Schmitt, Director of Public Works RE: Nicor Grant of Easement Request ATT: Easement Agreement with exhibit; letter of acceptance and consideration on behalf of Nicor Gas; Frank Harrison and Associates appraisal report BACKGROUND: Staff received the attached Grant of Easement request from Nicor Gas Company to install a gas valve vault to facilitate an upgrade to their gas distribution system. The easement requested is 15 feet by 88 feet and is adjacent to an existing Nicor easement located on the eastern lot line at the Public Works Facility at 1415 Industrial Drive. ANALYSIS: At the request and reimbursement by Nicor, staff contacted Frank Harrison and Associates to conduct an appraisal of the easement. Frank Harrison and Associates values the easement at $3,300.00 (see attached appraisal report). City Attorney IvicArdle and staff have reviewed the Grant of Easement request and recommends approval. RECOMMENDATION: Therefore, if Council concurs, it is recommended to authorize the Mayor's execution of the attached Grant of Easement to Nicor Gas Company for 15 feet by 88 feet easement at the Public Works Facility at 1415 Industrial Drive for the appraised value of $3,300. As I understand the situation, Nicor is interested in acquiring a 1546ot by 88400t permanent easement in the southeast portion of the 1.72-acre site, adjacent to their existing easement, for the purpose of creating and maintaining a vault. The purpose of illy inspection was to develop a market value opinion of the easement being requested by Nicor, as a part of a larger, 1.72-acre holding. The date of value is March 1, 2016, the date of inspection of the subject property. The legal description of the subject property was taken from an appraisal I did for the City of McHenry in 2007, when they acquired a 10.15-acre property from James Althoff; this 10.15-acre property included the 1.72-acre subject property in this assignment. For purposes of this assignment, the legal description is assumed to be correct. It is also assumed to be consistent with the land narratively described and visually portrayed in this appraisal report, Definitions Market value, as used in this report, is defined as the most probable price which a property should bring in a competitive and open market under all conditions requisite to a fair sale, the buyer and seller each acting prudently and knowledgeably, and assuming the price is not affected by undue stimulus. Implicit in this definition is the consummation of a sale as of a specified date and the passing of title from seller to buyer under conditions whereby: 1) buyer and seller are typically motivated, 2) both parties are well-informed or well-advlsed, acting in what they consider their own best interest; 3) a reasonable time is allowed for exposure in the open market; 4) payment is made in cash or U.S. Dollars or in terms of financial arrangements comparable thereto; and 5) the price represents the normal consideration for the property sold, unaffected by special or creative financing or sales concessions granted by anyone associated with the sale. Scope of Woa•Ic and Intended Use of the Appraisal This assignment included an inspection of the 1,72-acre subject property and its neighborhood, collection of factual infozmation relative to the subject property, preparation of a highest and best use analysis of the subject property, accumulation of market data to allow development of the sales comparison approach, development of the sales comparison approach and reconciliation of its findings into a market value opimon for the subject property, development of a market value opinion of the permanent easement being sought by Nicor on a portion of the subject property, and preparation of this appraisal report. Accordingly, the only mcaningful approach to value is the sales comparison approach, which has been developed in its traditional manner. The only limitations to development of the sales comparison approach are limitations in available market data. The extent of the data collection process used in this assignment will be addressed subsequently in this appraisal report. There are no other hypothetical conditions or extraordinary asstumptiozrs associated with this assignment. There is no personal property, business enterprise value, or going concern value associated with this assignment. It is my ruiderstazrding that the intended use of this appraisal is by my client in this natter, the City of McHenry, in negotiating the sale of a permanent easement on a small portion of the subject property to Nicor. The appraisal and appraisal report were ordered by Jon M. Schmitt, the Director of Public Works for the City of McHenry. To the best of my knowledge, the appraisal and appraisal report conform to the valuation and report writing standards of the tJn forin Standards of PTofesslonal Appretisal