HomeMy WebLinkAboutMinutes - 01/16/2017 - City CouncilREGULAR MEETING January 16, 2017 Mayor Low called the regularly scheduled January 16, 2017 meeting of the McHenry City Council to order at 7:00 p.m. In attendance were the following Aldermen: Santi, Glab, Schaefer, Curry, Wimmer, Peterson and Condon. Absent: None. Also in attendance: City Administrator Morefield, Deputy City Administrator Hobson, Director of Economic Development Martin, Chief of Police Jones, Construction Engineer Strange, Director of Community Development Polerecky, Director of Finance Lynch and City Clerk Jones. PLEDGE OF ALLEGIANCE LED BY MCHENRY CUB SCOUT PACK 214 Mayor Low invited the Scouts from McHenry Cub Scout Pack 214 to lead the Council in the Pledge of Allegiance. Following the Pledge of Allegiance, Mayor Low announced that the members of McHenry Cub Scout Pack 214 are working on their Citizenship Badge, SWEARING -IN CEREMONY FOR MCHENRY POLICE COMMANDER PAUL D. FUNK AND MCHENRY POLICE SERGEANT NICHOLAS R. CLESEN Mayor Low introduced Chief of Police Jones who introduced the three members of the Police Commission, Chairman Rich Huber, Commissioner Ramon Gregorio and Commissioner Michael Roberts. Chief Jones stated that it is always enjoyable to observe officers rise through the ranks in the Police Department. Chief Jones introduced Commander Paul D. Funk and informed the Council and that Commander Funk has been with the McHenry Police Department for 19-years and has served the last eight years as Sergeant. Police Commission Chairman Huber administered the Oath of Office to Commander Paul D. Funk. Chief Jones introduced Sergeant Nicholas R. Clesen and informed Council that Sergeant Clesen has served on the McHenry Police Department for 13-years and his most recent assignment was Investigator. Commissioner Gregorio administered the Oath of Office to Sergeant Nicholas R. Clesen. Mayor low congratulated Commander Funk and Sergeant Clesen stating it is always impressive and a pleasure when the opportunity presents itself for a gathering of the McHenry Police Department. Mayor Low thanked the members of the McHenry Police Department for their professionalism, dedication and service to the community. CITY OF MCHENRY MISSION STATEMENT Mayor Low read aloud the Mission Statement of the City of McHenry. PUBLIC INPUT SESSION No one spoke at Public Input Session. Award of Bid for Water Treatment Plant No. 4 Building Maintenance to Depree Construction of Joliet, Illinois, for an amount not to exceed $39,730.50; B. Second Year Contract Extension for 2017 Asphalt Crack Sealing Maintenance Program to SKC Construction, Inc., for $47,500 (actual amount my vary based on final measured quantifies); C. Advertise for Bids for 2017 Spring Tree Planting Program D. Issuance of As Needed Checks, in the amount of $3,043,382.82; and E. Approval of Payment of Bills, in the amount of $391,760.18. MOTION TO APPROVE (A) REQUEST FOR A LIQUOR LICENSE CLASSIFICATION TRANSFER FROM Al TO A, FROM I.M. STEIN D/B/A BIG FRAN'S BOARDWALK GAMING (A/K/A STUC'S PIZZA & RIBS), LOCATED AT 3401 WEST ELM STREET AND (B) ORDINANCE DECREASING THE NUMBER OF CLASS Al LIQUOR LICENSES AND INCREASING THE NUMBER OF CLASS A LIQUOR LICENSES N EFFECT City Administrator Morefield informed Council a request was submitted by Mr. Fritz Larsen, President and operator of I. M. Stein, Inc., d/b/a Stuc's Pizza & Ribs, located at 3401 West Elm Street, to transfer his current liquor license classification from Class Al to Class A. Mr. Larsen is changing the name of Stuc's Pizza to Big Fran's Boardwalk Gaming. The business would open at 10:00 am and have a limited menu, expanding to a full menu at 4:00 pm daily. City Administrator Morefield informed Council that Mr. Larsen was issued a City of McHenry Liquor License in March 2014, upon the purchase of the business known as Stuc's Pizza. In addition to Stuc's Pizza, Mr. Larsen owns two alcohol establishments in Johnsburg, Illinois, Big Fran's Boardwalk Gaming and Halftime Bar & Grill. Mr. Larsen and his employees are conversant with the Illinois Liquor Control regulations. All associated fees have been paid and all required documents have been submitted. Alderman Glab