The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, January 11, 1989 at 8 P.M. at City Hall. At roll call the following Aldermen were present: Bolger, Nolan, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Absent: None. City staff in attendance were Supt. Batt, Attorney Narusis, Clerk Gilpin, Park Director Merkel, Chief Joyce, Director of Development Greenwood. Absent: Finance and Personnel Administrator Vitas. Motion by Nolan, seconded by Patterson, to accept the minutes of the January 4, 1989 Regular Meeting as corrected. Voting Aye: Bolger, Nolan, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Developer Don Gerstad addressed the Council concerning annexation of First Addition to Winding Creek Unit 5. Motion by McClatchey, seconded by authorizing the execution of an annexation First Addition to Winding Creek Unit 5. Voting Aye: Bolger, Nolan, Lieder, McClatchey, Patterson, Voting Nay: None. Absent: None. Motion carried. Smith, to pass an ordinance agreement as presented for Teta, Smith, Serritella. Motion by Smith, seconded by Nolan, to pass annexing the territory known as First Addition to Winding contingent upon receipt of properly signed documents. Voting Aye: Bolger, Nolan, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Council Meeting Attendance Ordinance Annex. an ordinance Ordinance Creek Unit 5 Annex. Motion by Patterson, seconded by Lieder, to pass an zoning the territory known as First Addition to Winding Creek contingent upon receipt of properly signed documents. Voting Aye: Bolger, Nolan, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. ordinance Ord. 5 as RS-3 Motion by Bolger, seconded by Nolan, to accept the surrender of Whale's Tail (3425 W. Pearl) and Busy Bee's (4620 W. Elm) liquor licenses and to approve issuance of Class A liquor licenses to the new owners of Whale's Tail and Peking China Restaurant (formerly Busy Bee) contingent upon police clearance to the satisfaction of Mayor Busse, Liquor Commissioner. Voting Aye: Bolger, Nolan, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by McClatchey, seconded by resolution with the Illinois Department highway maintenance as presented. Voting Aye: ¢olger, Nolan, Lieder, McClatchey, Patterson, Voting Nay: None. Absent: None. Motion carried. Lieder, to pass the annual of Transportation concerning Teta, Smith, Serritella. The Mayor announced the continuation date for the annexation hearing on the Fritsch property would be from January 18, 1989 to January 30, 1989 at 8:00 P.M. Zon.Matt. Liquor Control & Lic. Resolut. St. Maint.& Repair Wednesday, January 11, 1989 Page 2 Motion by Smith, seconded by Patterson, to authorize and approve Spec.Assessthe partial payment request of George W. Kennedy Construction Company in McH. Shores the amount of $159,749.75 for McHenry Shores Area Sanitary Sewer Special Assessment project as recommended by Baxter & Woodman. Voting Aye: Bolger, Nolan, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Street Motion by Lieder, seconded by Nolan, to reopen McHenry Avenue Closings north of Bull Valley Road as recommended by the Superintendent of Public Works. Voting Aye: Bolger, Nolan, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Patterson, seconded by McClatchey, to authorize the Street Superintendent of Public Works to contact Commonwealth Edison for Lights installation of a street light at the intersection of Route 31 and Albany Street in Tonyan Industrial Park. Voting Aye: Bolger, Nolan, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Public Motion by Nolan, seconded by Patterson, to request the Public Property Works Department to install Italian white lights in the trees at the Misc. Green Street parking lot. Voting Aye: Nolan, Lieder, Teta, McClatchey, Patterson, Serritella. Voting Nay: Smith, Bolger. Absent: None. Motion carried. Landmark Mayor Busse announced that Dorothy Uttich of the McHenry Commissions Landmark Commission had submitted a letter of resignation because she was Resignations unable to attend many of the meetings due to a busy travel schedule. Mayor Busse accepted the resignation with regret. Motion by Nolan, seconded by Patterson, to go into executive Exec.Sess. session at 9:31 P.M. to discuss property acquisition. Voting Aye: Bolger, Nolan, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Teta, to go back into open session at 11:48 P.M. Voting Aye: Bolger, Nolan, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Mayor Busse scheduled a Special Meeting on Thursday, January 19, 1989 at 8:00 P.M. for an executive session to discuss property acquisition. Motion by Smith, seconded by McClatchey, to adjourn. Voting Aye: Bolger, Nolan, Lieder, Teta, Smith, McClatchey, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried.