Practice (USPAP). This letter is intended to be a restricted appraisal report, presented in a narrative format. The use of this restricted appraisal report is limited to the City of McHenry for their use in negotiating the acquisition of the subject property. Neighborhood Ovezview The subjects neighborhood is a heterogeneous district in the central part of McHenry. The neighborhood is almost fully developed; the only undeveloped portions of the neighborhood are some industrial sites in the industrial park north of the subject property and some park land owned by McHenry. Uses in the neighborhood inchide commercial, irldustrlal, residential, and special purposes. The commercial properties occur primarily in the Route 120 corridor. Commcrcial uses include grocery stores, a neighborhood shopping center, fast food restaurants, automobile service establislmients, etc. Industrial uses occur in the McHenry City Center Business Park north and west of the subject property. Uses include owner -occupied properties and rental properties; there are also several industrial condominiums. Residential properties are located north of the McHenry City Center Business Park and east of the railroad right -of --way. in McHenry Lakes Estates and Lakeland Park. These subdivisions are virtually 100% built -out and developed with detaehed single-family residences. Special purpose properties in the neighborhood include the railroad right-of-way, several parks owned by the City of McHenry, the Zion Lutheran school, church, and pre-school, and the McHenry Public Works property, of which the subject property in this assignment is a part. Zorrirrg is controlled by the City of McHenry. Water and sewer are available to properties in McHezuy. Associates, lxrc. Mr, Jon M. A relatively minor trend is the occasional rehabilitation of older properties. At times, such a property is acquired, improvements are demolished, and the sites are redeveloped. Very little new development is occurring, primarily because of the lack of available vacant sites that can be developed. A11 things considered, the subject's neighborhood is a heterogeneous neighborhood in central McHenry that consists of a variety of property types. The subject's neighborhood should continue to maintain its character as it becomes more stable over time. Market Data There has been virtually no industrial development anywhere itr McHenry County for• the past several years. Consequently, there have been virtually no sales of industrial development lard anywhere in McHenry County. For example, there have only been nine sates of vacant industrial land throughout all of McHenry County between January 2014 and the date of value in this assignment. However, three of the sales were large acreage tracts without water and sewer Mr. Jon M. Schmitt, File No. 11150, Nicor Easement, March 7, 2016, Page 6 availability, one was in a very remote portion of McHenry County {Hebron) that was not comparable from a locationaI point of view, two were involved in either foreclosure proceedings or were short sales, one was between related parties, and one was purchased with the intent of rezoning the site and re -developing it commercially. That only left one somewhat comparable sale in McHenry County. I expanded the search for comparable sales between January 2014 and the date of value in this assignment into northeastern Kane County and western Lake County. By doing this, I was able to identify two more sales - one in Mundelein in Lake County and one in tine Kane County portion of Huntley. These three sales formed the basis of the sales comparison approach that I developed in this assignment. The following sales are relatively recent sales of small acreage industrial developnnent #racts #hat Dave occurred between March 2014 and July 2015. Each has some degree of comparability to the subject property. A summary of each sale is presented below and on the following pages. Additional information on each sale is retained in my file. The sales are presented chronologically, starting with the oldest. A Sale Map has been prepared as an exhibit at the end of this appraisal report. The sales were reduced to an appropriate unit price for comparison to the subject property. The appropriate unit of comparison is sale price per square foot of land area. All of the sales involved the apparent arm's length transfer of fee simple interest. All of the sales occurred under market conditions equivalent to those in effect on the date of value for industrial development sites, All were annexed, with industrial zoning in place at the time of sale, and with water and sewer available. Finally, all of the sales were in industrial parks removed from ally major highways. All of the sales were slightly superior to the subject property with respect to access because they had direct street frontage