The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, March 4, 1987 at 7:30 P.M. P.M. at City Hall. At roll call the following Aldermen were present: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Absent: Council None. City staff in attendance were Supt. Batt, Attorney Narusis, Clerk Meeting Gilpin, Chief Joyce. Park Director Merkel arrived at 9:30 P.M. Attendance Mayor Busse called to order a Public Hearing at 7:35 P.M. for the purpose of discussion on vacating a portion of Brookwood Trail, a public dedicated roadway in Winding Creek Unit II. Roger Gerstad of Gerstad Hearings Builders was present to answer any questions of the Council or members of the audience. There were no comments, written or oral, from the audience Winding or that had been presented to the City Clerk's Office prior to the hear- Creek ing. Superintendent Batt suggested that an ordinance to vacate this property be voted on at the same time the final plat for Winding Creek Unit 4 is presented. The final plat will be presented to the City Council for approval at the April 1, 1987 meeting. There being no fur- ther comments on this matter, Mayor Busse adjourned the hearing at 7:38 P.M. Motion by Lieder, seconded by Nolan, to accept the minutes of the February 11, 1987 Regular Meeting and the February 18, 1987 Regular fleeting as presented. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Mayor Busse presented Landmark Plaque No. 4 for the Harrison Smith Home at 3804 W. Main Street which had been restored by the William Thomas Family. Nancy Fike, Chairman of the Landmark Commission, was pre- sent to explain the significance of this landmark home whose historic Landmark background was investigated by the McHenry Landmark Commission. Commission Mayor Busse presented developer donation checks for $21,200 to Robert Swartzloff, Superintendent of School District 156 and to Bill Landis, Business Manager of School District 15; also a developer donation check for 310,600 to Public Library Board President Richard Doherty. This money had been collected by the City during the past year as part of the Developer Donation Ordinance enacted by the McHenry City Council several years ago. A check for $300 was also given to Nancy Fike, Curator of the McHenry County Historical Society, which had been allocated from the City's Revenue Sharing Fund for the 1986-87 fiscal year. Richard Doherty, President of the McHenry Public Library, and Gary Schaefer, member of the McHenry Public Library Board, addressed the Council to request approval to convert the existing City Public Libary to a Public Library District. Motion by Lieder, seconded by Serritella and Bolger, to approve the Library Board's request to convert the existing City Public Library to a Public Library District. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Teta, seconded by Nolan, to concur with the recom- mendation of the Zoning Board of Appeals and pass an ordinance granting a zoning reclassification from RM-1 to RS-2 as requested by petitioners, Mount Prospect State Bank as Trustee under Trust No. 449, Thomas Origer, Leah R. Light, Fremont Backhaus and Irene Brackmann. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Developer Donations Revenue Sharing Library Ordinance Zoning Ords. Wednesday, March 4, 1987 page 2 Letters Motion by McClatchey, seconded by Snell, to concur with the of Credit recommendation of Baxter & Woodman and authorize a reduction in the Letter of Credit for McHenry Lakes Estates Unit II from $151,450 to $41 ,100 as requested by Don Gerstad of Gerstad Ruilders. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Sign Motion by Smith, seconded by Snell, to approve the request of Permits & Jack Hetu of Baird and Warner to permit the installation of three signs Variations at the follrnuing locations: Knox Park and Route 31, High Street and Route 31 and Bull Valley Road and Route 31, for a time period of one year. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Ordinances Motion by Teta, seconded by Nolan, to pass an ordinance amending the Municipal Code regarding various sections of the Building Code as Bldg. & presented. Zng. Misc. Motion by Nolan, seconded by Teta, to concur with the recom- mendation of the Zoning Board of Appeals and pass an ordinance granting Zoning the request of Shepherd of the Hills Lutheran Church for a conditional use permit to allow the construction of an addition to the church building at the northeast corner of the present building. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Snell, to pass an ordinance in - Ordinance creasing the number of Class "A" liquor licenses from 18 to 19 with the additional license to be granted to the Main Street Station on or about Liquor Lic. May 15, 1987. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Bolger, seconded by Nolan, to authorize the City Auth. Attorney to draft an agreement with the Chicago Northwestern Railroad to Easements obtain a 4,000' x 10' easement on rail road right-of-way property north of the CNWRR depot. