ATT: Easement Agreement with exhibit; letter of acceptance and consideration on
behalf of Nicor Gas; Frank Harrison and Associates appraisal report
BACKGROUND: Staff received the attached Grant of Easement request from Nicor Gas Company
to install a gas valve vault to facilitate an upgrade to their gas distribution system. The
easement requested is 15 feet by 88 feet and is adjacent to an existing Nicor easement located
on the eastern lot line at the Public Works Facility at 1415 Industrial Drive.
ANALYSIS: At the request and reimbursement by Nicor, staff contacted Frank Harrison and
Associates to conduct an appraisal of the easement. Frank Harrison and Associates values the
easement at $3,300.00 (see attached appraisal report). City Attorney IvicArdle and staff have
reviewed the Grant of Easement request and recommends approval.
RECOMMENDATION: Therefore, if Council concurs, it is recommended to authorize the Mayor's
execution of the attached Grant of Easement to Nicor Gas Company for 15 feet by 88 feet
easement at the Public Works Facility at 1415 Industrial Drive for the appraised value of $3,300.

That the City of McHenry, their successors, assigns, heirs, administrators and executors
(hereinafter "Grantor"), in consideration of the sum of Ten and 00/100 ($10.00) Dollars and
other good and valuable considerations, in hand paid by the Grantee, NORTHERN ILLINOIS
GAS COMPANY, an Illinois corporation, doing business as NICOR GAS COMPANY (the
sufficiency thereof and receipt of which is hereby acknowledged) does hereby give and grant
into said NICOR GAS COMPANY, its successors and assigns, a perpetual, non-exclusive
easement and right-of-way for the purpose of laying, maintaining, operating, renewing, replacing
and removing gas mains, vaults, at -grade vault covers, chart / control boxes, any required solar
panels, required pipeline markers and any necessary gas facilities appurtenant thereto, in,
upon, under, along and across the following described property, situated in McHenry County,

rights granted herein, provided, however, that Grantor shall not build, construct, erect or place,
or permit others to build, construct, erect or place, any buildings or public roads over the
easement property without the prior written consent of Grantee.

Grantee shall restore all that portion of Grantor's property damaged and/or disturbed by Grantee
during the original installation of Grantee's facilities on the Easement Premises and during any
subsequent, maintenance, repair, replacement or removal of Grantee's Facilities on the
Easement Premises to a condition as good as, or better than, that which existed immediately
prior to Grantee entering Grantor's property for such purposes. Regarding such restoration,
Grantor acknowledges that property restoration is dependent upon weather; therefore, weather
permitting Grantee agrees that it shall perform all such restoration in a timely manner.
The Grantee agrees to indemnify, defend and hold Grantor, its officers, directors, employees
and tenants harmless from and against all liability, claims, damages, losses and reasonable
expenses arising out of or resulting from the Easement Agreement, except that in no event shall
Grantee be responsible or indemnify, defend or hold harmless for any special or consequential
damages.
By recording this Grant of Easement, Grantee acknowledges its acceptance hereof and its
obligations hereunder and agrees to be bound by the terms hereof.

As requested, I have inspected the 1.72-acre vacant component of the holdings of the City of
McHenry off of Industrial Drive, east of Oak Street, at the railroad right-of-way, in McHenry,
Illinois. As I understand the situation, Nicor is interested in acquiring a 1546ot by 88400t
permanent easement in the southeast portion of the 1.72-acre site, adjacent to their existing
easement, for the purpose of creating and maintaining a vault. The purpose of illy inspection was
to develop a market value opinion of the easement being requested by Nicor, as a part of a larger,
1.72-acre holding. The date of value is March 1, 2016, the date of inspection of the subject
property.

subject property within the past three years. I am not aware of any offers to purchase the subject

The legal description of the subject property was taken from an appraisal I did for the City of
McHenry in 2007, when they acquired a 10.15-acre property from James Althoff; this 10.15-acre
property included the 1.72-acre subject property in this assignment. For purposes of this
assignment, the legal description is assumed to be correct. It is also assumed to be consistent
with the land narratively described and visually portrayed in this appraisal report,
Definitions
Market value, as used in this report, is defined as the most probable price which a property
should bring in a competitive and open market under all conditions requisite to a fair sale, the
buyer and seller each acting prudently and knowledgeably, and assuming the price is not affected
by undue stimulus. Implicit in this definition is the consummation of a sale as of a specified date
and the passing of title from seller to buyer under conditions whereby: 1) buyer and seller are
typically motivated, 2) both parties are well-informed or well-advlsed, acting in what they
consider their own best interest; 3) a reasonable time is allowed for exposure in the open market;
4) payment is made in cash or U.S. Dollars or in terms of financial arrangements comparable
thereto; and 5) the price represents the normal consideration for the property sold, unaffected by
special or creative financing or sales concessions granted by anyone associated with the sale.
Fee simple interes#, as used in this report, is defined as absolute ownership, unencumbered by
any other interest or es#ate, subject Drily to the governmental powers of eminent domain, escheat,
police power, and taxation.
Scope of Woa•Ic and Intended Use of the Appraisal
This assignment included an inspection of the 1,72-acre subject property and its neighborhood,
collection of factual infozmation relative to the subject property, preparation of a highest and best
use analysis of the subject property, accumulation of market data to allow development of the
sales comparison approach, development of the sales comparison approach and reconciliation of
its findings into a market value opimon for the subject property, development of a market value
opinion of the permanent easement being sought by Nicor on a portion of the subject property,
and preparation of this appraisal report.