and did not rely on access over intervening property. Reconciliation and Conclusion — Subject Propez•t3T In developing zuy final opinion of �Ilaz•ket value of the subject property in this rllatter, I considered all of the sales, the degree of comparability of each sale to the subject property, the range of unit prices, the current market conditions for industrial development sites in McHenry County, central and western Lake County, and northeast Kane County. By reason of my analysis of the market data gathered during my investigation, tempered by myJudgment and experience, I have formed the opinion that market value of the fee simple interest of the subject property was, as of March 1, 2016, measured in the amount of $2.50 per square foot. Based on the 74,923.20 square feet contained in the subject property, the resulting value of the subject property at the reconciled unit price is $187,308. I have also developed the conclusion that market value of the permanent easement interest of the 1,320 square foot permanent easement, as a part of the larger land Bolding characterized as the subject property in this appraisal, is also $2.50 per square foot, or $3,300. Jones, Chief of Police FOR: April 4th, 2016 RE: Intergovernmental Agreement for Dispatch Services for the Marengo Police Department Background: The McHenry Police Department has been providing dispatch services for the Village of Johnsburg Police Department, the McCollum Lake Police Department, the McHenry Township Fire Protection District, the Union Fire Protection District, the Marengo Fire Protection District and the Marengo Rescue Squad. With the upcoming consolidation mandate of PSAP's (Public Safety Answering Points) the Lake in the Hills PSAP is slated as one of the dispatch centers going out of business. One of the agencies that receive dispatch services from Lake in the Hills is the Marengo Police Department. The City of McHenry and the City of Marengo have been in negotiations regarding the McHenry Police Department taping over those dispatching needs. Providing those services for the Marengo Police Department falls in line with our consolidation efforts and allows us to dispatch for both their Police and Fire services as we are already the PSAP for the Marengo Fire and Marengo Rescue departments. Our dispatchers are undergoing continuous emergency dispatch training and quality control checks are being done on randomly selected calls for service. We are providing a high quality of service to our partners and plan to continue to improve that service. Analysis: The city and the Marengo Police Department agreed to an annual fee for dispatching services. This fee amount will increase annually based on calls for service from the previous year and a Consumer Price Index based adjustment in the rate charged per call. This more closely aligns fees charged to actual cost per call. This request is made to allow the Mayor to execute a contract and Intergovernmental Agreement with the City of Marengo for dispatch services. A. McHenry provides to its residents and businesses, among other services, radio dispatched police and law enforcement services ("Dispatching Services") within its corporate limits. B. Marengo desires to obtain for its residents within their City, the Dispatching Services of McHenry for the purposes of providing 24-hour E 941 1 telephone answering service for emergency police officers employed by the City and other services. C. McHenry and Marengo have the power and authority to enter into this Agreement pursuant to the provisions of Article VII, Section 10 of the Illinois Constitution of 1979, and the Illinois Intergovernmental Cooperation Act, as amended, 5 ILCS 220/1 et seq., and other applicable authority. NOW THEREFORE, in consideration of the mutual promises contained herein and other good and valuable consideration, the sufficiency and adequacy of which is hereby acknowledged as being received, Marengo and McHenry agree as follows: 1. McHenry's Obligation: McHenry shall provide Dispatching Services to Marengo during the term of this agreement in accordance with Illinois law including but not limited to 210 ILCS 50/1 et seq. Commonly known as the "Emergency Medical Services EMS Systems Act". Additional services include monitoring telephone services after 4 pm, or as needed, initiation of emergency weather warning sirens and closed circuit camera monitoring. 3. Marengo Hardware: At its sole expense, Marengo shall install and maintain any required radio infrastructure necessary to receive radio communications from its personnel and relay them to the McHenry Communications Center in McHenry, 1 Illinois. The cost of telephone lines and interface equipment necessary to accomplish these services shall be the responsibility of Marengo. 