Background:
The Police Department has continued to seek out the most cost effective and efficient way to
purchase and use vehicles. The police department has adopted and follows a vehicle
replacement plan and vehicle equipment replacement plan as highlighted in the 2015/16 Capital
Improvement Plan. Factors considered in the replacement of police vehicles and equipment
include upfront costs, maintenance cost during the life of the vehicle and equipment, projected
longevity of the vehicle and equipment, community expectations and vehicle and equipment
work performance needs.
The recently approved 2015/16 Capital Equipment Plan /Fund includes the following funding
for the purchase of police squad cars and equipment:
General Fund - $103,750
At this point the Police Department is looking to spend CIP funds in the following manner:
1. Purchase (2) two new police command vehicles (full size SUVs) for the Patrol Division
2. Purchase and install vehicle equipment and computers for new command vehicles.
3. Purchase and install (2) Panasonic In -Car Video Systems for existing squad cars.
4. Purchase & install equipment for new CSO vehicles (acquired through the LESO
Program)
5. Purchase and install equipment in new Evidence/MCAT/Public Relations Van (acquired
through the LESO Program)
Analysis:
Vehicles:
The department has analyzed the purchase options for both the Chevrolet Tahoe and the Ford
Expedition. These two vehicles are the only full size SUVs that have been available for purchase
in the past under the state contract for police vehicles.
Contact was made with Landmark Ford (the state contract holder) for pricing on the Ford
Expedition. Landmark Ford advised that the state contract for the Ford Expedition expired in
May of 2015 and the state will not be renewing the contract for next year as it looks like they
have decided to go exclusively with the Tahoe for the full size SUV.
The State of Illinois currently does not have a state bid for the new 2016 Chevrolet Tahoe as the
previous state contract (#4016025) has expired and the new contract will not be available until
November, with a order date of after January 2016. Due to this information the department has
sought out dealerships that have 2015 police models in stock that could be purchased. In this
search, Miles Chevrolet (the dealership awarded the state contract) confirmed that they have two
2015 black Chevrolet Tahoes in stock and will honor the previous state contract pricing
(Contract # 4016025). Miles Chevrolet has agreed to place a hold on these vehicles pending the
outcome of council approval. Miles Chevrolet is the recognized state contract dealership for
Chevrolet vehicles and was used by the department to purchase the last two Tahoes in 2012.
Miles Chevrolet provided McHenry outstanding customer service in the past.
By purchasing these 2015 models rather than waiting to the 2016 state contracted models are
available for purchase in November, the City will save approximately $5,620.00 due to pricing
increases for the new model year. See the attached pricing sheet for the cost differentiation
between model years.
In an effort to seek out competitive and comparable vehicles for consideration, the department
received a quote from Buss Ford for the purchase of a Ford Expedition that is not under state
contract. See the attached pricing sheet for further details.
The purchase of these two vehicles will allow the police department to repurpose their current
command SUVs and retire two aging police vehicles. The existing command vehicles will hence
be repurposed with one going to the truck enforcement unit and the other going to the NIPAS —
EST assigned operator. Furthermore the department acquired two used vans that were
repurposed as the new CSO Vehicle and the new Evidence/MCAT/Public Relations Van.

Cameras:
Currently the department has outfitted cameras in all of their patrol officer cars except for two,
due to previous budget restraints. Attached to this agenda is the pricing info for the purchase of
these two cameras through the authorized Panasonic dealer, in the amount of $11,418.00. These
cameras will be installed into squad 329 and squad 322.
Computers:
Attached council will also find pricing information for the purchase of two squad computers
needed for the new command SUVs, in the amount of $5,272.00. With the purchase of these two
Panasonic tablets the department will retire two existing computers that were scheduled to be
replaced in FY 2014/15 and are over six years old.
Equipment:
Finally, council will find the attached pricing for the purchase and installation of emergency
equipment and decals for the two new vehicles and the existing vehicles that have been
repurposed to extend the life of the fleet. The following is a breakdown of the equipment costs,

With approval for the purchase of these two new vehicles along with the equipment and
computers highlighted above, the department will be slated to retire its two oldest vehicles in the
fleet with future approval from council.
Recommendation: Staff requests City Council authorization to; (1) purchase a total of two 2015
Police Chevrolet Tahoes from Miles Chevy in the amount of $67,160.00, (2) purchase and install
emergency vehicle equipment from Ultrastrobe Inc in the amount of $17,975.81, (3) purchased
and install police decals from Eby Graphics in the amount of $1,735.00, (4) purchase two

Final Pay Request for Riverwalk Construction Phase 2A.1 & 2A.2
Pay Request
BACKGROiJND: On December 16 2013 the City Council awarded the bid for construction of
Riverwalk Phase 2A4 and Phase 2A-2 to the apparent low bidder Landmark Contractors, Inc.
for $313,859.00.
ANALYSIS: Attached is a final pay request letter from HR Green, Inc. recommending final
payment for Phase 2A.1 in the amount of $5,040 and Phase 2A.2 in the amount of $5,109.
The work has been completed satisfactorily and staff concurs with the engineer's
recommendation.
RECOMMENDATION: If Council concurs, it is recommended a motion is made to
approve the final pay request to Landmark Contractors, Inc. in the amount of $5,040 for
construction of Riverwalk Phase 2A.1 and $5,109 for construction of Riverwalk Phase 2A.2
as presented.

HR Green, Inc. (HR Green) has completed its review of Pay Applications #3 from Landmark
Contractors, Inc. for work performed on the McHenry Riverwalk Phase 2A.1, and 2A.2.
These Pay Applications contain the application, contractor invoice, Certified Payroll and
Waivers of Lien. All of the submitted documents have been found to be in general
conformance with the approved plans and specifications. HR Green is recommending that
the City approve these Pay Applications in the amounts of:
• Phase 2A.1 Riverwalk amount of: $5,040.00
This payment releases a hold on the bollard lights that were switched to the lights
mounted on the Miller Dream Marina Building.
• Phase 2A.2 Riverwalk amount of: $5,109.00
This payout releases the hold on the lighting for under the Rt. 120 Bridge.
The one-year maintenance period for both of these projects will expire on November 13,
2015.

RE: 2015 Downtown Christmas Walk/Toys for Tots Parade
The McHenry Downtown Business Association will host the annual Christmas Walk on Saturday,
November 21', 10:00 AM to 4:00 PM and Sunday, November 22"d from 10:00 AM to 4:00 PM. As
with past events, downtown shop windows will be decorated; businesses will offer Christmas
shopping specials; Carolers will perform; and, trolleys will be available to transport shoppers through
the downtown streets on. The event will also feature horse-drawn wagon rides on Riverside Drive to
Veterans Memorial Park and pony rides in the vacant lot on the southwest corner of Route 120 and
Riverside Drive. On Saturday, visits with Santa will be held in the park culminating with the annual
tree lighting ceremony at 4:30 PM.
The DBA is requesting permission to install temporary election -style signs in right -of --ways
throughout town and post one large sign created by the DBA, at the corner of Riverside Drive and
Route 120 in the vacant lot. The signs will be installed one week before the Christmas Walk and
removed the day after the event.
Toys for Tots Parade. Sunday, November 22nd, the McHenry Area Jaycees will host the annual Toys
foI Tots Parade at 1:00 PM. The parade route is identical to the Fiesta Days Parade route. The
procession will begin on Main Street and conclude at Veterans Memorial Park. In the park, a
presentation of toys will be made to the U.S. Marine Corps on behalf of the local Harley Owners
Group followed by an appearance by Santa Claus in the gazebo. The McHenry Area Jaycees will
setup tables and sell refreshments and provide activities for children after the parade.
To facilitate the parade, staff is requesting permission to close Court and Park Streets between Pearl
and Broad Streets for approximately three -hours to allow for parking of motorcycles and disbandment
of the parade.
If the Council concurs, then it is recommended a motion is considered to approve the special use
of Veterans Memorial Park, temporary advertising signs, and waiver of all associated fees for
the DBA Chrstimas Walk on November 2V & 22nd as presented; and b) temporary closure of
Main Street, Green Street, Riverside Drive, and Broad Street beginning at 19.00 PM and closure
of Park and Court Streets from 12:00 PM to 3*00 PM on Sunday November 22nd for the Toys for
Tots Parade as presented.

