Planning and Zoning Commission Meeting
April 2, 2009
Chairman Howell called the April 2, 2009 regularly scheduled meeting of the City of McHenry
Planning and Zoning Commission to order at 7:33 p.m. In Attendance were the following:
Buhrman, Howell, Nadeau, Schepler, Thacker. Absent: Ekstrom. Also in attendance were:
Attorney Carlos Arevelo, Planner Kolner.

Map Amendment
Chairman Howell called the Public Hearing to order at 7:34 p.m. regarding File No. Z-740, an
application for zoning map amendment to RS-4 High Density Singly Family District upon
annexation to the City as requested by Pamela Dietmeyer for her property located at 2919
Mourine Lane.
Chairman Howell stated notice of the Public Hearing was published in the Northwest Herald on
March 14, 2009. Notices were mailed to all abutting property owners of record via certified
mailing. The subject property was posted as required by ordinance. The Certificate of
Publication, certified mailing receipts, and affidavit of posting are all on file in the City Clerk’s
Office.
Planner Kolner noted the applicant, Pamela Dietmeyer, property owner of 2919 Mourine Lane,
was unable to attend this evening’s meeting. Ms. Kolner provided the commissioners with the
Staff Report regarding this matter. She stated the subject property is part of the Hunterville Park
Subdivision. However, it was not annexed along with the other lots in the subdivision. The
applicant is now seeking a single lot annexation and is requesting a zoning map amendment to
RS-4 High Density Single Family District. The RS-4 designation is consistent with the rest of the
Hunterville Park Subdivision. It complies with the Comprehensive Plan. The applicant is not
planning on doing anything to the property; the current use will not change. The applicant is not
seeking connection to municipal water and sanitary sewer service at this time.
Clarifying the boundaries of the subject property, Planner Kolner stated the applicant owns Lots
1 and 2 which comprise the property to be annexed at this time. Lots 7 and 3 are neighboring
properties.
In response to an inquiry, Planner Kolner stated Lot 7 is in the City and Lot 3 is outside the City
limits.
Question was raised as to why the applicant is not seeking connection to municipal water and
sanitary sewer. Planner Kolner responded the applicant’s well is fine at this time and she did not
indicate any problems with her septic system.

In response to a question regarding the driveway, Planner Kolner stated the driveway is asphalt
and there is a concrete patio. Responding to further inquiry, Planner Kolner stated the applicant
has no plans to improve her property at this time. She has completed various improvements, such
as a new roof, siding, fence and interior alterations including electrical rewiring, all within the
past year.
Chairman Howell noted there were no public comments or questions regarding this matter.
Motion by Nadeau, seconded by Buhrman, to recommend to the McHenry City Council, that
with regard to File No. Z-740, a request for zoning map amendment to RS-4 High Density Single
Family Zoning District upon annexation to the City, as requested by Pamela Dietmeyer for her
property located at 2919 Mourine Lane, be granted, and that Table 33, the Approval Criteria for
Zoning Map Amendments, page 401, of the Zoning Ordinance, has been met.
Voting Aye: Buhrman, Howell, Nadeau, Schepler, Thacker.
Voting Nay: None.
Not Voting: None.
Abstaining: None.
Absent: Ekstrom.
Motion carried 5-0.
Other Business
Planner Kolner announced there would be no meeting on April 16, 2009. The Kotiw matter
regarding 3320 Bull Valley Road will be presented to Council for consideration on April 20,
2009. There will be no recommendation from the Planning and Zoning Commission as the vote
on the matter as the vote resulted in a tie.
Question was raised as to how the Kotiw Mill Street Project is progressing. Planner Kolner
responded the application would include re-subdivision as well as zoning the property to an IDD
as there would be a mix of housing types. The current proposal being reviewed by Staff is less
dense than the first application submitted by Mr. Kotiw for the property.
Commissioner Buhrman reported that Johnsburg Planning and Zoning has scheduled a meeting
with Wal-Mart pertinent to their new location and inquired as to the City’s reaction to this news.
Planner Kolner stated the last the City heard was that Wal-Mart was not going to take any action
for a year regarding a potential move to a new location. Apparently the year is up and talks have
begun again about a possible move. Planner Kolner noted there are currently empty big boxes in
town but not much open land, except if someone is looking to locate on the south side of town.
The City needs some type of supermarket on the south side of town to help draw other retail to
the area.
Commissioner Buhrman requested more discussion occur particularly about big box parking lots
having narrow spaces and no safety zones for pedestrians. Planner Kolner suggested the matter

be presented before the City’s Community Development Committee for discussion and
recommendation.

Motion by Buhrman, seconded by Schepler, to adjourn the meeting at 7:53 p.m.
Voting Aye: Buhrman, Howell, Nadeau, Schepler, Thacker.
Voting Nay: None.
Not Voting: None.
Abstaining: None.
Absent: Ekstrom.
Motion carried 5-0.
The meeting was adjourned at 7:53 p.m.