opined that he is not comfortable voting on a video gaming establishment this evening. Alderman Schaefer stated that Stuc's Pizza has been an established business in the community and in his estimation he views the business as different then a video gaming establishment. Alderman Santi concurred with Alderman Schaefer stating this is a reinvestment in the community. Responding to an inquiry from Alderman Curry regarding the menu, Mr. Larsen stated that he would have a limited menu. The primary business would be video gaming as the pizza business has decreased significantly over the years. Regular Meeting Page 3 January 16, 2017 Responding to Alderman Condon's inquiry, Mr. Larsen answered there will still be pizza for carry -out orders however, there would no longer be delivery service. Mayor Low opined that Mr. Larsen has shown himself to be a responsible business owner and she is pleased he has chosen to remain in the City of McHenry. Mayor Low stated that Mr. Larsen's parents did a great deal for the community. She has heard good things about Big Fran's in Johnsburg and it is a tribute to his mother to have successful businesses named for her. Motion by Santi, second by Schaefer, (1) approving the transfer of liquor classification from Class Al to Class A, as presented, and (2) approving an Ordinance decreasing the number of Class Al licenses and increasing the number of Class A Liquor Licenses in effect. Voting Aye: Santi, Curry, Schaefer, Wimmer, Peterson, Condon. Voting Nay: Glab. Absent: None. Motion carried. MOTION TO TABLE THE PLANNING AND ZONING COMMISSION'S RECOMMENDATION TO ADOPT AN ORDINANCE GRANTING A CONDITIONAL USE TO ALLOW A TAVERN WITHOUT LIVE ENTERTAINMENT FOR CL QUICK STOP OF BELVIDERE, INC. D/B/A LUCKY POKER, LOCATED AT 2214 W. ROUTE 120 UNTIL THE FEBRUARY 6, 2017 REGULARLY SCHEDULED CITY COUNCIL MEETING Motion by Condon, second by Curry, to table the Planning and Zoning Commission's recommendation to adopt an Ordinance granting a Conditional Use to allow a tavern without live entertainment for CL Quick Stop of Belvidere, Inc. d/b/a Lucky Poker, located at 2214 W. Route 120, until the February 6, 2017 Regularly Scheduled Council meeting. Voting Aye: Santi, Curry, Schaefer, Wimmer, Peterson, Condon. Voting Nay: Glab. Absent: None. Motion carried. MOTION TO TABLE THE CONSIDERATION OF A CLASS A LIQUOR LICENSE FOR CL QUICK STOP INC D/B/A LUCKY POKER, LOCATED AT 2214 W. ROUTE 120, AND AN ORDINANCE INCREASING THE NUMBER OF CLASS A LIQUOR LICENSES IN EFFECT UNTIL THE FEBRUARY 6, 2017 REGULARLY SCHEDULED CITY COUNCIL MEETING Motion by Curry, second by Schaefer, to table consideration of a Class A Liquor License for CL Quick Stop, Inc. d/b/a Lucky Poker, located at 2214 W. Route 120, and an Ordinance increasing the number of Class A Liquor Licenses in effect, until the February 6, 2017 Regularly Scheduled City Council meeting. MAYOR'S STATEMENT AND REPORT Mayor Low welcomed back Alderman Wimmer back to the Council following an extended absence. COMMITTEE REPORTS There were no Committee Reports. EXECUTIVE SESSION Motion by Condon, second by Santi, to adjourn to Executive Session, for the discussion of Employment matters, pursuant to 5 ILCS 120/2(c)(1) at 7:30 pm. Voting Aye: Santi, Glab, Schaefer, Curry, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. Motion by Condon, second by Wimmer, to return to Open Session at 8:00 pm. MOTION FOR APPROVAL OF A LABOR AGREEMENT BETWEEN THE ILLINOIS FRATERNAL ORDER OF POLICE LABOR COUNCIL (FOP UNIT II), REPRESENTING TELECOMMUNICATORS, COMMUNITY SERVICES OFFICERS AND RECORDS CLERKS, EXPIRING APRIL 30, 2021 Motion by Condon, second by Wimmer, approving a Labor Agreement between the Illinois Fraternal Order of Police Labor Council (FOP Unit II), representing Telecommunicators, Community Services Officers and Records Clerks, expiring April 30, 2021, and authorizing the Mayor and the City Clerk to execute a Collective Bargaining Agreement between the Illinois Regular Meeting Page 5 January 16, 2017 Fraternal Order of Police, representing City of McHenry Telecommunicators, Community Services Officers and Records Clerks (Unit II) for the period May 1, 2017 through April 30, 2021.
