The Regular Meeting of the City Council was called to order on Wednesday, February 20, 1980 at 8:07 P.M. The meeting was rescheduled from Monday to Wednesday because Washington's Birthday, a federal legal holiday, fell on Monday. At roll call the following aldermen were present: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer. Absent: Nolan. Motion by Datz, seconded by Harker, to accept the minutes of the February 4, 1980 Regular Meeting as read. Voting Aye: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: Nolan. Motion carried. Mayor Stanek read a letter dated February 11, 1980 which was addressed to and sent to each alderman in which Stanek gave formal notification that he was vetoing the action taken at the February 4, 1980 Council Meeting re- garding the Non -Moving Violation and Vehicle Tag Violation Fee Structures. A copy of the letter is attached to the minutes of this meeting. Stanek proposed five revisions of the Non -Moving Violation structure and seven revisions of the Vehicle Tax Violation schedule. Motion by Wieser, seconded by Meurer, to over -ride the Mayor's veto of the Non -Moving Violation and Vehicle Tag Violation Fee structures. Motion by Pepping, ;seconded by Schooley, to table the over -ride of the veto motion. Voting Aye: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: Nolan. Motion carried. Attorney James Green representing Residential Development Group, Inc. requested that the Zoning Board of Appeals recommendation regarding RDG's petition concerning the golf course property in the Whispering Oaks Planned Unit Development be brought before a special meeting of the Council. Wednesday, February 20, 1980 Page 2 He indicated the petitioners wished to present evidence with regard to a school site and access roads to the property in question. It was the consensus of opinion of the Council that such a request would not be feasible. Green then announced that he was withdrawing the RDG petition prior to any action being taken 'by the Council. City Attorney Narusis informed the Council that he would investigate the matter and report back at the next meeting as to whether or not Green had the right to withdraw the petition. It was his feeling that it was legally right and permissible to do so. Steve Luster of St. Regis Tavern addressed the Council as spokesman for the tavern owners of the City of McHenry. It was their contention that the increase in liquor license fees passed at the February 4, 1980 meeting were excessive. Motion by Wieser, seconded by Pepping, to send the liquor license fee matter back to the License Committee for review. Voting Aye: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: Nolan. Motion carried. Gary Sinclar of Clark Outdoor Spraying Co. addressed the Council regarding mosquito abatement. He presented a two-year contract for mosquito control and explained that an additional program was now available for blanket aerial applications. Motion by Pepping, seconded by Harker, to enter into a two-year con- tract with Clark Outdoor Spraying for mosquito control within the City of McHenry for the 1980 and 1981 seasons with a contingency for aerial mosquito applications. Voting Aye: Pepping, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: Nolan. Motion carried. Wednesday, February 20, 1980 Page 3 Discussion was held on purchase of a lot on Green Street next to and south of the McHenry Theatre with the following dimensions: 61 feet to the West on Green Street, 129 feet to the north along the theatre, 119 feet to the south along the creek and 40 feet to the east on the rear side. Mrs. Chuck (Lillian) Coles is the owner of the property and was asking $10,000 for the land. Motion by Schooley, seconded by Datz, to enter into a real estate contract with Mrs. Lillian Coles for purchase of the Green Street lot along Boone Creek at a cost of $10,000.00. Voting Aye: Pepping, Harker, Datz, Schooley, Meurer. Voting Nay: Wieser, Adams. Absent: Nolan. Motion carried. Motion by Harker, seconded by Datz, to accept the recommendation of Baxter & Woodman and reduce the Construction Performance Bond for Winding Creek Subdivision Units 1 and 2 from $653,609.00 to $359,109.00. Voting Aye: Pepping, Harker, Datz, Schooley, Meurer, Wieser, Adams. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Wieser, seconded by Adams, to remove the proposed Pearl Street project from the FAU (Federal Aid Urban) projects list as previously outlined by Herbert Renwick of Hampton, Lenzint and Renwick. Motion by Harker, seconded by Schooley, to pay Keno & Sons Con- struction Company Payment Estimate No. 3 in the amount of $132,945.30 as recommended by Baxter & Woodman with payment to be made upon receipt of required waivers of lien. Motion by Datz, seconded by Pepping, to authorize the annual con- tribution to NIPC (Northeastern Illinois Planning Commission) in the amount of $466.00 to be paid during the 1980-81 fiscal year. The meeting reconvened at 10:25 P'.M. with all aldermen still in attendance. Motion by Schooley, seconded by Meurer, to authorize the Mayor to send a letter to the McHenry County Zoning Board of Appeals concerning a petition by Walter & John Fritsch for reclassification of land along the proposed Route 420 freeway corridor at the intersection of Cuhlman and Lincoln Roads. It was the consensus of opinion that the County Zoning Board be informed that major consideration should be given to any project which might impair construction of the 420 highway. Voting Aye: Pepping, Harker, Datz, Schooley, Meurer, Wieser, Adams. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Datz, seconded by Wieser, to enter into a contract with Chain O'Lakes Tile Company of Ingleside, to remodel the front entryway of city hall by installing quarry tile at an approximate cost of $1,794.00. Voting Aye: Pepping, Harker, Datz, Schooley, Meurer, Wieser, Adams. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Pepping, seconded by Harker, to transfer $250,000.00 from the Municipal Equity Fund Balance of the General Fund to a Reserve for Authorized Expenditures Account in the Municipal Equity category for capital outlay expenditures as recommended by our auditors, Lester, Witte Company. Motion by Meurer, seconded by Wieser, to advertise for bids for two trucks for the Public Works department as follows: a 1980 one ton 4 by 4 truck and a one-half ton pickup truck. Voting Aye: Pepping, Harker, Datz, Schooley, Meurer, Wieser, Adams. Voting Nay: None. Absent: Nolan. Motion carried. As outlined by the CTEP Grant recently awarded to the McHenry Police Department, Chief Pasenelli obtained bids for a squad car from three firms: 1980 Chevy Impala from Payton Chevrolet - $7,562.07; 1980 Marquis from Aaron Lincoln-Mercury - $7,664.16; 1980 Buick La Sabre from Mitchell Buick - $7,500.00. Motion by Adams, seconded by Pepping, to authorize the purchase of a 1980 Buick LaSabre from Mitchell Buick at the low quote price of $7,500.00 with $6,200.00 to be paid by the CTEP Grant and the balance from the General Fund of the City of McHenry.
