Any municipality that doesn't already cover harassment between elected officials, must do so. While the City's current harassment policy basically already covers this, since our complaint reporting procedures identify that officials can also file a complaint, the language provided in the resolution must be added. RECOMMENDATION: Therefore, if Council concurs, then it is recommended a motion be made to pass the attached Resolution Adopting a Revised Anti-Harassment Policy. R-20-4 RESOLUTION ADOPTING A REVISED ANTI-HARASSMENT POLICY WHEREAS, the Illinois General Assembly has recently enacted Public Act 101-0221, an Act concerning government, which signed into law August 9, 2019 and requires municipalities to adopt an ordinance or resolution amending their sexual harassment policy to provide for a mechanism for re- porting and independent review of allegations of sexual harassment made against an elected official of the governmental unit by another elected official of a governmental unit; and WHEREAS, pursuant to PA 101-0221, a policy has been drafted that complies with said Public Act and all prior policies prohibiting harassment, including sexual harassment, shall be superseded by the Anti-Harassment Policy adopted by this resolution. NOW, THEREFORE, BE RESOLVED by the CITY COUNCIL of the CITY OF McHENRY, McHenry County, Illinois, that the Anti-Harassment Policy, attached hereto and made a part hereof, is hereby adopted. Introduction The City of McHenry (the "City") desires to have a professional working environment for its employees so that they may carry out their duties in productive and positive surroundings. Although conduct may not rise to the level of unlawful harassment from a legal perspective, the City wants to protect its employees from abuse and to prevent conduct from becoming so severe or pervasive as to alter the conditions of an employee's employment, create an abusive, intimidating or hostile working environment, or result in a tangible employment action. Accordingly, the City has adopted a "zero tolerance" policy against harassment. Harassment is unwarranted and unwanted verbal or nonverbal conduct that threatens, intimidates, annoys or insults another person where such conduct has the purpose or effect of creating an offensive, intimidating, degrading and/or hostile working environment and/or interferes with and/or adversely affects a person's performance. The City prohibits any form of unlawful harassment against its employees and applicants for employment based on actual or perceived factors such as sex(including sexual harassment,gender harassment, and harassment based on pregnancy, childbirth, or related medical conditions), race, color, creed, religion, ancestry, national origin, age, mental or physical disability, marital status, order of protection status, military status, unfavorable discharge from military service, citizenship status, sexual orientation including gender-related identity whether or not traditionally associated with the person's designated sex at birth, or any other basis prohibited by applicable federal, state, or local fair employment laws or regulations. B. Sexual Harassment With respect to sexual harassment,the City prohibits any unwelcome sexual advances,request for sexual favors, and other verbal or physical conduct of a sexual nature when: 1.submission to such conduct is made either explicitly or implicitly a term or condition of an individual's employment; or 2.submission to or rejection of such conduct by an individual is used as the basis for employment decisions affecting such individual; or 3.such conduct may have the purpose or effect of unreasonably interfering with an individual's work performance; or 4.such conduct may create an intimidating, hostile, or offensive working environment. Examples of the types of conduct that would violate the City's policy including the following: Verbal: sexual innuendos, suggestive comments, insults, humor, and jokes about sex, anatomy or gender-specific traits, sexual propositions,threats,repeated requests for dates, or statements about other employees, even outside of their presence, of a sexual nature. Non-verbal: suggestive or insulting sounds(whistling),leering,obscene gestures,sexually suggestive bodily gestures, "catcalls", "smacking" or"kissing"noises. Visual:posters,signs,pin-ups or slogans of a sexual nature,viewing pornographic material or websites. Physical: touching, unwelcome hugging or kissing, pinching, brushing the body, any coerced sexual act or actual assault. Textual/Electronic: "sexting" (electronically sending messages with sexual content, including pictures and video), the use of sexually explicit language, harassment, cyber stalking and threats via all forms of electronic communication (e-mail, text/picture/video messages, intranet/on-line postings, blogs, instant messages and social network websites like Facebook and Twitter). The most severe and overt forms of sexual harassment are easier to determine. On the other end of the spectrum, some sexual harassment is more subtle and depends, to some extent, on individual perception and interpretation. The courts will assess sexual harassment by a standard of what would offend a"reasonable person." Both opposite sex and same sex harassment are prohibited under this policy. C. Other Forms of Harassment With respect to other forms of harassment, the City prohibits slurs or other verbal or physical conduct relating to matters such as actual or perceived race, color, creed, religion, ancestry, national origin, age, mental or physical disability, marital status, order of protection status, pregnancy, military status, unfavorable discharge from military service, citizenship status, sexual orientation including gender-related identity whether or not traditionally associated with the person's designated sex at birth, or any other basis prohibited by applicable federal, state, or local fair employment laws or regulations which: 1. may have the purpose or effect