look at the situation from every angle to see
if there would be some way the property could be annexed into the City.
Patterson suggested that the resolution be passed objecting to the County
Zoning Petition; that Anest be requested to submit a list of all of his
gas stations in the area; allow the City two weeks to do a background
check to see if there have been any problems at his other stations, and
then the Council could discuss the various aspects of an annexation
agreement.
Motion by Patterson to pass the resolution objecting to the Anest
County Zoning Petition, and then allow Mr. Anest to come back to the
Council for an annexation meeting.
The motion failed for lack of a second.
Motion by Bolger, seconded by Patterson, to request that the Mayor
meet with Anest as soon as possible, and see if some agreement can be
made to resolve this matter.

ECONOMIC DEVELOPMENT COMMISSION RESOLUTIONS
The agenda item to present resolutions to Thomas Bolger and Ronald
Bykowski recognizing their contributions to the EDC was postponed until
another meeting because both parties were out of town.
INTERGOVERNMENTAL LEASE AGREEMENT WITH DISTRICT 15
In considering the proposed Backhaus development, the City Council
considered the needs of School District 15 for property on which to build
an additional elementary school. The idea of leasing a portion of a
twenty-six acre site owned by the city and designated as a park was
discussed by the Council at previous meetings. The City Administrator
and the City Attorney were directed to meet with the staff of School
District 15 and begin development of an Intergovernmental Agreement to
achieve leasing of the property by the City to the School District in an
effort to reduce the impact of single family home development on the
local elementary school system. The City Council reviewed the draft of
the intergovernmental lease agreement which was prepared by the City
Administrator and City Attorney. Several revisions were suggested by the
Aldermen and the City Administrator was instructed to prepare a revised
lease agreement and bring it back to the Council before it is presented
to the school district.
FIREARMS ORDINANCE
The Police Department recommended a revision to the City Ordinance
which regulates the unlawful possession, carrying and discharge of
firearms. An ordinance was drafted by the Police Chief and the City
Attorney.
Motion by Patterson, seconded by Donahue, to pass an ordinance
regarding the unlawful possession, carrying and discharge of firearms as
presented.

A Finance Committee Meeting was scheduled for Monday, April 20 at
7:30 p.m. to discuss the 1992-1993 fiscal year budget. A Park Committee
Meeting was scheduled for Tuesday, April 21 at 7:30 p.m. in the Park
Conference Room.

The City entered into an agreement with McHenry Township for mosquito
abatement in the City's portion of McHenry Township. However a separate
contract had to be entered into with Clark Outdoor Spraying for the
portion of the City that is in Nunda Township.
Motion by Donahue, seconded by Locke, to enter into a one-year
contract with Clark Outdoor Spraying for mosquito control in the City's
portion of Nunda Township at a cost of $939.16.

ANY AND ALL BUSINESS
Alderman Locke requested that stop signs be installed at the
intersections of Greenbriar and Augusta and at Dartmoor and Thornwood.
Motion by Locke, seconded by Patterson, to pass an ordinance
establishing stop signs at the intersections of Greenbriar and Augusta
and at Dartmoor and Thornwood in Winding Creek Subdivision.

Director Batt reported that Mastercoil Spring Company had approached
the City for a building permit to expand their facility in Tonyan
Industrial Park and for connection to the city sanitary sewer system.
The question arose over the capital development fee for connection to the
sewer system. Under the present ordinance their fee would be $67,872.47,
but based on their current water usage and allowing for an increase in
the size of the building, the calculation for water and sewer based on a
twelve month period would be $20,634.48. Since Mastercoil has agreed to
compensate the city for any usage over the amount of water represented by
the $20,634.48, it was Director Batt's recommendation that it would be
appropriate to grant this variation as actual use more fairly represents
its impact on waste water treatment plant capacity.
Motion by Patterson, seconded by Serritella, to grant the variation
as requested and to accept a capital development fee of $20,634.48
conditioned upon Mastercoil Spring's agreement to compensate the City for
any usage over the amount of water represented by that fee.

The Northeast McHenry Chapter of the American Cancer Society
requested permission to conduct a residential door-to-door campaign on
Sunday, April 26 from noon to six p.m.
Motion by Donahue, seconded by Locke to grant permission as requested
by the Northeast McHenry Chapter of the American Cancer Society.

Alderman Bolger inquired as to when the ward boundary maps would be
presented for Council consideration. Mayor Busse said after the budget
is approved, the ward boundary situation will be addressed.

Alderman Serritella reported on a Ward 4 meeting with its
constituents. She felt that in the future it might be better to have all
Wards and Alderman represented with an open house type situation and have
staff in attendance to answer questions. She requested that the Police
Department, as well as the Building and Zoning Department, be alert to
situations where abandoned vehicles are sitting in residential
neighborhoods and where semi -trucks are being parked in residential areas.
Alderman Smith inquired as to the status of the City wide spring
clean up program, the spring brush pick up program and the yard waste
pick up program. Mayor Busse said that the brush pick up would move
forward but that the other two projects would be discussed when the
budget was presented for Council approval.
Motion by Smith, seconded by Adams to go into Executive Session at
9:55 p.m. to discuss property acquisition.
