MONDAY, JANUARY 20, 1992
A Special Meeting of the McHenry City Council was called to order by
Mayor Busse on Monday, January 20, 1992 at 8:00 P.M. in the Municipal
Center Council Chambers to discuss the annexation and preliminary plat
review of Foxview Highlands subdivision, south of McHenry Shores. At
roll call the following Aldermen were present: Bolger, Donahue, Locke,
Lieder, Adams, Patterson, Serritella. Absent: Smith. City Staff in
attendance were: City Clerk Gilpin, City Administrator Peterson, City
Attorney Narusis, Director of Parks and Recreation Merkel, Director of
Building and Zoning Halik. Absent: Chief of Police Joyce, Director of
Public Works Batt. Also in attendance were Court Reporter Cheryl Barone,
Petitioner Joseph Dieschbourg, his attorney John Roth, and his engineer
Scott DiGilio.
During the Ten Minute Public Input Session, the following people
spoke in opposition to allowing Dieschbourg to annex his property into
the City: Mark Stephenson of 1209 Capri Terrace, Christine Lawson of
1213 Capri Terrace, Edward Ligeza of 1210 Capri Terrace, Angie Benedetto
of 1203 S. Capri, and John Dendor of 1206 Capri Terrace. A letter in
opposition to the annexation from Katharine and Faustino Melesio was read
into the record by Christine Lawson. Speaking in behalf of Dieschbourg
and his work were: Jerry Ripley of 1212 Capri Terrace; Susan Dieschbourg,
wife of the developer; Richard Fiske of 1204 Capri Terrace; John Dudeck
of 2105 Columbia Court, Hawthorn Woods; Don Pease of 2101 Columbia Court,
Hawthorn Woods; Wayne Hajzl of 802 Grand Avenue, Wauconda; Jim Costello
of 407 High Street, Wauconda. The following objectors presented written
statements and/or pictures: Melesio, Lawson, Ligeza, and Costello.
Mayor Busse felt there were two issues to be addressed before
reviewing the annexation agreement: 1) the quality of work; 2)
connection to the City of McHenry's water system.
Dieschbourg addressed the Council and presented letters from six
homeowners saying that the repairs on their homes had been made and they
were satisfied with completion of work on their homes.
When the discussion arose as whether to allow Dieschbourg to hook up
to McHenry Shores Water Company of whether to require him to extend City
water to the property, Dieschbourg stated he would be willing to extend
the City water main from the Tonyan Industrial site if he could do 1t
within a reasonable time frame. He felt possibly in a couple of years he
could make the extension and work out a recapture agreement. Mayor Busse
felt that a recapture agreement could be worked out as it has been with
other developers in the past. However, easements would have to be
obtained from other property owners and required time frames could be put
in the annexation agreement.
The proposed subdivision would contain thirty-seven homes to be built
on 14.19 acres. The petitioner was requesting RS-2 zoning with lot sizes
ranging from 10,900 square feet to 21,324 square feet.
Motion by Serritella, seconded by Donahue, to approve the RS-2 zoning
for the property and require that City water mains be extended to the
Foxview Highlands subdivision.
Voting Aye: Donahue, Lieder, Adams, Serritella, Busse.
Voting Nay: Locke, Patterson.
Absent: Smith.
Abstaining: Bolger.
Motion carried.
REVIEW ANNEXATION AGREEMENT
The annexation agreement was then reviewed on a page by page basis.
Paragraph 5: Annexation fees were set at E500.00/acre and E500.00/unit
which resulted in a payment of $25,550.00 for 37 lots, payable at time of
annexation; Paragraph 6 will be amended to conform to standard City
language by Attorney Narusis; the preliminary plat as presented will be
adjusted to show minor sidewalk installation, and requirements for
maintenance and access to the retention areas; Paragraphs 8 and 9 will be
revised according to City standards by Attorney Narusis. Paragraph 10
was deleted, as was Paragraph 12. Paragraph 14 will be revised and
reworded by Attorney Narusis, as will Paragraph 15. Questions of phasing
and landscaping will be discussed with the developer prior to final
approval of the annexation agreement. Dieschbourg said they would comply
with all City requirements. A letter from Baxter & Woodman describing
conditions that need to be corrected was reviewed and Dieschbourg said
all conditions had been met on the plat.

Motion by Lieder, seconded by Serritella, to instruct the City
Administrator and staff to draft a final annexation agreement subject to
the conditions and recommendations made at this meeting.

Absent: Smith.
Abstaining: Bolger.
Motion carried.
Motion by Serritella, seconded by Donahue, to recess this Public
Hearing to the regular City Council meeting of February 19, 1992 for
final action on the annexation of Foxview Highlands.