of creating an intimidating,hostile,or offensive working environment; or 2. may have the purpose or effect of unreasonably interfering with an individual's work performance; or 3. otherwise may adversely affect an individual's employment opportunities. D. Coverage of the Policy 1.The City's "zero-tolerance" policy with respect to harassment applies to conduct in or connected to the workplace, whether it is physical or verbal, and whether it is committed by City officials, department heads, fellow employees or non-employees (such as customers,vendors, suppliers,or business invitees). The conduct prohibited by this policy is not only unacceptable in the workplace itself but also at any other work-related setting such as holiday parties, gatherings or other work-related social events, on business trips, and at conferences, seminars, educational gatherings, and other meetings. Each City official and department head is responsible for creating an atmosphere free of harassment, whether it is sexual or another form of harassment. In addition, all employees are responsible for respecting the rights of their fellow employees and for cooperating in any investigation of alleged harassment. 2. Responsibilities: Each employee is responsible for assisting in prevention of harassment through the following acts: Refraining from participation in, or encouragement of, actions that could be perceived as harassment; Reporting acts of harassment; and Encouraging any employee,who confides that he/she is being harassed,to report these acts of harassment. Each supervisor shall be responsible for preventing acts of harassment. These responsibilities include: Monitoring the workplace environment on a daily basis for signs that harassment may be occurring. Counseling all employees on the types of behavior prohibited and the City's procedures for reporting and resolving complaints of harassment. Stopping any observed acts that may be considered harassment and taking appropriate steps to intervene, whether or not the involved employees are within his/her line of supervision. Taking immediate action to limit the work contact between employees where there has been a complaint of harassment,pending investigation. Each supervisor has the responsibility to assist any employee, who comes to that individual with a complaint of harassment, in documenting and filing a complaint in accordance with this policy. Failure to take action to stop known harassment will result in disciplinary action up to and including termination of employment. E. Reporting and Investigating Alleged Harassment While the City encourages individuals who believe they are being harassed to firmly and promptly notify the offender that his or her behavior is unwelcome,the City also recognizes that power and status disparities between an alleged harasser and a target may make such a confrontation impossible. In the event that such informal, direct communication between individuals is either ineffective or impossible,or even when such communication between the individuals has occurred, the following steps should be taken to report a harassment complaint: 1. Reporting of the Incident: All City employees and officials are urged to report any suspected harassment by another employee or official to the Human Resources Director, except where the Human Resources Director is the individual accused of harassment. In that case,the complaint should be reported to the City Administrator. If the victim prefers to report the suspected harassment to someone of the opposite sex from that of the Human Resources Director or City Administrator, the complaint can be reported to a Director. Elected officials may report an incident to a council member in accordance with paragraph F of this policy. The report may be made initially either orally or in writing, but reports made orally must be reduced to writing before an investigation can be initiated and a resolution achieved. 2. Investigation of the Complaint: When a complaint has been reduced to writing, the City Administrator, or person receiving the complaint, will initiate an investigation of the suspected harassment. The investigation will include an interview with the individual(s) who made the initial report, the person(s) toward whom the suspected harassment was directed, and the individual(s)accused of the harassment. Any other person who may have information regarding the alleged harassment may also be interviewed. 3. Preparation of a Written Report: The person responsible for investigating the complaint shall prepare a written report. The report shall include a finding that harassment occurred, harassment did not occur, or there is inconclusive evidence as to whether harassment occurred.A copy of the report will be given to the individual(s)who made the initial report, the person(s) to whom the suspected harassment was directed, and the individual(s) accused of the harassment. Where a hostile work environment has been found to exist,the City will take all reasonable steps to eliminate the conduct creating such an environment. 4. Keeping of Records and the Confidentiality of Such Records: Employees or other persons who report incidents of harassment are encouraged to keep written notes in order to accurately record the offensive conduct. Every effort shall be made to keep all matters related to the investigation and various reports confidential to the extent possible. In the event of a lawsuit,however,the City advises that those records maintained by the City and any records maintained by the complainant may not be considered privileged from disclosure. F. Harassment Allegations by Elected Officials Against Other Elected Officials Alleged harassment by one elected official against another can be reported to the Mayor. If the Mayor is the person reporting the harassment or is implicated by the allegation, the report can be made to any other Alderman. If a complaint is made against an elected official of the City by another elected official of