The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, January 17, 1990 at 8 P.M. at City Hall. At roll call the following Aldermen were present: Bolger, Donahue, Teta, Smith, McClatchey, Patterson, Serritella. Lieder arrived at 8:15 P.M. Absent: None. City staff in attendance were Director of Public Works Batt, Attorney Narusis, Clerk Gilpin, Park Director Merkel, Chief Joyce, Building & Zoning Officer Halik. Nancy Fike of 2913 W. Virginia, Chairman of the Landmark Commission, spoke during the public input session to invite everyone to attend a special Landmark Commission slide show presentation on Tuesday, February 6, 1990 at 7:30 P.M. in City Hall. Nancy Baker of the McHenry County Planning Commission wi l l present a slide show showing all of the old buildings along Pistakee Bay which covers a period of about 35 years. Donna Santi of 4815 W. Home also spoke during the public input session. She said that illegal parking was taking place on the north side of Commercial Avenue in back of her home- and asked that the area be given closer surveilance by the Police Department and tickets should be issued for the cars parked on the roadway in violation of the signs posted in the area. Motion by Smith, seconded by Donahue, to approved the minutes of the January 3, 1990 Regular Meeting and the January 10, 1990 Special Meeting as presented. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Joe Dieschbourg of Midwest Horizon Builders presented a concept plan for annexation of 10 acres located south of McHenry Shores adjacent to Hilltop, Bonnie Brae, Broadway and Capri Terrace. The proposed subdivision called Fox View Subdivision was being proposed for 30 single family residential homes. Motion by McClatchey, seconded by Serritella, to authorize Midwest Horizon Builders to proceed to the Plan Commission and Zoning Board as the next step in the annexation process. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Tom Hopkins of the Landmark Commission presented a proposal prepared by the Landnark Commission to require that demolition permits be issued which would protect historic landmarks in the City. It was decided to have the Landnark Commission identify the historical structures which the commission had designated in an earlier survey. Before the proposed demolition ordinance is passed, owners of the historic structures in question would be notified and asked to attend a meeting held by the Landnark Commission so they could present input concerning the proposed demolition ordinance since it would affect their properties. Motion by Bolger, seconded by Teta, to approve a reduction in the letter of credit for Brittany Heights Unit III from $75,305 to $35,366 subject to receipt of "as built" plans and receipt of an open end guarantee bond in the amount of $6,390.20 as recommended by Baxter & Woodman. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Wednesday, January 17, 1990 Page 2 Motion by Patterson, seconded by Bolger, to approve a reduction in the Letter of Credit for Green Valley Subdivision Unit I from $866,909 to $80,870 subject to the receipt of "as built" plans, receipt of an open end guarantee bond in the amount of $97,469.88 as recomnended by Baxter & Woodmen and subject to verification by Director of Public Works Batt that the temporary pumping station for Green Valley Unit I has been removed. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Donahue, seconded by Smith, to authorize the Mayor to sign a release of easement for Winding Creek 5 since platting and construction work subsequent to the granting of the easement makes it no longer necessary. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Bolger, seconded by Serritlla, to approve the recommendation of the Finance Committee and authorize the purchase of four squad cars for the Police Department through the State Purchasing Program at a total cost of $54,751.52 for the four vehicles, to be paid from the 199-91 fiscal year budget. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting May: None. Absent: None. Motion carried. Motion by Smith, seconded by Donahue, to approve 2 sign variation requests by Dobyns House Restaurant at 1202 North Riverside Drive as presented. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by McClatchey, seconded by Bolger, to authorize and approve payment of $79,250 to Seagren/Shales Inc. as partial payment toward the South Wastewater Treatment Plant Project contingent upon receipt of Waivers of Lien as recommended by Baxter & Woodman. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Lieder, seconded by Teta, to approve the request of Building and Zoning Enforcing Officer Halik for reimbursement of tuition fees for Building Inspectors Howie Wagner and Ryan Schwalenberg for a total amount of $301.00 as presented. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Mayor Busse asked the Council for suggestions as to an appointment of a representative for the City on the McHenry County Solid Waste Advisory Committee. Two names were suggested: Tom McCarthy and Elizabeth Nolan, both are current members of the City of McHenry Environmental Advisory Committee. Mayor Busse was authorized to contact then to see if one of them could serve on the County Committee. Motion by Patterson, seconded by Teta, to approve the payment of $25 to the Illinois Section of the American Waterworks Assocation for the purpose of purchasing pamphlets outlining Federal and State laws and regulations for operation of water utlities. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Wednesday, January 17, 1990 Page 3 Motion by Serritella, seconded by Patterson, to contract with Mankoff Equipment Co. for removal and disposal of an underground fuel tank located at the Willow Avenue Lift Station which includes the pumping and disposal of the contents of the underground tank at a cost of $4,003. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Patterson, seconded by Donahue, to approve the low bid of U.S. Dismantlement Corp. of Chicago for demolition of the Jepsen Building at 3314 Elm Street in the amount of $21,000. Lengthy discussion ensued. Motion by Teta, seconded by Serritella, to call the question. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. It was noted that if there are cost overruns of over 10 percent for demolition of the Jepsen Building at 3314 Elm Street, Director Batt and the Mayor will report back to the Council as to the amount of the cost overrun. Motion by McClatchey, seconded by Patterson, to approve the City Administrator's job description as presented. Voting Aye: Bolger, Teta, Lieder, McClatchey, Patterson. Voting Nay: Donahue, Smith, Serritella. Absent: None. Motion carried. Mayor Busse called for a recess at 10:03 P.M. The meeting reconvened at 10:14 P.M. with everyone still in attendance. Mayor Busse announced that Mrs. Lillian Cairns was going to submit a resume and she would be his appointment as the new City Treasurer to fill the vacancy created by the resignation of Thomas C. Alverson. Her appointment would be made at the January 31, 1990 Meeting , to be effective February 1, 1990. Motion by McClatchey, seconded by Patterson, to approve the December Treasurer's Report as presented. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Discussion was held on when to send official notice to homeowners in McHenry Shores that they had one year to hookup to the sewer system. It was decided to send out notices immediately stating that the South Wastewater Treatment Plant was now in operation and sewer permits could be issued. However, it was decided to hold off sending the official notice giving them a one year time frame to hookup. Motion by Bolger, seconded by Donahue, that the official notice to McHenry Shores homeowners should not be sent until June 1, 1990 giving them official notification that they had one year to hookup to the sewer system. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None•. Motion carried. Mayor Busse announced that he had contacted School Officials from District "15 and 156. He suggested a meeting with those school representatives on either February 8 or February 22, 1990. When School Officials notify him as to a time, he will ask the Council to meet with them at a separate meeting. Neil Hunter of Lancer Corporation, Developers of Pheasant Valley Subdivision, requested that they be allowed to exchange the lots currently being held by the City of McHenry (Lots 111, 112 and 191). He wanted to place Lots 101, 102 and 182 in the trust at McHenry State Bank in exchange for those lots. The sidewalk and street work remaining to be finished in that subdivision is approximatley $18,000 to $20,000. The Council felt that since the subdivision improvements (sidewalks and street work) had been on hold for so many years it was time to pet the project completed. Motion by McClatchey, seconded by Patterson, to deny the request" of Neil Hunter for exchange of lots in Pheasant Valley Subdivision and require that the subdivision improvements be completed by June 30, 1990 and that if he wanted to release the lots the City is currently holding he could submit a cash bond for $20,000 to insure completion of the subdivision improvements by June 30, 1990. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Butch Meyer of Granite Builders addressed the Street 8 Sidewalk Committe to request the installation of custom street lights in the Green Valley Subdivision. This would be the same type as the City of McHenry presently has in Veterans Park and on Green Street. Motion by Smith, seconded by Bolger, to deny the request of Granite Builders for installation of custom street lights in Green Valley Subdivision and that he be required to follow regular street lighting standards. Voting Aye: Bolger, Donahue, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Patterson, seconded by Smith, to authorize and approve payment to McHenry State Bank for the following bonds: City of McHenry General Obligation Bond Series 1982 - Principle $20,000, Interest $6,037.50, Paying Agent Fees $25, total $26,092.50; and payment of Special Service Obligation Bond 1982 - Principle $60,000, Interest $23,820, Paying Agent Fee $25, total $83,845. Motion by Patterson, seconded by Bolger, to authorize the City Attorney to contact the law firm of Kelle, Nuelle and Loizzo and hire Attorney Vette Kell to review a lawsuit recently served on the City to determine whether or not the City should file declaratory judgement action on the lawsuit in questions.
