HomeMy WebLinkAboutMinutes - 10/11/1995 - City Council REGULAR MEETING WEDNESDAY, OCTOBER 11, 1995 The Regular Meeting of the McHenry City Council was called to order by Mayor Cuda at 7:30 P.M. on Wednesday, October 11 , 1995 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Bolger, Locke, Bates. Alderman Baird arrived at 8:05 P.M. Absent: Lawson. City Staff in attendance were City Clerk Althoff, City Administrator Peterson, Director of Public Works Batt. Absent: Director of Building and Zoning Lobaito, Director of Parks and Recreation Merkel, Chief of Police Joyce, City Attorney McArdle. TEN MINUTE PUBLIC INPUT SESSION Anton Rebel of 4009 Maple Avenue signed up to speak regarding the interest of any City of McHenry resident in circulating or signing petitions for a referendum staggering the terms for Aldermen. However, as the cable television camera was not yet operational, he asked that the ten minute public input session be postponed. Mayor Cuda concurred. October 11 , 1995 Page 2 CONTINUED DISCUSSION OF SUBDIVISION CONTROL ORDINANCE At the beginning of the 1994 calendar year, Council determined that the second regularly scheduled Council meeting of each month be utilized as a working meeting to discuss relevant issues concerning development, planning, and other related City matters. The Subdivision Control Ordinance has been under review and revision for several years. The current Council began its review process of the Subdivision Control Ordinance on June 2, 1995, reviewing pages 1-8 at that time. Council reviewed the remaining sub-sections of Section 5: Procedures from page 9 through page 28 at the July 12, 1995 working meeting. Council begins this evening's review on page 28, beginning with Section 6 -- Preliminary and Final Plat Preparation and Supporting Data. Section 6 - Preliminary and Final Plat Preparation and Supporting Data A lengthy discussion ensued regarding the differences between the City of McHenry and the County's platting process. County plats within the City of McHenry's mile and one-half jurisdiction require, by State Statute, City review and approval. Council agreed to review the Subdivision Control Ordinance language as per the City's platting requirements, and not to specifically address the County differences. Alderman Baird arrived at 8:05 P.M. Section 6.2.1- Drawing Size and Quality The addition of the following language: • Location of existing trees measuring three (3) inches in diameter or greater at breast height 54" above grade, as well as, • Names of all proposed streets (no proposed street names shall duplicate the name of any existing street within the jurisdiction of the McHenry Post Office unless such proposed street represents a continuation of such street). Section 6.3 - Construction Plans Council discussed the appropriateness of requiring engineering studies at the time of final plat, and noted if a potential problem was cited, engineering studies could be required by Council at the time of preliminary platting. Section 6.4 - Final Plat Preparation A lengthy discussion again ensued regarding the differences between the City of McHenry's and the County's platting process. Council requested further clarification be provided by staff at a subsequent Subdivision Control Ordinance working review meeting regarding all Statute requirements for final platting, particularly with regard to County properties located within the City of McHenry's mile and one-half jurisdiction. Section 6.4.2.2.10 "The exact width and center line of all easements, streets and alleys" has been deleted. Section 6.4.2.13 The language "hereby" was added after the phrase "and parks marked". October 11 , 1995 Page 3 Section 7 - Required Improvements and General Layout Principles Section 7.2.5 - Street Classifications and Definitions This section is entirely new and provides a cross-reference to the City's Comprehensive Plan which utilizes different terms for the same street definitions. A lengthy discussion followed regarding the plausibility of the City undertaking a comprehensive traffic study which would provide preliminary traffic count numbers and assist developers in planning street layouts. Further discussion noted the possible need for early Council review of proposed street layouts. Council requested the inclusion of language stating "traffic study and/or data may be required before preliminary plat approval". City Administrator Peterson suggested the Plan Commission be asked to make recommendations as to whether a developer needed to provide preliminary traffic studies and/or data during the preliminary plat review. Section 