The subject property is vacant land. Accordingly, the only mcaningful approach to value is the
sales comparison approach, which has been developed in its traditional manner. The only
limitations to development of the sales comparison approach are limitations in available market
data. The extent of the data collection process used in this assignment will be addressed
subsequently in this appraisal report.
There are no other hypothetical conditions or extraordinary asstumptiozrs associated with this
assignment. There is no personal property, business enterprise value, or going concern value
associated with this assignment.
It is my ruiderstazrding that the intended use of this appraisal is by my client in this natter, the
City of McHenry, in negotiating the sale of a permanent easement on a small portion of the
subject property to Nicor. The appraisal and appraisal report were ordered by Jon M. Schmitt,
the Director of Public Works for the City of McHenry. To the best of my knowledge, the
appraisal and appraisal report conform to the valuation and report writing standards of the
tJn forin Standards of PTofesslonal Appretisal Practice (USPAP). This letter is intended to be a
restricted appraisal report, presented in a narrative format. The use of this restricted appraisal
report is limited to the City of McHenry for their use in negotiating the acquisition of the subject
property.
Neighborhood Ovezview
The subjects neighborhood is a heterogeneous district in the central part of McHenry. The
neighborhood is almost fully developed; the only undeveloped portions of the neighborhood are
some industrial sites in the industrial park north of the subject property and some park land
owned by McHenry.
Uses in the neighborhood inchide commercial, irldustrlal, residential, and special purposes. The
commercial properties occur primarily in the Route 120 corridor. Commcrcial uses include
grocery stores, a neighborhood shopping center, fast food restaurants, automobile service
establislmients, etc. Industrial uses occur in the McHenry City Center Business Park north and
west of the subject property. Uses include owner -occupied properties and rental properties; there
are also several industrial condominiums. Residential properties are located north of the
McHenry City Center Business Park and east of the railroad right -of --way. in McHenry Lakes
Estates and Lakeland Park. These subdivisions are virtually 100% built -out and developed with
detaehed single-family residences. Special purpose properties in the neighborhood include the
railroad right-of-way, several parks owned by the City of McHenry, the Zion Lutheran school,
church, and pre-school, and the McHenry Public Works property, of which the subject property
in this assignment is a part.
Zorrirrg is controlled by the City of McHenry. Water and sewer are available to properties in
McHezuy.

The primary trend evident in the neighborhood is continuation of current uses for those
properties that represent the highest and best use. A relatively minor trend is the occasional
rehabilitation of older properties. At times, such a property is acquired, improvements are
demolished, and the sites are redeveloped. Very little new development is occurring, primarily
because of the lack of available vacant sites that can be developed.
A11 things considered, the subject's neighborhood is a heterogeneous neighborhood in central
McHenry that consists of a variety of property types. The subject's neighborhood should
continue to maintain its character as it becomes more stable over time.

The highest and best use of the subject property is ultimate industrial development, when real
estate market conditions have stabilized to the point where such development is economically
justifiable.
Market Data
There has been virtually no industrial development anywhere itr McHenry County for• the past
several years. Consequently, there have been virtually no sales of industrial development lard
anywhere in McHenry County. For example, there have only been nine sates of vacant industrial
land throughout all of McHenry County between January 2014 and the date of value in this
assignment. However, three of the sales were large acreage tracts without water and sewer

availability, one was in a very remote portion of McHenry County {Hebron) that was not
comparable from a locationaI point of view, two were involved in either foreclosure proceedings
or were short sales, one was between related parties, and one was purchased with the intent of
rezoning the site and re -developing it commercially. That only left one somewhat comparable
sale in McHenry County. I expanded the search for comparable sales between January 2014 and
the date of value in this assignment into northeastern Kane County and western Lake County. By
doing this, I was able to identify two more sales - one in Mundelein in Lake County and one in
tine Kane County portion of Huntley. These three sales formed the basis of the sales comparison
approach that I developed in this assignment.
The following sales are relatively recent sales of small acreage industrial developnnent #racts #hat
Dave occurred between March 2014 and July 2015. Each has some degree of comparability to
the subject property. A summary of each sale is presented below and on the following pages.
Additional information on each sale is retained in my file. The sales are presented
chronologically, starting with the oldest. A Sale Map has been prepared as an exhibit at the end
of this appraisal report.