MOTION
TO ADOPT AN ORDINANCE GRANTING A CONDITIONAL
USE PERMIT FOR ASSEMBLY
USE FOR
THE PROPERTY LOCATED AT 4513 FRONT ROYAL DRIVE,
WITH THE RECOMMENDED
CONDITIONS
City Administrator Morefield informed Council that Iglesia Casa De Vida currently holds
worship services in the City of McHenry and is seeking to purchase the Whispering Oaks
Community Center and utilize the building for a religious assembly use. City Administrator
Morefield noted that the Whispering Oaks Community Center has been used as an assembly
use for many years and was constructed several decades ago.
In accordance with the Building Code, as long as the occupant load does not exceed 100
people in the building at any one time, the building on the subject property is not required to
comply with the building code as an assembly use. If the occupant load exceeds 100, the
Building Code would require certain improvements for any type of assembly use or space
utilized for social, educational, religious, recreational or similar types of gatherings. If approve,
Staff would require a walk-thru by City Staff and the McHenry Township Fire Protection District
to ensure minimum life safety codes are met.
The proposed assembly use will be limited by the size of the existing building as it is
today. Parking for the building is provided directly to the north. There currently exist property
maintenance issues, Building Code and cosmetic issues associated with the property, which the
Applicant has agreed, as stipulated in the application, to address if this use is approved.
Staff believes this is an appropriate location for the proposed assembly use, which will
not adversely impact neighboring properties or public safety and health. Staff believes the use
would not require any additional public services and is compatible with the surrounding area.
Churches are not typically zoned residential and many are located within the midst of, or
adjacent to, residential neighborhoods in the City. The Planning and Zoning Commission
unanimously recommended approval (7-0) of a Conditional Use Permit to allow an assembly
use and any variances required to effectual the request on the subject property, located at
4513 Front Royal Drive, McHenry, as presented, subject to the following conditions:
• The building on the subject property shall only be utilized following a walk4hru
inspection by the City and McHenry Township Fire Protection District, and there can be
no more than 100 people inside the building at any one time, unless the building is
improved to meet building code requirements for an assembly use;
• Property maintenance issues including parking lot patch ing/restriping (in accordance
with City Ordinance and Illinois Accessibility Code), roof repair, repair of railings to
outside stairs, repair/replacement of all broken windows, and the applicant must
address exposed electrical and all other life safety and property maintenance issues to
accommodate use of the building to be completed prior to issuance of a Certificate of
Occupancy for an assembly use on the subject property. All of the aforementioned shall
be completed in compliance with all applicable City rules, Ordinances and regulations;

• Parking lot lighting shall be installed, to ensure the minimum parking lot lighting
requirements outlined in the City's Zoning Ordinance and other applicable ordinances
are met prior to issuance of a Certificate of Occupancy;
• Existing or any future dumpster is completely enclosed and screened; existing dumpster
shall be completely enclosed or screened prior to issuance of a Certificate of Occupancy.
This shall be completed in compliance with all applicable City rules, Ordinances and
regulations; and
• Parking of vehicles, other than those related to the use of the building on the subject
property, is prohibited. Vehicles cannot be parked or stored overnight on the subject
property.
Addressing concerns expressed by Alderman Schaefer regarding parking, Director of
Economic Development Martin stated the estimated 40 parking spaces are in accordance with
assembly use in the Zoning District.
Alderman Glab expressed concerns regarding a church's impact on the neighboring
community. He opined the building is not well insulated and noise could be a factor, disturbing
residents in close proximity.
Motion by Schaefer, second by Curry, approving an Ordinance granting a Conditional
Use Permit to allow an assembly use for the property located at 4513 Front Royal Drive, with
the aforementioned conditions, as recommended by the Planning and Zoning Commission.

MOTION TO GRANT A VARIANCE TO ALLOW AN OFF -PREMISE SIGN AT 1012 GREEN STREET
(NORTHEAST CORNER OF JOHN STREET AND GREEN STREET) FOR THE MCHENRY COUNTRY
CLUB
City Administrator Morefield informed Council a permit request had been submitted by
the McHenry Country Club to erect a 32-square foot, free-standing, off -premise sign at 1012
Green Street, at the northeast corner of Green Street and John Street (adjacent to McHenry
High School East Campus). The McHenry Country Club is located at 820 N. John Street and
approximately .33 miles to the east of the intersection of Green Street and John Street.
City Administrator Morefield informed Council that due to the location of the McHenry
County Club, and to enhance and promote activities and events at the Club, the McHenry
Country Club sought permission from McHenry High School District 156 to install an off -premise
sign at McHenry High School East Campus, at the northeast corner of John Street and Green
Street. The McHenry High School District 156 Board approved the proposed sign at East
Campus.

Responding to an inquiry from Alderman Curry, Director of Economic Development
Martin informed Council the sign is larger than a directional sign and is an off -premises sign.
The size of the proposed sign would conform to the Municipal Code if the sign was actually on
the property of the McHenry Country Club.
Alderman Peterson opined that he is familiar with how the McHenry Country Club has
struggled during the difficult economy. He stated that he supports the proposed sign. Alderman
Condon concurred with Alderman Peterson
Alderman Santi stated that he has no concerns with a directional sign, but has concerns
that the sign would be used for advertising.
Motion by Curry, second by Condon, granting the variance to allow an off -premise sign
at 1012 Green Street (northeast corner of Green Street and John Street). for the McHenry
Country Club, with the condition that the sign is in substantial conformance with the elevation
and dimensions provided.

City Administrator Morefield informed the Council that often the City of McHenry
receives requests from local food service establishments regarding opportunities for expanding
their service area, as weather permits, by providing outdoor seating for patrons and/or to host
live entertainment. City Administrator Morefield explained the definition and action
necessitated by the current Ordinance.
The amendments proposed are part of an ongoing effort to promote business by
allowing businesses the opportunity to offer outdoor seating and/or entertainment. All of the
text amendments to the Zoning Ordinance and/or Municipal Code include requirements, which
need to be met, to ensure that public health, safety and welfare are not compromised.

City Administrator Morefield explained each of the proposed amendments and
informed Council that the Planning and Zoning Commission unanimously recommended the
various text amendments to the City of McHenry Zoning Ordinance, including the amendments
to Article III General District Regulations and other applicable administrative sections in the
Zoning Ordinance and/or Municipal Code.
Alderman Condon stated that the proposed amendments streamline the process and
are business -friendly to the community. Alderman Condon, Chairman of the Community
Development Committee opined that as the times change, they might have to be re-evaluated
yet again.
Alderman Glab opined that there should be a fee required to obtain a permit annually.
Motion by Condon, second by Wimmer, approving the Ordinance authorizing various
text amendments to the Zoning Ordinance, including the following amendments to Article III
General District Regulations and other applicable administrative sections in the Zoning
Ordinance and/or Municipal Code.

