The meeting was called to order by Mayor Stanek. At roll call the following aldermen were present: Meurer, Schooley, Adams, Wieser, Datz, Harker, Nolan, Pepping. Absent: None. Motion by Nolan, seconded by Adams, to accept the minutes of the December 17, 1979 Regular Meeting as read. Voting Aye: Meurer, Schooley, Adams, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: None. Potion carried. Motion by Harker, seconded by Nolan, to set April 14, 1980 at 8 P.M. for a Public Hearing on the proposed annexation agreement by David Faestel and Ray Schmitt for a subdivision to be known as Valleybrook at the intersection of Bull Valley Road and Crystal Lake Road of approximately 202 acres. Voting Aye: Meurer, Schooley, Adams, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. .Absent: None. Monday, January 7, 1980 Page 2 Motion by Nolan, seconded by Harker, to authorize the expenditure of up to $10,000.00 to prepare plans and specifications for competitive bidding on the proposed swimming pool for Knox Park. Voting Aye: Meurer, Adams, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: Schooley. Absent: None. Motion carried. Attorney Dan Curran of Joslyn & Green addressed the Council concerning questions in connection with the multi -family zoning in Area 2 of McHenry Lakes Estates (Towne -Orleans) Subdivision near the intersection of Route 31 and McCullom Lake Road. Following lengthy discussion, Curran was advised to petition the Zoning Board of Appeals for an answer to the problems presented. At 9:27 P.M., the mayor declared a recess. The meeting was re- convened at 9:40 P.M. with all aldermen still in attendance. Motion by Adams, seconded by Datz, to appoint Lester, Witte & Company to prepare an audit of the 1979-80 fiscal year. Voting Aye: Meurer, Adams, Wieser, Datz, Harker, Nolan, Pepping, Schooley. Voting Nay: None. Absent: None. Motion carried. Motion by Harker, seconded by Datz, to pass a Resolution setting forth a schedule of Regular Council Meetings for the calendar year 1980. Motion by Harker, secondei by Schooley, to authorize the Mayor and Clerk to enter into an agreement: with the McHenry County Department of Health for animal control services for the City of IicHenry. Motion by Schooley, seconded by Adams, to pass two Supplemental Resolutions appropriating funds from the Motor Fuel Tax Fund, as recommended by MFT auditors, as follows: $4,708.50 for maintenance and engineering costs for calendar year 1977 and $3,464.57 for engineering costs for calendar year 1978. Voting Aye: Meurer, Adams, Wieser, Datz, Harker, Nolan, Pepping, Schooley. Voting Nay: None. Absent: None. Motion carried. Motion by Wieser, seconded by Meurer, to defer action on the ZBA's recommendation on the Tutera Condominium Zoning; Petition to the Regular Council Meeting of February 4, 1980 as requested by attorneys for the petitioner, James Bishop and Richard Kelly. Motion by ltolan, seconded by Meurer, to approve the Park Committee's recommendation toaallow the Johnsburg School's tennis team the use of two courts at Freund Field for their matches and practices with the provision that one of the four courts must always remain open for local residence use. Motion by Adams, seconded by Wieser, to pass a resolution authorizing the Lake -McHenry Law Enforcement Commission to serve as a local. criminal justice advisory board so as to improve the law enforcement and criminal and juvenile .justice systems within Lake -McHenry Region. The Purchasing Committee reported on three bids which had been received for fencing in Petersen .Park as follows: Dura-bilt Fence Co. $3,710.00; Meier's Masterbilt Mfg. $4,490.20 and Bell's Custom Fencing $4,566.75. It was the committee's recommendation that Dura-bilt Fence Co. be awarded the bid. Motion by Harker, seconded by Meurer, to approve the low bid of Dura-bilt Fence Co. for $3,710.00 for installation of fencing in Petersen Park for the lighted softball field. Mayor Stanek read a letter dated December 21, 1979 (a copy of which is attached to these minutes and a copy of which was given to each alderman prior to the meeting) wherein he declared ':e was vetoing a motion passed at the December 17, 1979 Council meeting "to accept the Longevity Program as presented by the Finance Committee with an effective date of May 1, 19p0." That motion carried by a five to three vote. 'The Mayor inquired if there was a motion to override. There was no motion made and no action was t_•aken by the Council to override the Mayors veto. Motion by Schooley, seconded by Adams, to pass an ordinance amending the liquor control ordinance to conform with the drinking age limitations for consumption of alcohol set by State Statutes. Voting Aye: Meurer, Adams, Datz, Ilarker, Nolan, Pepping, Schooley, Wieser. Voting Nay: None. Absent: None. Motion carried. STANEK CITY CLERK: BARBARA E. GILPIN SUPT.OF PUBLIC WORKS: FRED J. MEYER CHIEF OF POLICE: GEORGE R. PASENELLI As I stated at the Monday meeting of December 17th, I intended to veto the action taken regarding the seniority raises. This letter will officially notify you of that veto and the reasons for it. The annual consideration of pay increases has served us well in the past. I feel that it is the means whereby we can evaluate each employee's service to the City of McHenry and salary increases can be adjusted to reflect the employees' performances. Other means of rewarding valued employees is to establish job grades or classifications which would not necessarily be automatically given an employee because of tenure. I feel these two approaches allow us to reward employees on a quassi merit basis. ` I do not believe that the proposal made Monday night took into account the fact that it was a percentage increase with an accompanying dollar schedule that applied at the time it was proposed one month earlier. Those dollar amounts would only apply if on May 1st our city employees did not receive pay -increases. It is my assumption that we will be in a financial posture that could justify fair and equitable pay increases and those percentages for the senior employees would then be percentages of the increased emoluments and where there were any disparities between pay and performance, they would be magnified. I also feel that any employee who served the City of McHenry prior to our participation in either the Police Pension Fund or the Illinois Municipal Retirement Fund has been a beneficiary of a generous city by giving them retroactive pension time. Several examples were stated to you. Several of our employees presently will receive substantially larger pension checks because of that generosity and they especially, I do not believe, should receive additional consideration. Additionally, I believe the incentives for continued employment presently exist. Namely, longer vacation time, increased pension benefits and medical insurance. Our contribution to these categories automatically increases the benefits accruing to the employees. Page Two I also feel strongly that the monies which would be automatically received would be better spent by spreading them across the board and thereby employees performing similar duties would receive similar com- pensation. For the forgoing reasons, 1 ask that you respectfully reconsider the action taken at the December 17th meeting regarding this issue. Sincerely, Joseph Stanek, Mayor