rlrarket conditions, location, utility availability, and physical characteristics. The sales were
reduced to an appropriate unit price for comparison to the subject property. The appropriate unit
of comparison is sale price per square foot of land area.
All of the sales involved the apparent arm's length transfer of fee simple interest. All of the sales
occurred under market conditions equivalent to those in effect on the date of value for industrial
development sites, All were annexed, with industrial zoning in place at the time of sale, and with
water and sewer available. Finally, all of the sales were in industrial parks removed from ally
major highways. All of the sales were slightly superior to the subject property with respect to
access because they had direct street frontage and did not rely on access over intervening
property.
Reconciliation and Conclusion — Subject Propez•t3T
In developing zuy final opinion of �Ilaz•ket value of the subject property in this rllatter, I
considered all of the sales, the degree of comparability of each sale to the subject property, the
range of unit prices, the current market conditions for industrial development sites in McHenry
County, central and western Lake County, and northeast Kane County. By reason of my analysis
of the market data gathered during my investigation, tempered by myJudgment and experience, I
have formed the opinion that market value of the fee simple interest of the subject property was,
as of March 1, 2016, measured in the amount of $2.50 per square foot. Based on the 74,923.20
square feet contained in the subject property, the resulting value of the subject property at the
reconciled unit price is $187,308. This amount is expressed in round numbers as $187,000.

easement being sought in this instance is a permanent vault easement. It is located adjacent
to another perivarlent vault easement granted to Nicor, in the northeast portion of the subject
property. It is located on the south side of a bike path and easement access strip of land, and is
just west of the Chicago and Northwestern railroad riglzt�of4ay. There are several exhibits at
the end of this report portraying aspects of the easement. These include all Overview Easement
Plat (which shows the general location of the easement in relation to Industrial Drive and the

railroad right-ofway), an Easement Aerial Photograph (showing the location of the easement
outlined in white), and an Easement Location Plat (which shows the location of the easement in

document entitled Grao7t of Easement to Nicor Gas Conilmny. This document describes the

ghts and obligations encompassed by the permanent easement.
The easement sought is legally described as follows;
A 15-foot wide by 88-foot wide parcel of land lying ira that part of the Southeast
Quarter of Section 27, Township 45 North, Range 8 East of the Third Principal
Meridian, all described as follows: Commencing at the Northeast corner of said
Southeast Quarter; thence South 89 degrees 31 minutes 30 seconds West along the
North line of said Southeast Quarter a distance of 295.14 feet to the Westerly
right-ofway line of the Chicago and Northwestern Railroad right-ofway; thence
South 12 degrees 16 minutes 30 seconds East along said right-of-wayto the point
of intersection of said right-of-way with the South line of Maple Avenue extended
West; thence South 89 degrees 31 minutes 30 seconds West, 10.0 feet to the Point
of Beginnning# thence South 12 degrees 16 minutes 30 seconds East along a line
parallel with the Westerly right-ofway line of said Railroad, 88.0 feet to a point;

The permanent easement sought is arectangular-shaped tract of land adjacent to the west of an
existing Nicor permanent vault easement. It measures 15 feet by 88 feet, and contains 1,320
square feet. It will be used for vault purposes, and will also contain a chain surrounding the vault
and bollards to support the chain. The easement is located in the extreme easterly part of the
McHenry Public Works site, just west of the railroad right -of --way. Access to the easement is by
�vay of an existing access easement granted to Nicor by the City of McHenry. This access
easement runs between the railroad right-ofway and Industrial Drive. A bike path is also located
in the access easement.
The easement is a permanent easement, not a temporary easernent. That means that the land in
the easement will be used by Nicor pernnauen#ly. Nicor will have control of the easement area in,
orl, under, along and across tine easement. The City of McHenry cannot build any buildings or
public roads over the easement area unless allowed to do so by Nicor.

I have concluded that, although the subject laroperty inn this assigrnrnent is a permanent easernent,
its characteristics from a valuation point of view are similar to a fee acquisition. Typically, when
valuing an easement such as a sub -surface easement, the value of the easement is the difference
between the value of the land before encumbrance with the easement and the value of the land

filer encumbrance with the easement. However, the easement being sought by Nicor is not only
a permanent easement but also one that encompasses the easement area both above ground and
below ground.
Using the sates comparison approach, I concluded that the market value of the fee simple interest
of the subject property was $2.50 per square foot, or $187,000 (rounded). I have also developed
the conclusion that market value of the permanent easement interest of the 1,320 square foot
permanent easement, as a part of the larger land Bolding characterized as the subject property in
this appraisal, is also $2.50 per square foot, or $3,300. Finally, I have concluded that there would
be no damages to that portion of the subject property outside of the permanent easement area that
would occur by impressment of the permanent easement.

