Presentation of the Colors, Pledge of Allegiance and Opening Prayer Council for the meeting were presented by Cub Scout Webelos Pack 351 who are working Meeting toward their citizen award. Following the ceremony, Mayor Stanek called to Guest Presenta- order the regular meeting of the City Council on Monday, March 16, 1981 at t ion 8 P.M. At roll call the following aldermen were present: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Absent: None. Also in attendance Attendance) were Supt. Weber, Attorney Narusis, Clerk Gilpin, Chief Pasenelli, Park Director Merkel. Motion by Schooley, seconded by Datz, to accept the minutes of the March 2, 1981 Regular Meeting as read. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Motion by Pepping, seconded by Harker, to accept the 1981-82 Proposed Budget Control Budget as presented by the Finance Committee which includes the General and Water/Sewer Funds. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Art Newbrough, a member of School Board District 15, addressed the Election Council to encourage passage of a referendum to be voted on at the April 7, 1981 General Consolidated Election. Robert Grossman of Associated Planners, presented the amended Land Land Use Plan 2000 as approved by the Plan Commission. Following discussion between use Plan the Council and Grossman, Attorney Robert Gordon asked to address the Council from the audience as a representative of residents living in the residential area east of Route 31 in Edgebrook Heights subdivision. Motion by Nolan, seconded by Pepping, to allow Attorney Robert Gordon to address the Council as spokesman for the concerned residents. Motion by Wieser, seconded by Adams, not to allow anyone from the concerned residents to speak before the Council. Voting Aye: Harker, Datz, Wieser, Adams. Voting Nay: Pepping, Nolan, Schooley, Meurer. Absent: None. There not being a tie vote, Mayor Stanek cast a Nay vote and declared the motion did not carry. Motion by Nolan, seconded by Pepping, to allow one of the concerned residents to address the Council. Voting Aye: Pepping, Nolan, Harker, Datz, Schooley, Meurer. Voting Nay: Wieser, Adams. Absent: None. " " " Motion carried. Richard Golbeck of 3719 W. Young Street, addressed the Council and spoke on behalf of the Concerned Citizens of McHenry. His concern was the 12 acre parcel along Route 31 which was proposed as Light Commercial on Land Use Plan 2000. He suggested that the 12 acres be left as a residential district or that it be restricted for use as professional offices only. Golbeck stated that according to his attorney, the Appelate Court recently handed down a ruling that the 12 acres along Route 31 must remain as a residential district and if the City tried to change that classification, it would run into legal difficulties. Motion by Schooley, seconded by Wieser, to eliminate all Light Commer- cial classifications on the entire proposed Land Use Plan 2000 and substitute regular Commercial Classification in its place. Voting Aye: Harker, Datz, Wieser, Adams, Schooley. Voting Nay: Pepping, Nolan, Meurer. Motion carried. Motion by Schooley, seconded by Wieser, to accept the Land Use Plan 2000 as presented with elimination of the Light Commercial classification and its substitution with regular Commercial classification. The meeting reconvened at 9:34 P.M. with everyone still in attendance. Motion by Wieser, seconded by Harker, to approve the McHenry Planning Comprehen WorkBook on the Comprehensive Plan as presented by Associated Planners with s ive Plan the deletion of the Light Commercial District. Voting Aye: Harker, Datz, Wieser, Adams, Schooley. Voting Nay: Pepping, Nolan, Meurer, Stanek. Absent: None. Motion carried. Motion by Schooley, seconded by Adams, to authorize and approve a House Moving House moving permit for transfer of the house from 3512 W. Pearl Street to Permit a triangular lot at 3510 Washington Street. Voting Aye: Harker, Datz, Wieser, Adams, Schooley, Pepping, Nolan, Meurer. Voting Nay: None. Absent: None. Motion carried. Motion by Pepping, seconded by Harker, to pass a resolution authori-zing Lease,' Agreel the mayor and clerk to enter into a 4-year "Lease to Purchase Agreement" with me nt Agreemeni� Bruce Equipment for purchase of an Elgin Dual Vacuum Street Sweeper. Monday, March16, 1981 Page 4 Motion by Nolan, seconded by Meurer, to authorize and approve the Park Purchases purchase of a concession wagon for the Park Department from Adams Enterprises of McHenry at a cost of $5,263.40 and to advertise for bids on concession equipment for the Park Department. Voting Aye: Harker, Datz, Adams, Schooley, Pepping, Nolan,Meurer. Voting Nay: Wieser. Absent: None. Motion carried. Mayor Stanek read a letter of resignation from Mrs. Betty (Lester) Resigna- ti on Smith /asdsirector of the Emergency Services and Disaster Agency for the City of McHenry. He expressed gratitude to her on behalf of all the citizens of McHenry for her dedication to that job during her years of service.