the City under this Section, the matter must be referred to the City's legal counsel. The allegations of the complaint will be thoroughly investigated through an independent review, which may include referring the matter to a qualified, independent attorney or consultant to review and investigate the allegations. Further,reasonable remedial measures will be taken as determine by the other Aldermen who are not the complainant or the official who is the subject of the complaint. G. Time Frame for Reporting Harassment The City encourages prompt reporting of complaints so that rapid response and appropriate action may be taken.Thus,all complaints should be reported within six months of the alleged harassment. H. No Retaliation No City official or employee shall take any retaliatory action against any City employee due to a City employee's: 1. Disclosure or threatened disclosure of any violation of this policy, 2. The provision of information related to or testimony before any public body conducting an investigation,hearing or inquiry into any violation of this policy, or 3. Assistance or participation in a proceeding to enforce the provisions of this policy. For the purposes of this policy, retaliatory action means the reprimand, discharge, suspension, demotion, denial of promotion or transfer, or change in the terms or conditions of employment of any City employee that is taken in retaliation for a City employee's involvement in protected activity pursuant to this policy. No individual making a report will be retaliated against even if a report made in good faith is not substantiated. In addition, any witness will be protected from retaliation. Similar to the prohibition against retaliation contained herein, the State Officials and Employees Ethics Act (5 ILCS 430/15-10) provides whistleblower protection from retaliatory action such as reprimand, discharge, suspension, demotion, or denial of promotion or transfer that occurs in retaliation for an employee who does any of the following: 1. Discloses or threatens to disclose to a supervisor or to a public body an activity,policy, or practice of any City officer or employee that the City employee reasonably believes is in violation of a law, rule, or regulation, 2. Provides information to or testifies before any public body conducting an investigation, hearing, or inquiry into any violation of a law, rule, or regulation by any City officer or employee, or 3. Assists or participates in a proceeding to enforce the provisions of the State Officials and Employees Ethics Act. Pursuant to the Whistleblower Act (740 ILCS 174/15(a)), an employer may not retaliate against an employee who discloses information in a court,an administrative hearing,or before a legislative commission or committee, or in any other proceeding, where the employee has reasonable cause to believe that the information discloses a violation of a State or federal law,rule,or regulation. In addition, an employer may not retaliate against an employee for disclosing information to a government or law enforcement agency, where the employee has reasonable cause to believe that the information discloses a violation of a State or federal law, rule, or regulation. (740 ILCS 174/15(b)). According to the Illinois Human Rights Act(775 ILCS 5/6-101), it is a civil rights violation for a person, or for two or more people to conspire, to retaliate against a person because he/she has opposed that which he/she reasonably and in good faith believes to be sexual harassment in employment, because he/she has made a charge, filed a complaint, testified, assisted, or participated in an investigation, proceeding, or hearing under the Illinois Human Rights Act. An employee who is suddenly transferred to a lower paying job or passed over for a promotion after filing a complaint with IDHR or EEOC, may file a retaliation charge—due within 180 days IDHR) or 300 days (EEOC) of the alleged retaliation. I.Disciplinary Action If any City employee engages in conduct that violates this policy, or other conduct that the City believes is unprofessional, that employee will be subject to discipline up to and including termination of employment. In addition to any and all other discipline that may be applicable pursuant to municipal policies, employment agreements,procedures, employee handbooks and/or collective bargaining agreement, any person who violates the Prohibition on Sexual Harassment contained in 5 ILCS 430/5-65, may be subject to a fine of up to $5,000 per offense. J. Consequences for Knowingly Making a False Report of Sexual Harassment Pursuant to 5 ILCS 430/70-5 A false report is a report of sexual harassment made by an accuser using the sexual harassment report to accomplish some end other than stopping sexual harassment or retaliation for reporting sexual harassment.A false report of sexual harassment is not defined as a report made in good faith but which cannot be proven. Rather, a false complaint of sexual harassment is defined as an intentionally made false or frivolous report or bad faith allegation. Given the seriousness of the consequences for the accused, any person who intentionally makes a false report alleging sexual harassment shall be subject to discipline up to and including termination of employment. In addition,any person who intentionally makes a false report alleging a violation of any provision of the State Officials and Employees Ethics Act to an ethics commission,an inspector general,the State Police, a State's Attorney, the Attorney General, or any other law enforcement official is guilty of a Class A misdemeanor. An ethics commission may levy an administrative fine of up to 5,000 against any person who intentionally makes a false, frivolous or bad faith allegation. K. External Procedures The City hopes that any incident of harassment can be resolved through the internal procedures outlined above. Employees of the City,however, have the right to file formal harassment charges including charges of retaliation