RE: Intergovernmental Agreement for Dispatch Services for the Marengo Police
Department
Background:
The McHenry Police Department has been providing dispatch services for the Village of
Johnsburg Police Department, the McCollum Lake Police Department, the McHenry Township
Fire Protection District, the Union Fire Protection District, the Marengo Fire Protection District
and the Marengo Rescue Squad.
With the upcoming consolidation mandate of PSAP's (Public Safety Answering Points) the Lake
in the Hills PSAP is slated as one of the dispatch centers going out of business. One of the
agencies that receive dispatch services from Lake in the Hills is the Marengo Police Department.
The City of McHenry and the City of Marengo have been in negotiations regarding the McHenry
Police Department taping over those dispatching needs. Providing those services for the
Marengo Police Department falls in line with our consolidation efforts and allows us to dispatch
for both their Police and Fire services as we are already the PSAP for the Marengo Fire and
Marengo Rescue departments. Our dispatchers are undergoing continuous emergency dispatch
training and quality control checks are being done on randomly selected calls for service. We
are providing a high quality of service to our partners and plan to continue to improve that
service.
Analysis: The city and the Marengo Police Department agreed to an annual fee for dispatching
services. This fee amount will increase annually based on calls for service from the previous year
and a Consumer Price Index based adjustment in the rate charged per call. This more closely
aligns fees charged to actual cost per call. This request is made to allow the Mayor to execute a
contract and Intergovernmental Agreement with the City of Marengo for dispatch services.
Recommendation:
If Council concurs, then it is recommended that a motion is considered to authorize the Mayor to
sign and execute this new individual intergovernmental agreement between the City of McHenry
and the City of Marengo for dispatch services for a term starting May 1, 2016 until April 30t", 2019

AN ORDINANCE AUTHORIZING THE MAYOR'S EXECUTION OF AN
INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF MCHENRY AND
CITY OF MARENGO FOR DISPATCH SERVICES
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of
this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in the
Constitution of the State of Illinois; and
WHEREAS, the Mayor and the McHenry City Council desire to enter into an Intergovernmental
Agreement with the City of Marengo to provide Dispatch Services.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and the McHenry City Council as

a. The Intergovernmental Agreement, a copy of which is attached hereto as Exhibit A and made

INTERGOVERNMENTAL AGREEMENT FOR DISPATCH SERVICES
BETWEEN THE CITY OF MCHENRY AND CITY OF MARENGO
This Agreement is effective this 15t day of May, 2016 by and between the City of McHenry
("McHenry") and the City of Marengo ("Marengo").
A. McHenry provides to its residents and businesses, among other services, radio
dispatched police and law enforcement services ("Dispatching Services") within its
corporate limits.
B. Marengo desires to obtain for its residents within their City, the Dispatching Services
of McHenry for the purposes of providing 24-hour E 941 1 telephone answering
service for emergency police officers employed by the City and other services.
C. McHenry and Marengo have the power and authority to enter into this Agreement
pursuant to the provisions of Article VII, Section 10 of the Illinois Constitution of
1979, and the Illinois Intergovernmental Cooperation Act, as amended, 5 ILCS 220/1
et seq., and other applicable authority.
NOW THEREFORE, in consideration of the mutual promises contained herein and other good
and valuable consideration, the sufficiency and adequacy of which is hereby acknowledged as
being received, Marengo and McHenry agree as follows:
1. Term of Agreement: This Agreement shall commence on May 1, 2016 and
terminate on April 30, 2019 ("Original Term"), unless earlier terminated by either
party upon (6) six month's written notice to the other party for any reason or no
reason at all. In no event shall any portion of the fee payable herein be subject to
reimbursement due to early termination of this agreement by either party. Upon
expiration of the Original Term, the Agreement may only be extended by written
agreement of both parties hereto.
2. McHenry's Obligation: McHenry shall provide Dispatching Services to Marengo
during the term of this agreement in accordance with Illinois law including but not
limited to 210 ILCS 50/1 et seq. Commonly known as the "Emergency Medical
Services EMS Systems Act". Additional services include monitoring telephone
services after 4 pm, or as needed, initiation of emergency weather warning sirens
and closed circuit camera monitoring.
3. Marengo Hardware: At its sole expense, Marengo shall install and maintain any
required radio infrastructure necessary to receive radio communications from its
personnel and relay them to the McHenry Communications Center in McHenry,