MOTION TO ADOPT ORDINANCES GRANTING A ZONING MAP AMENDMENT FROM RS-4 HIGH -
DENSITY SINGLE FAMILY RESIDENTIAL TO C-5 HIGHWAY COMMERCIAL DISTRICT AND A
CONDITIONAL USE PERMIT TO ALLOW OUTDOOR STORAGE IN CONJUNCTION WITH A
CONTRACTOR'S OFFICE FOR THE PROPERTY LOCATED AT 920 FRONT STREET AND LOT
IMMEDIATELY ADJACENT OT THE EAST, WITH THE RECOMMENDED CONDITIONS
City Administrator Morefield informed Council that the applicant currently operates a
successful landscaping and snowplowing service business in Woodstock. Applicant is interested
in moving her business, which includes nine employees, to the property located at 920 Front
Street in the City of McHenry.
City Administrator Morefield explained to Council that the property at 920 Front Street
is an approximately 10,000 square foot building, which has been vacant for several years. The
building was formerly Alexander Lumber and McHenry County Supply, but has not been
occupied recently. The property lies along a major state highway, at the northeast corner of
Front Street and James Street (unimproved right-of-way). The applicant is proposing to
construct an office inside the building. Landscaping and snow removal material would be stored
outside, east of the building and vehicles (five outside) and appurtenances would also be stored
inside and outside of the building.

Staff believes the proposed land use is compatible with the surrounding land uses. The
area along Front Street and on the edge of the Main Street Downtown area is undergoing a
transition. There are several vacant buildings in close proximity to the subject property,
however, many new businesses have opened in the past several years and reinvestment in this
area has been occurring. The proposed use is a new building, filling a building which has been
vacant for many years. The Planning and Zoning Commission unanimously recommended
approval (7-0); subject to the following conditions:
• All materials stored outside be kept in bins and/or locked containers;
• There shall be no storage or permanent parking on the James Street right-
of-way;
• The property be maintained and kept in a neat and orderly appearance,
including painting the roof on the east half of the building within 60 days
of occupancy;
• Outdoor storage area must be secured, including some type of security
control/device during non -business hours or minimal security lighting;
• Outdoor storage shall be enclosed and screened on three sides and not
visible to the south or west or accessible to the general public and
material used for screening shall be approved by City staff prior to
construction;
• Outdoor storage area shall not impede access or vehicular circulation
and cannot occupy required customer or employee parking spaces;
• Any outdoor dumpster or additional mechanical equipment shall be screened in
accordance with City ordinances.
• Vehicles may temporarily load or unload within the James Street right-of-way,
not impeding access, and loading/loading on Front Street is prohibited;
• Written approval/confirmation from IDOT shall be secured prior to the applicant
receiving a certificate of occupancy;
• Employee parking shall generally be to the east of the building and located
within the James Street right-of-way allowing no impeding access or overnight
parking;
• Landscape improvements immediately west of the building shall be completed
within 60 days of issuance of a certificate of occupancy; such improvements shall
consist of low -growing shrubs/bushes and/or combined with planters, grasses or
flower beds and approved by staff;
• Applicant shall be required to complete all interior building improvements
required for the proposed use prior to issuance of a certificate of
occupancy being issued;
• Applicant shall maintain the James Street right-of-way immediately south
of the building and keep free of weeds, high grass and snow and ice;
applicant shall paint east half of building within 60 days of receiving a
certificate of occupancy;

• Light trespass to the east shall be prohibited and any after -hour security
lighting shall be minimal or controlled by motion sensors. All lighting shall
be shielded directly onto the lot away from Front Street, John Street,
James Street and Center Street and adjacent residential to the north and
east. Glare from the lighting should be minimized to the greatest extent
practical, and the use of the full cut-off fixtures shall be required.
Motion by Santi, seconded by Schaefer, approving the Ordinances granting a Zoning
Map amendment from RS-4 High -Density Single -Family Residential to C-5 Highway Commercial
District and Conditional Use Permit to allow outdoor storage in conjunction with a contractor's
office for the property located at 920 N. Front Street and the lot immediately adjacent to the
east, based on the conditions as recommended by the Planning and Zoning Commission.

AUTHORIZE THE MAYOR TO SIGN, FOLLOWING IEPA APPROVAL, THE CONSTRUCTION
CONTRACT, NOTICE OF AWARD, NOTICE TO PROCEED, AND ANY OTHER DOCUMENTS
NECESSARY TO IMPLEMENT THE TERMS OF THE CONSTRUCTION CONTRACT
City Administrator Morefield reiterated to Council that at the June 1, 2015 City Council
meeting, the Council authorized Staff to seek bids for the decommissioning of the Central
Wastewater Treatment Plant (CWWTP), and consolidation with the South Wastewater
Treatment Plant (SWWTP).
City Administrator Morefield informed Council the project consists of:
• Construction of a 24-inch sanitary sewer forcemain;
• CWWTP pumping station;
• Preliminary treatment improvements;
• Secondary treatment improvements (SBR);
• Tertiary treatment improvements (effluent

Bid documents were made available by the City on June 5, 2015, with a due date of July
24, 2015. The engineer's opinion of probable cost for the decommissioning/consolidation (less
the forcemain) was $25,200,000. Five bids had been received and were opened on July 24,
2015. The bids ranged from $30,180,000 to $35,800,000.
HR Green, Inc., the City's engineering firm, has checked the bids for accuracy and
recommends awarding the contract to Williams Brothers Construction, Inc. City Administrator
Morefield stated due to current market values for materials and a busy bidding environment,
HR Green, Inc. does not feel that there are any major adjustments that could be made to the
project.
City Administrator Morefield noted the low bid amount is $4,980,000 higher than the
opinion of probable cost. The higher cost is due to bids that were significantly higher than the
opinion of probable cost due to the cost of concrete and earthwork (excavation, trenching,
dewatering, etc.).
Responding to an inquiry regarding the separation of the forcemain from the remaining
portion of the project, City Engineer Pieper explained the forcemain could not be considered
within the loan cycle according to the requirements of the SRF.
Motion by Condon, second by Wimmer, authorizing the Mayor's execution of a Notice
of Intent to accept the bid of, and award a construction contract to, Williams Brothers
Construction, Inc., for the McHenry Sanitary Wastewater Treatment Facility Consolidated
Project, in the amount of $30,180,000, subject to IEPA approval, and to authorize the Mayor to
execute, following [EPA approval, the Construction Contract itself, Notice of Award, Notice to
Proceed and any other documentation necessary to implement the terms of the Construction
Contract., as presented.

As identified previously, due to the specialization of the forcemain portion of the project, the
project was divided into two separate bid packets. The City engineer's opinion of probable cost
for the forcemain project was $1,400,000, Bid information was made available at the City on
June 5, 2015, with a due date of July 24, 2015. One sealed bid for the McHenry Sanitary Sewer
System Improvements for the 24" Forcemain Extension was received on July 24, 2015 from RA
Mancini in the amount of $5,126,630.
The bid received from RA Mancini was analyzed and ascertained by the City Engineer to
be over three times the Engineer's Opinion of the Probable Costs for the project. This was an
abnormal result, as multiple contractors had picked up bid packages and attended the
mandatory pre -bid meeting. Following the bid opening, HR Green contacted several of the
contractors in an attempt to determine the reasons for not submitting bids. Their main
responses were related to being extremely busy and not having adequate time to focus on the
project. HR Green recommends rejecting the bid as no other bids were submitted that would
permit comparison to determine if the bid from RA Mancini is appropriate for the project
scope. HR Green recommends the project be rebid in January 2016.
City Administrator Morefield explained that due to the delay of the forcemain portion of
the project, the costs cannot be included in the scope of the State Revolving Fund (SRF) loan.
The loan is only issued for the project scope that is bid, reviewed and approved; as part of the
initial loan award, which, in this case, would not include the forcemain project. As a result, the
City of McHenry will have to identify a funding source for the forcemain project, which could
include, applying for an additional loan through the IEPA, obtaining traditional municipal loan
financing, and/or paying for the projection with funds in the General Fund.
Motion by Peterson, seconded by Santi, rejecting all bids, including the bid submitted by
RA Mancini, in the amount of $5,126,630, for the McHenry Sanitary Sewer System
Improvements to the 24" Forcemain Extension project.

