At roll call the following Aldermen were present: Bolger, Lieder, Locke, Smith, Adams, Patterson, Serritella. Absent: Donahue. City Staff in attendance: City Clerk Gilpin, City Attorney Narusis, Director of Parks and Recreation Merkel, Director of Public Works Batt. Absent: Chief of Police Joyce, City Administrator Peterson. TEN MINUTE PUBLIC INPUT SESSION During the Ten Minute Public Input Session, Phil Gust, Assistant Chief of the McHenry Township Fire Protection District, addressed the Council to request that the City allow the Fire District to use the water tower at Tonyan Industrial Park for rescue training exercises. They plan to do the training sometime in April or May on a Saturday morning. The Fire District would provide the City with a Certificate of Insurance naming the City as an additional insured. Motion by Patterson, seconded by Serritella, to approve the request of the McHenry Township Fire Protection District, and allow them to use the water tower at Tonyan Industrial Park for rescue training exercises, provided the City receives a Certificate of Insurance naming the City as additionally insured. Voting Nay: None. Absent: Donahue. Motion carried. March 18, 1992 Page 4 MAINTENANCE OF NAPOLI PIZZA SIGN The Napoli Pizza sign at 5009 W. Elm Street exists on a vacant site, and is in violation of the City Sign Ordinance. The owners have been asked to remove the sign, but have indicated a desire to build a new restaurant on the site later this year. They requested that they be given an extension of time to August 31, 1992 before having to remove the sign. Motion by Patterson, seconded by Bolger, to grant an extension of time to April 30, 1992,for maintenance of the Napoli Pizza sign, and if by that date a new building permit has not been issued for that property, the City Council will authorize the City Attorney to take action in court to have the sign removed. Voting Aye: Smith, Adams, Patterson, Serritella, Bolger, Locke, Lieder. Voting Nay: None. Absent: Donahue. Motion carried. PHILLIP'S 66 SIGN VARIATION REQUESTS The Phillip's 66 service station at 4713 W. Elm Street requests variation from the City ordinance for two different signs. Height and setback variations would be required for both signs. Motion by Patterson, seconded by Serritella, to deny all sign variation requests, as presented. Voting Aye: Bolger, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. WINDING CREEK SIGN VARIATION EXTENSION Gerstad Builders submitted a request for continuation of a sign which exists at 4103 W. Elm Street. The sign advertises the Winding Creek subdivision, and the temporary one-year sign variation has expired. Gerstad requests that the sign be allowed to remain on the property until build -out of his subdivision. Motion by Bolger, seconded by Locke, to grant an 18-month extension to allow the development advertising sign for the Winding Creek subdivision to remain at 4103 W. Elm Street. Voting Aye: Bolger, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. WINDING CREEK 5 SIGN VARIATION EXTENSION Gerstad Builders was requesting an extension for continuation of a sign at the intersection of Crystal Lake Road and Winding Creek Drive which advertises the Trails of Winding Creek. The sign variation previously approved has expired and Gerstad is requesting that a time extension be allowed until the build -out of the subdivision is complete. Motion by Lieder, seconded by Patterson, to grant an 18-month extension for the advertising sign of Winding Creek at the intersection of Crystal Lake Road and Winding Creek Drive for the Winding Creek 5 development. Voting Aye: Bolger, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. March 18, 1992 Page 5 FINAL PLAT - WINDING CREEK 5, UNIT 5 Roger Gerstad of Gerstad Builders was in attendance to request the final plat approval for the Winding Creek 5, Unit 5 subdivision. The plat consisted of 95 lots. It was the recommendation of the Plan Commission that the following conditions be given consideration by the Council before final plat approval: (1) That water and sewer stubs should be extended to the City -owned park site from Cross Trail; (2) That a sidewalk be installed on the west side of Cross Trail, along the City park frontage; (3) Topsoil must remain on the park site and the park site should not be used as a fill or storage site by the developer, and should not have crops planted on it this Spring. It was noted that crops have been planted on the park site for the past two years. Some Aldermen felt that compensation should be paid to the City for cropping of that land. Roger Gerstad felt that his company had received no rent payment for use of that land, and had gained nothing for maintaining that 5 acres. Motion by Patterson, seconded by Locke, to charge Gerstad Builders E80/acre to be paid within 30 days as rent on the 5 acres of park site in Winding Creek 5, which has been used for the past two years for cropping. Voting Aye: Patterson, Locke. Voting