Illinois. The cost of telephone lines and interface equipment necessary to accomplish
these services shall be the responsibility of Marengo.
4. No Supervision of Direction: McHenry Dispatching Services provided to Marengo
hereunder are limited to the dispatch of Marengo police officers. McHenry
dispatchers and on -duty supervisory personnel have no responsibility to ensure that
Marengo police officers comply with any applicable rules and regulations. The
supervision and direction Marengo police officers are outside the scope of this
Agreement and remain the responsibility of Marengo.
5. Dispatch Fee: Marengo shall, beginning May 1, 2016 ("Original Term Dispatch Fee"),
pay to McHenry monthly installments to be paid no later than the 101" day of each
month. The Original Term Dispatch Fee will be calculated based on the existing rate
of $26.00 per service call ("Service Call Rate") and $12.88 per traffic stop (Traffic
Stop Rate) plus the lesser of any increase in the Consumer Price Index from the prior
calendar year (2015), or three (3) percent ("Adjusted Call Rate"). Thereafter, the
Service Call Rate and Traffic Stop Rate shall change annually, on each anniversary
date of this Agreement, using the same Adjusted Call Rate calculation. The CPI
adjustment shall be calculated using the annual average change as published by the
United States Department of Labor's Bureau of Labor Statistics, All Items Consumer
Price Index for Urban Consumers for Chicago, Illinois. The Adjusted Call Rate shall
then be multiplied by the number of service calls and traffic calls dispatched by
McHenry for Marengo in the prior year, thereby arriving at the Dispatch Fee for the
next year of Dispatch Services to be paid on the same monthly basis as the Original
Term Dispatch Fee.
6. No Agency Created: Only an independent contractor relationship is created by this
Agreement and neither party shall constitute an authorized agent of the other.
7. Entire Agreement: This Agreement constitutes the entire agreement between the
parties hereto and no other person or entity shall be deemed to be a beneficiary of
this Agreement.
8. Assignment Prohibited: No party shall assign this agreement or the rights and
duties hereunder.
9. Notices: All notices give or required under this Agreement shall be in writing and
sent by certified mail to McHenry Administrator or the Marengo Police Chief,
respectively.
10. Indemnification: Marengo hereby indemnifies McHenry and its elected and
appointed officials, attorneys, officers, and employees, and hold them harmless
from any claim, injury, or loss, no matter how allegedly sustained, arising out of or
related in any way to the provision of, the use of, the disruption of, or the failure of
McHenry to adequately or effectively provide Dispatching Services pursuant to this
Agreement. Marengo shall reimburse McHenry for any attorneys' fees incurred by
McHenry in connection with defense of any such alleged claim, injury or loss,
occurring during the term of this agreement or thereafter arising out of the activities
contemplated by this Agreement provided that the cause of action is not the result
of negligence, lack of due care, gross negligence or willful and wanton misconduct
on behalf of McHenry or its agents.
11. Insurance: Marengo shall maintain, for the term of this Agreement, and any
extensions thereof, comprehensive general liability insurance, issued by an
insurance company qualified to do business in the State of Illinois, with minimum
limited of $1,000,000/$3,000,000. McHenry shall be named as an additional insured
on said policy and the policy shall provide that McHenry be given 30 days written
notice of cancellation or material charges thereto.

The City has received a special use request for Petersen Park by Carson and Barnes Circus to
host a circus on June 27th. The event is proposed to include a big top tent, bleachers, animals,
trucks, trailers, inflatables, midway games and concessions. The city has approved and hosted
this particular event in the past. Upon exiting the park during their last visit in 2014, there was
significant damage to the park in the form of trash and excessive ruts in the field. There was no
attempt by the organization to correct these identified problems. For this reason staff is
recommending denial of this special use permit.
If City Council concurs, then Staff is seeking a motion to deny the Special Use Request for
the requested use of Petersen Park by Carson and Barnes Circus

ANALYSIS: Attached is an honorary street sign application for Joseph W. Thome submitted by one of his
sons, Bryan Thome. The honorary street sign is proposed at the intersection of Millstream Drive and
Maple Street, Mr. Thome and his family moved to the City of McHenry in 1977. His son states on the
attached application that his father volunteered his service to the United States Navy during the
Vietnam War, being stationed in Saigon. He served as treasurer of the McHenry County Chapter
VietNow Veterans Organization and was instrumental in having the Pearl Street Park name changed to
Veteran's Memorial Park.
A few examples of Mr. Thome's service to the community include assisting veterans and their families,
volunteering to be Santa Clause for VietNow functions, involvement with the McHenry Area Soccer
Federation and the McHenry Boy Scout Troop.
On March 21, 2016, the Public Worl<s Committee unanimously recommended approval of this
designation. Attached for the Council's consideration is the application from Joseph W. Thome, and the
Resolution designating the intersection of Millstream Drive and Maple Avenue as Honorary Joseph W.
Thome Way.
RECOMMENDATION: If Council concurs, then it is recommended a motion be considered to approve the
attached Resolution request as presented.

CRITERIA FOR DESIGNATION
HISTORICAL AND/OR CULTURAL INFLUENCE OF THE HONOREE ON THE
CITY:
The best way to describe Joseph W. Thome is "Volunteer" and as a
person who "Loved his Community". Joe volunteered his service to the U.S. Navy
to serve his country during the Vietnam War. He served in Saigon. When moving
to McHenry, IL, he took on the position of McHenry's Assistant Postmaster. He
immediately fell in love with McHenry. Joe was a member of the McHenry County
Chapter VietNow Veterans Organization. He served as Treasurer and worked to
assist veterans and their families in the community. He volunteered to be Santa
Claus for a local business and for VietNow sharing the joy of Christmas to both
young and old. He became an Assistant Soccer Coach for the McHenry Area
Soccer Federation. Joe served as the Assistant Scoutmaster for McHenry's Boy
Scout Troop 131 and helped revive the troop's status in the Blackhawk Area
Council. He remained active in the troop by accompanying the boys on camp
outs and various other scouting events. He always made sure to use one week's
vacation time to go with the scouts on their annual summer camp trip. He taught
the scouts lifelong skills through the scouting program and encouraged and
helped boys to achieve the rank of Eagle Scout. Joe was nominated by his fellow
scouts and was elected to be inducted into the Order of the Arrow. Joe was a
committee member of the Chicago Welcome Home Parade for Vietnam Veterans
and was also instrumental in renaming Pearl Street Park to Veterans Park. One
of his favorite activities was being a volunteer during McHenry's annual Fiesta
Days. Joe always reserved vacation days to help out in any way that he could.
No job was ever too small or too big. He so admired Fiesta Days that he brought
together the McHenry Chapter of Vietnow Veterans Organization and the Fiesta
Days' committee to bring more assistance on board. That friendship still exists
today.