with the Illinois Department of Human Rights(the"IDHR")and/or with the Equal Employment Opportunity Commission (the "EEOC"). A charge with the IDHR must be filed within 180 days of the harassing incident. A charge with the EEOC must be filed within 300 days of the incident. It is unlawful for an employer to retaliate against an employee for filing a charge of harassment with the IDHR or the EEOC. McArdle, City Attorney RE: 1. Rejection of all Bids for Printing and Delivery of Recreation Brochures and City Newsletter; and 2. Consideration and Approval of a Negotiated Contract with Woodward Printing Services in an amount not to exceed $25,929 for Printing and Delivery of Recreation Brochures and City Newsletter ______________________________________________________________________________ AGENDA SUMMARY: Upon the completion of the bidding process for the group purchase of three seasonal Recreational Brochures and two seasonal City Newsletters staff is requesting Council’s authorization to (1) reject all bids and (2) enter into a negotiated contract with Woodward Printing Services for all five brochures and newsletters in an amount not to exceed $25,929. BACKGROUND: The City of McHenry issued a request for bids for the printing and delivery of three seasonal recreation brochures for the Parks & Recreation Department and two seasonal City newsletters. The bids were to be received by the City by 11:00 a.m. on Tuesday, February 25, 2020. Four total bids were received although only two bids were received in a timely manner. The timely bids received were from John Swift Co. Inc. in the amount of $32,408 and Castle Printech in the amount of $42,670. The late bidders were American Litho and Woodward Printing Services. Last year, 2019, Woodward Printing Services was the lowest responsive and responsible bidder and was awarded a contract in the amount of $25,929. ANALYSIS: The timely bids (John Swift and Castle Printech) received were between $6,000 and $16,000, higher than the previous year’s contract. The two late bids cannot be considered without risking a violation of bidding laws. Therefore, it is in the best interests of the City to reject all the bids. The competitive bidding statute does not preempt home rule authority and is not required. Instead, the City may negotiate a contract. RECOMMENDATION: Due to the significant increase in the amounts of the bids over the previous year’s contract, it is recommended that the City reject all the bids for the printing and delivery of three seasonal recreation brochures for the Parks & Recreation Department and two seasonal City newsletters. It is recommended that the City negotiate a contract with last year’s vendor. Therefore, if Council concurs, it is recommended that the following motions be made an acted upon: 1) Rejection of all bids received in response to the Bid for Printing and Delivery of Recreation Brochures and City Newsletter due to the City by 11:00 a.m. on Tuesday, February 25, 2020. 2) Negotiation and approval of a contract with Woodward Printing Services in an amount not to exceed $25,929 for the printing and delivery of three seasonal recreation brochures for the Parks & Recreation Department and two seasonal City newsletters. im Department of Public Works Troy Strange, P.E., Director of Public Works i 1415 Industrial Drive McHenry, Illinois 60050 Phone: (815) 363-2186 Fax: (815) 363-2214 McHeni 1/ www.cityofmchenry.org CONSENT AGENDA SUPPLEMENT DATE: March 2, 2020 TO:Mayor and City Council FROM: Troy Strange, P.E., Director of Public Works RE:Well 8 Raw Water Line Rehabilitation ATT: Project Location Map AGENDA ITEM SUMMARY: Staff requests City Council to consider authorizing staff to publicly bid the Well 8 Raw Water Line Rehabilitation Project. BACKGROUND: Fiscal Year 2020/2021 Capital Improvement Program will include $300,000 in Water & Sewer Funds for the construction of the Well 8 Raw Water Line Rehabilitation Project. Well 8 is one of two wells which supply raw water to Water Treatment Plant 3, located at 105 S. Crystal Lake Road. However, Well 8 is located approximately 2 blocks away from the Plant in the Malibu "Tot Lot".The well was drilled and raw water piping was installed to Water Treatment Plant 3 in 1985. During the past decade,the raw water line has developed a substantial number of leaks, requiring City personnel to perform numerous spot repairs. The raw water line has experienced pinhole leaks on most of the pipe bells. In recent years, a galvanized nipple and a galvanized plug have been replaced on the well's pitless adaptor. Several means were used to investigate the source of these failures. An electrician and a representative from the Ductile Iron Pipe Research Association (DIPRA) visited the site to determine the cause of the failures. The results of these inspections were inconclusive. As no definitive cause for this depreciation has been determined and the condition of the pipe continues to depreciate, it is recommended to rehabilitate the line in its entirety. Staff previously determined that a fibrous liner method similar to the process utilized for sewer lining would be the most cost effective option to complete the work. This project was originally included in the FY19/20 budget and bid out in the Summer of 2019; however, costs for the project came in well above the budgeted amount and the project was therefore deferred. The current budget number was developed utilizing the previous year's bid results and includes a minor adjustment in project limits. The current budget for the project is 300,000, which will be paid for utilizing Water & Sewer Capital Funds. Staff have coordinated the preparation of construction documents and will perform bidding services as well as construction inspection services. The project is anticipated to be completed by Fall of this year. As this project is being released for bid prior to the beginning of the FY20/21 fiscal year, staff are seeking authorization from City Council to publicly bid the