HomeMy WebLinkAboutMinutes - 02/25/1988 - City CouncilSPECIAL MEETING THURSDAY, FEBRUARY 25, 1988 The Special Meeting of the McHenry City Council was called to Council order by Mayor Busse on Thursday, February 25, 1988 at 8 P.M. at City Meeting Hall. At roll call the following Aldermen were present: Bolger, Nolan, Attendance Lied er, Teta, Smith, Patterson, Serritella. Absent: McClatchey. City staff in attendance were Attorney Narusis„ Clerk Gilpin, Building and Special Mtg. Zoning Officer Zabor. Annexations The purpose of the Special Meeting was to continue discussion on requests of McHenry Sand and Gravel for 1) extension of the existing annexation agreement on 125 acres of land known as McHenry Sand and Gravel West Pit; 2) proposed annexation agreement for annexation of 253 acres and; 3) amendment to the Woodcreek annexation agreement concerning 139 acres of lard . Allen Miller, president of McHenry Sand and Gravel, and his Attorney Tom Rausch were in attendance to discuss the various annexation agreements. This meeting was recessed from February 11, 1988. At that meeting the proposed annexation agreement for annexation of 253 new acres into the City was discussed.. The first matter to be brought up was the annexation fees. At the conclusion of the last meeting, Mayor Busse was instructed to meet with the petitioners and come back with a proposal for a annexation fee schedule. Mayor Busse announced that the following fee schedule had been developed between the petitioners and himself: 2 cents per ton for the first five years (60 months); 2.5 cents per ton for years five through nine inclusive; 3 cents a ton for years 10 through 14 inclusive; 4 cents a ton for years 15 through 19 inclusive; after 20 years the annexation fee will increase 1 cent per ton every five years until mining is completed. If the gravel pit has a life of 30 years it would result in payments to the City of $2,250,000. Motion by Lieder, seconded by Patterson, to authorize the Annexations Attorneys to include the annexation fee schedule per ton as presented into the annexation agreement. Voting Aye: Bolger, Nolan, Lieder, Teta, Smith, Patterson, Serritella. Voting Nay: None. Absent: McClatchey. Motion carried. Discussion was held on the agreement which had been made between the Pd Hoc Committee for Wood creek/Glacier Ridge property owners and McHenry Sand and Gravel. McHenry Sand and Gravel agreed to convey to Wood creek/Glacier Ridge property owners approximately 23 acres of wooded and open space land which would serve as the buffer zone. McHenry Sand and Gravel also would offer the rights to the lakeside property after the completion of a lake near the buffer zone. It was the opinion of some All ennen that this land should either be conveyed to the City, or McHenry Sand and Gravel should keep that property. Motion by Patterson, seconded by Teta, to allow the property owners associationsof Woodcreek and Glacier Ridge to accept the 200 foot buffer property running the length of the property as well as the 10 acres of Eppel Woods for a total of 23 acres and to accept the rights to the lakeside property within nine months after the completion of the lake which would be determined by mining operations and that in the event either Woodcreek or Glacier Ridge Property Owners Association should fail, conveyance of the title would automatically go to the City of McHenry and be available for recreational use. Voting Aye: Bolger, Nolan, Teta, L.ieder, Patterson. Voting Nay: Smith, Serritella. Absent: McClatchey. Motion carried. It was a consensus of opinion that standards for operations as outlined in the City of McHenry Zoning Ordinance pages 333 - 336 should be incorporated into the annexation agreement and frozen for the life of the gravel operation for this proposal. Mayor Busse called for a recess at 9:20 P.M. The meeting reconvened at 9:33 P.M. with everyone still in attendance. Annexations Thursday, February 25, 1988 Pagc 2 Discussion was then held on extension of the existing annexation agreement and the amendment to the Woodcreek annexation agreement. Many of the items outlined in the annexation agreement for the 253 acres of new land into the City were also incorporated into the other two annexation agreements. Following review of the remaining two annexation agreements, the attorneys were instructed to draft all of the provisions as discussed at the last two meetings into the revised annexation agreements and present them to the City Council at a later date for final approval. Motion by Smith, seconded by Patterson, to adjourn. Voting Aye: Bolger, Nolan, Lieder, Teta, Smith, Patterson, Serritella. Voting Nay: None. Absent: McClatchey. Motion carried.