7.2.6 - Continuity of Street Alignment with Existing Streets The addition of the following sentence at the end of sentence one: "Consideration shall be given to traffic impact when streets from two or more subdivisions are connected." Council also noted under certain circumstances, direct connection of proposed streets to existing streets may not be appropriate and all connections may not be a continuous direct line to an arterial thoroughfare. Section 7.2.7 - Extension of Boundary Lines of Property Deleting the phrase "in the opinion of the Plan Commission" found in line 2 of this section. Section 7.2.12 - Deceleration Lanes This is an entirely new section recommended by the Plan Commission, stating "Deceleration lanes shall be provided for access from arterial streets onto collector or minor streets and if applicable, Federal, State, County or Township highways." Section 7.4 - Easements It was the suggestion of Director of Public Works Batt to recommend the City Attorney review this entire section. Although no real changes have been made from the past language, utility easements are currently in a state of flux and should be reviewed at this time. Section 7.5.1 - Requirement for Sanitary Sewer Systems It was the suggestion of Public Works Director Batt to review this section more thoroughly, developing language which would be consistent with the City's Master Plan. Section 7.5.3 - Conformity to Master Plan s This is an entirely new section stating, "All city sewerage systems shall be designed and constructed in compliance with the City's sanitary sewer system Master Plan. Section 7.8 - Street Lighting Council discussed the possibility of requiring developers to provide City standardized street light fixtures. Upon the development's completion, the fixtures would be turned over to the City for maintenance and upkeep. Further discussion will continue during Section 8.7 - Design Standards. October 11 , 1995 Page 4 Section 7.9 - Sidewalks This entire section is new, stating, "Sidewalks shall be provided along all roadways in accordance with design standards in Section 8.8. Some discussion followed regarding requiring all streets to have curb and gutter. Section 7.10.1 - Street Signs Council requested language be provided requiring standardized signs _ throughout the City of McHenry's new developments. Section 7.11.1 - Existing Tree Protection The word "desirable" shall be added to the first sentence between "wherever possible" and "existing trees". Section 7.11.3 - Tree Planting Requirements Director of Public Works Batt suggested Council review this section more thoroughly. Mayor Cuda reported in light of Judge Sullivan's ruling, City Attorney McArdle was researching and reviewing the City of McHenry's Subdivision Control Ordinance developer donation language, and if appropriate, will make recommendations for compliance and clarification. ANY AND ALL BUSINESS WHICH MAY PROPERLY COME BEFORE COUNCIL Alderman Bolger scheduled a Public Works Committee meeting for Wednesday, November 8, 1995 at 7:30 P.M. City Clerk Althoff requested Council approve the 4-H Club's request to utilize the Municipal Center's classroom on Monday, October 16, 1995 from 7:00-9:30 P.M. Motion by Bolger, seconded by Bates, to approve the use of the Municipal Center classroom for the 4-H Club's meeting on Monday, October 16th from 7:00 P.M to 9:30 P.M. Voting Aye: Bolger, Locke, Bates, Baird. Voting Nay: None. Absent: Lawson. Motion carried. (Note: Due to previously scheduled meetings on October 16th in both the classroom and Council Chambers, the 4-H Club withdrew their request.) EXECUTIVE SESSION Motion by Locke, seconded by Bates, to go into Executive Session at 10:00 P.M. to discuss Personnel. Voting Aye: Bolger, Locke, Bates, Baird. Voting Nay: None. Absent: Lawson. Motion by Locke, seconded by Bolger, to go back into Open Session at 10:10 P.M. Voting Aye: Bolger, Locke, Bates, Baird. Voting Nay: None. Absent: Lawson. Motion carried. October 11 , 1995 Page 5 Alderman Bates, Chairman of the Parks and Recreation Committee, cancelled the committee meeting for October and rescheduled a meeting for Tuesday, November 21 , 1995 at 7:30 P.M. Alderman Locke requested the Public Works Committee consider additional parking on the east side of Riverside Drive near Weber Park. He noted Director of Public Works Batt can provide the particulars. Alderman Locke also requested clarification of Council's standard procedure for approving requests by Aldermen for making copies, as well as clarification regarding usage of the $500.00 allowance provided for each Alderman and the ■-- Mayor.
