Planning and Zoning Commission Meeting
November 15, 2007
Chairman Howell called the November 15, 2007 regularly scheduled meeting of the City of
McHenry Planning and Zoning Commission to order at 7:30 p.m. In Attendance were the
following: Buhrman, Cadotte, Ekstrom, Howell, Nadeau, Schepler, Thacker. Absent: None. Also
in attendance were: Attorney Cahill, Planner Kolner, Deputy Clerk Kunzer.
Approval of Minutes
Motion by Cadotte, seconded by Nadeau, to approve the minutes of the Planning and Zoning
Commission as follows:
November 1, 2007 regularly scheduled meeting.
Voting Aye: Buhrman, Cadotte, Ekstrom, Howell, Nadeau. Schepler, Thacker.
Voting Nay: None.
Not Voting: None.
Abstaining: None.
Absent: None.

Conditional Use Permit
Chairman Howell called the Public Hearing to order at 7:32 p.m. regarding File No. Z-718, an
application for a conditional use permit to allow the outdoor storage of vehicles in conjunction
with the Maaco Auto Painting facility located at 2826 Barney Court as submitted by David H.
Brown.
In attendance representing the applicant were proposed business owner David Brown and Maaco
employee Mike Waltman, who were sworn in by Chairman Howell.
Notice of the Public Hearing was published in the Northwest Herald on October 27, 2007.
Notices were mailed to all abutting property owners of record via certified mailing. The subject
property was posted as required by ordinance. The Certificate of Publication, certified mailing
receipts, and affidavit of posting are all on file in the City Clerk’s Office.
Mr. Waltman stated the applicant intends to construct a fence to secure the area which would
house the cars being stored overnight on the premises. He stated there would likely be no more
than 10-12 cars being stored outdoors on any given day. At most times there would likely be
only six or seven cars stored outdoors. Mr. Waltman noted no work would be done on the
vehicles outside of the building. All work would be done within the building.
Planner Kolner provided the commissioners with the Staff Report regarding this matter. She
noted Maaco employees would park within the fenced area in order to provide more customer
parking in front of the building. Staff indicated the security fence should be constructed of either
wood or vinyl and it should be a privacy (solid) fence in order to screen the vehicles from
visibility from adjacent properties within the business park. Staff is further recommending a

condition be placed on the use limiting the outside storage of vehicles to no more than ten
consecutive days per vehicle. Planner Kolner stated the proposed use is permitted in the zoning
district. Staff has investigated the proximity of the City water tower to the site and determined
the City’s water supply is not in danger of contamination due to the location of the proposed
business on the premises.
Mr. Waltman stated Maaco specializes in production painting. There would be no mechanical
work, frame work or other automobile repairs on the premises. If such work is needed, the
vehicles would be sent out to an auto repair facility. Mr. Waltman noted in most instances,
vehicles are parked overnight on the premises for three to five days.
Chairman Howell opened the floor for questions and comments from the commissioners.
Responding to an inquiry, Mr. Waltman noted hours of operation would be 7 a.m. until 7 p.m. on
Monday through Friday, 7 a.m. until 1 p.m. on Saturdays. The business would not be open on
Sundays.
In response to an inquiry regarding outside lighting in order to provide security for the vehicles,
Mr. Waltman stated there would be all-mounted lights. The business would depend upon the
security fencing and security cameras to protect the vehicles which are being stored outside.
Brief discussion followed regarding the City’s enforcement of the ten-day overnight storage
maximum to be included as a condition of the approval of the conditional use permit. Mr.
Waltman stated there would be no problem complying with the condition. Maaco has criteria
which prohibit the long-time storage of vehicles on the premises of its businesses.
Responding to an inquiry regarding landscaping, Mr. Waltman noted they would comply with
the City’s landscape ordinance requirements.
Mr. Waltman responded to a question regarding proposed signage for the facility noting the
standard Maaco wall sign is 144 square inches in size. If allowed, they would also construct a
monument sign on the site. Mr. Waltman noted they would conform to the sign ordinance
requirements.
In response to Chairman Howell invitation for questions or comments from the audience, there
were none. There was no further testimony, question or comment regarding this matter.
Motion by Cadotte, seconded by Nadeau, to recommend to City Council with regard to File No.
Z-718, a request for conditional use permit to allow outdoor storage for the overnight parking of
vehicles on the premises located at 2826 Barney Court as requested by David H. Brown, be
granted subject to the following conditions:
1. Fencing materials surrounding the outdoor storage area shall be of solid wood or vinyl
only in order to provide adequate screening of the area;
2. No vehicles shall be parked or stored overnight for a period longer than ten consecutive
days;
and that, Table 31, the Approval Criteria for Conditional Use Permits, pages 357-358 of the
Zoning Ordinance, has been met.

Chairman Howell closed the Public Hearing at 7:45 p.m.
Other Business
Ekstrom noted Wal-Mart intends to begin phasing out its sewing, notions and fabrics division in
all of its stores and requested Staff once again look into the possibility of acquiring a fabric store
in town.
Brief discussion also occurred regarding the possibility of Olive Garden locating a site in
McHenry.
