Mayor Stanek called to order the Regular Meeting of the City Council Council on Monday, March 21, 1983 at 8:05 P.M. in city hall. At roll call the follow- Meeting ing aldermen were present: Pepping, Nolan, Busse, Datz, Gelwicks, Smith, Serritella, Meurer. Absent: None. City staff in attendance were Supt. Attendanc Halvensleben, Attorney Narusis, Clerk Gilpin, Chief Pasenelli, Park Director Merkel. Motion by Nolan, seconded by Serritella, to accept the minutes of the March 7, 1983 Regular Meeting and the minutes of the Public Hearing and Special Meeting on March 2, 1983 as presented. Voting Aye: Pepping, Nolan, Busse, Datz, Gelwicks, Smith, Serritella, Meurer. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Gelwicks, to concur with the recommenda- tion of the Zoning Board and grant a "B-1" zoning for the Conway -Wieser Ordinanc property at 409 N. Front St., McHenry. Zoning Voting Aye: Pepping, Busse, Datz, Gelwicks, Smith, Serritella, Meurer. Voting Nay: Nolan. Absent: None. Motion carried. Motion by Smith, seconded by Busse, to concurwith the recommendation of the Zoning Board of Appeals and deny the request of Hillcrest Inc. for re- duction of parking spaces for their apartment complex on the southeast corner of McCullom Lake Road and Orleans Street. 'Voting Aye: Busse, Datz, Smith. Voting Nay: Pepping, Nolan, Gelwicks, Serritella, Meurer. Absent: None. Motion did not carry. Motion by Pepping, seconded by Nolan, to grant the petition of Ordinance Hillcrest Inc. to reduce the number of parking spaces required per apart- Zoning ment unit from 2 to 1.5 contingent upon the following condition: That at anytime the City deems it necessary, additional parking will be installed to bring the number of required spaces per unit back up to 2. Voting Aye: Pepping, Busse, Datz, Nolan, Gelwicks, Meurer, Serritella. Voting Nay: Smith. Absent: None. Motion carried. Motion by Nolan, seconded by Pepping, to deny the petition of Long John Silver's and Roger Feldman for a "B-1" variation request to allow Zoning operation of a muffler shop on West Elm Street east of the Long John Silver's restaurant. Voting Aye: Pepping, Busse, Datz, Nolan, Meurer, Serritella, Smith. Voting Nay: Gelwicks. Absent: None. Motion carried. Motion by Busse, seconded by Meurer, to pass a resolution appro- Resolutio priating $12,152.00 of Motor Fuel Tax Funds for the purpose of maintaining streets and highways for the calendar year 1-1-82 to 12-31-82. Motor Fuel Voting Aye: Pepping, Nolan, Busse, Datz, Gelwicks, Smith, Tax Meurer, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Datz, seconded by Meurer, to pass a resolution opposing Resolutior USEPA's proposed sanctioning of northeast Illinois for a mandatory vehicle EPA inspection and maintenance program by 1987. Voting Aye: Pepping, Nolan, Busse, Datz, Gelwicks, Smith, Meurer, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Meurer,.seconded by Serritella, to increase the number Ordinance of Class "H" from four to five and grant a Class"H" to Philip Grande doing Liquor Licenses Monday, March 21, 1983 Page 2 business as Papa G's at 3910 W. Main Street contingent upon his establishing residency in city limits or incorporating the business. Voting Aye: Pepping, Nolan, Busse, Datz, Gelwicks, Smith, Meurer, Serritella. Voting Nay: None. Absent: None. Motion carried. rdinance Motion by Nolan, seconded by Meurer, to pass an ordinance amend - Liquor ing the Municipal Code section 4-26 which prohibits the delivery of alcoholic Licenses beverages by a person under the age of 21 in his employment. Voting Aye: Pepping, Nolan, Busse, Gelwicks, Smith, Meurer, Serritella. Voting Nay: Datz. Absent: None. Motion carried. Ordinance Motion by Gelwicks, seconded by Serritella, to pass an ordinance City Lic.fees increasing various city license fees. Voting Aye: Pepping, Nolan, Busse, Datz, Gelwicks, Smith, Meurer, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Meurer, seconded by Pepping, to increase the swimming Parks- pool fees for season passes with old rates applicable prior to April 15, fees 1983 and new rates applicable after April 15, 1983. Voting Aye: Pepping, Nolan, Busse, Datz, Gelwicks, Smith, Meurer, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Meurer, to accept the February Treasurer's report as presented. Voting Aye: Pepping, Nolan, Busse, Datz, Gelwicks, Smith, Meurer, Serritella. Voting Nay: None. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Serritella, to back into open session at 10:13 P.M. Mayor Stanek instructed Attorney Narusis to draft proposed rules and regulations applying to the subdivision of small tracts of land and present itat thenext council meeting for approval. Motion by Datz, seconded by Meurer, to authorize and approve payment of payment request No. 2 for the Bull Valley Road Watermain and Sanitary Sewer Extension to E.M. Melahn Construction Co. Inc. in the amount of $128,994.30 as recommended by Baxter & Woodman. Voting Aye: Pepping, Nolan, Busse, Datz, Gelwicks, Smith, Meurer, Serritella. Executive Session Subdivision of land Bull Valley Watermain Extension Monday, March 21, 1983 Page 6 Voting Nay: None. Absent: None. Motion carried.