ANALYSIS: Attached is an honorary street sign application for Reverend Roger W. Schneider submitted
by the Shepherd of the Hills Church Council. The honorary street sign is proposed at the intersection of
Green Street and Shepherd Hill Lane, In 1969, Reverend Schneider and his family moved to the City of
McHenry where he was pastor at the Shepherd of the Hills Church ever since.
As stated on the application, Reverend Schneider was pastor for 47 years at Shepherd of the Hills Church
where he and his family also resided. He performed over 2,000 weddings, 4,000 baptisms, and 2,000
funerals. There were four building additions to the church to accommodate the largest congregation in
the Northern Lutheran Synod. He served the community in an outreach capacity, helping people in need
by providing food baskets, gas cards, gift cards for food, payment of utilities, coats, assisting with PADS,
and counseling people in crisis. Under Reverend Schneider's leadership an endowment fund was created
to offer scholarships to the parish youth and to assist people in need. Staff believes the criteria for
approval of an honorary street sign have been satisfied.
On March 21, 2016, the Public Works Committee unanimously recommended approval of this
designation. Attached for the Council's consideration is the Honorary Street Sign Application and
Resolution designating the intersection of Green Street and Shepherd Hill Lane as Honorary "Reverend
Roger W. Schneider Way."
RECOMMENDATION: Therefore, if Council concurs, it is recommended the attached request be

ANALYSIS: Attached is an honorary street sign application for "Bjorkman Family Way" submitted by
Edward J. Neumann Jr. The honorary street sign is proposed at the intersection of Crystal Lake Road and
Lillian Street.
Bjorkman's Ace Hardware was founded in 1948 by Walter Bjorkman and his son Stanley. Their original
store, located on Riverside Drive was 1,500 square feet in size. Later, Stanley with sons Steve, and Craig
re -located their business to Elm Street. In the late 1970's, Craig and Steve took over the business and
moved their store to the existing 30,000 square feet building on Crystal Lake Road. The family provided
the community with exceptional products, focusing on old-fashioned customer service.
The applicant, Mr. Neumann is requesting the rule of issuing no more than three honorary signs
annually be relaxed in 2016. (In 2016, City Council approved one honorary sign and two additional
designations are on this evening's Council agenda.)
Stanley's wife, Helen survives and is the only Bjorkman who was involved from day one. She is of frail
physical health but of sound mind and would enjoy the recognition for her family.
On March 21, 2016, the Public Works Committee unanimously recommended approval of this
designation making an exception to the honorary street sign policy by allowing one additional honorary
street sign in 2016. Consequently, in 2017 only two honorary signs will be allowed. Attached for the
Council's consideration is the Honorary Street Sign Application and Resolution designating the
intersection of Crystal Lake Road and Lillian Street as Honorary "Bjorkman Family Way."
RECOMMENDATION: Therefore, if the Council concurs that in 2016 there should be an exception to the
policy by allowing an additional honorary designation, and that in 2017 there will be only two honorary
street signs allowed, it is recommended a motion be considered to approve the attached Resolution
request as presented.

I was saddened recently to learn, as I'm sure were you and many others, that after three
generations of the BjorlGnan family providing a uniquely fine retail hardware store to our
community that they have sold their store as the third generation of their family retires.
The Bjoil�nan family stony of success in their retail hardware business is well known
throughout our community. For three generations, beginning with Walter Bjorlunan
operating his first store on Riverside Drive, and subsequent generations with his son
Stanley and grandsons Steve and Craig operating and expanding their Ehn Street
location, and finally with the building of their mega store on Crystal Lake Road, the
Bjorkman family has provided our community with an exceptional product and service.
I am requesting you to use your good offices and influence to recognize this fine family
and their contribution to our community by designating their present store's section of
Crystal Lake Road in the City's honorary street program. I would suggest that
consideration might be given to that designation being: "Honorary Bjorlman Family
Way", or more simply: `Bjorkman Family Way".
I know chat you and many others know of their generous support of every organization,
club, charity or event that has come their way. I would think that this street designation
might be a fitting tribute to their family for all that they have done for our community.