City Administrator Morefield reiterated on May 18, 2015, the Council authorized Staff to
publicly bid the Crystal Lake Road/Dartmoor Drive Traffic Signal project. The 2015/2016 Capital
Improvement Program (CIP) includes $400,000 for the design/observation engineering and
construction of traffic signals at the intersection of Crystal lake Road and Dartmoor Drive. Two
sealed bids were received for the project. HR Green, Inc. has analyzed and checked the bids for
accuracy and recommends awarding the contact to Virgil Cook & Son of DeKalb, Illinois in the
amount of $204,851.84. City Administrator Morefield noted that the Staff of the Public Works
Department would be relocating the existing pedestrian crossing lights on Crystal Lake Road at
Dartmoor Drive to Curran Road at Dartmoor Drive.
Alderman Glab opined he has some concerns regarding the relocation of the existing
pedestrian crossing lights to Curran Road at Dartmoor Drive due to the speed of traffic along
Curran Road.
Motion by Schaefer, second by Condon, authorizing the Mayor and City Clerk's
execution of a Construction Contract with Virgil Cook & Son of DeKalb, in an amount not to
exceed $204,851.85, for the Crystal Lake Road/Dartmoor Drive Traffic Signal project, as

MOTION TO WAIVE ADVERTISMENT FOR BIDS AND AUTHORIZE THE MAYOR AND THE CITY
CLERK TO SIGN A CONTRACT WITH XYLEM WATER SOLUTIONS USA, INC., FOR AN AMOUNT
NOT TO EXCEED $81,824.60, FOR THE PRE -PURCHASE OF SUBMERSIBLE PUMS AND RELATED
EQUIPMENT FOR THE FIELDSTONE LIFT STATION REHABILITATION PROJECT
City Administrator Morefield informed Council that the Fieldstone Lift Station was put
into service in 1997. The Fieldstone Lift Station is one of the deepest lift stations in the sanitary
collection system. In February 2008, while removing the pump for routine maintenance, the
pump slipped off the hook and fell back to the bottom of the lift station. When the pump fell it
damaged the base elbow, which is attached to the pump. The lift station has continued to
operate with one pump until a replacement could be obtained. Due to the depth of the lift
station, an outside contractor was hired to set the replacement pump however the outdated
guide wire system in the lift station was not centered and as a result, the pump was damaged
during removal.
Rehabilitation of the lift station consists of replacing the pumps, pump control, guide
rails, base elbows, discharge piping and a top hatch. In addition, the replacement pumps will be
sized to handle additional wastewater flow as the Legend Lakes subdivision is built out.

City Administrator Morefield stated Council that Staff and HR Green, Inc. are
recommending pre -purchasing the submersible pumps and related equipment directly from the
sole source vender rather than through a third party contractor, as it was ascertained the
procedure would reduce cost and expedite delivery of the equipment.
City Administrator Morefield informed Council that the approved 2015/2016 Capital
Improvement Program (CIP) includes $330,000 for the design/observation, engineering and
construction of the Fieldstone Lift Station Rehabilitation project, with funding from the
Water/Sewer revenues and $100,000 from the Legend Lake Surety Bond.
Motion by Curry, second by Wimmer, to waive the advertisement for bids and authorize
the Mayor and the City Clerk's execution of a contract with Xylem Water Solutions USA, Inc., for
an amount not to exceed $81,824.60 for the pre -purchase of submersible pumps and related
equipment for the Fieldstone Lift Station Rehabilitation project, as presented.

MAYOR'S STATEMENT AND REPORT
Mayor Low announced Thursday, August 20, 2015, will be the finale of the Summer
Concert series in Veterans Memorial Park. The final concert will feature Hans and the
Hormones, at 7:00 pm. The Mayor added that there was a record crowd in attendance at last
week's concert. She expressed gratitude to all the sponsors, food and beverage vendors, and
the community for a successful season.
COMMITTEE REPORTS
Chairman Alderman Condon of the Community Development Committee informed
Council the Community Development Committee meeting scheduled on Monday, August 24th is
cancelled and will be rescheduled.
STAFF REPORTS
Director of Public Works Schmitt informed Council the Fall Brush Pickup Program will
begin on August 31, 2015. The chipper will go door4o-door and is for residential properties
only.

Alderman Condon stated that she has no issues attending a Special Meeting. However
she added, the expense of holding a Special Meeting for two items on a Consent Agenda, which
could have easily been addressed by Staff, is unnecessary and not in the best interest of the
tax -paying citizens. Alderman Condon suggested discussions with the City Attorney regarding
amending the Ordinance so Staff or the Mayor could approve some items without the necessity
of calling a Special Meeting.
Alderman Curry stated that as long as the Ordinances of the City of McHenry call for
items to be voted on by Council those Ordinances should be followed, however, he noted that
he is not adverse to amendments being reviewed and revised, as necessary.
Alderman Peterson opined that these are unique circumstances in that it has been an
extraordinary lengthy period of time between Regular Council meetings, which is unusual.
Mayor Low stated the circumstances of the Special Meeting are unique. She opined that
the McHenry High School Marching Band is highly visible and valued component of the
community. The Band attends many events and supports many of the activities within the
municipality.

MAYORS STATEMENTS AND REPORT
Mayor Low announced on Friday, September 11, 2015 at 9:00 am, a memorial ceremony
will be held in Veterans Memorial Park commemorating the event of September 11, 2001.
Father Paul White will officiate and many members of the Police Department and McHenry
County Fire Protection District will be in attendance. Mayor Low encouraged everyone who is
able to attend the memorial.
Mayor Low informed Council the blue ribbons displayed throughout the City are in
recognition of slain Fox Lake Police Lieutenant Charles Joseph Gliniewicz. The campaign was
initiated by the wives and children of several City of McHenry Police Officers. Mayor Low
expressed pride and appreciation at the outpouring of sympathy shown by the citizens of the
City of McHenry for the slain officer and his family.
Mayor Low announced a National Day of Recognition for Police Officers will take place
on September 19, 2015. Mayor Low encouraged participation in displaying of blue ribbons
around trees and poles.

Attached is a request for an Honorary Street Sign for Virginia T. Williams. It was submitted by
Joseph Doherty and Carol Sweeney and is proposed at the intersection of Kane Avenue and
Center Street. Ms. Williams lived in the McHenry area her entire life and continued to reside at
her childhood home at 705 Center Street until moving to the McHenry Villa.
A few examples of Ms. Williams's service to the community include being the sole owner of
"Family Nursing', the first independent nursing practice in Illinois. She served on the McHenry
Hospital Board of Trustees and in 1975 received "Woman of the Year' award from the Business
and Professional Women's Club. Years later she was awarded the Centegra "Community Leader
of the Year" and was a member of the Board of Directors for the Comprehensive Health
Planning Agency for McHenry, Kane, and Lake Counties.
On September 14, 2015 the Public works Committee unanimously recommended approval of
this designation. Attached for the Council's consideration is the letter of request from Joseph
Doherty and Carol Sweeney and the Honorary Street Sign Application and Resolution
designating the intersection of Kane Avenue and Center Street as Honorary Virginia (finny)
Williams RN Dr.
If Council concurs, then it is recommended a motion be considered to approve the attached
Resolution request as presented.

