The Regular Meeting of the McHenry City Council was called to order Council by Mayor Stanek on Monday, February 20, 1984 at 7:30 P.M. in city hall. At meeting roll call the following aldermen were present: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Absent: None. City staff in attend- ance were Supt. Halvensleben, Attorney Narusis, Clerk Gilpin, Chief Pasenelli, Park Director Merkel. Motion by McClatchey, seconded by Nolan, to accept the minutes of the February 6, 1984 Regular Meeting as presented with one correction. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Robert Sargis addressed the Council and requested a variation on the location of his driveway in Woodcreek Subdivision Block 1, Unit 1. On variations the recorded plat of the subdivision there is a notation stating that no driveway from the subdivision should exit onto Draper Road. Building Inspect- or Richard Rosing surveyed the site and found no problem with the variation request. Also Thomas Harding of Harding Real Estate, developers of Woodcreek, also submitted a letter stating they had no objections to permitting this driveway exit. Motion by Bolger, seconded by Datz, to approve the variation request of Robert J. Sargis and authorize the building inspector to apply the variation to his building permit. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Attorney Jay Ward of Chapman & Cutler addressed the Council concern- ing the first amendment to preliminary bond resolution of Chroma Corporation Indust - concerning an increase in their original Industrial Revenue Bond request. ria 1 Chroma's original request was to cover expansion of their existing plant. Be- cause a fire recently destroyed almost all of their facilities they were request- Revenue ing an increase in the original Industrial Revenue Bond request from $1,000,000 Bonds to $2,600,000 in order to enable them to rebuild, expand and replace their damaged facility and equipment. Motion by Datz, seconded by Nolan, to pass a resolution approving the first amendment to the preliminary bond resolution for Chroma Corporation Resolutions in the amount of $2,600,000. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Bolger, to concur with the recommenda- ZBA & tion of the Zoning Board and pass an ordinance granting a variation on the Zoning "B-3" zoning requested by Alexander Lumber Co. for property located adjacent Ordinance and north of their existing property. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. The McHenry Public Library submitted a request for a monthly credit Library on their telephone bills of $67.02 from the City of McHenry's franchise credit allowance. Motion by Busse, seconded by Nolan, to deny the Library's request for issuance of a $67.02 monthly credit on their telephone bill. Voting Aye: Bolger, Nolan, Busse, Datz, Smith, Snell, Serritella. Motion by Smith, seconded by Snell, to authorize the payment of Repairs, etc. $700 to Illinois Hydraulic Construction Co. for installation of a new door at the Sewer Plant. Water Line Motion by Bolger, seconded by Datz, to accept the proposal made by Repairs, Iry Coppel for Hillcrest Apartments that he would pay immediately for 1/3 Improvements of the costs of looping the watermain from Orleans St. along McCullom Lake Road along Route 31. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Committees Mayor Stanek appointed a special committee to study the question of Auth, etc. & mosquito control for the City of McHenry in 1984 with the following aldermen Mosquito to serve on that committee: Chairman, Datz; committee members Aldermen Busse Abatement and Nolan. Chicago & N.W. Mayor Stanek announced that four companies had responded to a request & Parking Reg. for a proposal on design and construction inspection for commuter parking & Lots lot improvements for the City of McHenry parking lot at the Chicago North- western Train Depot. They were Baxter & Woodman, Hampton Lenzini & Renwick, Donahue and Associates and Richard Miller and Associates. Motion by Smith, seconded by Nolan, to select the firm of Baxter & Woodman to do the professional engineering services on the commuter parking lot improvements to be financed 100 percent for engineering and construction by an Illinois Department of Transportation Grant and to submit a letter to the IDOT Project Manager seeking their concurrence on our selection. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Serritella. Voting Nay: Snell. Absent: None. Motion carried. Police Dept. Motion by McClatchey, seconded by Snell, to send a letter to Triple A Misc. Security Alarm Co. which has alarm boards at the McHenry Police Department and inform them that before any additional alarms can be added on those boards approval must be received from the McHenry City Council. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Purchases Motion by Snell, seconded by Datz, to authorize and approve the Water Dept. payment of $9,530.00 to Sunnyside Co. for purchase of a 1984 Dodge Van for the Water Department with payment to be made from the Water Department Funds. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Pub. Property Motion by Smith, seconded by Bolger, to authorize and approve payment Purchases to Wm. Tonyan & Sons in the amount of $5,480.00 for completion of the Petersen Repairs Park Concession stand and to retain $2,104.00 until the exterior painting is complete. Motion by Busse, seconded by Snell, to authorize and approvement payment to School District 15 in the amount of $31,700.00, to School District 156 in the amount of $31,700.00 and to the McHenry Public Library in the amount of $16,775.00 as their portion of Developer Donation Fees collected by the City as of January 31, 1984. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Mayor Stanek recessed the meeting at 9:32 P.M. The meeting reconvened at 9:45 P.M. with everyone still in attendance. Motion by Snell, seconded by Datz, to go into Executive Session at 9:45 P.M. to discuss pending litigation and personnel. Voting Aye: Datz, Nolan, Busse, Snell, McClatchey, Smith, Bolger, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Snell, seconded by Smith, to go back into open session at 10:48 P.M. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Snell, seconded by Busse, to authorize the City Attorney to file an intervening petition in connection with the rate increase requested from the ICC by the Lakeland Park Water Co. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Bolger, to authorize and approve the hiring of an appraiser to obtain appraisals for two city owned lots in Orchard Heights and one city owned lot adjacent to Royal Terrace property in Whispering Oaks Subdivision. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Bolger, seconded by Busse, to authorize and approve using Baxter & Woodman Services for estimates on water tower tank sizes for use in a grant application to DCCA. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Bolger, seconded by Snell, to set a Public Hearing on March 19, 1984 at 7:15 P.M. for the purpose of notifying the public that the City of McHenry attends to make application for grant funds pursuant to the Illinois Community Development Assistance program for funds to construct a water tower.
