HomeMy WebLinkAboutResolutions - 20-6 - 03/16/2020 - Miller Point Park Resolution 20-6 A Resolution Establishing Miller Point a Public Park to be Known as Miller Point Park WHEREAS, the City of McHenry, McHenry County, Illinois (the "City"), is a home rule municipality as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of this Resolution constitutes an exercise of the City's home rule powers and functions as granted in the Constitution of the State of Illinois; WHEREAS, Section 11-98-1 of the Illinois Municipal Code allows the corporate authorities of each city to establish and maintain public parks ("Public Park") for the use and benefit of the inhabitants of the municipality (65 ILCS 5/11-98-1); WHEREAS, pursuant to Chapter 8, Developer Donations, of Title 12 of the Municipal Code, City of McHenry, Illinois, the City holds in trust in a special segregated fund, cash donations for the acquisition or development of park and recreational land and facilities to service the needs of its residents ("Developer Donations"); and WHEREAS, the City desires to establish Miller Point, as defined below, as a Public Park, for various reasons, including proper use of Developer Donations for the development of Miller Point to service the needs of City residents. NOW, THEREFORE, BE RESOLVED by the CITY COUNCIL of the CITY OF McHENRY, McHenry County, Illinois, as follows: Section 1: The City hereby establishes the property located at 1202 N. Riverside Drive, McHenry, Illinois, with the designated Property Index Number of 09-26-477-012 and depicted on the attached Exhibit A, commonly known as Miller Point, as a Public Park hereby designated as Miller Point Park. Section 2: Any Developer Donations that have been acquired by the City in lieu of park land dedications may, in the future, be used for the development of Miller Point Park. Section 3: All resolutions and parts of resolutions in conflict with this Resolution be and the same are hereby superseded, that this Resolution be in full force and effect forthwith upon its adoption and that this Resolution shall be deemed to be subject to modification in application to comply with the general election law.