Historical and Cultural Influence of the Honoree on the City:
Virginia T. Williams, known to most simply as finny, was the sale owner of "Family
Nursing" located in McHenry. This was the first independent nursing practice
conceived, developed and practiced in the state of Illinois. In 1973, she ventured
away from the medical model saying that doctors are in the business of curing
patients and nurses are in the profession of caring for patients. Her level of
independence in nursing practice has been admired, reviewed and studied by
Universities and many graduate level nurses, researchers and faculty learned about
her work through internships. She took on all teachable opportunities with
professional interest, helping others learn. Her highest priority was caring for
people, regardless of their ability to pay. In 1973, she charged $10 for a home visit
and $5.00 for an office visit, never indicating the duration of the visit. If the client
was not able to pay for the visit, some of them would trade Jinny goods or food for
her services.
Provide proof of significant lineage or family ties to the city and Establish a
clear geographical relationship of street to the area of interest of the

Both of her parents, Joseph and Elizabeth Williams were lifetime residents of
McHenry. Her siblings, Richard, Bea (Newkirk) and Rosalie (Doherty) all grew up at
705 Center Street and lived here as well. All of her siblings were born right in the
house. She and each of her siblings have a place in McHenry history. Jinny lived on
Center Street for pretty much all of her life until she suffered a stroke on January 16,
1995. After the stroke she continued to live at her home until it was no longer
feasible when she moved into the McHenry Villa where she spent her last days
experiencing living at her highest level of independence.

1942-Graduated from McHenry High School with 37 other students.
1962- Graduated with her Bachelor of Science in Nursing, Cum Laude, from Loyola
1968 -She coordinated a federal program to attract inactive nurses back into
practice.
1973 -Graduated with her Masters in Community Health Nursing from Northern
Illinois University.
1975- She was elected to the McHenry Hospital Board of Trustees and received
"Woman of the Year" award from the Business and Professional Women's Club.
2005 -She was awarded the Centegra Community Leader of the Year Award which
is awarded to an individual who has demonstrated service on a broad scale and has
resulted in improvements and contributions to overall community health.
She was a member of the Board of Directors for the Comprehensive Health Planning
Agency for McHenry, Kane and Lake Counties.
A chapter titled "Virginia T. Williams" is included in Anne Zimmerman's book
Making Choices Taking Chances, Nurse Leaders Tell Their Stories.
Until the day she suffered a stroke, she spent her days driving around serving
families m our community. She provided nursing care to more than 1,000
clients/families during her many years as an independent practitioner. Because of
her many connections in the community, she always found that extra wheelchair or
walker so someone could attend a family outing. There was always a lot of sharing
and caring going on when Jinny was around town.

Centegra Health System recently presented Virginia T. Williams, of McHenry, with the
Centegra Community Leader of the Year Award for ?005. The Centegra Community
Leader of the Year Award is given each year to an individual who has demonstrated
service on a broad scale that has resulted in improvements and contributions in the realm
of community service and overall community health. The award was developed to
recognize the achievements of an individual leader living in our local community who
demonstrates the attributes of servant leadership, especially in the area of community
sere;ice. Virginia T. Williams, who was the first independent nursing practitioner in the
state of Illinois and only the second in the United States, and was honored for her
pioneering attitude towards change in the nursing industry. She helped to revolutionize
the approach to caring for the total patient including his physical, spiritual, emotional and
educational needs. "Ms. Williams was selected as this year's award recipient because her
revolutionary approach to healthcare was vital to the advancement of the field of nursing
as well as to the enhancement of the care the residents of the McHenry County area
received," Michael S. Eesley, Centegra President and CEO said. "Patients in northeastern
Illinois and nurses all around the country benefited greatly from her philosophy of care
and her willingness to make a difference," he added. In her independent nursing practice,
which she established in 1973, Ms. Williams was a partner with her patients as well as
her patients' physicians. She created a formidable team to fight against illness and she
reinforced the bridge bet-ween doctor and patient to develop efficient and effective care in
the patients' homes. Ms. Williams believed that the patient is much more than the disease
or injury and that the patient's family needed to be included in the care plan_ "Ms_

Foundation. Centegra Health System is located in McHenry County, Illinois. It includes
the services of Centegra Memorial Medical Center, Centegra Northern Illinois Medical
Center, Centegra Primary Care, Centegra home health Care, and Health Bridge Fitness
Center. Annually, over 330,000 patient visits are made in acute and ambulatory settings
within Centegra facilities. A work force of 3100 Associates and 450 physicians provide

Agenda Item 1: Honorary street sign dedication for Virginia T. Williams
Public Works Director stated that staff received an honorary street application by Joseph
Doherty and Carol Sweeny for Virginia T. Williams. The honorary street sign is proposed at the
intersection on Kane Avenue and Center Street and is the third one this year. He stated that
according to City policy no more than three honorary designations shall be awarded in the City
per calendar year.
After reviewing the application, the committee agreed that all criteria have been satisfied and
that this should go forward to the City Council.
Motion by Alderman Glab, seconded by Alderman Wimmer, to recommend to the City Council
approval of the honorary street sign for Virginia T. Williams as presented.

Other Bus' ublic Works Director began a discussion about the 2014 street ranking and
pavement condition r tem. To establish the priority list of street improvements, staff
visits each street to verify and ins a current condition of the pavement in order to rank
streets for improvement. Street ranking is on a 10 point system, with the ranking of #1
being equivalent to a gravel road and a ranking of #1 equivalent to a newly paved road.
Attached to the agenda were the street rankings with a scor or less conducted by Street
Division Superintendent Stull during the summer of 2014. Superin ent Stull is currently
updating the street rankings list. Staff will present an updated street ranking r discussion
at a future Public Works Committee meeting.

A RESOLUTION DESIGNATING THE INTERSECTION OF KANE AVENUE AND CENTER STREET AS AN
HONORARY STREET ENTITLED "HONORARY VIRGINIA (11NNY) WILLIAMS RN DRIVE" IN THE CITY OF
MCHENRY, MCHENRY COUNTY, ILLINOIS
WHEREAS, the City Council has established the Honorary Street Sign Policy and Program to honor
individuals from the City of McHenry who have contributed significantly to the City of McHenry or our society in
general through cultural, historical or humanitarian acts; and
WHEREAS, the City Council has considered the evidence and recommendation and finds that the approval
of the application for the Honorary Street Designation of "Virginia (finny) Williams RN" at the intersection of Kane
Avenue and Center Street is consistent with the criteria set forth in the Honorary Street Sign Policy.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY,

BACKGROUND: In 2003 the Dunkin Donuts located at 4502 W Elm was rebuilt after the
demolition of the existing store and adjacent fueling station/Handy Pantry, and a larger store

with an accompanying Baskin Robbins (3,280 square feet) was constructed. The City Council
approved a request for a conditional use for a drive-in establishment with outdoor seating as
well as variances to accommodate the new store on April 3, 2003. In 2004 the ordinance was
amended to allow for the reconfiguration of the driveway to and from Ramble Road.
In 2008 Diamond Plaza, a 7,205 square -foot strip retail building was constructed and an
additional Dunkin Donuts store was opened at the southern end cap of the building. A drive-
hru wraps around the west side (rear of that building) and the drive-thru window is located on
the south side of the building.
The applicant is proposing to construct a third Dunkin Donuts store at the southwest corner of
Oak Avenue and Front Street. In order to facilitate this development a conditional use permit is
required to allow a drive-in establishment and outdoor seating and variances from the zoning
ordinance including: variance from the off-street parking and loading ordinance (7 spaces);
variance from the landscaping and screen requirements (10 feet residential screening strip
along the west lot line and 7 feet foundation base planting requirement along the front (north)
Me of the building); and a variance from the accessory uses, yards and fences section of the
zoning ordinance to allow a refuse enclosure in the required corner side yard.
The applicant is also seeking a variance from the municipal code to allow asix-foot solid
wooden fence in the required corner side yard in order to provide screening from the subject
property to the site immediately adjacent to the west.

