The Regular Meeting of the City Council was called to order by Mayor Stanek on Monday, March 29, 1982 at 8 P.M. At roll call the following alder- Council Mtg, men were present: Pepping, Harker, Nolan, Wieser, Smith, Serritella, Meurer. Attendance Absent: Datz. Also in attendance were: Supt. Weber, Attorney Narusis, Clerk Gilpin, Chief Pasenelli. Motion by Harker, seconded by Nolan, to accept the minutes of the March 15, 1982 Regular Meeting as presented. Voting Aye: Pepping, Harker, Nolan, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Datz. Motion carried. It was announced that through a referendum held in the Primary Elec- McHenry tion on March 16, 1982, the Village of McHenry Shores was annexed to the City Shores of McHenry. The referendum passed in both municipalities by the following Annexati vote: City of McHenry - Yes votes 1498, No votes 850; Village of McHenry Shores - Yes votes 313, No votes 46. Annexation was immediate on March 17, 1982 as per Illinois State Statutes. The City of McHenry succeeded immediate- ly to all assets, obligations and rights of the former Village of McHenry Shores. A canvas of the election is attached to these minutes as a point of information. Dr. Hal Sundin of Baxter and Woodman, Attorney Jeff Ladd of McHenry McHenry Hospital and Attorney Narusis presented an outline to the Council of steps Hospital necessary to secure financing for sewer and water line extensions to the new hospital site. Motion by Harker, seconded by Nolan, to authorize Narusis to draw Water Sewer up the necessary paperwork for a Special Service Area Taxation on acreage of the McHenry Hospital to produce financing for utility extensions to the new site. Authorizations Voting Aye: Pepping, Harker, Nolan, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Datz. Motion carried. Motion by Smith, seconded by Serritella, to call a Special Meeting on Wednesday, March 31, 1982 at 8 P.M. for the purpose of discussing waiving of fees for hospital construction and review of the 1982-83 Water -Sewer budget. Voting Aye: Pepping, Harker, Nolan, Wieser, Smith, Serritella, Meurer. Voting Nay: None Absent: Datz. Motion carried. Motion by Smith, seconded by Meurer, to approve the recommendation of City of McHenry ESDA Director John Shay and authorize the attendance of Mrs. Charlene Svihlik, Asst. ESDA Coordinator, at the Illinois Emergency Services Management Conference in Springfield on April 29-May 2 at an estimated cost of $218.71; to approve the purchase of a mobile radio for her automobile at a cost of $620; and to table action on acceptance of Shay's resignation and the appointment of Mrs. Svihlik to take his place at a cost of $150.00 per month with an additional $700.00 per year for training, conferences and associa- tions dues. Special Mtg.1 McHenry Hospital ESDA Mayor Stanek appointed a Special Committee to realign ward boundary lines and come back with a recommendation to the Council. Meurer was appointed Ward Chairman with Wieser, Harker and Pepping as members of the Committee. Monday, March 29, 1982 Page 2 Motion by Nolan, seconded by Meurer, to conduct Spring cleanup Cleanup days in the City during the week of June 7 thru June 11 and accept the Days proposal of McHenry Woodstock Disposal who will supply the vehicles and drivers, with the city providinglabor to load the trucks, at a cost of $189.50 per vehicle, plus a $2.50 per yard disposal fee. Voting Aye: Pepping, Harker, Nolan, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Datz. Motion carried. Motion by Pepping, seconded by Nolan, to authorize and approve McHenry payment of bills incurred by the former Village of McHenry Shores in the Shores amount of $10,385.50 as presented as follows. Authorizations Motion by Pepping, seconded by Wieser, to authorize an increase Police Dept. in the number of patrolmen on the Police Department from 15 to 18 with the hiring of the men to take place as soon as possible. Employees Voting Aye: Pepping, Harker, Nolan, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Datz. Motion carried. Mayor Stanek called for a recess at 10:03 P.M. The meeting reconvened at 10:13 P.M. with everyone still in attendance. Motion by Wieser, seconded by Harker, to authorize and approve Tag Days the following tag days requests: Lions Candy Day on October 9; McHenry Pigtail League on June 5 and Helping Paws on June 19. Voting Aye: Pepping, Harker, Nolan, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Datz. Motion carried. Public Works Motion by Smith, seconded by Wieser, to approve the proposal of Purchases Althoff Industries in the amount of $790.00 to replace the furnace in the Public Works Maintenance garage on Green Street. Voting Aye: Pepping, Harker, Nolan, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Datz. Motion carried. Committees Motion by Smith, seconded by Meurer, to authorize Chairman Meurer of the Purchasing Committee to handle disposition of two vehicles obtained Sale of through the annexation of McHenry Shores in the best way he deems possible. Property Voting Aye: Pepping, Harker, Nolan, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Datz. Motion carried. Monday, March 29, 1982 Page 3 Motion by Serritella, seconded by Wieser, to deny the request of Requests - Towne & Country Fund Raisers to install an advertising banner over Green Misc. Street for the reason that it would set a precedent for all future fund raising projects. Voting Aye: Pepping, Harker, Wieser, Smith, Serritella, Meurer. Voting Nay: Nolan. Absent: Datz. Motion carried. Motion by Serritella, seconded by Meurer, to pass an Ordinance Ordinance designating stop sign locations in McHenry Shores Subdivision. Stop Voting Aye: Pepping, Harker, Wieser, Smith, Serritella, Meurer, Nolan. Voting Nay: None. Signs Absent: Datz. McHenry Motion carried. Shores Motion by Smith, seconded by Wieser, to approve the request of the Park Catholic Order of Foresters for a park beer permit on July 18, 1982 at the Permits Pearl Street Park. Voting Aye: Pepping, Harker, Wieser, Smith, Serritella, Meurer,Nolan. Voting Nay: None. Absent: Datz. Motion carried. Motion by Serritella, seconded by Nolan, to ratify the action Audit taken to hire the firm of Yapelli Ketchmark to perform an immediate audit McHenry on the McHenry Shores financial books. Shores Voting Aye: Pepping, Harker, Wieser, Smith, Serritella, Meurer, Nolan. Voting Nay: None. Absent: Datz. Motion carried. Motion by Pepping, seconded by Meurer, to authorize and approve Insurance payment of $15,578.30 to Prudential Insurance Company for two months health insurance premiums. Voting Aye: Pepping, Harker, Wieser, Smith, Serritella, Meurer, Nolan. Voting Nay: None. Absent: Datz. Motion carried. Motion by Nolan, seconded by Harker, to authorize the hiring of Authorization a full time employee in the City Clerk's office to replace a vacancy and Clerk's to rehire the departing employee on a part-time basis. Motion by Serritella, seconded by Harker, to authorize Attorney Authorization Narusis to proceed with necessary steps to rezone the recently annexed McHenry Shore Tonyan Industrial Park to Industrial zoning if a previous annexation agreement does not already cover the matter. Zoning Matters Voting Aye: Pepping, Harker, Wieser, Smith, Serritella, Meurer, Nolan. Voting Nay: None. Absent: Datz. Motion carried. Attorney Narusis advised the Council of a lawsuit filed against Lawsuits the former Village of McHenry Shores by a former police officer of the McHenry village, Nobert Sauers, which the City of McHenry now has the obligation Shores to defend.