project. The award of the project will be made in May of this year and will be contingent upon the approval of the FY20/21 budget and inclusion of the project. Subsequent to that approval, staff has brought forward a discussion item on the conceptual extension of the Sunday hours of Fiesta Days to accommodate the change in dates of the city Fireworks show from the first Saturday in July as an independent event to the incorporation of the event into the Fiesta Days schedule.The requested extension of the hours on Sunday July 12, 2020, would be to 10 p.m. The Chamber of Commerce is also requesting an extension of their Special Event Liquor License to 9:45 p.m. on the same date. BACKGROUND: The City of McHenry has traditionally partnered with the McHenry Area Jaycees to put on the Jaycee Days Independence Day Firework Show on the first Saturday in July. The City would typically provide $10,000 - $15,000 for the show and secure the fireworks vendor. The Jaycees would run all aspects of the event on the day of the show including parking cars and collecting money for the parking on a per car basis. The Jaycees would then present the City a check usually for$5,000 from the event revenue to offset the show costs. The last two years the City has incurred all costs for the event and also collected all the revenue from the cars and at the gate. In turn the City would then return 20% of the revenue to the McHenry Area Jaycees for their efforts of running the event on the day. The Jaycees have not been in a position to contribute toward the show for the last three years and as membership has dwindled, they have had a more difficult time putting on this large scale event. At the same time the City has spearheaded the effort to create partnerships and to streamline events to maximize the use of and burden upon the staff of the City of McHenry, particularly the police officers and the parks and recreation maintenance workers. With that in mind, discussions were initiated with the Chamber of Commerce and the Jaycees on the combination of the fireworks into the regular schedule of events for the Sunday of Fiesta Days as a true family day for the event. After an initial agreement from both parties and the coordination of internal logistics within the city, the discussion item was presented to City Council. The discussion was also received favorably and the Chamber was asked to submit a formal request for the change in the events. A proposed amended schedule of events was submitted and it attached to this supplement for review. The Chamber is requesting the extension of the event hours on Sunday July 121"to 10 p.m. and a liquor license to 9:45 p.m. (ticket sales ending at 9:30 p.m.). They would add live entertainment and have committed to add $5,000 to the City's existing contribution of$15,000 bring the total show back up to $20,000. The Jaycees will assist with the event and the Chamber will make a contribution the Jaycees for this assistance. Lastly the pull on city services will have been reduced on a key weekend in the summer schedule. ANALYSIS: A great number of benefits exist for all parties involved; however,the biggest win will be for the residents and event attendees, as the event offerings will multiply from previous years and the event will be free for all attendees. There will be many more food choices, live entertainment and a carnival for the children. The biggest benefactor may actually be the fireworks show itself. The additional$5,000 will make a great difference as will moving the show to a non-prime weekend. This change in date alone will account for a 10% increase in the number of shells that would be typically included in a show. The city show has fallen slightly behind other local shows in recent years and this is the opportunity to truly give it a shot in the arm that is needs. The show will occur on what has become the slowest day of the weekend for the event itself also giving it that same shot in the arm. The Chamber will gain some volunteers for the day of the event through the Jaycees participation and the Jaycees will receive a contribution without the entire event resting on their shoulders. Lastly, the creation of the partnership does streamline the summer event schedule giving city staff a brief respite in the middle of the summer. RECOMMENDATION: Therefore, if Council concurs,then staff requests that a motion be made to grant the McHenry Area Chamber of Commerce an extension of the event hours on Sunday July 12, 2020 to 1) accommodate the annual city fireworks show and 2) to extend the hours of the special event liquor license to 9:45 p.m. on July 12, 2020. Kelsey No. 3 LLC has since entered into a restaurant / bar agreement with the McHenry Country Club and will be taking over effective March 1 lth, 2020. Kelsey No. 3 LLC will also be d/b/a Metalwood Grille and has submitted an application for issuance of a Class "A" liquor license located at 820 N. Front Street(McHenry Country Club). Background: In March of 2019 the McHenry Country Club decided to outsource their food and beverage service which resulted in City Council accepting the surrender of the Country Club's Class "A" liquor license and the issuance of a new Class "A" license to Food For Thought LLC in its place in April of 2019. In March of 2020 the McHenry Country Club notified staff that they will be ending their agreement with Food For Thought LLC and have decided to enter into an agreement with Kelsey No. 3 LLC for both food and beverage service at the McHenry Country Club. With such a Class "A" license application has been submitted by Kelsey No. 3 LLC for consideration. Analysis: A complete background investigation was conducted by the police department. The results of this background confirmed that Kelsey No. 3 LLC is in good standing with the State. The owner of Kelsey No. 3 LLC, Lynn Manna was found to have successfully passed all requirements set forth in the ordinance. In addition it should also be noted that Ms. Manna has over 