Staff believes the land use is appropriate for this site. There is a commercial shopping center
north of the subject property and an office/commercial building south of the site, and the
property is located along a major commercial corridor. The applicant has had preliminary
conversations with the Illinois Department of Transportation which stated the following:
"The Illinois Department of Transportation (Department) is currently engaged in a preliminary
engineering and environmental study (Phase IJ for the proposed improvement of IL 31 from IL
176 to IL 120 in McHenry County. This improvement is not currently included in the
Department's FY 2016-2021 Proposed Highway Improvement Program. However, this project
will be included in our priorities for future funding considerations among similar improvement
needs throughout the region. The general scope of work for this improvement is anticipated to
consist of roadway widening and reconstruction to provide two lanes in each direction
separated by a median, bicycle and pedestrian accommodations, and intersection and drainage

improvements. Attached for your review are the preliminary plan &profile and cross section
sheets at the proposed development."
Attached are the preliminary plan and profile from IDOT which includes a full access of off Front
Street and approximate right-of-way dedication along Front they may seek in the future. This is
also depicted on the site plan. The applicant is proposing an additional full access off of Oak
Avenue, which is a City roadway. Although full access is proposed off of Front Street it should
be noted the majority of traffic in the morning peak hours goes southbound or eastbound and
Dunkin Donuts does most of their business before 12:00 p.m.
Conditional Use Permit for Drive-thru/Outdoor Seating
Staff has been working with the applicant for some time on several potential locations for a
third store and believes that the proposed site and drive-thru layout is in substantial
conformance with the drive-in establishment guidelines established by the City Council (see
attached guidelines). Staff and the applicant discussed the feasibility of an "escape lane" curb
cut at the southwest corner of the site from the drive-thru lane to the property to the south.
While this may be a benefit for someone within the drive-thru who has to exit for some reason
immediately it could also be a safety concern if a vehicle attempted to travel north into the
drive-thru lane from Lillian Street.
Practically, the access to the south would have to be one-way however there would be the
potential, if this curb cut existed, for someone to drive north into the drive-thru lane.
Additionally, in order for a vehicle within the drive-thru lane to utilize this curb cut the car
would have to be at the appropriate location to do so at the exact time when they would need
to utilize it. Dunkin Donuts monitors the length of time it takes for a customer from the time
they order to the time they exit the drive-thru. This standard is roughly between 76 and 90
seconds, therefore staff is not concerned with the lack of an "escape" or "by-pass" lane.
The zoning ordinance requires five stacking spaces for adrive-thru and the attached site plan
can accommodate seven vehicles. The hours of the drive-thru are proposed from 5:30 a.m. to
10:00 p.m. Residential property exists immediately adjacent to the west of the site and to the
east across Front Street, and the applicant is proposing to erect a six-foot high solid wooden
fence along the western property line with landscaping. The fence ordinance requires fences in
corner side yards to be setback 15 feet and given the size of the property this is impractical.
Staff does not believe the proposed fence would in any way inhibit or compromise safety due
to the proximity of the curb cut onto Oak Avenue being located north of the fence line.

The applicant is proposing outdoor seating immediately east of the building, similar to the
location on Elm Street. The outdoor seating area would have a three-foot tall decorative fence
installed adjacent to the drive-thru lane. Staff is comfortable with the driveAhru layout and
outdoor seating area as -proposed.
Variance from the Off -Street Parking and Loading Requirements
The parking requirement for this facility is 15 parking spaces/1,000 square feet of floor area,
with 10 parking spaces/1,000 square feet of net floor area required to be built immediately and
adequate room on -site to add five additional spaces if necessary. The site as -proposed requires
29 parking spaces utilizing the 15 space/1,000 square feet of floor area standard and 19 spaces
required to be constructed immediately. The site plan depicts 22 parking spaces. Staff believes
this variance is acceptable due to the large drive-thru business that this restaurant will generate
(60%) therefore, reducing the need for off-street parking.
Variance from the Landscaping and Screening Requirements
The applicant is seeking two variances from the landscaping and screen requirements. The first
is from the 15400t residential screening strip requirement. The zoning ordinance requires a 15-
foot residential screening strip along the length of all lot lines which abut an adjacent
residentially -zoned property on a parcel devoted to a more intensive use. Therefore the
subject property is required to maintain a 15400t wide strip of land along the east and west
property lines excluding access ways.
The property directly to the west of the subject property is zoned RM-2 High -Density Multi -
Family Residential and to the east across Front Street the property is zoned RS-4 High -Density
Single -Family Residential. Appropriate screening may include trees and shrubs and/or a solid
fence or wall with a minimum initial height of five feet at planting or installation in the case of a
wall or fence. The applicant is depicting a five-foot wide strip of land along the western
property line with a six-foot high solid wooden fence combined with landscaping in addition to
landscaping along the eastern property boundary. Therefore a variance of 10 feet is required
along the western lot line. A single-family residence is directly to the west of the subject
property as depicted below.

The applicant is also seeking a variance from the front foundation base planting requirement.
The ordinance requires foundation base plantings along the front, side and rear of buildings,
and the width and extent of the requirement is based on the size of the building. For buildings
less than 10,000 square feet a 10400t wide front foundation base planting is required. The
applicant is seeking a variance of seven feet. On the attached landscape plan a three-foot wide
landscape strip is depicted. Adjacent is a five-foot wide sidewalk. While the width is less than
required staff believes the intent of the ordinance has been satisfied, mainly the use of
foundation base plantings and staff believes a five-foot wide sidewalk is appropriate.
Variance from the Accessory Uses, Yards and Fences Requirements
The applicant is seeking a variance from the accessory uses, yards and fences requirement in
the zoning ordinance to allow a refuse enclosure in the required corner side yard. On the
attached site plan the refuse enclosure is situated at the northwest section of the property.
The enclosure is appropriately screened however the zoning ordinance only permits refuse
enclosures to protrude in rear and interior side yards. By definition Oak Avenue abuts the
corner side lot line of the subject property therefore a thirty-foot yard is required. The
proposed enclosure is 10 feet from the corner side lot line therefore a variance of 20 feet is
required. The applicant has landscaped around the enclosure in addition to providing a solid
screen around the perimeter of the enclosure which is required to be a minimum of six -feet in
height and of similar material and appearance as the principal structure.
The primary justification for variances relates to unique circumstances attributable to the
property in question and must deal with the physical aspects of the site such as topography and

zoning district. The aforementioned variances are primarily the result of the size and shape of
the site. The subject property consists of three lots of record or lots which existed prior to
adoption of the zoning ordinance.
The property is landlocked, located on a state route and adjacent to City roadway. Further
there are multiple utility boxes and associated appurtenances along the east property line
which inhibit compliance with all required ordinances and impact the design of the site;
however staff believes the applicant has done a good job dealing with the aforementioned
challenges and is taking appropriate measures to mitigate potential adverse land use impacts to
abutting properties.
PLANNING AND ZONING COMMISSION: The Planning and Zoning Commission recommended
unanimously recommended approval (7-0) of a conditional use permit to allow a drive-in
establishment and outdoor seating as presented by the applicant, be granted, subject to the
following conditions:
• Site is developed in substantial conformance with the attached site and landscape plans and
building elevations;
• Applicant shall contact the Illinois Department of Transportation (IDOT) and submit an
approval letter from IDOT permitting the use of the subject property as proposed prior to a
building permit being issued;
• All off -site and on -site (access and roadway) improvements to and from Front Street shall be
in accordance with the requirements of IDOT;
• Applicant shall dedicate right-of-way required for long-term roadway improvements to Illinois
Route 31; dedication shall be made to the City free and clear of any liens and encumbrances
and a plat of dedication shall be submitted to the City for recordation; City will work with
applicant and IDOT to determine amount of right-of-way which may be required.
And;