Dear Mayor Low and Marci:
Thanks to both of you for the follow up and your desixe to embrace the request to honor the
Bjorkman Family in the City's Honorary Street Sign Program. I'm attaching the formal
application form which I didn't know existed when I made my request. I'm also attaching a
copy of my original letter which embellishes my brief responses on the application.
When I requested that their section of Crystal Lake Road be named in their honor, I was
thinking of that section that runs by the front of their store. The closest street sign to their
store's entrance is at Crystal Lake Road and Lillian Street. It is there that I assumed the
designation would be above the Crystal Lake Road part of that sign.
So that it doesn't become too wordy, I suggest that it might be "The Bjorkman Family Way."
Another thing that went into my thoughts which I was planning to share with you after the
concept was embraced, will be especially appreciated by the two of you. As often has been
said, behind every good man is a good woman. A unique element about the three generations
of Bjorkman Family that this designation will recognize is that there is only one constant of
the three generation who is still living. Walter Bj orkman and his son Stanley opened their
first store on Riverside Drive right next to what is now Bimbo's. Stanley's wife Helen
survives and is the only Bjorkman who was there from Day 1. She is Steve and Craig's
mother. She is of frail physical health but of sound mind.
Helen Bjorkman, who is in her mid to late eighties, lives near her daughter in the Twin. Cities
and returns here for two ALA each summer. Not knowing of the time and Limitation
restraints associated with getting this done, I was thinking it might be slick to have it happen
while she might enjoy the recognition. Even though the sign and unveiling might not happen
this year I'd like to see knowledge of it happening be shared with her before then.
If one were trying to get it done completely this year, one possible path might be for staff to
request that the council approve transferring one of next year's three slots to this year so that
they, staff, can bring forth an application for approval. How it would then move forward
while maintaining an element of surprise has probably happened before.
I have not shared any of this with anyone and do not plan to. I appreciate you embracing this
request and will unquestionably defer to your wishes as to who, how and when this gets
communicated. I don't mean to infer that Helen Bjorkman is about to expire, but she is an old

RE: Jaycees Day Fireworks Celebration
ATT: Proposal from Mad Bomber Fireworks Productions
Background. On February lst, the City Council authorized staff to partner with the McHenry
Area Jaycees to roduce the annual Jaycees Day Fireworks Celebration in Petersen Park on
Saturday, July 2n with a rain date of Sunday, July 3rd. The Jaycees will donate $10,000 towards
the cost of the contract with a contribution of $5,000 paid by the city. In addition to financial
participation, Council approved the use of city services from Parks, Public Works, and the Police
Department. Equipment and staff from the McHenry Township Fire Protection District will also
assist as necessary. The Jaycees will provide funds for a sound system and background music
through revenue derived from the $6 per car parking fee.
Two companies, Melrose Pyrotechnics and Mad Bomber Fireworks Productions, responded to
the city's Request for Qualifications to produce at minimum, a 25-minute display choreographed
to music selected by the city and Jaycees. A third proposal from Five Alarm Fireworks Co. who
produced last year's show, was submitted to the city after the RFQ deadline of February 26th.
Analysis. After review of the RFQ's and professional references, the Jaycees recommend the
selection of Mad Bomber Fireworks Productions to produce a 25-minute program choreographed
to music for $15,000. In addition to professional references, staff consulted with the McHenry

has no concerns with the proposal as presented. Mad Bomber has been in business for 25 years
and produces displays for over 500 customers each year. A team of trained pyrotechnicians with
more than 10 years experience will produce the show. Additional information about the
company is included in the attached proposal.
If Council concurs, then it is recommended to consider a motion to accept the proposal
from Mad Bomber Productions, Elgin, IL, to produce the a 25-minute fireworks display for
$15,000 with a $5,000 financial contribution from the City of McHenry as presented.

Witness: Seller agrees to provide and Buyer agrees to purchase certain Fireworks Display in accordance with the Program.
Buyer will pay Seller a sum of $15 , a . n 0 for said Display. Upon acceptance of this agreement Buyer will pay
Seller a sum of (W A Iy F D) as an Earnest Money Deposit with the Balance due and payable within 30 days after the
display date agreed upon. A late charge of 1'/Z% per month will be assessed on accounts not paid within thirty days of display date.
Both Seller and Buyer mutually agree to the following terms, conditions, and stipulations:
Seller will present said Fireworks Display on the evening of the 2 N D day of J U L Y , 2016,
it being understood that should there be inclement weather the day of the display the Seller has sole discretion to
cancel display. An alternate display date will be given within six months of the original Display Date agreeable to
both the Seller and Buyer.
2. The Fee for cancellation for any reason of the Fireworks Display is 40% of the agreement price if Buyer chooses to not
select another Display Date within six months of Lite original Display Date.
3. Buyer will provide a sufficient area for the Display, including a minimum spectator set back of 420' feet at all points
from the discharge area. Buyer will provide protection of the display by roping -off or other suitable means. Buyer will
provide adequate police protection to prevent spectators from entering display area. Buyer agrees to search the fallout area
at first light following a night display.
4. Seller reserves the right to terminate the Display in the event that persons enter the secured Danger Zone and Security is
unable to secure the Danger Zone.
5. Seller agrees to provide Qualified Technicians to take charge of and present said Display.
6. Seller agrees to provide Liability Insurance in the amount of $10,000,000.00 for the benefit of both the Buyer and Seller.
7. Mad Bomber Firework Productions retains the right to substitute product of equal or greater value in the event of shortage.

