HomeMy WebLinkAboutMinutes - 06/13/2013 - Planning and Zoning CommissionCity of McHenry Planning and Zoning Commission Minutes June 13, 2013 Chairman Strach called the June 13, 2013 regularly scheduled meeting of the City of McHenry Planning and Zoning Commission to order at 7:30 p.m. In attendance were the following: Buhrman, Nadeau, Sobotta, Strach, and Thacker. Absent: Morck, Doherty. Also in attendance were: Deputy City Administrator Martin and Planning and Zoning Secretary Wolf. Approval of Minutes Motion by Buhrman, seconded by Nadeau, to approve the minutes of the Planning and Zoning Commission Meeting as presented: April 25, 2013 regularly scheduled meeting. Voting Aye: Buhrman, Nadeau, and Strach. Voting Nay: None. Not Voting: None. Abstaining: Sobotta, Thacker. Absent: Morck, Doherty. Public Hearing: Next Automotive Sales Service and Collision File No. Z-812 2826 Barney Court Use variance to allow an open sales lot and Variance from the off-street parking requirements for vehicle sales Chairman Strach called the Public Hearing to order at 7:32 p.m. regarding file Z-812 filed by Next Automotive Sales Service and Collision for the property located at 2826 Barney Court in which the applicant was seeking a recommendation to grant a use variance to allow an open sales lot and variance from the off-street parking requirements for vehicle sales on the premises. Deputy City Administrator Martin stated the applicant has requested dismissal of the case. Chairman Strach closed the Public Hearing regarding this matter at 7:34 p.m. Public Hearing: Ryan Lanning File No. Z-814 2906 W. Illinois Route 120 Use Variance to Allow Tattooing Chairman Strach called the Public Hearing to order at 7:35 p.m. regarding File No Z-814 an application for a use variance to allow tattooing as submitted by Ryan Lanning for the property located at 2906 W. Illinois Route 120. Chairman Strach stated Notice of the Public Hearing was published in the Northwest Herald on May 29, 2013. Notices were mailed to all abutting property owners of record as required by ordinance. The subject property was posted. A Certificate of Publication and Affidavit of Compliance with notice requirements are on file in the City Clerk’s Office. Planning and Zoning Commission June 13, 2013 Page 2 In attendance was Ryan Lanning who was sworn in by Chairman Strach. Mr. Lanning said he would like to keep his tattoo shop in the City of McHenry believing it will be beneficial to the art community of the City. He will be sure it is clean and sterile. Deputy City Administrator Martin provided the Commission with the Staff Report regarding this matter stating the applicant recently received an extension to an existing temporary use permit to continue allowing tattooing until July 1, 2013 but is seeking a use variance to allow the use permanently. The applicant is licensed from the Illinois Department of Public Health to do tattooing. Staff does not believe a tattoo parlor will have any adverse land use impacts on adjacent properties or require additional City services. Deputy City Administrator Martin further stated Staff supports the use variance to allow tattooing on the subject property with the condition the use variance shall expire and become null and void if the tattoo use ceases for a period of six consecutive months. Chairman Strach invited questions and/or comments from the Commission. Commissioner Thacker asked if Mr. Lanning was currently doing business at the property address and if any type of signage would be added. Mr. Lanning responded that he is currently doing business there under a temporary use permit. Mr. Lanning also stated that he will have window signage and possibly add a professional 3x4 sign at the street. Mr. Lanning noted that some of his employees constructed a makeshift sign out of plywood and they have been told to remove it. Mr. Lanning offered to let Commissioners view pictures he had with him of the inside of the shop. Commissioners viewed the pictures. Commissioner Nadeau asked if the McHenry County Health Department checks on tattoo establishments periodically. Mr. Lanning replied that they do and he has all his appropriate documentation. Commissioner Thacker inquired into the frequency of Health Department visits and whether they are scheduled or unscheduled. Mr. Lanning stated there is one inspection that is scheduled per year. If the Health Department receives complaints, they will then do unscheduled visits. Chairman Strach opened the floor to questions and comments from the audience. There was nobody in attendance who wished to address the Commission regarding this matter. Chairman Strach closed the public comment portion of the hearing at 7:42 p.m. Motion by Nadeau, seconded by Buhrman, to recommend to the City Council with regard to File No. Z- 814, an application for a use variance to allow tattooing on the property located at 2906 W. Illinois Route 120, as presented by applicant Ryan Lanning with the condition the use variance shall expire and become null and void if the tattoo use ceases for a period of six consecutive months, be granted, and that Table 32 (A), of the Zoning Ordinance, has been met. Motion carried 5-0. Chairman Strach closed the Public Hearing regarding File No. Z-814 at 7:45 p.m. Staff Report There was a request by Next Automotive for a special meeting to be held on July 18, 2013. A quorum can attend. A special meeting of the Planning and Zoning Commission will be scheduled for July 18, 2013 for that purpose. The next regularly scheduled meeting of the Commission will be on July 25, 2013 Other Business Deputy City Administrator Martin introduced Mike Sobotta as the new plan commissioner. Mr. Sobotta stated he likes living in McHenry and is happy to contribute to the development of the City. Adjournment Motion by Nadeau, seconded by Thacker, to adjourn the meeting at 7:50 p.m. Voting Aye: Buhrman, Nadeau, Sobotta, Strach and Thacker. Voting Nay: None. Not Voting: None. Abstaining: None.