4. No Supervision of Direction: McHenry Dispatching Services provided to Marengo hereunder are limited to the dispatch of Marengo police officers. McHenry dispatchers and on -duty supervisory personnel have no responsibility to ensure that Marengo police officers comply with any applicable rules and regulations. The supervision and direction Marengo police officers are outside the scope of this Agreement and remain the responsibility of Marengo. 5. Dispatch Fee: Marengo shall, beginning May 1, 2016 ("Original Term Dispatch Fee"), pay to McHenry monthly installments to be paid no later than the 101" day of each month. The Original Term Dispatch Fee will be calculated based on the existing rate of $26.00 per service call ("Service Call Rate") and $12.88 per traffic stop (Traffic Stop Rate) plus the lesser of any increase in the Consumer Price Index from the prior calendar year (2015), or three (3) percent ("Adjusted Call Rate"). Thereafter, the Service Call Rate and Traffic Stop Rate shall change annually, on each anniversary date of this Agreement, using the same Adjusted Call Rate calculation. The CPI adjustment shall be calculated using the annual average change as published by the United States Department of Labor's Bureau of Labor Statistics, All Items Consumer Price Index for Urban Consumers for Chicago, Illinois. The Adjusted Call Rate shall then be multiplied by the number of service calls and traffic calls dispatched by McHenry for Marengo in the prior year, thereby arriving at the Dispatch Fee for the next year of Dispatch Services to be paid on the same monthly basis as the Original Term Dispatch Fee. 6. Joe was nominated by his fellow scouts and was elected to be inducted into the Order of the Arrow. Joe was a committee member of the Chicago Welcome Home Parade for Vietnam Veterans and was also instrumental in renaming Pearl Street Park to Veterans Park. One of his favorite activities was being a volunteer during McHenry's annual Fiesta Days. Joe always reserved vacation days to help out in any way that he could. No job was ever too small or too big. In the late 1970's, Craig and Steve took over the business and moved their store to the existing 30,000 square feet building on Crystal Lake Road. The family provided the community with exceptional products, focusing on old-fashioned customer service. The applicant, Mr. Neumann is requesting the rule of issuing no more than three honorary signs annually be relaxed in 2016. (In 2016, City Council approved one honorary sign and two additional designations are on this evening's Council agenda.) Stanley's wife, Helen survives and is the only Bjorkman who was involved from day one. She is of frail physical health but of sound mind and would enjoy the recognition for her family. When I requested that their section of Crystal Lake Road be named in their honor, I was thinking of that section that runs by the front of their store. The closest street sign to their store's entrance is at Crystal Lake Road and Lillian Street. It is there that I assumed the designation would be above the Crystal Lake Road part of that sign. So that it doesn't become too wordy, I suggest that it might be "The Bjorkman Family Way." Walter Bj orkman and his son Stanley opened their first store on Riverside Drive right next to what is now Bimbo's. Stanley's wife Helen survives and is the only Bjorkman who was there from Day 1. She is Steve and Craig's mother. She is of frail physical health but of sound mind. Helen Bjorkman, who is in her mid to late eighties, lives near her daughter in the Twin. Cities and returns here for two ALA each summer. Not knowing of the time and Limitation restraints associated with getting this done, I was thinking it might be slick to have it happen while she might enjoy the recognition. Even though the sign and unveiling might not happen this year I'd like to see knowledge of it happening be shared with her before then. If one were trying to get it done completely this year, one possible path might be for staff to request that the council approve transferring one of next year's three slots to this year so that they, staff, can bring forth an application for approval. How it would then move forward while maintaining an element of surprise has probably happened before. I have not shared any of this with anyone and do not plan to. I appreciate you embracing this request and will unquestionably defer to your wishes as to who, how and when this gets communicated. I don't mean to infer that Helen Bjorkman is about to expire, but she is an old lady and I'm sure her family would like her to know of this. On February lst, the City Council authorized staff to partner with the McHenry Area Jaycees to roduce the annual Jaycees Day Fireworks Celebration in Petersen Park on Saturday, July 2n with a rain date of Sunday, July 3rd. The Jaycees will donate $10,000 towards the cost of the contract with a