The regular meeting of the McHenry City Council was called to order by Mayor Stanek on Monday, January 17, 1983 at 8:00 P.M. At roll call the following aldermen were present: Pepping, Nolan, Busse, Datz, Gelwicks, Smith, Serritella. Absent: Meurer. City Staff in attendance were Supt. Halvensleben, Attorney Narusis, Clerk Gilpin, Park Director Merkel. Absent: Chief Pasenelli. Motion by Nolan, seconded by Datz, to accept the minutes of the January 3, 1983 Regular Meeting and the January 13, 1983 Special Meeting as presented with one correction. Voting Aye: Pepping, Nolan, Busse, Datz, Gelwicks, Smith, Serritella. Voting Nay: None. Absent: Meurer. Motion carried. Motion by Busse, seconded by Serritella, to pass an Ordinance establishing future Council voting procedures. Voting Aye: Pepping, Nolan, Busse, Datz, Gelwicks, Smith, Serritella. Voting Nay: None. Absent: Meurer. Motion carried. Motion by Smith, seconded by Gelwicks, to pass a Resolution authorizing the execution of a Memorandum of Agreement with McHenry County Association for the Retarded, whereby the City of McHenry agrees to act as sponsor for grant funding to finance expansion of Pioneer Center, and to authorize the Mayor and Clerk to sign said agreement. Voting Aye: Pepping, Nolan, Busse, Datz, Gelwicks, Smith, Serritella. Voting Nay: None. Absent: Meurer. Motion carried. Motion by Busse, seconded by Datz, to pass an ordinance amending Section 26 of the Municipal Code regarding the following paragraphs: 31, 44, 45, 61, and 62. Voting Aye: Pepping, Nolan, Busse, Datz, Gelwicks, Serritella. Voting Nay: Smith. Absent: Meurer. Motion carried. Motion by Busse, seconded by Datz, to pass a Resolution authorizing the execution of a Memorandum of Agreement with Equity Investment Group I Project, as requested by Frank Gradishar for issuance of Industrial Revenue Bonds in the Amount of $3,000,000.00 for construction of a commercial building at 616 S. Route 31, and to authorize the Mayor and Clerk to sign said agreement. Voting Aye: Pepping, Nolan, Busse, Datz, Gelwicks, Smith, Serritella. Voting Nay: None. Absent: Meurer. Motion carried. Public Mayor Stanek announced that Maintenance Plan John Mergl was Property- proceeding with building improvements by rewiring a section of the Park Misc. Department Office in the basement of City Hall to provide for installation and movement of computer equipment from a first floor office to the base- ment. The former computer room will be remodeled into an office for the Building and Zoning Officer. Northern Ill. Attorney Narusis reported that ICC hearings on proposed water Utilities rate increases for McHenry Shores Water Company and Lakeland Park Water Company have been scheduled for January 27, 1983 at Chicago. Anyone Water Serv. having any information which might assist him in the City's planned objection to these rate increases should contact him. Narusis also reported on progress of his attempts to get an extended easement from Mid -States Development Company for installation of a water line to the hospital site along the west side of Route 31. Monday, January 17, 1983 Page 5 The attorney for Mid -States submitted a proposal to Narusis and asked that he present it to the Council. Mid -States suggested that if they agree to give a 20-foot easement to the City, the City should, in turn, agree to waive tap on fees, waive recapture fees and pay a specified dollar amount for property involved in the easement dedication. Originally a 10-foot easement was involved but upon examination of the site, it was discovered that Northern Illinois Gas Company had installed a gas line in that 10-foot easement. Therefore, Baxter & Woodman recommended that a 20-foot easement be sought to provide a separation between the gas and water lines to prevent any possible future problems. Motion by Datz, seconded by Serritella, to inform Mid -States that the City refuses to waive any fees or make a financial commitment toward any easement on the property in question and that the water line should be installed in the 10-foot easement as originally intended or in the 20-foot easement if it can be obtained.