15 years of experience in alcohol sales as a previous liquor license holder. Attached to this supplement Council will find the license application and proof of insurance for review. Green Street, was granted a Class G1 Liquor License in October of 2017 (minutes attached). The business is now open and the operator, Mr. Dan Kernes, would like to add video gaming. Under guidelines adopted by Council in 2019,businesses wishing to have video gaming must apply and be approved by Council separate from liquor licensing. City Administrator Morefield noted Dan and Christine Kearns doing business as Hidden Pearl Cafe have submitted a request for a Class G1 liquor license for their new location at 1250 N. Green Street, former site of Some Other Nuts. Approval of the license requires approval of an ordinance amending the Municipal Code to increase the number of G1 licenses in effect. At this meeting Staff had the opportunity to review the concept of a Non-Highway Vehicle Ordinance with City Council and multiple members of the public. The results of this November discussion confirmed that Council and the public was in support of a new ordinance. During this Council Meeting staff was given direction from Council on regulations regarding; location of use, location restrictions, registration requirements, safety equipment, time restrictions, time of year usage and more. This is item is being brought forward at the March 2, 2020 City Council Meeting first, as a Discussion Item, to provide Council the opportunity to comment further, followed by an action item should Council choose to enact this ordinance following the discussion. In January staff drafted a proposed ordinance and subsequently met with available members of the Council in February to review the proposed ordinance for additional input and revisions. In addition, an interactive GIS Map was also composed as part of the ordinance. The results of these meetings allowed staff to make additional revisions recommended by Council. The below language is an accurate copy of the draft ordinance. Overview: 7-2-5 OPERATION OF NON-HIGHWAY VEHICLES ON CITY STREETS A. Definitions: For the purposes of this section, non-highway vehicle means a motor vehicle not specifically designed to be used on a public highway, including: 1. A golf cart, as defined in 625 ILCS 5/123.9; 2. A recreational off-highway vehicle,as defined in 625 ILCS 5/1-168.8. B. Operation: No person shall operate a non-highway vehicle on a City street except as set forth in this section. C. Registration: Each non-highway vehicle operating on a City street shall be registered with the City and display a City registration stickers and plate. This registration shall be valid from May The City of McHenry is dedicated to providing the citizens, businesses and visitors of McHenry with the highest quality of programs and services in a customer-oriented, efficient and fiscally responsible manner. 1st through November 1st of the year it was issued. Registrations shall not be transferable in the event of a change in ownership of the non-highway vehicle. Prior to issuance of a registration by the City,a non-highway vehicle must comply with the requirements set forth below. 1. An annual safety inspection shall be conducted by the McHenry Police Department or a designee authorized by the Chief of Police. 2. A non-highway vehicle must have,at minimum,the following operating equipment: a. Brakes; b. A steering apparatus; c. Tires; d. A rearview mirror; e. Red reflectorized warning devices in the front and rear; f. Seatbelts; g. A slow moving emblem(as required of other vehicles in 625 ILCS 5/12-709)on the rear of the non-highway vehicle; h. A headlight that emits a white light visible from a distance of five hundred (500) feet to the front and a tail lamp that emits a red light visible from at least one hundred(100)feet from the rear; i. Brake lights; and j. Turn signals. 3. A non-highway vehicle shall not have a modified exhaust system which will amplify or increase the noise of the non-highway vehicle above that emitted by the muffler originally installed on the non-highway vehicle. 4. Proof of valid insurance, as identified in 625 ILCS 5/7-601, et seq., must be provided for the non-highway vehicle and the registrant must agree to insure the non-highway vehicle while in use on City streets. 5. The registrant must agree and sign an indemnification form, releasing the City, its elected officials and its employees from liability and indemnifying and holding them harmless from any and all claims resulting from the operation of the non-highway vehicle. 6. A fee of one hundred dollars($100.00) shall be paid for the initial annual safety inspection of each non-highway vehicle. A fee of fifty dollars ($50.00) for the annual re-inspection for the same non-highway vehicle under the same ownership each year thereafter shall be paid. D. Location: No person shall operate a non-highway vehicle except on a City street as permitted in this section and no person shall operate a non-highway vehicle on the streets and locations specifically prohibited in this section. The City approved interactive GIS Golf Cart/UTV Map can be found on the City's website (www.cityofmchenry.org) which identifies the prohibited streets and locations along with permitted intersection crossings. 