Nay: Bolger, Lieder, Smith, Adams, Serritella. Absent: Donahue. Motion did not carry. Motion by Serritella, seconded by Adams, to approve the final plat of Winding Creek 5, Unit 5, as presented, conditioned upon the following requirements: (1) That water and sewer stubs be extended to the City -owned property site from Cross Trail at a location determined by the City within two years as the Subdivision Control Ordinance requires for all subdivision improvements; (2) That sidewalks be installed on the west side of Cross Trail, along the City park frontage; and, (3) That all topsoil remain on the park site, and that no crops be planted for 1992 on that site without City Council approval. Motion by Lieder to amend the original motion, and add that Gerstad Builders be directed to determine any revenue they derived from farming on their property for the past two years, and that it be pro rated on the 5 acres that the City has owned for the past two years. Roger Gerstad made an offer to work with the Park Department on improving the 5 acre park site. Aldermen encouraged Park Director Merkel and Gerstad to proceed with discussions on this project. AWARD BID FOR NEWSLETTER Price quotes were solicited for printing of the quarterly newsletter. Four bids were received. Motion by Locke, seconded by Serritella, to approve the low bid of McHenry Printing Services, and award a two-year bid for the quarterly newsletter. March 18, 1992 Page 6 Motion by Bolger, seconded by Smith, to table the motion until more information is presented to the Council. Voting Aye: Bolger, Serritella, Smith. Voting Nay: Lieder, Locke, Patterson, Adams. Absent: Donahue. Motion did not carry. Motion by Locke, seconded by Serritella, to amend the original motion to read that the low hid from McHenry Printing Services be accepted for printing of the City newsletter, provided however, that the question of whether the newsletter should be printed semi-annually or quarterly will be decided at a future date. Voting Aye: Bolger, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. CHICAGO NORTHWESTERN TRANSPORTATION COMPANY AGREEMENT Under the terms of an annexation agreement, the Amoco Oil Company is obligated to extend a sanitary sewer from their property on the southwest corner of Bull Valley and Crystal Lake Roads, along Bull Valley Road to a sanitary sewer manhole 1100 feet east of the Chicago Northwestern Railroad tracks. In order to cross the railroad property, it is necessary to receive permission of the Chicago Northwestern Transportation Company. A license was attached for Council approval. Attorney Narusis suggested that two articles in the agreement be revised. Motion by Bolger, seconded by Smith, to authorize the Mayor and City Clerk to sign the lease agreement with the Chicago Northwestern Transportation Company, conditioned upon revisions suggested by the City Attorney. Voting Aye: Bolger, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. MAYOR'S STATEMENT AND REPORTS The Mayor reported on a Committee Meeting of the Whole where discussion was held on redistricting of the City Council. Motion by Patterson, seconded by Smith, to approve the recommendation of the Committee Meeting of the Whole, and add a fifth Ward and two additional Aldermen to the City COuncil, effective in 1993 at the next City General Election. Voting Aye: Locke, Bolger, Serritella, Patterson, Smith. Voting Nay: Lieder, Adams. Absent: Donahue. Motion carried. COMMITTEE REPORTS Alderman Lieder, Chairman of the Finance Committee, reported that the Finance Committee had made a recommendation to approve a Revolving Loan Fund Grant to Hobbytown for $6,000.00. Motion by Adams, seconded by Bolger, to approve the Finance Committee recommendation and award a $6,000 Revolving Loan Fund Grant to Mike and Patricia Hollingsworth, DBA Hobbytown, Inc. Voting Aye: Bolger, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: Donahue. Motion carried. March 18, 1992 Page 7 DEPARTMENT HEAD REPORTS The McHenry Preservationists, who annually undertake the clean up of Boone Creek, have requested that the City provide dumpsters for them to use for deposit of debris from the creek clean up. Volunteers do the clean-up work, and they ask the City to participate by providing the dumpsters. Motion by Patterson, seconded by Adams, to provide as many dumpsters as are necessary for clean-up of Boone Creek on May 30, 1992. Voting Aye: Voting Nay: Absent: Motion carried. EXECUTIVE SESSION Bolger, Lieder, Locke, Smith, Adams, Patterson, Serritella. None. Donahue. Motion by Bolger, seconded by Smith, to go into Executive Session at 9:55 P.M. to discuss personnel. Motion by Lieder, seconded by Patterson, to authorize the Mayor to hire a candidate for the Building and Zoning Director's position under terms discussed in Executive Session, based on the Mayor's findings of a final background check for the individual Voting Aye: Bolger, Lieder, Locke, Smith, Adams, Patterson, Serritella.
