Chairman Howell call the March 15, 2007 regularly scheduled meeting of the City of McHenry
Planning and Zoning Commission to order at 7:30 p.m. In attendance were Commissioners
Buhrman, Cadotte, Ekstrom, Howell, Nadeau, Schepler, and Thacker. Also in attendance were
Director of Community Development Napolitano, City Attorney Cahill, and Community
Development Department Administrative Assistant Oliver.
Approval of Minutes
Chairman Howell announced the approval of minutes is being tabled until the April 5, 2007
regularly scheduled meeting.
Public Hearing – Tim and Margaret Adams

Zoning upon Annexation
Chairman Howell called to order a Public Hearing at 7:32 p.m. regarding an application for
zoning map amendment to RS-4 High Density Single Family Residential Zoning District upon
annexation to the City as submitted by Tim and Margaret Adams of 2918 Lincoln Road.
Chairman Howell stated notice of the public hearing was published in the Northwest Herald on
February 23, 2007. Notices were mailed to all abutting property owners of record via certified
mail. An affidavit of service and posting requirements as well as a certificate of publication is on
file in the office of the City Clerk.
In attendance was applicant Tim Adams who was sworn in by Chairman Howell.
Mr. Adams, a resident of 2918 Lincoln Road, stated he would like to connect to City water and
sanitary sewer. He was advised by Staff in order to do so, he should seek annexation to the City.
He noted he is before the Commission this evening to request RS-4 zoning upon annexation of
his property to the City.
Director Napolitano provided the Commission with the Staff Report regarding this matter. He
noted the subject property is adjacent to Huntersville Park Subdivision and other City properties.
He stated the requested RS-4 zoning is consistent with the area. It is Staff’s recommendation to
support the request.
It was noted the swimming pool is located in the corner side yard and does not conform to the
City ordinance. Director Napolitano responded the property would be annexed as is; but if any
changes are made to the property, it would have to be brought into compliance.
Concern was expressed regarding the fence location surrounding the property and a potential for
safety issues, particularly regarding vision clearance. It was noted as Mary Lane is a dead-end
street, there is limited traffic on the road.
Following an inquiry, Mr. Adams stated he is seeking annexation so that he can connect to
municipal sanitary sewer as his septic is failing. Responding to further inquiry, Mr. Adams stated
he was aware of the costs to connect to City services and that his property is subject to the terms
of a recapture agreement which must be paid prior to connection.

In response to Chairman Howell’s inquiry there were no comments or questions from the
audience. There were no further inquiries from the Commission.
Motion by Cadotte, seconded by Nadeau, to recommend to the City Council, with regard to File
No. Z-702, a request for zoning map amendment to RS-4 High Density Single-Family Zoning
District upon annexation to the City be granted; and that Table 33, the Approval Criteria for
Zoning Map Amendments, page 401 of the Zoning Ordinance, has been met.
Voting Aye: Buhrman, Cadotte, Ekstrom, Howell, Nadeau, Schepler, Thacker.
Voting Nay: None.
Not Voting: None.
Abstained: None.
Absent: None.
Motion carried 7-0.
Chairman Howell closed the Public Hearing at 7:36 p.m.
Other Business
General discussion occurred regarding future annexations which could occur in the area along
Lincoln Road, and why the City did not encourage the property owners to come in at one time.
Director Napolitano advised letters were sent out encouraging annexation; however only two or
three residents expressed interest at this time. Some discussion followed regarding forced
annexation procedures and cost savings to the benefit of the City.
Director Napolitano provided the Commission with updates on the progress of the Whale’s Tail
renovations, work in Whispering Oaks Park across from Jewel, and Centegra NIMC revisions to
their ring road circulation plan. Commissioners also discussed Captain Rod’s sign. Director
Napolitano stated Rodney Schuh (Captain Rod) will be on the April 5, 2007 agenda requesting a
conditional use permit.
All commissioners commented positively on the new lights along Municipal Drive.

Motion by Ekstrom, seconded by Schepler, to adjourn at 7:50 p.m.

Motion carried 7-0. The meeting was adjourned at 7:50 p.m.