1. Permitted Streets: The operation of a non-highway vehicle shall be permitted on all City owned streets with a posted speed limit of 25 mph or less. In addition,the operation of a non- highway vehicle shall be permitted on the following streets at the specified locations: a.McCullom Lake Road from Blake Boulevard to Olde Mill Lane b. McCullom Lake Road between Pine Street and Kennedy Drive c. Crystal Lake Road between Front Royal and Lillian Street d. Cunat Drive between Bull Valley Road and Crystal Lake Road e. Municipal Drive 2. Prohibited Streets and Locations: The operation of a non-highway vehicle at the following locations is strictly prohibited: a.Green Street between John Street and Pearl Street b.Main Street between Front Street and Crystal Lake Road c.Pearl Street between Green Street and Richmond Road d.Pearl Street between Park Street and Lincoln Road(including Pearl Street Bridge) e.Riverside Drive between Miller Riverfront Park and Broad Street f.Waukegan Road east between Green Street and the end of the property located at 1110 N. Display of registration decals and rear registration plate; Non-highway vehicles registered with the City are issued two registration decals. The decals must be displayed on both sides of the machine by its own adhesive, in a position which is forward of the operator and visible to law enforcement. Operators should carry all necessary registration cards and paperwork with them for display to a law enforcement officer upon request. In addition, all non-highway vehicles registered as public use will be required to furnish a rear plate that displays the registration number. Plates can be created or purchased at owner's expense. Plate specifications: a. The plate must be a minimum of 4" in height and 7 1/2" wide and made of white material. b. The registration number must be made of black lettering a minimum of 1 1/2"high with a minimum 3/16" stroke. c. Only the four registration numbers and two letters need to be on the plate. The registration number can be found on both the decals issued by the City. d. The owner must maintain the plate so it is in legible condition; and the plate shall be attached to the rear of the vehicle. 3. Valid driver's license by the operator of the non-highway vehicle issued in his or her name by the Illinois Secretary of State or by a foreign jurisdiction; 4. The operator shall yield the right of way to all pedestrian and vehicular traffic which constitutes a hazard; 5. Compliance with the provisions of the Illinois Vehicle Code (625 ILCS 511-100, et seq., as amended)to include all speed limits and rules of the road; 6. No operation shall occur when visibility is impaired by weather, smoke, or other conditions or at any time when there is insufficient light to clearly see persons and vehicles on the roadway at a distance of five hundred(500)feet; 7. The number of occupants shall not exceed the number of seatbelts in the non-highway vehicle; and 8. Headlight and tail lamps must be lighted at all times when operating on City streets. G. Driving Under the Influence: A person who operates or is in actual physical control of a non- highway vehicle while under the influence of alcohol, drugs or a combination thereof shall be subject to enforcement through the Illinois Vehicle Code. H. Violation;Penalty: 1. Any person violating this section shall be subject to a citation and imposition of a fine up to 750 plus any attorney's fees incurred by the City for the prosecution of the case. 2. Any person who is cited for a violation of the Illinois Criminal Code or Illinois Vehicle Code while using their non-highway vehicle in McHenry, including no valid license, suspended/revoked license, reckless driving and driving under the influence which results in arrest shall result in an automatic temporary suspension of any City registrations and, upon a finding of guilty of a violation, shall result in an automatic revocation of any City registration. 3. Any person who has been issued two(2)or more citations for violations of this section within a twelve (12) month period shall result in an automatic temporary suspension of any City registrations, and, upon a finding of guilty of a violation, shall result in an automatic revocation of any City registrations for a minimum of twelve(12)months. Birk,Chief of Police RE: Ordinance 7-2-5: Operation of Non-Highway Vehicles on City Streets Attachments: Ordinance 7-2-5 Operation of Non-Highway Vehicles on City Streets Overview: After Council Discussion on November 181h, 2019, preparation meetings in February 2020 and follow-up discussion set for March 2, 2020, staff is seeking Council authorization to enact the attached new ordinance to allow for the controlled use of non-highway vehicles with the City of McHenry. Staff is present to answer any further questions Council may have. Background: After receiving numerous inquiries from within the community regarding the operation of non- highway vehicles on City streets, staff brought forward the topic for discussion at the November 181h, 2019 City Council Meeting. At this meeting Staff had the opportunity to review the concept of a Non-Highway Vehicle Ordinance with City Council and multiple members of the public. The results of this November discussion confirmed that Council and the public was in support of a new ordinance. During this Council Meeting staff was given direction from Council on regulations regarding; location of use, location restrictions, registration requirements, safety equipment, time restrictions, time of year usage and more. In January staff drafted a proposed ordinance and subsequently met with available Council in February to review the proposed ordinance for additional input and revisions. On March 2°d, 2020 at the regular City Council Meeting, Council has been scheduled to further discuss the draft ordinance. Analysis: Upon detailed discussions a Draft Ordinance (attached) was created and is being brought before Council for consideration. Within the ordinance the following topics were covered in detail. 1. Definitions 2. Operation 3. Registration The City of McHenry is dedicated to providing the citizens, businesses and visitors of McHenry with the highest quality of programs and services in a customer-oriented, efficient and fiscally responsible manner. 