Chairman Strach called the Public Hearing to order at 8:07p.m. regarding File No Z- 873, an
application for a conditional use permit to allow a drive-in establishment and outdoor seating;
Variances from the Landscaping and Screening, Accessory Uses, Yards and Fences and Off -
Street Parking and Loading requirements in the zoning ordinance and any variances required to
effectuate the aforementioned request on the subject property as submitted by Suresh Patel
for the property located at the southwest corner of Front Street (Illinois Route 31) and Oak
Avenue.
Chairman Strach stated Notice of the Public Hearing was published in the Northwest Herald on
August 12, 2015. Notices were mailed to all abutting property owners of record as required by
ordinance. The subject property was posted. A Certificate of Publication and Affidavit of
Compliance with notice requirements are on file in the City Clerk's Office.
In attendance was Eric Carlson, ECA Architects, 24 N. Bennett St., Geneva, IL, who was sworn in
by Chairman Strach. Mr. Carlson provided a summary of the request before the Commission at
this Hearing stating he represents the owner of the business, a Dunkin Donuts franchisee, who
is active in the community and is seeking to add a stand-alone Dunkin Donuts with a drive -
through on the property. He is here to request what is needed for this use on the subject
property site.
Director of Economic Development Martin provided the Commission with the Staff Report
regarding this matter stating the applicant is proposing to construct a third Dunkin Donuts store
at the southwest corner of Oak Avenue and Front Street, which is zoned C5 Highway
Commercial. In order to facilitate this development a conditional use permit is required to allow
a drive-in establishment and outdoor seating and variances from the zoning ordinance

including: variance from the off-street parking and loading ordinance (7 spaces); variance from
the landscaping and screen requirements (10 feet residential screening strip along the west lot
line and 7 feet foundation base planting requirement along the front (north) side of the
building); and a variance from the accessory uses, yards and fences section of the zoning
ordinance to allow a refuse enclosure in the required corner side yard.
Staff believes the land use is appropriate for this site. There is a commercial shopping center
north of the subject property and an office/commercial building south of the site, and the
property is located along a major commercial corridor. The applicant has had preliminary
conversations with the Illinois Department of Transportation.
The preliminary plan and profile from IDOT were presented, which includes a full access of off
Front Street and approximate right-of-way dedication along Front they may seek in the future.
This is also depicted on the site plan. The applicant is proposing an additional full access off of
Oak Avenue, which is a City roadway.
Staff has been working with the applicant and believes that the proposed drive-thru layout is in
substantial conformance with the drive-in establishment guidelines established by the City
Council. Staff and the applicant discussed the feasibility of an "escape lane" curb cut at the
southwest corner of the site from the drive-thru lane to the property to the south. While this
may be a benefit for someone within the drive-thru who has to exit for some reason
immediately it could also be a safety concern. Practically, the access to the south would have to
be one-way however there would be the potential, if this curb cut existed, for someone to drive
north into the drive-thru lane. Additionally, in order for a vehicle within the drive-thru lane to
utilize this curb cut the car would have to be at the appropriate location to do so at the exact
time when they would need to utilize it. Dunkin Donuts monitors the length of time it takes for
a customer - from the time they order to the time they exit the drive-thru. This standard is
roughly between 76 and 90 seconds, therefore staff is not concerned with the lack of an
"escape" or "by-pass" lane.
The zoning ordinance requires five stacking spaces for adrive-thru and the attached site plan
can accommodate seven vehicles. The hours of the drive-thru are proposed from 5:30 a.m. to
10:00 p.m. Residential property exists immediately adjacent to the west of the site and to the
east across Front Street, and the applicant is proposing to erect a six-foot high solid wooden
fence along the western property line with landscaping.
The applicant is proposing outdoor seating immediately east of the building, similar to the
location on Elm Street. The outdoor seating area would have athree-foot tall decorative fence
installed adjacent to the drive-thru lane. Staff is comfortable with the drive-thru layout and

outdoor seating area as -proposed and believes the criteria outlined in Table 31 for conditional
uses have been satisfied. The parking requirement for this facility is 15 parking spaces/1,000
square feet of floor area, with 10 parking spaces/1,000 square feet of net floor area required to
be built immediately and adequate room on -site to add five additional spaces if necessary. The
site as -proposed requires 29 parking spaces utilizing the 15 space/1,000 square feet of floor
area standard and 19 spaces required to be constructed immediately. The site plan depicts 22
parking spaces. Staff believes this variance is acceptable due to the large drive-thru business

Director of Economic Development Martin further stated the applicant is seeking two variances
from the landscaping and screen requirements. We have building foundation planting
requirements on the front, the side and the rear, depending on a percentage of each. In the
front they cannot meet that requirement due to space constraints, however they did do
landscaping in the front along the foundation yet they cannot fully meet the entire width
requirement. The way the lot is seated, the dumpster enclosure is located in the required
corner side yard. The zoning ordinance states the refuse containers can only be permitted to
protrude into the rear and interior side yards, not a corner side yard. Typically there would be a
20' variance required because the corner side yard is 30', however they
will screen it with materials that will match the building which will be enclosed. Practically, the
location works out to be in a corner side yard for garbage pickup by zoning regulations but
there is not really another location on the property for the refuse containers.

the following Variances from the zoning ordinance:

along the west lot line and 7400t variance from the front foundation base planting
requirement); and
• variance from the accessory uses, yards and fences section of the zoning ordinance to allow a

Staff finds that the requirements in Tables 32 (Variances) of the Zoning Ordinance have been
met. Chairman Strach invited questions and/or comments from the Commission.
Commissioner Meyer stated he is concerned with the property exiting to the left onto Route 31.
He believes the busiest time for business will also be the time with the most traffic on Route 31
and opined traffic will often become backed up on Route 31, which will cause issues.
Commissioner Doherty asked if it is possible that IDOT may include a center lane in the
expansion on Route 31 that would not allow traffic to cross over it in the future. Director of
Economic Development Martin stated he was not sure and everything is still in planning stages.
He further stated traffic is able to make a left turn onto Route 31 there now, either way on Oak
or Front. He added that IDOT did look at the plans and gave minimal comments and that issue
did not seem to be a concern. Commissioner Doherty opined surprise a full access is not
indicated.
Photographic images of the proposed building were presented. Chairman Strach opened the
floor to questions and comments from the audience. There was nobody in attendance who
wished to address the Commission regarding this matter. Chairman Strach closed the public
comment portion of the hearing at 8:20 p.m.
Commissioner Thacker asked the hours of operation and clarification on .the typical percentage
of drive -through business. Mr. Carlson stated the overall average on drive -through business is
typically 60% but some locations get up to 75% drive -through traffic throughout the day.
Discussion was held regarding the number of parking spaces required at each of the Dunkin
Donuts locations.

Any Drive-in establishment proposed in the City of McHenry may be subject to any or all of
the following design considerations imposed as conditions by the City Council:
1. Adequate spacing between order window/box and the nearest residentially zoned property.
2. Adequate number of stacking spaces is shown on site plan (five spaces per window).
3. No stacking space shall block any right-of-way or common driveway aisle.
4. Demonstrate an adequate turning radius is shown on the site plan as the onsite circulation
path moves around the building or structure, particularly regarding emergency vehicle
access.
5. Consider limiting the hours of operation of drive-in window, particularly if adjacent to
residentially zoned property.
6. Vehicle stacking area must be isolated from parking and any means of circulation by means
of a landscape median.
7. Consider limiting access cuts to public roadways.