The good news is that for the
second straight year, the cost
of producing pyrotechnics has

The cost of chemicals and raw
materials in China and high labor

Presently, there are only two
ocean carriers that are accepting
display firework shipments to
the United States. Shanghai
in Eastern China and Bei Hei,
located in Southwest China,
are the only ports authorized to
handle r.3G Display Fireworks.
Mad BomUer is fortunate in that our Chinese suppliers are
located in the Bei Hei area in XianglD. Province. Any company
who trucks product into Bei Hei from another Province is
subject to a hefty surcharge for using the port.
As you can imagine, all this
creates a big traffic jam at the
ports. Storage of fireworks at the
ports is now prohibited which
makes things worse. Anew port
at Wuzhou will Ue authorized to
ship i.3G in the near future.
The largest proUlem now facing
all firework factories in China
is a lack of employees. Despite
having a population of over
one Uillion people, China now
faces labor shortages in all
manufacturing sectors. Many
laUorers have Ueen lured away
from fireworks to take Vetter
paying jobs in the larger cities.
More money, benefits and better
working conditions stimulate
workers to leave for positions at
firms such as Dupont, GM or
Westinghouse.

along way since trade with the

We received great feedback from many of our customers on these
unique colors.
Mad Bomber Fireworks will also be utilizing some magnesium
colors such as:
Mag Green, Mag Lime, Mag Orange, Mag Red and Mag White
Magnesium stars are brighter than normal stars and have longer
burn duration. When ordering any of these colors we always
use contrasting and complimentary pistils or effects. White
Chrysanthemum with Mag Lime Pistil and Silver Serpent with
Magenta Stars are examples.

Did you ever wonder about the myriad of colors produced
in fireworks? To the benefit and enjoyment of spectators,
the technology of fireworks is advancing and today there
are thousands of color combinations available, using only

Randy McCasland, Mad Bomber's Operations Manager,
inspects production at the Kanto Fireworks Factory near
Beihai, China last November. Randy toured six different
manufacturing sites in China, conducting quality control

Background:
On January 6—, 2016 Officer Foley of the McHenry Police Department was involved in a motor
vehicle accident while driving her police vehicle (Squad 326). As a result of this accident Squad
326 (2011 Ford Crown Victoria) was damaged beyond repair.
On February 19th, 2016 Officer Lazicki of the McHenry Police Department was involved in a
motor vehicle accident while driving his police vehicle (Squad 324). As a result of this accident
Squad 324 (2011 Ford Crown Victoria) was damaged beyond repair.
With the nature of the work that law enforcement does, the risk of vehicle accidents is always
high. In both of these incidents, the officers exercised safe vehicle operation practices and the
accidents were caused by the other driver, with no fault on the part of the officers. Insurance
payout on these two police vehicles were as follows:

The McHenry Police Department utilizes a rotational vehicle plan for the patrol division. This
means that seventeen patrol vehicles are shared between thirty six officers and three separate
shifts. This plan allows for the agency to run roughly 2/3 of the patrol fleet each 24 hour period.
This is done so that the agency can control mileage and wear on the vehicles, assuring maximum
service life. With the loss of Squad 324 and Squad 326 the remaining patrol fleet will see an
increase in mileage and wear, affecting the service life and maintenance costs of other patrol
vehicles. The department therefore needs to replace Squad 324 and Squad 326 in a timely
Analysis:
With the loss of these two vehicles the department began the process of finding replacements for
Squad 324 and Squad 326. The McHenry Police Department currently uses the Ford Interceptor
Sedan as the agency's approved patrol vehicle. In searching for replacement vehicles two
options are available.
The first option would be to order a new vehicle through a dealership that can conduct police
vehicle sales through the approved Illinois State Contract for Ford Interceptors. This process
includes vehicle/option selection, ordering, vehicle manufacturing and delivery. Manufacturing
time for new vehicles is an eight week minimum and pricing is higher due to next year's contract
pricing.
The second option is to search for Ford Interceptor Sedans that have already been manufactured
and are at a dealership and available for purchase. This option allows for immediate replacement
of the vehicles and still utilizes state contract pricing or a competitive comparable contract.
The department chose option two as the preferred method to replace Squad 324 and Squad 326.
With such the department began to search regional dealerships for two black Ford Interceptor
Sedans. This regional search identified only two new vehicles that meet the requirements
(make/model/options). Both of these vehicles were located at Morrow Brothers Ford in
Greenfield, Illinois. Morrow Brothers is an authorized dealer for the Illinois State Contract.
Contact was made with Morrow Brothers Ford and they provided the below pricing for each new
vehicle.

Although the sales of these vehicles is normally first come first serve, Morrow Brothers Ford has
agreed to hold these vehicles for McHenry pending the direction of City Council.
Finally, council will find the attached pricing for the purchase and installation of emergency
equipment and decals for the two new vehicles. The following is a breakdown of the equipment
costs:

The total cost of purchasing these two vehicles (with equipment) is $62,393.30. With the
utilization of the insurance payout of $13,453.00, the remaining outstanding balance to acquire
these vehicles and equipment is $48,940.3a.
Recommendation: Staff requests City Council authorization to; (1) purchase one 2015 Ford
Interceptor Sedan and one 2016 Ford Interceptor Sedan from Morrow Brothers Ford in the
amount of $52,718.00, (2) purchase and install emergency vehicle equipment from Ultrastrobe
Inc. in the amount of $8,725.30, (3) purchased and install police decals from Eby Graphics in the
amount of $950.00, and (4) authorize a budget amendment for the 2015/16 fiscal year in the
amount of $48,940.30.