4. ORDINANCE NO. An Ordinance Amending Title 7; Motor Vehicles and Traffic, Chapter 2; General Regulations, by adding Section 7-2-5, Operation of Non-Highway Vehicles on City Street. WHEREAS, the City of McHenry, McHenry County, Illinois, ("City") is a home rule municipality as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in the Constitution of the State of Illinois; and WHEREAS, the City of McHenry is authorized under 625 ILCS 5/11-1426.1 to establish a local ordinance that allows for the legal use and restrictions of non-highway vehicles in the corporate limits of McHenry. WHEREAS, it is in the interest of the City and the desire of the City Council to establish a local ordinance that allows for the regulated use of non-highway vehicles within the City of McHenry. NOW, THEREFORE, BE IT ORDAINED by the CITY COUNCIL of the CITY OF McHENRY, McHenry County, Illinois, as follows: SECTION 1: Title 7; Motor Vehicles and Traffic, Chapter 2; General Regulations, by adding Section 7-2-5, Operation of Non-Highway Vehicles on City Street as follows: 7-2-5 OPERATION OF NON-HIGHWAY VEHICLES ON CITY STREETS A. Definitions: For the purposes of this section,non-highway vehicle means a motor vehicle not specifically designed to be used on a public highway, including: 1. A golf cart, as defined in 625 ILCS 5/123.9; 2. A recreational off-highway vehicle, as defined in 625 ILCS 5/1-168.8. B. Operation: No person shall operate a non-highway vehicle on a City street except as set forth in this section. C. Registration: Each non-highway vehicle operating on a City street shall be registered with the City and display a City registration stickers and plate. This registration shall be valid from May 1 st through November 1 st of the year it was issued. Registrations shall not be transferable in the event of a change in ownership of the non-highway vehicle. Prior to issuance of a registration by the City, a non-highway vehicle must comply with the requirements set forth below. 1. An annual safety inspection shall be conducted by the McHenry Police Department or a designee authorized by the Chief of Police. 2. A non-highway vehicle must have, at minimum, the following operating equipment: a. Brakes; b. A steering apparatus; c. Tires; d. A rearview mirror; e. Red reflectorized warning devices in the front and rear; f. Seatbelts; g. A slow moving emblem (as required of other vehicles in 625 ILCS 5/12-709) on the rear of the non-highway vehicle; h. A headlight that emits a white light visible from a distance of five hundred (500) feet to the front and a tail lamp that emits a red light visible from at least one hundred (100) feet from the rear; i. Brake lights; and j. Turn signals. 3. A non-highway vehicle shall not have a modified exhaust system which will amplify or increase the noise of the non-highway vehicle above that emitted by the muffler originally installed on the non-highway vehicle. 4. Proof of valid insurance, as identified in 625 ILCS 5/7-601, et seq., must be provided for the non-highway vehicle and the registrant must agree to insure the non-highway vehicle while in use on City streets. 5. The registrant must agree and sign an indemnification form, releasing the City, its elected officials and its employees from liability and indemnifying and holding them harmless from any and all claims resulting from the operation of the non-highway vehicle. 6. A fee of one hundred dollars ($100.00) shall be paid for the initial annual safety inspection of each non-highway vehicle. A fee of fifty dollars ($50.00) for the annual re-inspection for the same non-highway vehicle under the same ownership each year thereafter shall be paid. D. Location: No person shall operate a non-highway vehicle except on a City street as permitted in this section and no person shall operate a non-highway vehicle on the streets and locations specifically prohibited in this section. The City approved interactive GIS Golf Cart/UTV Map can be found on the City's website(www.cityofmchenr org)which identifies the prohibited streets and locations along with permitted intersection crossings. 1. Permitted Streets: The operation of a non-highway vehicle shall be permitted on all City owned streets with a posted speed limit of 25 mph or less. In addition, the operation of a non-highway vehicle shall be permitted on the following streets at the specified locations: a. McCullom Lake Road from Blake Boulevard to Olde Mill Lane b. McCullom Lake Road between Pine Street and Kennedy Drive c. Crystal Lake Road between Front Royal and Lillian Street d. Cunat Drive between Bull Valley Road and Crystal Lake Road e. Municipal Drive 2. Prohibited Streets and Locations: The operation of a non-highway vehicle at the following locations is strictly prohibited: a. Green Street between John Street and Pearl Street b. Main Street between Front Street and Crystal Lake Road c. Pearl Street between Green Street and Richmond Road d. Pearl Street between Park Street and Lincoln Road(including Pearl Street Bridge) e. Riverside Drive between Miller Riverfront Park and Broad Street f. Waukegan Road east between Green Street and the end of the property located at 1110 N. Green Street g. All City-owned municipal parking lots within the Downtown Business District h. All City-owned Parks, sidewalks, walking paths and bicycle paths. i. All County Roads j. All Township Roads k. All State Highways 3. Designated Approved Intersections: It shall be unlawful for a non-highway vehicle to cross a prohibited street unless done so at one of the following authorized intersection crossings: a. Curran Road and Dartmoor Drive b. Front Royal Road and Crystal Lake Road c. Lillian Street and Crystal Lake Road d. Winding Creek Drive and Crystal Lake Road e. Dartmoor Drive and Crystal Lake Road f. Meadow Avenue and Elm Street(IL Route 120) g. Lillian Street and Front Street(IL Route 31) h. Biscayne Road and Barreville Road i. McCullom Lake and Riverside Drive E. Time: A person may operate a non-highway vehicle on permitted streets from May 1st through November 1 st each year from 6:00am to 9:30pm. The use of non-highway vehicles on City Streets between November 2nd and April 30th and afterhours is prohibited. F. Operation Regulations: The operation of a non-highway vehicle is subject to the following requirements: 1. Ability to travel at a speed of nineteen(19) miles per hour 2.
