MONDAY, FEBRUARY 4, 1980 8 P.M.
The regular meeting of the City Council was held on Monday,
February 4, 1980. The meeting was called to order by Mayor Stanek.
At roll call the following aldermen were present: Meurer, Schooley,
Adams, Wieser, Datz, Harker, Nolan, Pepping. Absent: None.
Motion by Adams, seconded by Harker, to accept the minutes
of the January 21, 1980 Regular Meeting and of the January 24, 1980
Special Meeting as read with one correction.
Voting Aye: Meurer, Schooley, Adams, Wieser, Datz, Harker,
Nolan, Pepping.
Voting Nay: None.
Absent: None.
Motion carried.
Attorney James Bishop, representing Peter Tutera who petitioned
the city for a zoning reclassification to allow the conversion of an
apartment building at 3705 W. James Street into a condominium. complex,
addressed the Council and presented an Ordinance. Discussion was held
on the Zoning Board of Appeals recommendation which was presented to each
alderman and read by the Mayor.
Motion by Wieser, seconded by Adams, to concur with the Zoning
Board of Appeals recommendation and deny the request of Peter Tutera for
condominium conversion of an apartment building at 3705 W. James Street.
Voting Aye: Meurer, Schooley, Adams, Wieser, Datz.
Voting Nay: Harker, Nolan, Pepping.
Absent: None.
Motion carried.
Herbert Renwick of the engineering firm of Hampton, Lenzini
and Renwick, Inc. explained three FAU (Federal Aid Projects) which he
had been requested to estimate. He presented estimates for Pearl Street,
Meadow Lane and Main Street. After lengthy discussion, it was decided
to proceed with improvement of Main Street from Borden Street west to
Crystal Lake Road and with improvement of Meadow Lane from Elm Street
north to Shore Drive. The Pearl Street proposal was tabled until the
next meeting.

Motion by Harker, seconded by Schooley, to authorize Hampton,
Lenzini and Renwick, Inc. to prepare engineering reports for FAU projects
on Meadow Lane and Main Street as outlined in Renwick's presentation.

Nolan, Pepping.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Pepping, seconded by Harker, to authorize and
approve payment of $7,500.00 from the Public Benefit Fund to the
Lakeland Park Special Assessment Account as the city's annual share
t of the! ten-year program.
Voting Aye: Meurer, Schooley, Adams, Wieser, Datz, Harker,
Nolan, Pepping.
Voting Nay: None.
Absent: None.
Motion. carried.
The Mayor declared a recess at 9:38 P.M. The meeting was
reconvened at 9:451 P.M. with all aldermen still in attendance.
Motion by Wieser, seconded by Datz, to authorize and approve
the following solicitation requests: April 20, March .of Dimes marathon;
June 6, Salvation Army Donut Day and February 15-27, Girl Scout Cookie
Door -to -Door sales.
Voting Aye: Meurer, Schooley, Adams, Wieser, Datz, Harker,
Nolan, Pepping.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Wieser, seconded by Adams, to pass a Garage Sale
ordinance as recommended by the License Committee.

Motion by Wieser, seconded by Schooley, to change the annual
Liquor License Fees as follows: Class A & F from $700 to $1,100; Class
G from $450 to $700; Class H from $350 to $550 and Class B from $200
to $325.
Motion by Harker, seconded by Nolan, to amend the above
motion to charge $1,000 for Class A & F Liquor Licenses instead of
$1,100.

Motion by Pepping, seconded by Wieser, to raise the! floor on
the fines for Traffic Fine Violations from $5 to $30. (Section 13-1901
(a) in Motor Vehicle Ord. #MC-78-141).

Motion by Harker, seconded by Nolan, to retain the present
Vehicle Sticker Fee Schedule with no increases.

Voting Nay: Meurer, Schooley, Adams, Wieser.
Absent: None.
There being a tie vote, Mayor Stanek cast an AYE vote and declared the
motion carried.
Motion by Wieser, seconded by Adams, to pass an ordinance
establishing parking zones for Handicapped Parking on city streets
and to authorize the City Clerk to issue stickers, at no cost, for
temporarily and permanently handicapped persons to park in the Handi-
capped Parking Zones.
Voting Aye: Datz, Harker, Nolan, Pepping, Meurer, Schooley,
Adams, Wieser.

Absent: None.

Motion by Wieser, seconded by Schooley, to approve the erection
of a sign at the entrance to Winding Creek Subdivision on Crystal Lake
Road with supervision by the Supt. of Public Works.
Voting Aye: Meurer, Schooley, Adams, Wieser, Datz,, Harker,
Nolan, Pepping.
Voting Nay: None.,
Absent: None.
Motion carried.
Motion by Harker, seconded by Nolan, to approve the! request
of the Johnsburg Rescue to have their calls answered,'at no charge,
through the Police Department communication desk until such time as the
City of McHenry decides otherwise.

Nolan, Pepping.
Voting Nay: None.,
Absent: None.
Motion carried.
Motion by Adams, seconded by Schooley, to authorize payment
of $50 per man for police department personnel who wished to volunteer
to attend the EMT (Emergency Medical Training) program at McHenry
Hospital with payment to be made upon satisfactory completion of the
course.
Voting Aye: Meurer, Schooley, Adams, Wieser, Datz, Harker,
Nolan, Pepping.

Police Chief Pasenelli explained in detail the $106,000
CTEP (Comprehensive Traffic Enforcement Program) Grant which had been
awarded the city through ID(Yr (Illinois Department of Transportation).

Motion by Harker, seconded by Adams, to approve participation
in the Grant and authorize the Mayor and other city officials to sign
the Grant and to authorize the hiring of two new policemen and one
dispatcher.

Nolan, Pepping.

Absent: None.
Motion carried.
Mayor Stanek proclaimed March as American Red Cross Month.
It was the concensus of opinion that the Mayor should send
a letter to the McHenry County Zoning Board of Appeals stating that the
City of McHenry had no objection to the pending zoning request of the
McHenry County Association for the Retarded for a housing development
for the developmentally disabled in Cooney Heights at the northwest
corner of Maryetta Street and Valley View Road.
Motion by Pepping, seconded by Nolan, to publish the
ordinances passed at this Council Meeting in pamphlet form.

Nolan, Pepping.
Voting Nay: None.

Motion by Harker, seconded by Nolan, to pass an Ordinance
to secure an easement for an outfall pipe over the Decker property as
recommended in a :letter of Dr. Hal Sundin of Baxter & Woodman, city
engineers, a copy of said letter being attached to the minutes of this
meeting.

Motion by Harker, seconded by Schooley, to authorize surging
of Well No. 2 at an approximate cost of $1,900 to $2,150.

Motion by Harker, seconded by Meurer, to replace the media
at Wells 2 and 3 at an approximate cost of $1,730.

Motion by Harker, seconded by Pepping, to approve the recommen-
dation of Baxter & Woodman and inform Residential Development Group
that they be required to lower the water mains in Boone Valley Unit 13
and that the city require a Performance Bond from RDG in the amount of
$10,000.

Nolan, Pepping.

Motion by Meurer, seconded by Wieser, to pass an Ordinance
regulating the storage of garbage and refuse containers and the length
of time the containers should be left on the street prior to and after
pickups.

Alderman Meurer, Chairman of the Purchasing Committee reported
that his committee had inspected the paint striper up for bid by the
McHenry Twonship Road Commissioner and had decided not to enter a bid
as it was their opinion it was not a necessary purchase.