THE PROPERTY LOCATED AT THE SOUTHWEST CORNER OF OAK AVENUE AND FRONT STREET

WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as

• All off -site and on -site (access and roadway) improvements to and from Front Street
shall be in accordance with the requirements of IDOT;
• Applicant shall dedicate right-of-way required for long-term roadway improvements to
Illinois Route 31; dedication shall be made to the City free and clear of any liens and
encumbrances and a plat of dedication shall be submitted to the City for recordation;
City will work with applicant and IDOT to determine amount of right-of-way which may
be required.
SECTION 2: In granting said Conditional Use Permit, the City Council finds that the
requirements of Table 31 of the Zoning Ordinance have been met in that:
1. Any adverse impact of types or volumes of traffic flow not otherwise typical in
the zoning district has been minimized.
2. Any adverse effects of noise, glare, odor, dust, waste disposal, blockage of light
or air, or other adverse environmental effects of a type or degree not
characteristic of permitted uses in the zoning district, have been appropriately
controlled.
3. The proposed use will fit harmoniously with the existing natural or man-made
character of its surroundings, and with permitted uses in the zoning district. The
use will not have undue deleterious effect on the environmental quality,

4. The proposed use will not require existing community facilities or services to a
degree disproportionate to that normally expected of permitted uses in the
district, nor generate disproportionate demand for new services or facilities, in
such a way as to place undue burdens upon existing development in the area.
5. The proposed use will not be detrimental to the safety or health of the
employees, patrons, or visitors associated with the use nor of the general public
in the vicinity.
6. The proposed use is in harmony with all other elements of compatibility
pertinent to the Conditional Use and its particular location.

screening strip requirements along the west property line; a seven -foot variance from the front

of the land or building(s) for which the variance is sought, such as dimension,
topography, or soil conditions. They do not concern any business or activity the
present or prospective owner or tenant carries on, or seeks to carry on, therein,
not to the personal, business, or financial circumstances of such owner or tenant
or any other party with interest in the property.
3. The special circumstances that are the basis for the variance have not resulted
from any act of the applicant or of any other party with interest in the property.
4. The strict application of the provisions of the Zoning Ordinance would result in
unnecessary and undue hardship upon the applicant, as distinguished from a
mere inconvenience.
5. A Variance is necessary for the applicant to preserve and enjoy a substantial
property right possessed by other properties in the same zoning district and does
not confer a special privilege ordinarily denied to other properties in the district.
6. The granting of a Variance is necessary not because it will increase the
applicant's economic return, although it may have this effect, but because
without the variance the applicant will be deprived of any reasonable use or
enjoyment of the property.
7. The granting of a Variance will not alter the essential character of the locality nor
substantially impair environmental quality, property values, or public safety or

AN ORDINANCE GRANTING A VARIANCE FROM CHAPTER SEVEN ARTICLE XI OF THE
CITY OF MCHENRY MUNICIPAL CODE ENTITLED FENCES TO ALLOW A FENCE IN THE REQUIRED

WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the
passage of this Ordinance constitutes an exercise of the City's home rule powers and functions
as granted in the Constitution of the State of Illinois.
NOW, THEREFORE, BE IT ORDAINED by the CITY COUNCIL of the CITY OF MCHENRY,
McHenry County, Illinois, as follows:
SECTION 1: That the property legally described on Exhibit "A" attached hereto and
incorporated herein, the "SUBJECT PROPERTY" is hereby granted a variance from Sec. 7-145

SECTION 2: If any section, paragraph, subdivision, clause, sentence or provision of this
Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such
judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder
shall remain and continue in full force and effect.
SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: This Ordinance shall be in full force and effect upon its passage, approval

Prmiect Narrative
Dunkin Brands Franchisee, Suresh Patel, is proposing to build a new standalone Dunkin ponuts drive-
thru on the current undeveloped .54 acre property located at the southwest corner of Front Street (IL
Route 31) and Oak Ave. in McHenry, IL. The proposed development will contain a 2,280 square foot
wood framed building designed following the Dunkin Brands prototype guidelines. There will be an
outdoor patio for seating on the east end of the building. Due to the relatively small site, the parking
available allows for 22 spaces. While this is less than allowed by the current Ordinance, it would be
adequate for the Dunkin Donuts use. The store does a majority of its volume in the morning between
6:00 a.m and 10:00 a.m. The driveAhru accounts for roughly 60% of the Dunkin Donuts business and
few patrons park and enter the store. Of the patrons that enter the store, most are in and out and
occupying a parking space for much less time than a standard restaurant, of which the Ordinance is
based.
The proposed development has incorporated perimeter landscaping along all 4 property lines as much
as possible given the constraints of the small site. A 6' high solid fence will be placed along the west
property line that provides additional screening to the residence. This is a similar method used by the
site directly south, with the addition of some landscaping between the drive lane and the fence. Efforts
have been made to provide landscaping around the site as much as possible to keep the intent of the
Ordinance and maintain good circulation on the site allowing efficiency of the business. The site
contains significantly better landscaping and screening than many other businesses along Front St.
The hours of the drive -through are proposed to be 5:30 a.m. to 10:00 p.m. It is anticipated that the
store will have product deliveries 2-3 time per week and trash pick-up 2-3 times per week. The hours of
the deliveries and trash pick-up will be non -peak business hours and scheduled minimize disturbance
to neighboring properties.
Dunkin Donuts makes every attempt to set a high standard to provide quality service, a quality product,

that normally expected of permitted uses in the district, nor generate disproportionate demand for new

The utilities used for Dunkin Donuts are consistent with other restaurant / coffee shop uses. The
area appears to easily support this type of use without any impact to the development area.
5. Public Safety and Health
The proposed use will not be detrimental to the safety or health of the employees, patrons, or visitors
associated with the use nor of the general public in the vicinity.
There is nothing unique about the site and the proposed drive-thru that would be detrimental to the
safety or welfare of the public.
6. Other Factors
The proposed use is in harmony with all other elements of compatibility pertinent to the Conditional Use
and its particular location.
The drive-thru Dunkin Donuts is a use that in consistent along Front Street. The area has a wide variety
of business and the drive-thru would supplement the other business's and local patrons.

impossible. Efforts have been made to maximize landscaping and screening while keeping the building
and site functional.
5. Preserves Rights Conferred by District
A variance is necessary for the applicant to preserve and enjoy a substantial property right possessed by
other properties in the same zoning district, and does not confer a special privilege ordinarily denied to other
properties in the district.
As stated previously, the applicant has made efforts to comply as much as possible given the constraints
noted. Due to the corner lot and smaller size, the variances are necessary for the proposed use, which
would be fitting for this location, and per the applied C-5 zoning.
6. Necessary for Use of Property
The granting of a variance is necessary not because it will increase the applicant's economic return, although
it may have this effect, but because without a variance the applicant will be deprived of any reasonable use
or enjoyment of the property.
The return value on the property is on the drive-thru component. In today's economy the drive-thru
caters to tjhe fast pace, convenience mind -set of the general public. More than 50% of a Dunkin
Donuts business is through the drive-thru. This site would not support itself without the drive-thru.

7. Not Alter Local Character
The granting of a variance will not alter the essential character of the locality nor substantially impair
environmental quality, property values, or public safety or welfare in the vicinity.
The variety of different businesses along Front Street add to the overall success of each business. Adding
a Dunkin Donuts drive-thru would mesh well with the local character and enhance the the surrounding
properties and businesses.
8. Consistent with Zoning Ordinance and Comprehensive Plan
The granting of the variance will be in harmony with the general purpose and intent of the Zoning Ordinance
and Comprehensive Plan of the City, as viewed in light of any changes conditions since their adoption.
The proposed use is consistent with the C-5 zoning and would be in harmony with the surrounding uses.
9. Minimum Variance Required
The variance requested is the minimum required to provide the applicant with reasonable use and enjoyment
of the property.
Efforts have been made to minimize the width of the buildin while still allowing for optimal functionality.
The requested variations are minimized with the proposed layout.
