The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, March 21, 1990 at 8 P.M. at City Hall. At roll call the following Aldermen were present: Bolger, Donahue, Lieder, Teta, Smith, Patterson, Serritella. Absent: McClatchey. City staff in attendance were Director of Public Works Batt, Attorney Narusis, Clerk Gilpin, Park Director Merkel, Building & Zoning Officer Halik. Absent: Chief Joyce. During the public input session of the meeting two people signed up to speak. Roberta Fiali of 1012 N. Ridge Road and Robert Wolfenberger of Sycamore, Illinois. Ms. Fiali asked the Council to reconsider construction of a deceleration lane in front of her home on Ridge Road for the Burning Tree Subdivision entrance since this would eliminate much landscaping and many large pine trees in front of their home. The landscaping and trees afford a barrier and privacy for their home. Mr. Wolfenberger is a land broker and representative of Art Koehn who owns property on the north side of Bull Valley Road between Crystal Lake Road and the railroad tracks. He asked that the Council reconsider the designation of single family homes on the Comprehensive Plan for that section of the property and that it be given a multi -family designation. Motion by Bolger, seconded by Donahue, to approve the minutes of the March 7, 1990 and March 14, 1990 Regular Minutes as corrected. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, Patterson, Serritella. Voting Nay: None. Absent: McClatchey. Motion carried. Director Batt presented a memo on the "Needs Assessment" for a water system. In order to begin implementation on the recommendation of Baxter & Woodman in the 1989 Master Plan for water and sewer, consideration should be given now as to hiring a consultant to begin a needs assessment for the entire water distribution system. A consultant should be hired to perform all tasks associated with the design of distribution system improvements for water mains throughout the City. The Utilities Committee was instructed to study the matter and report back to the Council with a recommendation. John Gann of Gann Associates presented a letter dated March 12, 1990 which suggested various revisions to the draft of the McHenry Development Plan Map. The suggestions were: "l. Change the "Industrial" classification to "Business Park". Reclassify all the Industrial areas shown on the Map to Business Park. 2. Route the extension of Mason Hill Road to intersect with Route 31 further south. Drop the extension of Mason Hill Road east of Route 31. 3. Change the "Open Space" classification to "Open Space or Conservation." Include in this classification the Open Space areas shown on the draft Map plus all other areas shown as "Parks & Open Space" on the 1981 Comprehensive Plan map. Boundaries of these areas would be general, and no distinction would be made between areas proposed for acquisition for public parks and conservation areas that would remain in private hands. Adoption by the City of a conservation zoning district is once again proposed to implement the designation of conservation areas on the Plan Map. If such a district is adopted, the Zoning District Map would show precise boundaries of the conservation areas based on data wetlands, flood plains, soil conditions, etc. 4. Show on the Street Plan overlay generalized suggested routes for pedestrian/bicycle trails through the lengthier linear Open Space or Conservation areas. 5. Reclassify the entire area west of Ringwood Road -Curran Road as Rural Residential except for the commercial around FAP 420 interchange. Wednesday, March 21, 1990 Page 2 It is recommended that the City consider adoption of an estate residential zoning district to implement this designation, since Rural Residential is intended normally to represent lot sizes of one acre or more, whereas the largest required lot under the present City zoning regulations is 30,000 square feet. 6. Drop the major retail center at Chapel Hill Road and Route 120 and replace it with the pink designation, which would represent just an extension of the present highway strip commercial use to this intersection. 7. Prepare the Public Hearing Draft version of the Map in color rather than in black and white." In addition to the above items the following suggestions were presented by the Aldermen: 1) On Route 31 going south the strip zoning on the east side of Route 31 should be designated as 0-1 Office District because it primarily abuts residential housing; and 2) McCullom Lake should be shown as a conservation area. Mayor Busse will contact Gann and report on the Council's action. Park Director Merkel presented an itemized list of bids to approve the above recommendations which had been received for playground and park equipment for various parks throughout the City. Motion by Bolger, seconded by Lieder, to approve the purchase of playground equipment from the following low bidders: Howard L. White Co. - $4,950 for bleachers; Brentwood Enterprises - $428 for bicycle racks; Mike Schramm & Assoc. - $27,206 for picnic tables, shelters, play benches and playground climber as presented. Voting Aye: Bolger, Donahue, Lieder, Teta, Patterson. Voting Nay: Smith, Serritella. Absent: McClatchey. Motion carried. , Curt Langille, Developer of Burning Tree Subdivision, appeared before the Council to request preliminary plat approval of his 65 lot subdivisions fronting on Ridge Road. Lengthy discussion took place on road widths, sodding of ditches, water retention and detention, engineerig problems brought up by Shamrock Farms, acceleration and deceleration lanes on Ridge Road, collector streets in the subdivision and right-of-way widths on Ridge Road. Motion by Bolger, seconded by Lieder, to approve the preliminary plat of Burning Tree Subdivision as presented with notice to the Plan Commission that on the final plat, three things need to be addressed: 1) road widths; 2) deceleration lanes; and 3) approval of the six items outlined in a report done by Lindley & Sons Inc. for Shamrock Beef Cattle Farms concerning drainage run-off and soil erosion problems. Voting Aye: Bolger, Donahue, Lieder, Smith, Patterson, Serritella. Voting Nay: Teta. Absent: McClatchey. Motion carried. It was decided to authorize the City Attorney to draft an ordinance permitting the use of excelsior blankets in drainage ditches. Motion by Lieder, seconded by Patterson, to authorize the Mayor and City Clerk to enter into engineering agreements with Baxter & Woodman for the following three projects: 1. Redesign of Bar Screen and Grit Removal improvements for the Central Wastewater Treatment Plant in the amount of $43,200. 2. Inspection and Construction Management Agreement for the Millstream Pumping Station presently under contract to Mosele for reconstruction at a cost not to exceed $10,000. 3. Inspection and Construction Management Agreement for the Construction of a Seawall at the Central Wastewater Treatment Plant at a cost not to exceed $10,000. Voting Aye: Bolger, Donahue. Motion by Smith, seconded by Patterson, to authorize the Mayor to enter into an agreement with Smith Engineering at a cost not to exceed $1,000 for preparation of an exhibit and cost estimate of three options available to service the new City Hall site with sanitary sewer. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, Patterson, Serritella. Voting Nay: None. Absent: McClatchey. Motion carried. Wednesday, March 21, 1990 Page 6 Mayor Busse announced that Section 9 of Nunda Township lies within the Fritsch property and the Corporate Center Development. It is not in the McHenry Facility Planning Area (FPA). It is considered to be in "No Mans Land". In 1985 a letter was sent to NIPC asking that Section 9 be included in the McHenry Facility Planning Area. NIPC approved it but when it went to the Department of Agriculture, they denied the request. Now that there is a request to furnish sewer service to the Fritsch Property and the Corporate Center, the City has again requested that NIPC consider annexating this Section 9 of Nunda Township into the McHenry FPA. Mayor Busse will be attending a meeting at NIPC on April 4, 1990 to again present this request. A resolution of support from the Council would emphasize to NIPC and the Department of Agriculture that this request should be granted. Motion by Teta, seconded by Bolger, to pass a resolution requesting that Section 9 of Nunda Township be annexed into the City of McHenry's Facility Planning Area. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, Patterson, Serritella. Voting Nay: None. Absent: McClatchey. Motion carried. Motion by Teta, seconded by Smith, to cancel the Deerwood Annexation Special Meeting of April 2, 1990 and reschedule it for April 30, 1990 at 8:00 P.M. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, Patterson, Serritella. Voting Nay: None. Absent: McClatchey. Motion carried. Motion by Teta, seconded by Donahue, to request City employees to man the booth at the Trade Fair and pay them time and one-half for working there. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, Patterson, Serritella. Voting Nay: None. Absent: McClatchey. Motion carried. Mayor Busse reported that the McHenry Public Library has requested a waiver of the retained personnel fee, Zoning Board of Appeals application fee, Plan Commission application fee and sign deposit fee which are normally required of developers in the annexation process. This request was in connection with their pending applications for annexation and zoning before the various City Boards. Following discussion it was decided not to waive these fees since the same request had not been granted for the Fire District or the School Districts. McHenry Savings Bank requested a sign variation from the City Council to relocate their sign on Elm Street at the entrance to the Green Street Parking Lot. The Public Works Department .and the State of Illinois requested this re -location which is necessary because of relocating the driveway onto Elm Street from the Green Street Parking Lot caused by the reconstruction of the bridge over Boone Creek. Motion by Bolger, seconded by Lieder, to ;approve the sign variation request from McHenry Savings Bank as presented,. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, Patterson, Serritella.
