HomeMy WebLinkAboutMinutes - 01/08/2004 - Planning and Zoning CommissionMinutes of the City of McHenry PLANNING AND ZONING COMMISSION January 8, 2004 The January 8, 2004 meeting of the City of McHenry Planning and Zoning Commission was called to order by Chairman Howell at 7:31 p.m. in the McHenry Municipal Center Classroom. Commission members in attendance: Buhrman, Cadotte, Ekstrom, Howell, Nadeau, Thacker. Absent: Franzen. Also in attendance: Planner Martin, Deputy Clerk Kunzer. Public Hearing: Kimball Hill Homes File No. Z-609 Shamrock Farms N4 and N5 Chairman Howell at 7:32 p.m. called to order a Public Hearing regarding an application for lot width variances in Shamrock Farms Neighborhood 4 and Neighborhood 5, as filed by Kimball Hill Homes. Planner Martin, noting Staff had met with the applicant today, requested the Public Hearing be recessed until Thursday, January 15, 2004 at 7:30 p.m. Additional information agreed upon by the City and the applicant would be provided to the Commission prior to January 15th. Motion by Cadotte, seconded by Nadeau, to recess the Public Hearing regarding File No. Z-609, an application for lot width variances for Kimball Hill Homes Shamrock Farm Subdivision Neighborhood 4 and Neighborhood 5, until Thursday, January 15, 2004 at 7:30 p.m. in the McHenry Municipal Center Council Chambers. Voting Aye: Buhrman, Cadotte, Ekstrom, Howell, Nadeau, Thacker. Voting Nay: None: Not Voting: None. Abstaining: None. Absent: Franzen. Motion carried 6-0. Chairman Howell closed the Public Hearing at 7:35 p.m. Approval of Minutes Motion by Buhrman, seconded by Cadotte, to approve the minutes of the regularly scheduled December 18, 2003 meeting of the Planning and Zoning Commission as presented. Voting Aye: Buhrman, Cadotte, Ekstrom, Howell, Nadeau, Thacker. Voting Nay: None: Not Voting: None. Abstaining: None. Absent: Franzen. Motion carried 6-0. P&Z Commission January 8, 2004 Page 2 Public Hearing File No. Z-607a – William and Gina Kolar 4405 Ponca Street and File No. Z-607b – Craig and Laurie Roby 4406 Ponca Street At 7:36 p.m. Chairman Howell called to order the Public Hearing regarding: • File No. Z-607a, an application for zoning map amendment to RS-4 upon annexation, filed by William and Gina Kolar for their property located at 4405 Ponca Street; • File No. Z-607b, an application for zoning map amendment to RS-4 upon annexation, filed y Craig and Laurie Roby for their property located at 4406 Ponca Street. Chairman Howell stated Notice of the Public Hearing was published in the Northwest Herald on December 19, 2003. A Certificate of Publication is on file in the Office of the City Clerk. Certified notices were mailed to all adjacent property owners. An affidavit of service is on file in the Office of the City Clerk. City Planner Martin stated the purpose of this Public Hearing is to review the applicants’ requests for zoning classification to RS-4 upon annexation to the City of McHenry. He noted both applicants sought connection to municipal water following failure of the Ponca Neighborhood Community Well. Council granted the connections to the non-residents provided they commence annexation proceedings within 90 days of the connection approval. The request for consideration this evening is to reclassify the subject properties to RS-4 upon annexation. He noted the size of the lots most closely conforms to the City’s RS-4 bulk area requirements. He concluded it is Staff’s recommendation to grant the request. Chairman Howell opened the floor to questions and/or comments from the Commissioners. In response to an inquiry, Planner Martin stated sporadic requests for connection to City water and/or sanitary sewer are received by Council. Council has made it a policy to require these applicants to seek annexation. A Public Hearing before the Planning and Zoning Commission is required in order to reclassify these parcels. Following a question regarding the contiguity of the parcels to City limits, Planner Martin stated once 4406 Ponca is annexed, 4405 Ponca will also be contiguous to the City. Some discussion occurred regarding the capping of the community well. Concerns were raised that the well should be inspected and capped as it will no longer be used. Chairman Howell invited questions and/or comments from the audience. There were none. Roger Barnes, 4407 Ponca Street was sworn in by Chairman Howell and addressed the Commission. Mr. Barnes stated the Kolar’s and Roby’s were the last two families to cease using the community well. He questioned if the City would inspect the well, assure that it is capped and that the 6’ X 20’ vault will be sealed now that the well is no longer being used. Planner P&Z Commission January 8, 2004 Page 3 Martin responded noting he was not certain if the City or County would be responsible for the inspections of the well. Mr. Barnes stated the Ponca Street residents do not want to be forcibly annexed to the City. He noted these two residents have been forced into annexation so that they can connect to City water. He stated the remainder of the Ponca Street residents have installed their own private wells and do not want to annex into the City. Motion by Buhrman, seconded by Cadotte, to recommend to the City Council that regarding: • File No. Z-607a, an application for zoning map amendment to RS-4 upon annexation, filed by William and Gina Kolar for their property located at 4405 Ponca Street; • File No. Z-607b, an application for zoning map amendment to RS-4 upon annexation, filed y Craig and Laurie Roby for their property located at 4406 Ponca Street. and that Table 33 the Approval Criteria for Zoning Map Amendments, page 401 of the Zoning Ordinance, has been met. Voting Aye: Buhrman, Cadotte, Ekstrom, Howell, Nadeau, Thacker. Voting Nay: None. Not Voting: None. Abstaining: None. Absent: Franzen. Motion carried 6-0. Chairman Howell stated for the record regarding the forced annexation of the islands of land issue, the residents in the area receive City services such as police and fire protection and snowplowing. Their properties should be annexed by the City. Thacker concurred with Chairman Howell. Chairman Howell closed the Public Hearing at 7:48 p.m. Other Business Planner Martin reported the Community Development Committee Meeting has been scheduled for Wednesday, January 14, 2004. at 7:30 p.m. in the Municipal Center Aldermen’s Conference Room the Agenda will include discussion regarding aesthetics, the revised concept plan for the Adams Farm, and revisions to the PUD ordinance. Planner Martin encouraged the Commissioners to attend the committee meeting. Planner Martin also reported Council adopted the Downtown Plan at its December 19th regularly scheduled meeting. Pier design for the Riverwalk has also been approved.
