WEDNESDAY, FEBRUARY 10, 1988 8:00 P.M.
The Regular Meeting of the McHenry City Council was called to
order by Mayor Busse on Wednesday, February 10, 1988 at 8 P.M. at City
Hall. At roll call the following Aldermen were present: Bolger, Nolan, Council
Lieder, Teta, McClatchey, Patterson, Serritella. Absent: Smith. City Meeting
staff in attendance were Supt. Batt, Attorney Narusis, Clerk Gilpin, Park Attendance
Director Merkel, Chief Joyce, Finance and Personnel Administrator Vitas.
Motion by McClatchey, seconded by Nolan, to accept the minutes
of the February 3, 1988 Regular Meeting as presented.
Voting Aye: Bolger, Nolan, Lieder, Teta, McClatchey,
Patterson, Serritella.
Voting Nay: None.
Absent: Smith

Nancy Fike, Chairman of the Landmark Commission, presented
Landmark Plaque No. 9 to James and Mary Cavanaugh of 3715 W. Waukegan
Road. The gable end of the hone that faces Waukegan Road was built about Landmark
1855 by George Gage and was one of the earlier hones built in West Commission
McHenry. The most famous resident of the home was Samantha Mc Cullom
Button, a daughter of Wi l li an McCul l on, one of the original settlers of
the area. She was the oldest surviving Civil War mother in the country
and lived to be 102 years of age. Mayor Busse congratulated the
Cavanaughs and commended then for the restoration work that they are
doing on this landmark homesite.

Busse appointed Tom Fleming, of 4318 Sioux Lane, to be the
Service and Disaster Agency Director for the City of Appointments

Motion by Teta, seconded by Nolan, to confirm the Mayor's
appointment of Tan Fleming as ESDA Director for the City of McHenry.
Voting Aye: Bolger, Nolan, Lieder, Teta, McClatchey,
Patterson, Serritella.

Attorney Phil Grossman addressed the Council concerning a map
amendment and rezoning of the land known as Riverside Terrace comprising
approximately 21 vacant acres bounded on the east by Riverside Drive on
the north by McCullan Lake Road and by Route 31 on the west. They are
seeking reclassification from RS-2 to RA-1. The Zoning Board of Appeals
conducted a hearing on January 18, 1988 and by a vote of 4 to 1 the
Zoning Board recommended approval of the zoning reclassification. There
were nunerous objectors present at this City Council Meeting who were
opposed to the extension of Court Street into the new proposed
subdivision.
Motion by Patterson, seconded by Bolger, to concur with the 'ening Ords.
Zoning Board of Appeals recommendation and, pass an ordinance granting `
the petitioner's request to amend the zoning classification on the Ordinances
subject property from RS-2 to RA-1 and to approve the request for the map
amendment as presented conditioned upon the following: 1) that Court
street not be made a thru street from Washington Street to McCullom Lake
Road, that a right-of-way be maintained and, a culdesac be constructed on
the property in question in case the City might want to extend Court
Street at a future date and 2) that the water retention and drainage
problems be thoroughly addressed.

Patterson, Serritella.

Motion carried.
Brian Cunat of Cunat Brothers addressed the Council concerning
his request that a variation be granted for his property located at the
southwest corner of the intersection of McCulloo Lake Road and Orleans
Street allowing the construction of not more than nine (9) buildings
containing 207 total units. The Zoning Board of Appeals conducted a
hearing on February 1, 1988 and by a vote of 7 to 0 recommended approval
of Cunat's recommendations.
Motion by Bolger, seconded by Nolan, to concur with the Zoning Zoning Ords.
Board of Appeals recommendation and pass an ordinance granting a Ordinances
variation to allow the construction of not more than nine (9) buildings
containing 207 units on the property in question subject to the following
restri cti ons:

(a) The implenentation of the detention basin plan dated July 24,
1986, a copy having been filed with the City and previously
approved by the City in the Zoning Variation granted in
Ordinance No. 0-86-395, passed and approved August 20, 1986.
(b ) The construction of the detention basin in accordance with the
plan shall commence concurrently with the construction of the
first building on the subiect property and shall be
functionally conplete prior to the issuance of the building
permit on the second building for the subject property.
(c) There shall be a prohibition of motor vehicle parking in the
area designated as detention on the attached engineering plan.
(d) There shall be a building setback line of at least two hundred
(200) feet from that part of the Southern property line of the
subiect property which abuts property currently zoned
Single -Family Residential.

Audit Motion by Lieder, seconded by Patterson, to approve the format
for audit proposal requests for fiscal year 1987-88 as presented.
Voting Aye: Bolger, Nolan, Lieder, Teta, McClatchey,
Patterson, Serritella.
Voting Nay: None.
Absent: Smith
Motion carried.
Motion by McClatchey, seconded by Serritella, to pass the annual
Resolutions Resolution for maintenance on state highways as presented.
Voting Aye: Bolger, Nolan, Lieder, Teta, McClatchey,
Patterson, Serritella.
Voting Nay: None.
Absent: Smith
Motion carried.
Ordinances Motion by Nolan, seconded by Bolger, to pass an ordinance
establishing 25 mph speed limits in various areas of the City as
presented.
Voting Aye: Bolger, Nolan, Lieder, Teta, McClatchey,
Patterson, Serritella.
Voting Nay: None.
Absent: Snith

Tag Days Motion by Nolan, seconded by Lieder, to approve the National
Organization Tag Day requests as presented.

reconvened at 9:35 P.M. with everyone still in attendance.
Purchases- Motion by Lieder, seconded by Patterson, to approve the proposal
Police Dept, for replacement of three squad cars for fiscal year 1988-89 at ar
approximate total cost of $35,856.81.
Voting Aye: Bolger, Nolan, Lieder, Teta, McClatchey,
Patterson, Serritella.
Voting Nay: None.
Absent: Smith
Motion carried.
Resolutions Motion by Patterson, seconded by Nolan, to pass a Resolution
renaming the Decker Property north of Bull Valley Road to South
Parks Riverfront Park and also to authorize the City to apply for an Illinois
Grants Department of Conservation Boat Access Area Grant to be financed from
Marine Motor Fuel Tax Revenues.
Voting Aye: Bolger, Nolan, Lieder, Teta, McClatchey,
Patterson, Serritella.
Voting Nay: None.
Absent: Smith
Motion carried.
Motion by Patterson, seconded by McClatchey, to approve the
Parks -Fees recommendation of the Park Committee and establish a daily boat launch
fee of $8 for the proposed new City boat access area at South Riverfront
Park.

recommendation of the Park Committee and pursue discussions with the Parks -Fees
McHenry High School District for installation of lighting at the West
Campus tennis courts.

Patterson, Serritella.
