HomeMy WebLinkAboutMinutes - 11/03/2005 - Planning and Zoning CommissionMinutes of the City of McHenry PLANNING AND ZONING COMMISSION November 3, 2005 Chairman Howell called the November 3, 2005 regularly scheduled meeting of the City of McHenry Planning and Zoning Commission to order at 7:30 p.m. in the McHenry Municipal Center Council Chambers. Commission members in attendance: Buhrman, Cadotte, Ekstrom, Howell, Nadeau, Schepler. Absent: Thacker. Also in attendance: City Planner Zeller, City Attorney Rob Fetzner, Deputy Clerk Kunzer. Minutes Approval Motion by Cadotte, seconded by Schepler, to approve the minutes of the October 6, 2005 Planning and Zoning Commission meeting as presented. Voting Aye: Buhrman, Cadotte, Ekstrom, Howell, Nadeau, Schepler. Voting Nay: None. Not Voting: None. Abstaining: None. Absent: Thacker. Motion carried 6-0. Public Hearing – City of McHenry File No. Z-653 Stade Property –Elevated Water Storage Facility Chairman Howell at 7:35 p.m. convened the Public Hearing for an application filed by the City of McHenry for a Zoning Map Amendment to RS-1 Low Density Single Family Residential District and a conditional use permit to allow an elevated water storage facility on the property. Chairman Howell stated notice of Public Hearing was published in the Northwest Herald on October 19, 2005. Certificate of Publication is on file in the City Clerk’s office. Certified notice of the Public Hearing was sent to all abutting property owners. Receipts are on file in the Clerk’s office. Planner Zeller stated the Commission on October 6, 2005 heard all testimony with regard to the City’s request for zoning map amendment and conditional use permit to allow an elevated water storage facility on the newly purchased Stade Property. The subject property is located south of the southwest corner of the Bull Valley Road and Crystal Lake Road intersection. Planner Zeller noted the City had neglected to notify all abutting properties of the impending public hearing prior to the October 6th date as required by statute. The motions for recommendation at the October 6th public hearing were contingent upon all notification requirements having been met. As that was not the case, the City once again published for tonight’s public hearing. All last known tax payers of property abutting the subject property have been notified of this evening’s hearing as well. As the City is now in compliance with all notification requirements, the City is requesting the commissioners once again recommend to the City Council that the requests for map amendment and conditional use permit be granted. The testimony as presented on October 6th stands on its record. P&Z Commission November 3, 2005 Page 2 Chairman Howell invited questions and comments from the commissioners. In response to an inquiry, Planner Zeller stated the fire hydrant on the property would likely be used to fill tankers on the site and/or to flush the system at this location. There was no one in the audience desiring to present any questions or comments regarding the matter. Motion by Cadotte, seconded by Nadeau, to recommend to Council with regard to File No Z- 653, a request for zoning map amendment to RS-1 Low Density Single Family District for the one-acre Stade Property upon annexation to the City of McHenry, and that Table 33, the Approval Criteria for Zoning Map Amendment, page 401 of the Zoning Ordinance, has been met. Voting Aye: Buhrman, Cadotte, Ekstrom, Howell, Nadeau, Schepler. Voting Nay: None. Not Voting: None. Abstaining: None. Absent: Thacker. Motion carried 6-0. Motion by Cadotte, seconded by Nadeau, to recommend to Council with regard to File No. Z- 653, a request for conditional use permit to allow the construction and operation of an elevated water storage facility on the subject property be granted; and that Table 31, the Approval Criteria for Conditional Use Permits, page 376-377, has been met. Voting Aye: Buhrman, Cadotte, Ekstrom, Howell, Nadeau, Schepler. Voting Nay: None. Not Voting: None. Abstaining: None. Absent: Thacker. Motion carried 6-0. Chairman Howell adjourned the Public Hearing at 7:41 p.m. Public Hearing – Jake Neulist File No. Z-656 The Cove Landing Chairman Howell at 7:42 p.m. opened the recessed Public Hearing regarding File No. Z-656, a request for • map amendment to RM1; • variance to required lot width for dwelling units on a lot; • variance as to required lot width for property abutting a major arterial street P&Z Commission November 3, 2005 Page 3 as filed by Jake Neulist for the property located north of Brittany Park Subdivision on the east side of Ringwood Road. Chairman Howell noted the Public Hearing was originally scheduled for September 15, 2005 and was recessed to this date. Planner Zeller informed the Commission the applicant has not yet supplied all information requested at the September 15, 2005 Public Hearing. A request for continuance to the January 5, 2005 regularly scheduled meeting of the Planning and Zoning Commission is requested. Motion by Ekstrom, seconded by Schepler, to recess the Public Hearing regarding File No. Z- 655 until Thursday, January 5, 2006 at 7:30 p.m. Voting Aye: Buhrman, Cadotte, Ekstrom, Howell, Nadeau, Schepler. Voting Nay: None. Not Voting: None. Abstaining: None. Absent: Thacker. Motion carried 6-0. Other Business Planner Zeller stated Nicolino’s has recently made application for a building permit for a small building expansion to accommodate the Off Track Betting facility.
