The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, April 11, 1990 at 8 P.M. at City Hall. At roll call the following Aldermen were present: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Absent: None. City staff in attendance were Director of Public Works Batt, Attorney Narusis, Clerk Gilpin, Park Director Merkel, Chief Joyce, Building & Zoning Officer Halik. During the 10 minute public input session Scott Nolan spoke on behalf of the Alliance Bible Church which is located on Bull Valley Road. The Church property is adjacent to the property being annexed by the First National Bank of McHenry which fronts on Route 31. It was the concern of the church that water run-off created by the new construction on the bank property would impact adversely on the church property. He requested that City Engineers be made aware of a potential problem there. Motion by McClatchey, seconded by Bolger, to approve the minutes of the April 4, 1990 Regular Meeting as presented. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Loreen Redwanz and Mary Ann Wegener of the McHenry Woman's Club presented a check for $150 to Pete Merkel of the Park Department and Mayor Busse. The money was to be used for purchase of a maple tree to be planted on Arbor Day, April 27, 1990, in Veteran's Memorial Park. A plaque will also be installed commemorating the donation by the Woman's Club. Mayor Busse and Park Director Merkel expressed thanks to the McHenry Woman's Club for their many years of contributions to the City and to the McHenry Library. Attorney Steve Cuda and Developer Don White appeared before the Council to seek preliminary plat approval of Biscayne Highlands. Motion by McClatchey, seconded by Teta, to approve the developer's request to have Outlot A be combined with Lot 1 'and Outlot B be combined with Lot 25 as depicted on the preliminary plat of Biscayne Highlands on the condition that the City will receive an easement from the developer to maintain storm water detention areas on the properties. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Lieder, seconded by Donahue, to approve the preliminary plat of Biscayne Highlands as presented and amended. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by McClatchey, to approve the request of David Backhaus and grant a 90 day extension for the Backhaus/Brackmann Annexation Agreement as presented. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Serritella. Voting Nay: Patterson. Absent: None. Motion carried. Motion by Teta, seconded by Lieder, to pass an ordinance to temporarily eliminate parking on the north side of Elm Street from Riverside Drive to Richmond Road to allow traffic re-routing for the Route 120/31 Bridge Replacement Project. Voting Aye: Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: Bolger. Absent: None. Motion carried. Wednesday, April 11, 1990 Page 2 Motion by Bolger, seconded by Donahue, to pass a Resolution authorizing the Mayor to write a letter to the Corps of Engineers supporting Chuck Miller's Dobyns House Restaurant project supporting the installation of boat parking and to emphasize its positive effect on economic development in the McHenry Area. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Alderman Bolger, Chairman of the Utilities Committee, reported on a Utilities Committee Meeting held Monday, April 9, 1990. Ron Schaefer, a homeowner, was requesting that he not have to pay a water bill which was left unpaid by a tenant in one of his rented homes. Since it is a City Ordinance that it is the landowners responsibility to pay for any utility bills on his property, the Utilities Committee denied the request to waive the payment. Motion by Smith, seconded by Lieder, to approve the attendance of Richard Orton at a Management Skills Training Course June 13 -14, 1990, in Chicago at a cost of $149. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Patterson, seconded by McClatchey, to go into executive session at 9:17 P.M. to discuss personnel and prospective litigation. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Patterson, seconded by McClatchey, to go back into open session at 11:30 P.M. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Lieder, seconded by Donahue, to authorize the Mayor to contact the homeowner at 1204 Bonnie Brae in McHenry Shores and get a letter in writing agreeing that the pile of debris in front of her home is a public nuisance; that she would like the City to remove the debris from her property and that she would pay for the cost of removal and if unable to pay would agree in writing that a lien could be placed on her home. Voting Aye: Donahue, Lieder, Teta, Smith, McClatchey, Patterson. Voting Nay: Bolger, Serritella. Absent: None. Motion carried. Motion by Smith, seconded by McClatchey, to adjourn.
