A Special Meeting of the McHenry City Council was called to order by Mayor Busse on March 17, 1986 at 7:30 P.M. at City Hall. At roll call the following Aldermen were present: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella. Absent: Teta. City staff in attendance were Supt. Batt, Attorney Narusis, Clerk Gilpin, Building & Zoning Inspector Rosing. Special Meeting was called for the purpose of considering the Boro-Zielke annexation agreement and zoning proposal. Mayor Busse asked if the Council was ready to act on the Zoning Board recommendation or if they wished to hear further testimony. The Aldermen replied that: they felt no further testimony was necessary. Richard J. Short, attorney for petitioners, Raymond J. Boro, Kenneth E. Bien, Christine H. Bien, Roger J. Zielke and Linda R. Zielke was in attendance. Also in attendance was Attorney Dan Curran, repre- senting the objectors. Attorney Narusis reported that it would take a two-thirds vote of the Council to overturn a Zoning Board of Appeals recommendation and a two-thirds vote of the Council to pass an annexation agreement. Motion by Lieder, seconded mendation of the Zoning Board of request for reclassification. by Serritella, to accept the recom- Appeals and deny the petitioner's Voting Aye: Lieder, McClatchey, Nolan, Smith, Voting Nay: Bolger. Absent: Teta. Motion carried. Snell, Serritella. Attorney Narusis then said "The substance of the motion was to accept the recommendation of the Zoning Board which means to deny the petition for the reclassification and at this point it would be appropriate to put the question to the petitioner whether or not he wishes to persist in his petition for annexation or withdraw it because the petition for annexation would not carry the zoning that he is requesting." Attorney Short, speaking on behalf of the petitioners, said they would withdraw their request for annexation. Attorney Short then presented a notice that was mailed to one of the tax payers of property adjoining the subject property, which was to be entered into the record as being returned "Unclaimed". Motion by Smith, seconded by Nolan, that the Council would con- cur in the withdrawal by the petitioners for annexation. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: Teta. Motion carried. The meeting adjourned at 7:40 p.m. regarding the Boro-Zielke annexation and zoning request. City Clerk's Notes The City Clerk's Office received notice at 3:30 p.m. March 17, 1986 that the court reporter who was to respond for the Special City Council Meeting on the Boro-Zielke annexation would not be able to attend since all of the court reporters for the McNamara Reporting Service had left that company.