contribution of $5,000 paid by the city. In addition to financial participation, Council approved the use of city services from Parks, Public Works, and the Police Department. Equipment and staff from the McHenry Township Fire Protection District will also assist as necessary. The Jaycees will provide funds for a sound system and background music through revenue derived from the $6 per car parking fee. Two companies, Melrose Pyrotechnics and Mad Bomber Fireworks Productions, responded to the city's Request for Qualifications to produce at minimum, a 25-minute display choreographed to music selected by the city and Jaycees. A third proposal from Five Alarm Fireworks Co. who produced last year's show, was submitted to the city after the RFQ deadline of February 26th. Analysis. After review of the RFQ's and professional references, the Jaycees recommend the selection of Mad Bomber Fireworks Productions to produce a 25-minute program choreographed to music for $15,000. In addition to professional references, staff consulted with the McHenry Township Fire Protection District. The district is familiar with Mad Bomber Productions and has no concerns with the proposal as presented. Mad Bomber has been in business for 25 years and produces displays for over 500 customers each year. A team of trained pyrotechnicians with more than 10 years experience will produce the show. Graphics Estimate - Eby Graphics Background: On January 6—, 2016 Officer Foley of the McHenry Police Department was involved in a motor vehicle accident while driving her police vehicle (Squad 326). As a result of this accident Squad 326 (2011 Ford Crown Victoria) was damaged beyond repair. On February 19th, 2016 Officer Lazicki of the McHenry Police Department was involved in a motor vehicle accident while driving his police vehicle (Squad 324). As a result of this accident Squad 324 (2011 Ford Crown Victoria) was damaged beyond repair. With the nature of the work that law enforcement does, the risk of vehicle accidents is always high. In both of these incidents, the officers exercised safe vehicle operation practices and the accidents were caused by the other driver, with no fault on the part of the officers. Insurance payout on these two police vehicles were as follows: Squad 324. $6,975 8qua&326:r ` $6,478 The McHenry Police Department utilizes a rotational vehicle plan for the patrol division. This means that seventeen patrol vehicles are shared between thirty six officers and three separate shifts. This plan allows for the agency to run roughly 2/3 of the patrol fleet each 24 hour period. This is done so that the agency can control mileage and wear on the vehicles, assuring maximum service life. With the loss of Squad 324 and Squad 326 the remaining patrol fleet will see an increase in mileage and wear, affecting the service life and maintenance costs of other patrol vehicles. The department therefore needs to replace Squad 324 and Squad 326 in a timely Analysis: With the loss of these two vehicles the department began the process of finding replacements for Squad 324 and Squad 326. The McHenry Police Department currently uses the Ford Interceptor Sedan as the agency's approved patrol vehicle. In searching for replacement vehicles two options are available. The first option would be to order a new vehicle through a dealership that can conduct police vehicle sales through the approved Illinois State Contract for Ford Interceptors. This process includes vehicle/option selection, ordering, vehicle manufacturing and delivery. Manufacturing time for new vehicles is an eight week minimum and pricing is higher due to next year's contract pricing. The second option is to search for Ford Interceptor Sedans that have already been manufactured and are at a dealership and available for purchase. This option allows for immediate replacement of the vehicles and still utilizes state contract pricing or a competitive comparable contract. The department chose option two as the preferred method to replace Squad 324 and Squad 326. With such the department began to search regional dealerships for two black Ford Interceptor Sedans. This regional search identified only two new vehicles that meet the requirements (make/model/options). Both of these vehicles were located at Morrow Brothers Ford in Greenfield, Illinois. Morrow Brothers is an authorized dealer for the Illinois State Contract. Contact was made with Morrow Brothers Ford and they provided the below pricing for each new vehicle. $25,690.00 $26,690.00 $338.00 Although the sales of these vehicles is normally first come first serve, Morrow Brothers Ford has agreed to hold these vehicles for McHenry pending the direction of City Council. Finally, council will find the attached pricing for the purchase and installation of emergency equipment and decals for the two new vehicles.
