HomeMy WebLinkAboutResolutions - 20-12 - 06/15/2020 - Non-Discrimination PolicyRESOLUTION LU-IL A RESOLUTION ADOPTING A NON-DISCRIMINATION POLICY WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in the Constitution of the State of Illinois; and WHEREAS: It is the policy of the City of McHenry ("City") to comply with Title VIII of the Civil Rights Act of 1968 as amended, (commonly known as the Fair Housing Act) by ensuring that its zoning and land use decisions do not discriminate against persons based on race, color, religion, national origin, disability, familial status or sex. This policy means that, among other things, the City and all its officials, agents and employees will not discriminate in any aspect of housing based on these protected class characteristics. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MCHENRY OF MCHENRY COUNTY, ILLINOIS AS FOLLOWS: SECTION 1: The foregoing recitals shall be and are hereby incorporated as findings of fact as if said recitals were fully set forth herein. SECTION 2: The Mayor and City Council of the City of McHenry hereby approve and adopt the Non -Discrimination Policy, attached hereto as Exhibit A and made a part hereof. SECTION 3: Any policy, resolution or ordinance of the City that conflicts with the provisions of this Resolution or the attached Policy shall be and is hereby repealed to the extent A such conflict. SECTION 4: That the City Clerk is hereby ordered and directed to publish this Resolution in pamphlet form, and this Resolution shall be in full force and effect from and after its passage, approval, and publication as required by law. Ayes Alderman Devine x Alderman Glab x Alderman Harding x Alderman Mihevc x Alderwoman Miller x Alderman Santi x Alderman Schaefer x Nays Absent Abstain Wayne Jett, Mayor II&'t& (:L. ?"*%J Monte Johnson, Deputy City Clerk Exhibit A Non -Discrimination Policy a) Making unavailable or denying a dwelling to any person based on race or color; b) Discriminating against any person in the terms, conditions or privileges of a dwelling, or in the provision of services or facilities in connection therewith based on race or color; c) Making, printing, or publishing or causing to be made, printed, or published any notice, statement, or advertisement, with respect to a dwelling that indicates and preference, limitation, or discrimination based on race or color; d) Representing to persons because of race or color that any dwelling is not available when such dwelling is in fact so available; e) Interfering with any person in the exercise or enjoyment of, or on account of his having exercised or enjoyed, or on account of his having aided or encouraged any other person in the exercise or enjoyment of, any right protected by the Fair Housing Act; f) Interfering with the funding, development, or construction of any affordable housing units because of race or color; and g) Discriminating on the basis of race or color in any aspect of the administration of its zoning, land use, or building ordinances, policies, practices, requirements, or processes relating to the use construction, or occupancy of dwellings.