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Mayor Busse informed the Council he would respond to a letter Easements from engineers for the K-mart shopping center regarding vacation of a 5 foot public and municipal utility easement which runs along the common boundaries ofLlot 1 and 2 in Riverside Terrace Subdivision Phase I. Mayor Busse called for a recess at 8:45 P.M. The meeting reconvened at 8:57 P.M. with everyone still in attendance. Wednesday, Ilarch 4, 1987 page 3 Mayor Busse announced that following the meeting with the EDC and the Chamber it appeared that neither of those organizations were interested in participating with the City for funding of July 4th fire- works this year. Therefore no funds would be committed in this year's budget for a fireworks display. Alderman Snell stated he would still like to see the fireworks program continued. Alderman Teta, Chairman of the Building & Zoning Committee, reported that the Committee had studied the request of the McHenry Town- ship Fire Protection District for waiver of fees associated with the con- struction of a new fire station at Elm and Richmond Road. Fees totaled $21,720. It was the recommendation of the Building & Zoning Committee to wait until firm plans came in for the new building and then to consider waiving the fees at a percent of 0 to 50 percent but in no way more than a 50 percent reduction since much of the fire protection district boundaries are outside of city limits. No action was taken at this time. Motion by Nolan, seconded by Bolger, to pass an ordinance amend- ing the building code to waive the 75 percent brick masonry requirement for multi -family dwelling where four units or less were built in one dwelling unit. Motion by Snell, seconded by Nolan, to pass an ordinance deleting the requirement that subdivision plat show the number of degrees and minutes in all exterior boundary and block angles. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Snell , seconded by Smith, to approve the purchase of two overhead doors at the Public Works garage at a cost of $4,525. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Lieder, seconded by Snell, to authorize and approve the purchase of two steel entrance doors and frames at the Public Works Garage at a price of $2,365. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Snell, seconded by Bolger, to authorize and approve the purchase of one new two-way radio from Radicom for installation in the skyjacker truck at an approximate cost of $700. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Teta, to authorize and approve the purchase of a Xerox Copy Machine with stand at a cost of $4,555.60. Motion by McClatchey, seconded by Smith, to raise the minimum fine for handicap parking violations from $20 to $50 including settlement fine. Page 4 to authorize the Motion by Bolger, seconded by Nolan, to call back on the table a motion which was tabled at the last meeting regarding fees for liquor licenses. Voting Aye: Bolger, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: Lieder. Absent: None. Motion carried. The orginial motion which was brought back on the table was as follows "Motion by Bolger, seconded by Snell, to authorize the City Attorney to draft an ordinance giving relief to those who apply for liquor licenses during the year as follows: six months or over - applicant pays full fee; three months to 6 months - applicant pays 50 percent of total fee; one day to three months - applicant pays 25 percent of total fee." Motion by Smith, seconded by Serritella, to amend the motion to read that liquor licenses be issued in increments of 6 months instead of annually. Voting on the amendment: Voting Aye: Serritella, Smith, Teta. Voitng Nay: Snell, McClatchey, Lieder, Bolger, Nolan. Failed Absent: None. Motions Motion did not pass. Voting on the orginal motion. Motion by McClatchey to create a special license in the Class "A" liquor category for a specific period of time such as a 30 day license for $75.00. Following discussion McClatchey withdrew his motion. Motion by Smith to establ ish a half year 1 iquor license. Fol - lowing discussion Smith withdrew his motion. Liquor Licenses Alderman Bolger made a motion to direct the Mayor to consider issuing a temporary license when an applicant comes in. The Mayor stated he would do this anyway and so Bolger withdrew his motion. Authorizations. Motion by Bolger, seconded by Nolan, to authorize the Super- intendent of Public Works to work with the postal authorities and establish a location in the Green Street Parking Lot for installation of a drivers -side, drive -up, drop -in mailbox for the postal department. Wednesday, March 4, 1987 page 5 Motion by Lieder, seconded by McClatchey, to make adjustments in the salary of the following persons: Jon Schmitt from Grade 4A, Step 2.75 to Grade 6A, Step 2.75 effective February 20, 1987 and Dan Duffy Employees from Grade 4A, Step 1 to Grade 5A, Step 1 effective March 6, 1987 to reflect their promotions for receipt of Class Licenses for the Water and Sewer Department.
